Bentham's best-known book stands as a classic of both philosophy and jurisprudence. The 1789 work articulates an important statement of the foundations of utilitarian philosophy — it also represents a pioneering study of crime and punishment. Bentham's reasoning remains central to contemporary debates in moral and political philosophy, economics, and legal theory.

Various social animal species have been noted to inhibit aggressive attacks when a conspecific displays submission cues. Blair (1993) has suggested that humans possess a functionally similar mechanism which mediates the suppression of aggression in the context of distress cues. He has suggested that this mechanism is a prerequisite for the development of the moral/conventional distinction; the consistently observed distinction in subject's judgments between moral and conventional transgressions. Psychopaths may lack this violence inhibitor. A causal model is developed showing how (...) the lack of this mechanism would explain the core behavioural symptoms associated with the psychopathic disorder. A prediction of such a causal model would be that psychopaths should fail to make the moral/conventional distinction. This prediction was confirmed. The notes are very complete and expound not only Kant's views on ethics but many of his opinions on life and human nature. Much of this material has never before been translated into English. Mind perception entails ascribing mental capacities to other entities, whereas moral judgment entails labeling entities as good or bad or actions as right or wrong. We suggest that mind perception is the essence of moral judgment. In particular, we suggest that moral judgment is rooted in a cognitive template of two perceived minds—a moral dyad of an intentional agent and a suffering moral patient. Diverse lines of research support dyadic morality. First, perceptions of mind are linked to moral judgments: dimensions (...) of mind perception (agency and experience) map onto moral types (agents and patients), and deficits of mind perception correspond to difficulties with moral judgment. Second, not only are moral judgments sensitive to perceived agency and experience, but all moral transgressions are fundamentally understood as agency plus experienced suffering—that is, interpersonal harm—even ostensibly harmless acts such as purity violations. Third, dyadic morality uniquely accounts for the phenomena of dyadic completion (seeing agents in response to patients, and vice versa), and moral typecasting (characterizing others as either moral agents or moral patients). Discussion also explores how mind perception can unify morality across explanatory levels, how a dyadic template of morality may be developmentally acquired, and future directions. (shrink)

Recent empirical research seems to show that emotions play a substantial role in moral judgment. Perhaps the most important line of support for this claim focuses on disgust. A number of philosophers and scientists argue that there is adequate evidence showing that disgust significantly influences various moral judgments. And this has been used to support or undermine a range of philosophical theories, such as sentimentalism and deontology. I argue that the existing evidence does not support such arguments. At best it (...) suggests something rather different: that moral judgment can have a minor emotive function, in addition to a substantially descriptive one. (shrink)

Commentators have noted that the issue stands taken by each side of the American “culture war” lack conceptual consistency and can even seem contradictory. We sought to understand the psychological underpinnings of culture war attitudes using Moral Foundations Theory. In two studies involving 24,739 participants and 20 such issues, we found that endorsement of five moral foundations predicted judgments about these issues over and above ideology, age, gender, religious attendance, and interest in politics. Our results suggest that dispositional tendencies, particularly (...) a person’s moral intuitions, may underlie, motivate, and unite ideological positions across a variety of issues and offer new insights into the multiple “moral threads” connecting disparate political positions. There are two primary traditions in philosophical theorizing about moral standing—one emphasizing Experience (the capacity to feel pain and pleasure) and one emphasizing Agency (complexity of cognition and lifestyle). In this article we offer an explanation for this divide: Lay judgments about moral standing depend importantly on two independent cues (Experience and Agency), and the two philosophical traditions reflect this aspect of folk moral cognition. In support of this two-source hypothesis, we present the results of a series of new experiments (...) providing evidence for our account of lay judgments about moral standing, and argue that these results lend plausibility to the proposed causal link between folk moral cognition and the philosophical traditions. Personhood is a foundational concept in ethics, yet defining criteria have been elusive. In this article we summarize attempts to define personhood in psychological and neurological terms and conclude that none manage to be both specific and non-arbitrary. We propose that this is because the concept does not correspond to any real category of objects in the world. Rather, it is the product of an evolved brain system that develops innately and projects itself automatically and irrepressibly onto the world whenever (...) triggered by stimulus features such as a human-like face, body, or contingent patterns of behavior. We review the evidence for the existence of an autonomous person network in the brain and discuss its implications for the field of ethics and for the implicit morality of everyday behavior. “A sentimental layman would feel, and ought to feel, horrified, on being admitted into [an expert art] critic's mind, to see how cold, how thin, how void of human significance, are the motives for favour or disfavour that there prevail.” Thus writes William James. The art-world is dominated by critics who sneer and sentimentality, resist evocation, and issue stale, dispassionate appraisals. Memorized standards are coolly deployed to scan works for the features that are currently in fashion, before an icy verdict (...) is delivered. Untutored art enthusiasts make aesthetic judgments in an entirely differently way. For them, appraisal is read off “the sounding board of the body.” They use their emotions. Thus, according to James, there are two ways to assess art: cold and hot. So who is right, the rhapsodical museum-goer or the effete professional critic? As a first pass, I side with the rhapsodies. I think dispassionate appraisal is parasitic on passionate appraisal. Cool reason can never be sufficient on its own to assess artistic merit. This is a corollary of “aesthetic sentimentalism”—a view was championed by Hume and other British moralists. Of course, aesthetic sentimentalism does not entail that critics are wrong when they depart from the bubbling masses. It entails merely that good critics must be slaves to their own passions. Hacks may deliver aesthetic judgments dispassionately, but more sensitive critics have been known to muster an occasional gasp or thrill. Perhaps the refined emotions of professional critics have more validity than the crude gushings of James ’s “sentimental layman.” True beauty may be restricted to those works that elicit goosebumps in skilled viewers. Despite the wealth of recent work implicating disgust as an emotion central to human morality, the nature of the causal relationship between disgust and moral judgment remains unclear. We distinguish between three related claims regarding this relationship, and argue that the most interesting claim (that disgust is a moralizing emotion) is the one with the least empirical support.

Are disgusting or disrespectful actions judged to be moral violations, even when they are harmless? Stories about victimless yet offensive actions (such as cleaning one's toilet with a flag) were presented to Brazilian and U.S. adults and children of high and low socioeconomic status (N = 360). Results show that college students at elite universities judged these stories to be matters of social convention or of personal preference. Most other Ss, especially in Brazil, took a moralizing stance toward these actions. (...) For these latter Ss, moral judgments were better predicted by affective reactions than by appraisals of harmfulness. Results support the claims of cultural psychology (R.A. Shweder, 1991a) and suggest that cultural norms and culturally shaped emotions have a substantial impact on the domain of morality and the process of moral judgment. Much recent research has sought to uncover the neural basis of moral judgment. However, it has remained unclear whether "moral judgments" are sufficiently homogenous to be studied scientifically as a unified category. We tested this assumption by using fMRI to examine the neural correlates of moral judgments within three moral areas: (physical) harm, dishonesty, and (sexual) disgust. We found that the judgment ofmoral wrongness was subserved by distinct neural systems for each of the different moral areas and that these differences (...) were much more robust than differences in wrongness judgments within a moral area. Dishonest, disgusting, and harmful moral transgression recruited networks of brain regions associated with mentalizing, affective processing, and action understanding, respectively. Dorsal medial pFC was the only region activated by all scenarios judged to be morally wrong in comparison with neutral scenarios. However, this region was also activated by dishonest and harmful scenarios judged not to be morally wrong, suggestive of a domain-general role that is neither peculiar to nor predictive of moral decisions. These results suggest that moral judgment is not a wholly unified faculty in the human brain, but rather, instantiated in dissociable neural systems that are engaged differentially depending on the type of transgression being judged. Recent behavioral experiments, along with imaging experiments and neuropsychological studies appear to support the hypothesis that emotions play a causal or constitutive role in moral judgment. Those who resist this hypothesis tend to suggest that affective mechanisms are better suited to play a modulatory role in moral cognition. But I argue that claims about the role of emotion in moral cognition frame the debate in ways that divert attention away from other plausible hypotheses. I suggest that the available data may (...) be more plausibly explained by appeal to predictive and evaluative mechanisms, which are neither wholly affective nor straightforwardly cognitive. By recognizing this fact, we can begin to see why questions about the role of emotion in moral psychology are likely to be empirically misguided. (shrink)

How and why do moral judgments vary across the political spectrum? To test moral foundations theory, the authors developed several ways to measure people’s use of 5 sets of moral intuitions: Harm/care, Fairness/reciprocity, Ingroup/loyalty, Authority/respect, and Purity/sanctity. Across 4 studies using multiple methods, liberals consistently showed greater endorsement and use of the Harm/care and Fairness/reciprocity foundations compared to the other 3 foundations, whereas conservatives endorsed and used the 5 foundations more equally. This difference was observed in abstract assessments of the (...) moral relevance of foundation-related concerns such as violence or loyalty, moral judgments of statements and scenarios, “sacredness” reactions to taboo trade-offs, and use of foundation-related words in the moral texts of religious sermons. These findings help to illuminate the nature and intractability of moral disagreements in the American “culture war.”. (shrink)

Moral emotions are evolved mechanisms that function in part to optimize social relationships. We discuss two moral emotions— disgust and the “cuteness response”—which modulate social-engagement motives in opposite directions, changing the degree to which the eliciting entity is imbued with mental states (i.e., mentalized). Disgust-inducing entities are hypo-mentalized (i.e., dehumanized); cute entities are hyper-mentalized (i.e., “humanized”). This view of cuteness—which challenges the prevailing view that cuteness is a releaser of parental instincts (Lorenz, 1950/1971)—explains (a) the broad range of affiliative behaviors (...) elicited by cuteness, (b) the marketing of cuteness to children (by toy makers and animators) to elicit play, and (c) the apparent ease and frequency with which cute things are anthropomorphized. Theoretical models and correlational research suggest that anger and disgust play different roles in moral judgment. Anger is theorized to underlie reactions to crimes against persons, such as battery and unfairness, and disgust is theorized to underlie reactions to crimes against nature, such as sexual transgressions and cannibalism. To date, however, it has not been shown that induction of these two emotions has divergent effects. In this experiment we show divergent effects of anger and disgust. We use sounds to elicit (...) anger and disgust, and participants are then asked to consider moral vignettes. As compared to disgust and control condition, anger increases severity of judgments about crimes against persons, and disgust increases severity of judgments about crimes against nature, but not conversely. In this article, we present evidence of a bidirectional coupling between moral concern and the attribution of properties and states that are associated with experience (e.g., conscious awareness, feelings). This coupling is also shown to be stronger with experience than for the attribution of properties and states more closely associated with agency (e.g., free will, thoughts). We report the results of four studies. In the first two studies, we vary the description of the mental capacities of a creature, and assess (...) the effects of these manipulations on moral concern. The third and fourth studies examine the effects of variations in moral concern on attributions of mindedness. Results from the first two studies indicate that moral concern depends primarily on the attribution of experience, rather than the attribution of agency. The results of the latter two studies demonstrate that moral concern increases attributions of mindedness, and that this effect is stronger for attributions of experience than for attributions of agency. In six experiments, we investigated the role of resource valence in intergenerational attitudes and allocations. We found that, compared to benefits, allocating burdens intergenerationally increased concern with one’s legacy, heightened ethical concerns, intensified moral emotions (e.g., guilt, shame), and led to feelings of greater responsibility for and affinity with future generations. We argue that, because of greater concern with legacies and the associated moral implications of one’s decisions, allocating burdens leads to greater intergenerational generosity as compared to benefits. Our data (...) provide support for this effect across a range of contexts. Our results also indicate that the differential effect of benefits versus burdens in intergenerational contexts depends on the presence of two important structural characteristics that help enact concerns about legacies, including (1) future impact of decisions, and (2) a self-other tradeoff. Overall, our findings highlight how considering resource valence brings to the fore a number of key psychological characteristics of intergenerational decisions—especially as they relate to legacies and ethics. In this fresh and powerfully argued book, Mark Bernstein identifies the qualities that make an entity deserving of moral consideration. It is frequently assumed that only (normal) human beings count. Bernstein argues instead for "experientialism"--the view that having conscious experiences is necessary and sufficient for moral standing. He demonstrates that this position requires us to include many non-human animals in our moral realm, but not to the extent that many deep ecologists champion.

This article describes a qualitative investigation of environmental ethics as construed by environmental activists. Twenty-nine participants responded in writing to open-ended questions on their definitions of an environmental ethic, how they expressed and experienced this moral orientation in their lives, and what sustained it. Four major themes emerged. First, ethical consideration of the natural environment pervaded morality, values, and private and public life. Second, emotional or spiritual experiences, or personal fulfillment, were important for many. Third, there was disagreement on the (...) relationships among environmental principles, intentions, and behaviors, as well as the necessity of prescribing specific behaviors. Finally, there were diverse views on the role of humanitarian concerns in an environmental ethic. These themes are discussed in terms of parallels to religious experience, motivations for an environmental ethic, and implications for nonenvironmental realms of ethics and justice. (shrink)

Conservative Christian theology contains a set of beliefs that run counter to the philosophy supporting environmentalism. Conservative eschatology, religious tradition, and religious commitment should be negatively related to support for environmental policy. Using data from four national surveys of clergy, religious activists, political-party contributors, and the mass public, we analyze the impact of religious variables on attitudes toward environmental protection. We find that conservative eschatology, religious tradition, and religious commitment all have strong bivariate associations with environmentalism. In multivariate analyses, however, (...) conservative eschatology proves by far the strongest religious predictor of environmental perspectives, although other measures exert occasional influence. Recent research on the connection between religion and environmental concern and activism has led to divergent conclusions, with some studies finding a negative effect of religious factors, and others finding no influence or a positive effect. Using a conceptual apparatus of structuration theory, we explain how these divergent findings might be reconciled. We examine data from the 1993 General Social Survey to elaborate how religious affiliation, participation, and beliefs influence environmental concern and private and political environmental activism. Estimates from structural (...) equation models are presented to show the sometimes competing direct and indirect effects of religious affiliation, participation, and beliefs on environmental concern and private and political environmental action. Examined the moral and ecological reasoning of second, fifth, and eighth graders regarding the Exxon Valdez oil spill. Found that children understood negative effects of the spill, cared that harm occurred to shoreline and marine life, and thought it violated a moral obligation. Fifth and eighth graders used a greater proportion of anthropocentric and biocentric reasoning than second graders.

Interviews with fifth graders living in rural and urban parts of the Brazilian Amazon region revealed that children were aware of environmental problems, believed that throwing garbage into the Rio Negro harmed the environment and violated a moral obligation, cared about environmental harm, and supported conservation of the Amazon rain forest.
