What makes a living system a living system? What kind of biological phenomenon is the phenomenon of cognition? These two questions have been frequently considered, but, in this volume, the authors consider them as concrete biological questions. Their analysis is bold and provocative, for the authors have constructed a systematic theoretical biology which attempts to define living systems not as objects of observation and description, nor even as interacting systems, but as self-contained unities whose only reference is to themselves. The (...) consequence of their investigations and of their living systems as self-making, self-referring autonomous unities, is that they discovered that the two questions have a common answer: living systems are cognitive systems, and living as a process is a process of cognition. The result of their investigations is a completely new perspective of biological (human) phenomena. During the investigations, it was found that a complete linguistic description pertaining to the ‘organization of the living’ was lacking and, in fact, was hampering the reporting of results. Hence, the authors have coined the word ‘autopoiesis’ to replace the expression ‘circular organization’. This article contributes to the revision of the concept of system in social theory using complexity theory. The old concept of social system is widely discredited; a new concept of social system can more adequately constitute an explanatory framework. Complexity theory offers the toolkit needed for this paradigm shift in social theory. The route taken is not via Luhmann, but rather the insights of complexity theorists in the sciences are applied to the tradition of social theory inspired by Marx, Weber, (...) and Simmel. The article contributes to the theorization of intersectionality in social theory as well as to the philosophy of social science. It addresses the challenge of theorizing the intersection of multiple complex social inequalities, exploring the various alternative approaches, before rethinking the concept of social system. It investigates and applies, for the first time, the implications of complexity theory for the analysis of multiple intersecting social inequalities. Autopoiesis is normally considered to be the systems theory in law. In this paper complexity theory is presented as an alternative systems approach. In order to position complexity theory as a plausible alternative to autopoiesis I discuss the differing understanding of boundary within each theory, and use this as a vehicle to critique autopoiesis. My critique is situated within systems theory thinking but is external to both autopoiesis and complexity theory. Because both approaches possess an understanding of boundary it provides (...) an effective tool to contrast their differences, while permitting each to be described in its own language. It is argued that complexity theory offers an approach to boundaries as contingent, emergent interfaces, which the autopoietic construction of boundary can learn from in several ways. More generally it is suggested that the complexity approach to boundaries offers lawyers engaging with systems theory a new critical perspective to assess legal constructions. (shrink)

This is a review article of Paul Cillier's 1999 book _Complexity and Postmodernism_. The review article is generally encouraging and constructive, although isolates a number of areas in need of clarification or development in Cillier's work. The volume of the _South African Journal of Philosophy_ in which the review article appeared also printed a response by Cilliers.

Among social theories, autopoiesis achieves an almost unequalled level of complexity and abstraction. Yet this has has not in any way deterred commentators from among the ranks of legal and socio-legal academics from launching critical attacks on the theory. This article argues that many of these detractors miss their mark, because their authors either misinterpret the theory by failing to recognize its radical nature and the new paradigm that it introduces, or, in the more extreme cases, project onto the theory (...) immoral or irrational ambitions which are nowhere to be found in the writings of Niklas Luhmann or other autopoietic theorists. All this brings to mind Nabokov's novel Pale Fire, which also is concerned with criticism, projection and misinterpretation. In that novel the text is a poem, while the plot, concerning a paranoid literary critic, unfolds in the notes commenting on this poem. This article reverses this device by placing the main commentaries and criticisms in the main text and the `autopoietry', extracts from the writings of autopoietic scholars, which form the subject of the critical attacks, in the footnotes. Even television has incorporated the (...) topics of complexity science. Crime shows ® ® such as 24 or CSI typically feature investigators using the latest advances in computational modeling to “simulate scenarios” or “data mine” all p- sible suspects—all of which is done before the crime takes place. The ® World Wide Web is another example. A simple search on Google. Com using the phrase “complexity science” gets close to a million hits! C- plexity science is ubiquitous. What most scholars do not realize, however, is the remarkable role sociologists are playing in this new science.
