Philosophers and ethicists debate this controversial moral principle illustrating its application to current moral dilemmas such as war, suicide, nuclear power, affirmative action, and morphine use for terminal cancer patients.

One of the reasons why most of us feel puzzled about the problem of abortion is that we want, and do not want, to allow to the unborn child the rights that belong to adults and children. When we think of a baby about to be born it seems absurd to think that the next few minutes or even hours could make so radical a difference to its status; yet as we go back in the life of the fetus we (...) are more and more reluctant to say that this is a human being and must be treated as such. No doubt this is the deepest source of our dilemma, but it is not the only one. For we are also confused about the general question of what we may and may not do where the interests of human beings conflict. We have strong intuitions about certain cases; saying, for instance, that it is all right to raise the level of education in our country, though statistics allow us to predict that a rise in the suicide rate will follow, while it is not all right to kill the feeble-minded to aid cancer research. It is not easy, however, to see the principles involved, and one way of throwing light on the abortion issue will be by setting up parallels involving adults or children once born. Any acceptable account of moral epistemology must accord with the following points. (1) Different people acquire seemingly very different moralities. (2) All normal people acquire a moral sense, whether or not they are given explicit moral instruction. Language resembles morality in these ways. There is considerable evidence from linguistics for linguistic universals. This suggests that (3) despite the first point, there are moral universals. If so, it might be possible to develop a moral epistemology that is analogous to the theory (...) of universal grammar in linguistics. ��Is moral judgment accomplished by intuition or conscious reasoning? An answer demands a detailed account of the moral principles in question. We investigated three principles that guide moral judgments: (a) Harm caused by action is worse than harm caused by omission, (b) harm intended as the means to a goal is worse than harm foreseen as the side effect of a goal, and (c) harm involving physical contact with the victim is worse than harm involving no physical contact. Asking whether (...) these principles are invoked to explain moral judgments, we found that subjects generally appealed to the first and third principles in their justifications, but not to the second. This finding has significance for methods and theories of moral psychology: The moral principles used in judgment must be directly compared with those articulated in justification, and doing so shows that some moral principles are available to conscious reasoning whereas others are not. The analyses of impartiality, rationality, and of morality as a public system not only explain why some bioethical questions, such as the moral acceptability of abortion, cannot be resolved, but also provide (...) a method for determining the correct answer for those occasions when a bioethical question has a unique correct answer. This new edition includes an entire chapter that has been added to address the controversial issue of abortion within the authors' distinct framework. This book presents the latest revisions of the authors' orignial analyses of the concepts of death and disease, analyses that have had a significant impact on the field of bioethics. It also includes an added chapter on mental disorders, where the authors' definition influenced what psychiatry classifies as a mental disorder, and so has had an impact that reveals beyond the field of bioethics. In this edition, the authors also offer a new, more developed perspective on the concept of valid or informed consent by considering what information physicians should be required to know before proposing screening, diagnostic testing, prescribing medications, or performing surgery. The book also integrates some of the important insights of the field of clinical epidemiology into its discussion of valid consent. Its account of paternalism and its justification, perhaps the most ubiquitous moral problem in medical ethics, has had considerable influence. Its discussion of euthanasia and physician assisted suicide challenges the standard views that have been put forward by both proponents and opponents of physician assisted suicide and voluntary active euthanasia. The concept of acting intentionally is an important nexus where ‘theory of mind’ and moral judgment meet. Preschool children’s judgments of intentional action show a valence-driven asymmetry. Children say that a foreseen but disavowed side-effect is brought about 'on purpose' when the side-effect itself is morally bad but not when it is morally good. This is the first demonstration in preschoolers that moral judgment influences judgments of ‘on-purpose’ (as opposed to purpose influencing moral judgment). Judgments of intentional action are usually (...) assumed to be purely factual. That these judgments are sometimes partly normative — even in preschoolers — challenges current understanding. Young children’s judgments regarding foreseen side-effects depend upon whether the children process the idea that the character does not care about the side-effect. Scientists from various disciplines have begun to focus attention on the psychology and biology of human morality. One research program that has recently gained attention is universal moral grammar (UMG). UMG seeks to describe the nature and origin of moral knowledge by using concepts and models similar to those used in Chomsky's program in linguistics. This approach is thought to provide a fruitful perspective from which to investigate moral competence from computational, ontogenetic, behavioral, physiological and phylogenetic perspectives. In this article, (...) I outline a framework for UMG and describe some of the evidence that supports it. I also propose a novel computational analysis of moral intuitions and argue that future research on this topic should draw more directly on legal theory. (shrink)

It is widely believed that the primary function of folk psychology lies in the prediction, explanation and control of behavior. A question arises, however, as to whether folk psychology has also been shaped in fundamental ways by the various other roles it plays in people’s lives. Here I approach that question by considering one particular aspect of folk psychology – the distinction between intentional and unintentional behaviors. The aim is to determine whether this distinction is best understood as a tool (...) used in prediction, explanation and control or whether it has been shaped in fundamental ways by some other aspect of its use. Recent studies point to a surprising divergence between people's use of the concept of _intention_ and their use of the concept of _acting intentionally_. It seems that people's application of the concept of intention is determined by their beliefs about the agent's psychological states whereas their use of the concept of acting intentionally is determined at least in part by their beliefs about the moral status of the behavior itself (i.e., by their beliefs about whether the behavior is morally good (...) or morally bad). These findings raise a number of difficult questions about the relationship between the concept of intention and the concept of acting intentionally. The present paper addresses those questions using a variety of different methods, including conceptual analysis, psychological experimentation, and an examination of people's use of certain expressions in other languages. Recent experimental fi ndings by Knobe and others ( Knobe, 2003; Nadelhoffer, 2006b; Nichols and Ulatowski, 2007 ) have been at the center of a controversy about the nature of the folk concept of intentional action. I argue that the signifi cance of these fi ndings has been overstated. My discussion is two-pronged. First, I contend that barring a consensual theory of conceptual competence, the signifi cance of these experimental fi ndings for the nature of the concept of intentional action (...) cannot be determined. Unfortunately, the lack of progress in the philosophy of concepts casts doubt on whether such a consensual theory will be found. Second, I propose a new, defl ationary interpretation of these experimental fi ndings, ‘ the trade-off hypothesis ’ , and I present several new experimental fi ndings that support this interpretation. Marc Hauser puts forth the theory that humans have evolved a universal moral instinct, unconsciously propelling us to deliver judgments of right and wrong independent of gender, education, and religion. Combining his cutting-edge research with the latest findings in cognitive psychology, linguistics, neuroscience, evolutionary biology, economics, and anthropology, Hauser explores the startling implications of his provocative theory vis-à-vis contemporary bioethics, religion, the law, and our everyday lives.

The thesis we develop in this essay is that all humans are endowed with a moral faculty. The moral faculty enables us to produce moral judgments on the basis of the causes and consequences of actions. As an empirical research program, we follow the framework of modern linguistics.1 The spirit of the argument dates back at least to the economist Adam Smith (1759/1976) who argued for something akin to a moral grammar, and more recently, to the political philosopher John Rawls (...) (1971). The logic of the argument, however, comes from Noam Chomsky’s thinking on language specifically and the nature of knowledge more generally (Chomsky, 1986, 1988, 2000; Saporta, 1978). If the nature of moral knowledge is comparable in some way to the nature of linguistic knowledge, as defended recently by Harman (1977), Dwyer (1999, 2004), and Mikhail (2000; in press), then what should we expect to find when we look at the anatomy of our moral faculty? Is there a grammar, and if so, how can the moral grammarian uncover its structure? Are we aware of our moral grammar, its method of operation, and its moment-to-moment functioning in our judgments? Is there a universal moral grammar that allows each child to build a particular moral grammar? Once acquired, are different moral grammars mutually incomprehensible in the same way that a native Chinese speaker finds a native Italian speaker incomprehensible? How does the child acquire a particular moral grammar, especially if her experiences are impoverished relative to the moral judgments she makes? Are there certain forms of brain damage that disrupt moral competence but leave other forms of reasoning intact? And how did this machinery evolve, and for what particular adaptive function? We will have more to say about many of these questions later on, and Hauser (2006) develops others. However, in order to flesh out the key ideas and particular empirical research paths, let us turn to some of the central questions in the study of our language faculty.. (shrink)
