(Ak 10:74).[1] During the so-called ‘silent decade’ of the 1770s, when Kant was working on the Critique of Pure Reason, he promised repeatedly not only that he would soon finish that work but also that he would soon publish a “metaphysics of morals” (Ak 10:97, 132, 144).[2] Yet it was not until four years after the first Critique that Kant finally wrote a work on ethics, and even then he merely laid the ground for a metaphysics of morals by identifying (...) and establishing the supreme principle on which a system of duties would be based (G 4:392). Three years later, in the Critique of Practical Reason Kant once again dealt entirely with foundational questions in moral philosophy. Kantian ethics is primarily known, especially among English-speaking philosophers, through these two ethical works of the 1780s, neither of which contains anything like a ‘metaphysics of morals’. Es gibt zwei Versionen von Naturalismus in der Ethik: Der erste (Praktischer Naturalismus I) behauptet, daß jeder praktische Satz (der eine Norm oder ein Werturteil ausdrückt) äquivalent zu einem deskriptiven Satz ist. Der zweite (Praktischer Naturalismus II) sagt, daß die Gültigkeit von praktischen Sätzen ausschließlich von kontingenten empirischen Tatsachen abhängt. Um scharf zwischen diesen beiden Versionen zu unterscheiden, wird der Begriff der praktischen Gültigkeit eingeführt und in einer Form definiert, die sich radikal von Tarskis Konvention T unterscheidet. Die erste Version (...) des Naturalismus wird generell als durch die Argumente von Moore und Hare widerlegt angesehen. Die zweite Spielart wurde bislang nicht widerlegt. Es wird versucht zu zeigen, daß der Praktische Naturalismus II, wenn er als radikaler Naturalismus formuliert wird, einen circulus vitiosus oder infiniten Regreß impliziert. Der einzige Weg, dies zu verhindern ist, zumindest ein praktisches Prinzip zuzulassen, dessen GüUigkeit nicht von kontingenten Tatsachen abhängt. Auf diese Weise hängt der Naturalismus in der Ethik von wenigstens einem transzendenten Prinzip ab. (shrink)

The thesis that Kant's “Rechtslehre” is entirely independent of his transcendental idealism is simply not correct. In fact: the material contents of the “Rechtslehre” follow analytically from the logical explication of the empirical concept of external freedom, whereas the absolute practical validity (“Verbindlichkeit”) of the imperative and of the imperatives of right is based exclusively on the categorical imperative and therefore ultimately on transcendental idealism.

Kants Metaphysische Anfangsgründe der Rechtslehre galten seit ihrem Erscheinen 1797 als mehr oder weniger verunglücktes Alterswerk. Bernd Ludwigs Untersuchung beansprucht dagegen, in ihrem ersten Teil den Nachweis zu führen, daß der problematische Zustand der Schrift nicht etwa den nachlassen den Geisteskräften des Autors zuzuschreiben ist, sondern sich vielmehr einer verunglücken Drucklegung verdankt: Zum Druck gelangte ein Manuskript, in dem nicht nur einzelne Textpassagen falsch angeordnet waren, sondern das auch Vorarbeiten enthielt, die für den Druck gar nicht vorgesehen waren. Anhand von (...) philologischen Indikatoren läßt sich eine Version rekonstruieren, die der von Kant intendierten Textgestalt weitgehend entspricht, ihr zumindest aber wesentlich näher kommt als der Druck von 1797. Im zweiten Teil wird in Gestalt eines analytischen Kommentars feingliedrig die Kantische Argumentation rekonstruiert und auf diesem Wege aufgezeigt, daß das wiederhergestellte Werk tatsächlich die über dreißig Jahre währende Arbeit Kants an seiner Rechtsphilosophie erfolgreich zum Abschluß gebracht hat. Spuren nachlassender Geisteskräfte sind dabei nicht auszumachen. Vielmehr erweist sich Kant als Autor, der traditionelle Lehrstücke des Naturrechts souverän an seine kritische Grundlegung der praktischen Philosophie anschließt. (shrink)

Some contemporary intepreters of Kant maintain that on Kant's view fulfilling duties of virtue require doing so from the motive of duty. I argue that there are interpretive and doctinal reasons for rejecting this interpretation. However, I argue that for Kant motives can be deontically relevant; one's motives can affect the deontic status of actions.

Kant hat bewiesen, dass reine Vernunftnotwendigkeit der einzige nicht zufällige, also unbedingte Geltungsgrund von Ethos und Recht ist. Dazu bedarf Vernunftnotwendigkeit der Anwendung auf die menschliche Praxisdisposition und wird dadurch zum Sittengesetz. Es begründet das untergeordnete Verhältnis von Recht und Moral. Die menschliche Freiheit hat in der Notwendigkeit des Sittengesetzes ihren absoluten Grund und ihr Kriterium. Daher kann es nicht in unserem Belieben stehen, soziale, ethische und rechtliche Regeln aufzustellen, sondern es ist unabweisbare Menschenpflicht, sich nur Regeln zu geben, die (...) dem Sittengesetz gemäß sind. Auch die Geltung staatlicher Gesetze ist von dieser Übereinstimmung abhängig.Kant has shown that pure rational necessity is the single non-contingent and thus unconditional basis for the validity of law and ethics. In addition, rational necessity requires application to human practical disposition and thereby becomes moral law. The moral law provides the basis for the subordinate relationship of law and ethics. Human freedom finds its absolute foundation and its criterion in the necessity of the moral law. Accordingly, it cannot be within our discretion to establish social, ethical, and juridical rules, bur instead it is an imperative duty for human beings to adopt rules that accord with the moral law. Der Aufsatz behandelt den Zusammenhang zwischen Recht, Ethik und Moral in der MdS. Ausgangspunkt ist der Befund, daß Kants System der Pflichten in der MdS weder konsistent noch vollständig ist, weil Rechts- und Tugendpflichten, entgegen Kants Annahme, den Bereich der moralischen Pflichten nicht erschöpfen . Kants System der Pflichten beruht auf den Unterscheidungen zwischen Recht und Ethik und zwischen Legalität und Moralität. Letztere konzipiert Kant in der MdS anders als in früheren Werken, indem er sie nun auf die beiden Arten (...) der "Gesetzgebung" in Recht und Ethik und die daraus entspringenden Gesetze zurückführt . Im Zusammenhang mit der "ethischen" Gesetzgebung ergibt sich das Problem, wie es ethisch geboten sein kann, aus Pflicht zu handeln . Analog dazu stellt sich mit Blick auf die "juridische" Gesetzgebung die Frage, warum man befugt ist, andere zu rechtlichem Handeln zu zwingen. Handelt es sich um eine moralische oder eine spezifisch rechtliche Befugnis? Es zeigt sich, daß Kant zwei unvereinbare Auffassung miteinander verbindet: Aus seiner "offiziellen" Auffassung, wonach das Recht ein Teil der Moral ist, würde folgen, daß die Zwangsbefugnis im Recht moralisch gerechtfertigt werden kann. Tatsächlich ist eine solche Rechtfertigung aber nicht möglich, die "offizielle" Auffassung also unzureichend. Kant greift in der MdS aber auch mehrfach auf eine "alternative" Auffassung zurück, der zufolge das Recht als eine eigenständige Form autonomer Gesetzgebung neben der Moral steht . Dieser alternativen Auffassung zufolge, die der "offiziellen" insgesamt überlegen ist, würde die "Rechtslehre" also gar nicht in die Metaphysik der Sitten gehören. (shrink)
