Negative facts get a bad press. One reason for this is that it is not clear what negative facts are. We provide a theory of negative facts on which they are no stranger than positive atomic facts. We show that none of the usual arguments hold water against this account. Negative facts exist in the usual sense of existence and conform to an acceptable Eleatic principle. Furthermore, there are good reasons to want them around, including their roles in causation, chance-making (...) and truth-making, and in constituting holes and edges. (shrink)

I present and develop the view that omissions are de re possibilities of actual events. Omissions do not literally fail to occur; rather, they possibly occur. An omission is a tripartite metaphysical entity composed of an actual event, a possible event, and a contextually specified counterpart relation between them. This view resolves ontological, causal, and semantic puzzles about omissions, and also accounts for important data about moral responsibility for outcomes resulting from omissions.

It is typically assumed that actions are events, but there is a growing consensus that negative actions, like omissions and refrainments, are not events, but absences thereof. If so, then we must either deny the obvious, that we can exercise our agency by omitting and refrainment, or give up on event-based theories of agency. I trace the consensus to the assumption that negative action sentences are negative-existentials, and argue that this is false. The best analysis of negative action sentences treats (...) them as quantifying over omissions and refrainments, conceived of as events. (shrink)

Michael Moore’s Causation and Responsibility offers an integrated conception of the law, morality, and metaphysics, centered on the notion of causation, grounded in a detailed knowledge of case law, and supported on every point by cogent argument. This is outstanding work. It is a worthy successor to Harte and Honoré’s classic Causation in the Law, and I expect that it will guide discussion for many years to come.

Philosophical theories of agency have focused primarily on actions and activities. But, besides acting, we often omit to do or refrain from doing certain things. How is this aspect of our agency to be conceived? This book offers a comprehensive account of omitting and refraining, addressing issues ranging from the nature of agency and moral responsibility to the metaphysics of absences and causation. Topics addressed include the role of intention in intentional omission, the connection between negligence and omission, the distinction (...) between doing and allowing, and the distinction in law between act and omission. But if there aren’t, then ‘they’ are not caused by anything and do not cause anything. That certainly appears to be false, however. John’s absence from our party might have been caused by his having fallen ill, and might cause a commotion. Dick’s not eating his soup might have been caused by his having fallen ill, and might cause a commotion.

We can use language to say what people did, often describing the same action in different complex ways. Davidson offered an illuminating analysis of action reports like “Miss Scarlet stabbed Colonel Mustard with a dagger in the library,” which involve adverbial modifiers. Part of the challenge here is to say how such modifiers are semantically related to the rest of the sentence. Building on the ancient observation that verbs are often used to describe what happened, Davidson argued that an action (...) report implies the occurrence of an eventthat meets the conditions specified by the report; where an event can be described in endlessly many ways. In this chapter, I review Davidson's account, his arguments in favor of it, and his responses to some initial objections. I also discuss some subsequent work that supports central aspects of Davidson's proposal while also presenting challenges for combining his analysis of action reports with his broader conception of linguistic meaning.
