The ‘expropriation of the expropriators’ is a delicious turn of phrase, one that Marx even compares to Hegel’s infamous ‘negation of the negation’. But what does it mean, and is it still relevant today? Before I analyse the content of Marx’s expression, I briefly consider contemporary legal understandings of expropriation, as well as some examples of it. In the remainder of the essay, I spell out different kinds of expropriation in Marx and focus on an ambiguity at (...) the core of the notion of ‘expropriating the expropriators’, namely, whether it describes an immanent and objective tendency within the development of the capitalist mode of production or else actively prescribes a form of revolutionary political praxis for the working class. My answer is that it does both, though not without tension. Finally, I develop some implications of these reflections by showing how the concept of expropriation can be put to use today, in struggles around housing, climate and work. (shrink)

A citizens’ movement in Berlin advocates for the expropriation of housing corporations and has won a significant majority in a popular referendum in September 2021. Building on this proposal, this paper develops a general account of expropriation as a measure for corporate reform and thereby contributes to the ongoing debate on the democratic accountability of business corporations. It argues that expropriation is a valuable tool for intervention in a dire situation in some economic sector to enable a (...) re-structuring of the governance of the assets in question. Compared with other tools available, expropriation is a more forward-looking, genuinely political measure that does not depend on the legal assignment of guilt but rather proceeds in a pragmatic and problem-oriented manner. It also allows us to reconsider in how far the market mechanism should be employed in the administration of assets. Objections from private property rights against expropriation fail as corporations generally are privileged, quasi-public institutions that can justifiably be subject to democratic interventions. Expropriation is thus an important addition to the arsenal of corporate reform proposals, especially for those concerned with a broad democratization of the corporation. (shrink)

What Ivan Illich regarded in his Medical Nemesis as the ‘expropriation of health’ takes place on the surfaces and in the spaces of the screens all around us, including our cell phones but also the patient monitors and (increasingly) the iPads that intervene between nurse and patient. To explore what Illich called the ‘age of the show’, this essay uses film examples, like Creed and the controversial documentary Vaxxed, and the television series Nurse Jackie. Rocky’s cancer in his last (...) film (submitting to chemo to ‘fight’ cancer) highlights what Illich along with Petr Skrabanek called the ‘expropriation of death’. In contrast to what Illich denotes as ‘Umsonstigkeit’ – i.e., a free gift, given undeservedly, i.e., gratuitously – medical science tends to be tempted by what Illich terms scientistic ‘black magic’, taking over (expropriating) the life and the death of the patient in increasingly technological ways, a point underscored in the concluding section on the commercial prospects of xenotransplants using factory farm or mass-produced (and already for some time) human-pig mosaics or chimeras. Business corporations hold an enormous amount of power towards employees, contractors, customers, and the general public and they do so largely without effective democratic control. Within the workplace democracy debate scholars have argued that this current state is unjustifiable and that corporations must be democratized. But what exactly does that mean? In my thesis, I explore three questions regarding the details of democratization. First, who should be enfranchised in a democratic business corporation? Second, what are plausible pathways towards democratic corporations? (...) And, third, how can we ensure that democratized business corporations last? I discuss these questions in the spirit of methodological realism, paying special attention to considerations of feasibility, ability, and motivation as well as empirical data and examples. I argue that democratization should involve a number of constituencies beyond workers, especially customers and local populations, because an all-affected principle of participation best captures what is distinctive about corporate power. I then offer a number of institutional innovations for the process of democratization. Building on the example of the Berlin expropriation campaign, I argue that expropriation policies can help circumvent the power of those opposed to democratization and provide a helpful path towards democratization. I suggest that a transitional democratic dictatorship modelled after Marx's dictatorship of the proletariat could solve problems of cooperation and sabotage for newly democratized corporations. And, finally, I propose a class-specific corporate tribunate and a right to strike for the democratic corporation to provide institutional counterpower in order to prevent elite capture and the degeneration of democratic corporations. Mass shootings constitute a recurrent and most violent phenomenon in the U.S. and elsewhere. This paper challenges the ready-made, solipsistically contained metanarratives on offer by mainstream media and formal institutions with regard to the psychological antecedents of the perpetrating social actors, while theorizing mass shootings as acts of violence that are systemically inscribed in the foundations of communities. These foundations abide by the logic of sacrifice which is propagated in instances of collective traumatism. It is argued that the cultural trauma (...) that emanates from events of mass shootings, inasmuch as the commemorative events that are performed on regular occasions, constitute re-enactments of the death drive that sustains communities. The cultural analytic deploys against a CDA reading of longitudinal studies on mass shootings, coupled with psychoanalytic discourse analysis, prior to submitting mass shootings to a deconstructive line of reasoning as systemically necessary transcendental violence. Ultimately, it is shown that the intertextual institutional chain that informs the mediatized representation of this social phenomenon merely attains to obliterate and, hence, to propagate cultural traumatism and the sacrificial logic that underpins it. The terms micrometanarrative, parafunction and expropriating ipseity are introduced and operationalized in this context. (shrink)

We address the most fundamental yet routinely ignored issue in economics today: that of distributive impact of the monetary system on the real economy. By re-examining the logical implications of token re-presentation of value and Irving Fisher’s theory of exchange, we argue that producers of value incur incidental expropriation of wealth associated with the deflationary effect that new value supply has on the purchasing power of money. In order to remedy the alleged inequity we propose a value-added negative tax (...) (VANT) based on net individual contribution to the economic output, which is structured as a negative tax function geared to profits derived from eligible productive activities in consideration of their estimated deflationary impact. We show that an adequately optimised VANT can be non-inflationary and have zero net cost to the public. Furthermore, economic output stands to improve due to direct incentivisation of value creation, making the proposed scheme not only politically feasible but economically desirable. The proposal advances the principle of ‘fair money’, where all forms of economic value are attributed to their rightful owners prior to any positive taxation. (shrink)

In a recent essay, Donald Dripps advanced what he calls a “commodification theory” of rape, offered as an alternative to understanding rape in terms of lack of consent. Under the “commodification theory,” rape is understood as the expropriation of sexual services, i.e., obtaining sex through “illegitimate” means. One aim of Dripps's effort was to show the inadequacy of consent approaches to understanding rape. Robin West, while accepting Dripps's critique of consent theories, criticizes Dripps's commodification approach. In its place, West (...) suggests a more phenomenological approach. The author argues that neither Dripps nor West offers convincing critiques of consent-based theories; the alternatives they offer presuppose the vitality of a consent-based approach to understanding rape; and that both Dripps and West consistently conflate more general moral and political issues with that of the nature of rape. Sacred value attitudes involve a distinctive profile of norm psychology: an absolutist prohibition on transgressing the value, combined with outrage at even hypothetical transgressions. This article considers three mechanisms by which such attitudes may be adaptive, and relates them to central theories regarding the evolution of religion. The first, “deterrence” mechanism functions to dissuade coercive expropriation of valuable resources. This mechanism explains the existence of sacred value attitudes prior to the development of religion and also explains analogues of sacred (...) value in non-human species. The two remaining mechanisms, “assurance” and “coalitional,” are more likely to have been involved in the cultural evolution of specifically religious behavior. In the assurance mechanism, sacred value attitudes increase the cost of ideological commitments, making them more reliable as signals of a cooperative disposition. In the coalitional mechanism, sacred value attitudes make it dangerous for third parties to dissent from a social norm, and thus discourage competitor ideologies. While both these mechanisms are compatible with major accounts of the evolution of religion, different theories suggest a greater or lesser emphasis on one mechanism or the other. (shrink)

The essay “Was ist der Mensch?” appeared for the first time in December 1944 in the German magazine with a hundred years of tradition edited by the publisher J. J. Weber Illustrierte Zeitung Leipzig [Illustrated Magazine Leipzig]. This special cultural edition, entitled Der europäische Mensch [The European Man], which was distributed exclusively abroad, was to be the last volume of the magazine after its final regular issue in September 1994 (No. 5041). Only in 1947, the text was republished, with the (...) same pagination, in a compilation made by J. J. Weber, Vom Wahren, Schönen, Guten. Aus dem Schatz europäischer Kunst und Kultur [On the True, the Beautiful, the Good. From the Treasury of European Art and Culture]. The publisher was expropriated in 1948, and three years later the company was finally removed from the German commercial registry. “Was ist der Mensch?” has never been released in any of Gadamer’s books or separately published in a journal; it also does not appear within the 10 volumes of his Gesammelte Werke [Collected Works]—the only exception is an Italian translation included in a volume devoted to Gadamer’s views on education and the notion of Bildung (cf. Gadamer 2012). The aim of this translation is to make accessible this Gadamer’s quest for the occidental interpretations of human self-consciousness, which has until now been almost unknown and in which, for the first time, Gadamer shows, from a theoretical standpoint, not only his early—although implicit—keen interest in Max Scheler’s anthropology (particularly Scheler’s considerations on the basic historical types of the occidental man’s self-perception in accordance with the basic and underlying concept of human history that still have powerful effectiveness in modern times), but also—at the historical threshold of the imminent ending of World War II—his own concern regarding possible philosophical answers to the question: “What is man?” Cf. especially Scheler 1926 (GW 9, 120–144); 1928 (GW 9, 7–71); 1929 (GW 9, 145–170). Often described as an outcome, inequality is better understood as a social process -- a function of how institutions are structured and reproduced, and the ways people act and interact within them across time. Racialized inequality persists because it is enacted moment to moment, context to context -- and it can be ended should those who currently perpetuate it commit themselves to playing a different role instead. This essay makes three core contributions: first, it highlights a disturbing parity between the (...) people who are most rhetorically committed to ending racialized inequality and those who are most responsible for its persistence. Next, it explores the origin of this paradox – how it is that ostensibly antiracist intentions are transmuted into ‘benevolently racist’ actions. Finally, it presents an alternative approach to mitigating racialized inequality, one which more effectively challenges the self-oriented and extractive logics undergirding systemic racism: rather than expropriating blame to others, or else adopting introspective and psychologized approaches to fundamentally social problems, those sincerely committed to antiracism can take concrete steps in the real world – actions which require no legislation or coercion of naysayers, just a willingness to personally make sacrifices for the sake of racial justice. In On Touching, Derrida commends philosopher Jean-Luc Nancy for ‘taking into account [the] plasticity and technicity “at the heart” of the “body proper.”’ Specifying the meaning of this plasticity and technicity, Derrida writes, the"[s]upplementarity of technical prosthetics originarily spaces out, defers, or expropriates all originary properness: there is no “the” sense of touch, there is no “originary” or essentially originary touching before it." What is ‘proper’ or ‘original’ to the body, it seems, is not any set of properties or capacities (...) – including sensorial or perceptual powers – but rather the ‘plastic and substitutive structure of prosthetics’, the very possibility of the body’s ‘technical’ supplementation. Nikolai Fedorov (1829–1903), the progenitor of so-called Russian Cosmism, is an eccentric figure without parallel in the domain of modern thought. His intellectual vision, elaborated across a number of essays and the sprawling unpublished magnum opus written from the 1870s to the 1890s, The Question of Fraternity, attempted a novel theorization of the trajectory, meaning, and telos of the human species through the fulcrum of resurrection. The speculative dimension of Fedorov's cosmist project has garnered the most sustained theoretical interest, but (...) this speculative dimension develops out of a determinate critical diagnosis of the fundamental operations of Western modernity. Reconstructing the elements that make up the diagnostic tendency of Fedorov's project, and then recentering his project around them, allows for the speculative and cosmic elements of his thought to be properly understood. As a result, his project is revealed to be a thinking and acting out of an intimacy with death and with the earth, a thinking and acting grounded in a delegitimating refusal of the colonial, biopolitical, and capitalist foundations of modernity. Only with the delineation of the critical as the internal drive for the cosmically speculative is Fedorov's difference from dominant modes of eco- and geo-constructivist thought sufficiently retained. Our essay pursues this line of thinking to show the decisive significance of Fedorov's critical project, incubated on the margins of Western modernity, for two dominant lines of critical theory—those associated most closely with the names of Karl Marx and Michel Foucault. It does so by reconstructing Fedorov's refusal of the modern biopolitical paradigm, his expansion of the analytics of expropriation, his ambitious reconfiguration of the cartographical imaginary of collective life around the cemetery and the commune, and finally his speculative rewriting of the liturgy as the material enactment of the common task. Global capitalism is the politico-economic structure that subjects everything to its interests. It creates unimaginable poverty, ecological crisis, the ongoing pandemic, wars without end, and other horrors that humans can inflict against each other. Within this capitalist configuration, an idea and a political movement emerged that seeks to destroy the foundation of this system. Communism is this idea and political movement. The foundation of capitalism that they wanted to dismantle is private bourgeois property. In general, the Bolshevik revolution did destroy (...) that foundation, but this was not enough. It only resulted in the eventual transformation of the party as the collectivized bourgeoisie with its authoritarian state apparatus. It transformed this bourgeois-liberal capitalism into state-run capitalism. The revolutionary class that was supposed to be emancipated, remained as they were in capitalism, producer of the means of subsistence and surplus value. The eventual dissolution of the Soviet Union did not mean that the idea of communism is already dead. It should have been the perfect time to reassess the theoretical foundations of communism and test the ideas of Marx and others in their practical-idealistic form. The production and reproduction of capitalist social relations create everyday consciousness for all capitalist subjects, even to passionate communist revolutionaries. This is how ideology works. But the continuing havoc of global capitalism continues. The Left goes on with their same old traditions. They do not see that precisely ii their unceasing failure is one of the conditions for capitalism and its state apparatus to have the capacity to reinvent itself. In Pandemic 2: Chronicles of a Time Lost, Slovenian-born philosopher and global thinker Slavoj Zizek said that capitalism is incapable of solving the Covid-19 crisis. In his more than a thousand-page book paradoxically called Less Than Nothing, he said that ‘really existing’ socialism failed because it was ultimately a subspecies of capitalism. Can we utilize this Zizekian idea of communism, an idea that generates criticism both to capitalism and 20th-century communism to reinvent communism for it to revitalize its struggle against global capitalism? To answer this question, I employed Critical Theory through the ideas of communism of Zizek. I started with capitalism’s totality. It manifests itself in the world of commodities. Commodities are everywhere and almost in everything. Commodification not only involves things that man uses but humanity herself is commodified. Then I elaborated on the notion of the proletariat because she is the “commodified man” personified. The identification of the proletariat almost exclusively with factory workers is the prevailing idea in the Left movement. I tried to show that the proletariat is the overwhelming majority in every industry. Capitalism, I claim is both producing employment and unemployment. And the unemployed, not only are included as members of the proletarian class, but looking at it objectively, they may play a significant role in the political struggle of the proletariat against the bourgeoisie. Therefore, as I tried to describe in quite a detailed fashion the various industries of capitalism and the sub-groups of the unemployed, it becomes evident that even without mentioning it, the proletariat is the class that almost everyone belongs to, except, as might be expected, the bourgeoisie. -/- Then I mustered the audacity to question Marx and Engels’ Communist Manifesto. I also tried to imagine what will happen to the economic categories in Marx’s Capital in communism. My objective was to identify what is lacking in Marx that may explain the Left’s unending failure. I think I succeeded, although in a very superficial manner, in trying to locate what was missing in Marx’s theory. It was not enough to transform the bourgeois property into public property, but this transformation must stop commodity production itself. Commodity production is this self-perpetuating character of capitalist production. Then it led to further elucidation of the metamorphosis of commodity production to the production of human needs. Another idea is the double negation of the communist revolution. Communism must not only negate the bourgeois class but the proletariat herself. Marx only emphasized the dissolution of the bourgeoisie but failed to relate this dissolution to the proletariat’s self-negation. Absolutely, the significant reduction of working hours is fundamental for communism. This reduction must result from the conscious expansion of the workers' free time. Expanding free time is at the same time reducing time for production. Essentially, this is the process of the self-negation of the proletariat. I also tried to put forward an idea that directly links reform and revolution. They are directly linked with each other because both are communistic. A communist campaign for higher wages is directly involved with the communist expansion of political power. Communist reform becomes revolutionary. Concomitantly, the notion of revolution also changes. The communist revolution, instead of it being a sudden, external, and most often violent event, becomes an internal transformative process and possibly less violent. I concluded by transforming the concepts I think Marx missed into political possibilities. That is why I expounded on the immediate aims Marx and Engels enumerated in the Communist Manifesto and tried to claim the probability of the impossible in the communist struggle for political power and Man’s eventual freedom. -/- Marx's description of factory work creates no illusion about the status of freedom in capitalism. In Capital, he said that “factory work... confiscates every atom of freedom, both bodily and in intellectual activity.” And I think Marx made clear that the only way to freedom is ultimately to destroy capitalism. These words of his in Capital will cast no doubt, “the knell of capitalist private property sounds. The expropriators are expropriated.” And to signify who are those experiencing this unfreedom, Marx and Engels summon the subject of the revolution in their famous lines in the Communist Manifesto and urge them to fight, “the proletarians have nothing to lose but their chains. They have a world to win.” Today is the time for philosophy because it is the age of declining freedom. But the prevailing capitalist structure is necessitating this unfreedom. And for philosophy to become what it is, communism should become philosophy. (shrink)

This piece of writing has investigated the legal and institutional frameworks regulating rural land governance in Ethiopia by taking the comparative analysis of rural land governance of other African countries, namely Ghana, Kenya and Uganda. The best experience of these countries on the legal and institutional frameworks is examined so as to draw a lesson for the Ethiopian land governance system. The article has employed doctrinal legal research approach and rural land legislations of the country were investigated in great detail. (...) The article has also comparative aspect because, it has drawn lessons from the legal regimes of other African countries that have best experience on the legal and institutional frameworks governing rural lands. Ethiopia can draw many good practices from Ghanaian, Kenyan and Ugandan rural land governance. Rural land legislations in these countries have given sufficient room for the protection of customary land rights and these rights are equally compensated at the time of compulsory acquisition of land use rights. In addition to these, land legislations in these countries compensate owners not only for the value of the produce upon their land but also for the market value of the land taken, cost of disturbance and other damage like severance and injurious affection. So, this can be a good lesson for Ethiopia in order to consider the life of individuals whose land is being expropriated but unable to rehabilitate to their past economic situation after compulsory acquisition. Ethiopia can also acquire a good lesson from these countries on the mode of institutional arrangement governing rural land administration is concerned. In all these African countries, the mandate to administer land is arranged at the ministry level at the apex and there are also other independent sector based institutions up to the lowest administrative hierarchy. Ethiopia, that governs land at the directorate level under the Ministry of Agriculture at the top and bureau of land and environmental protection at the middle and land and environmental protection offices/departments at the lower administrative level can capture this good practice from Ghana, Kenya and Uganda in order to give sufficient room for this vital economic resource that is livelihood for mass populations of the country. We investigate the association between controlling shareholders' ownership (CS_Own) and firms' leverage decisions in the Singaporean context. We examine whether the impact of ownership concentration on leverage differs across excess and lower control. We report that shareholders with excess control prefer leverage financing for an optimal capital structure and focus on value maximisation rather using leverage as a tool of minority shareholders' expropriation. Our analysis shows that firms capital structure significantly influences by the coalition of shareholders particularly decisions about (...) leverage financing in addition to the firms' specific characteristics and institutional arrangements. Our empirical evidence shows that controlling shareholders with a lower fraction of equity are more concerned about limited holding thus prefer leverage over equity financing to inflate their equity stake to protect them from the potential takeovers and mergers. We report that capital structure decisions in Singapore are linked with the trade-off between the controlling shareholders' target of mitigating firm risk and their non-dilution entrenchment needs. Further, we found an inverted U-shaped association between control ownership and leverage financing. In terms of moderating effect of family-controlled ownership, our findings exhibit that leverage financing is less pronounced for family firms in Singapore due to the under-diversified investment portfolio.
