In his Tanner Lecture of 1979 called ‘Equality of What?’ Amartya Sen asked what metric egalitarians should use to establish the extent to which their ideal is realized in a given society. What aspect of a person’s condition should count in a fundamental way for egalitarians, and not merely as cause of or evidence of or proxy for what they regard as fundamental?

In this paper I seek to explore how the idea of modus vivendi might help us to understand political legitimacy. A suitable conception of modus vivendi, I suggest, can represent a way of underpinning a viable and attractive account of political legitimacy. On my account a modus vivendi is basically a set of arrangements that are accepted as basis for conducting affairs by those who are party to them. Political legitimacy, I argue, is ultimately rooted in the judgements of those (...) subject to it, but is mediated through a language in which claims to it are argued and assessed. The thought is that the web of operative beliefs and values in any given society, which constitute the grounds of judgements about political legitimacy, are what sustains a modus vivendi around the basic political institutions and practices. On this view, legitimate political institutions and practices incline towards a modus vivendi in that they are the outcome of an historical and ongoing conglomeration of settlements reflecting shifting and conflicting values and interests, as well relative balances of power, both currently and in the past. The marriage of modus vivendi and political legitimacy, therefore, seeks to reflect the contingent and ‘negotiated’ character of basic political institutions and practices and an understanding of political legitimacy that sees it as mediated through an ongoing and emergent discourse of argument and judgement, which remains nonetheless always vulnerable to challenge and change. This paper outlines an account of political realism as a form of ideology critique. Our focus is a defence of the normative edge of this critical-theoretic project against the common charge that there is a problematic trade-off between a theory’s groundedness in facts about the political status quo and its ability to consistently envisage radical departures from the status quo. To overcome that problem we combine insights from three distant corners of the philosophical landscape: theories of legitimacy by Bernard Williams (...) and other realists, Frankfurt School-inspired Critical Theory, and recent analytic epistemological and metaphysical theories of cognitive bias, ideology, and social construction. The upshot is a novel account of realism as empirically-informed diagnosis- critique of social and political phenomena. This view rejects a sharp divide between descriptive and normative theory, and so is an alternative to the anti- empiricism of some approaches to Critical Theory as well as to the complacency towards existing power structures found within liberal realism, let alone mainstream normative political philosophy, liberal or otherwise. White supremacy is the unnamed political system that has made the modern world what it is today. You will not find this term in introductory, or even advanced, texts in political theory. A standard undergraduate philosophy course will start off with plato and Aristotle, perhaps say something about Augustine, Aquinas, and Machiavelli, move on to Hobbes, Locke, Mill, and Marx, and then wind up with Rawls and Nozick. It will introduce you to notions of aristocracy, democracy, absolutism, liberalism, representative government, (...) socialism, welfare capitalism, andlibertarianism. But though it covers more than two thousand years of Western political thought and runs the ostensible gamut of political systems, there will be no mention of the basic political system that has shaped the world for the past several hundred years. And this omission is not accidental. Rather, it reflects the fact that standard textbooks and courses have for the most part been written and designed by whites, who take their racial privilege so much for granted that they do not even see it as political, as a form of domination. Ironically, the most important political system of recent global history-the system of domination by which white people have historically ruled over and, in certain important ways, continue to rule over nonwhite people-is not seen as a political system at all. It is just taken for granted; it is the background against which other systems, which we are to see as political are highlighted. This paper provides a critical overview of the realist current in contemporary political philosophy. We define political realism on the basis of its attempt to give varying degrees of autonomy to politics as a sphere of human activity, in large part through its exploration of the sources of normativity appropriate for the political and so distinguish sharply between political realism and non-ideal theory. We then identify and discuss four key arguments advanced by political realists: from ideology, from the relationship of (...) ethics to politics, from the priority of legitimacy over justice and from the nature of political judgement. Next, we ask to what extent realism is a methodological approach as opposed to a substantive political position and so discuss the relationship between realism and a few such positions. We close by pointing out the links between contemporary realism and the realist strand that runs through much of the history of Western political thought. (shrink)

Political philosophers frequently claim that political ideals can provide normative guidance for unjust and otherwise nonideal circumstances. This is mistaken. This paper demonstrates that political ideals contribute nothing to our understanding of the normative principles we should satisfy amidst unjust or otherwise nonideal circumstances.

This article sets out some of the key features of a realist critique of liberal moralism, identifying descriptive inadequacy and normative irrelevance as the two fundamental lines of criticism. It then sketches an outline of a political theory of modus vivendi as an alternative, realist approach to political theory. On this account a modus vivendi should be understood as any political settlement that involves the preservation of peace and security and is generally acceptable to those who are party to it. (...) In conclusion, some problems with this conception of modus vivendi and with a realist political theory more generally are discussed. In particular, the question is raised of whether a realist political theory should be understood as an alternative to liberal moralism or only a better way of doing basically the same kind of thing. In recent decades, a ‘realist’ alternative to ideal theories of politics has slowly taken shape. Bringing together philosophers, political theorists, and political scientists, this countermovement seeks to reframe inquiry into politics and political norms. Among the hallmarks of this endeavor are a moral psychology that includes the passions and emotions; a robust conception of political possibility and rejection of utopian thinking; the belief that political conflict — of values as well as interests — is both fundamental and ineradicable; a focus (...) on institutions as the arenas within which conflict is mediated and contained; and a conception of politics as a sphere of activity that is distinct, autonomous, and subject to norms that cannot be derived from individual morality. For political realists, a ‘well-ordered society’ is rarely attainable; a modus vivendi without agreement on first principles is often the only practical possibility. Not only will ‘full compliance’ never be achieved, but also it is an assumption that yields misleading accounts of political norms. While realists offer a number of compelling criticisms of ideal theory, there are some lacunae in their stance. It is not yet clear whether realism constitutes a coherent affirmative alternative to idealism. Nor have realists clarified the extent of conflict that is consistent with political order as such. And because both sides accept ‘ought implies can’ as a constraint on the validity of political norms, much of the debate between realists and idealists revolves around deep empirical disagreements that are yet to be clarified. There is a widespread belief that, conceptually, justice cannot require what we cannot achieve. This belief is sometimes used by defenders of so-called ‘non-ideal theories of justice’ to criticise so-called ‘ideal theories of justice’. I refer to this claim as ‘the feasibility constraint on the concept of justice’ and argue against it. I point to its various implausible implications and contend that a willingness to apply the label ‘unjust’ to some regrettable situations that we cannot fix is going to enhance (...) the action-guiding potential of a conception of justice, by providing an aspirational ideal. This is possible on the condition that, at all times, we cannot specify with certainty the limits of what is feasible for us collectively. The rejection of the feasibility constraint entails that there can be injustice without perpetrators; this is a theoretical price worth paying. (shrink)

This paper explores two different versions of ‘the realist turn’ in recent political theory. It begins by setting out two principal realist criticisms of liberal moralism: that it is both descriptively and normatively inadequate. It then pursues the second criticism by arguing that there are two fundamentally different responses among realists to the alleged normative inadequacy of ideal theory. First, prescriptive realists argue that the aim of realism is to make political theory more normatively adequate by making it more realistic. (...) Interpretative realists, on the other hand, argue that realist theorising should detach itself from such an aspiration, and instead aim at theoretical understanding rather than normative prescription. In recent years, a number of realist thinkers have charged much contemporary political theory with being idealistic and moralistic. While the basic features of the realist counter-movement are reasonably well understood, realism is still considered a critical, primarily negative creed which fails to offer a positive, alternative way of thinking normatively about politics. Aiming to counteract this general perception, in this article I draw on Bernard Williams’s claims about how to construct a politically coherent conception of liberty from the non-political (...) value of freedom. I do this because Williams’s argument provides an illuminating example of the distinctive nature of realist political thinking and its attractions. I argue that Williams’s account of realist political thinking challenges the orthodox moralist claim that normative political arguments must be guided by an ideal ethical theory. This paper offers a systematic examination of the political thought of Bernard Williams by explaining the relation between his political realism and critical assessment of modern moral philosophy and discussing how his work illuminates the debates about the nature and purpose of political theory. I argue that Williams’s realism is best read as an attempt to make ethical sense of politics, and as an attempt to explain how we can continue to affirm a kind of liberalism, without recourse to the (...) moralized presuppositions that he insists we must jettison. I begin by outlining Williams’s claims about the limits of philosophy and his conception of confidence. I then address his understanding of the relationship between historical and philosophical inquiry and his contention that historical understanding can foster a kind of confidence in some of our contemporary commitments. I conclude by showing how this leads Williams to articulate a defense of liberalism that is compatible with his skepticism about modern moral philosophy and his ancillary critique of political moralism. In this sense, Williams’s work has important implications for political theory and the study of politics more generally because it enables us to articulate a defense of liberalism that has marked advantages over the “high liberalism” that most contemporary liberal political philosophers defend and shows how we might develop a political theory that does not begin by asserting universal moral foundations but which, despite this, avoids reverting to a crude postmodern antifoundationalism.
