According to a prominent view in Jewish-Halakhic literature, “mitzvot (commandments) require intention.” That is, to fulfill one’s obligation in performing a commandment, one must intend to perform the act because it’s a mitzvah; one must take the fact that one’s act is a mitzvah as her reason for doing the action. I argue that thus understood, this Halakhic view faces a revised version of Thomas Hurka’s recent dilemma for structurally similar views in ethics: either it makes it a necessary condition (...) for the act’s being a mitzvah that one has a false belief about the act’s Halakhic status, or it commits proponents of the “mitzvot require intention” view to a sort of rational failure in performing the mitzvot. The dilemma arises, however, only if we interpret this Halakhic view as requiring one to have a belief about her act’s Halakhic status in order for it to have this status. I suggest that the dilemma can be avoided by interpreting the intention requirement as requiring a make-belief, instead of a belief. Under this understanding, Halakha (or God) doesn’t care about why one performs an act of a mitzvah, but rather about how she does it; how she sees and experiences her action. This suggests another form of worship central to Judaism—worship via make-believing. (shrink)

Moral realism is often taken to have common sense and initial appearances on its side. Indeed, by some lights, common sense and initial appearances underlie all the central positive arguments for moral realism. We offer a kind of debunking argument, taking aim at realism’s common sense standing. Our argument differs from familiar debunking moves both in its empirical assumptions and in how it targets the realist position. We argue that if natural selection explains the objective phenomenology of moral deliberation and (...) judgement, then this undermines arguments from that phenomenology. This results in a simpler, and in some ways more direct, challenge to realism. It is also less vulnerable to the main objections that have been leveled against such arguments. If accepted, our conclusion should make a real difference to the dialectic in this area. It means that neither realism nor its denial is the default, to-be-refuted, position. (shrink)

Some philosophers think that knowledge or justification is both necessary and sufficient for rational action: they endorse knowledge-action or justification-action biconditionals. This paper offers a novel, metaphysical challenge to these biconditionals, which proceeds with a familiar question: What depends on what? If you know that p iff it is rational for you to act on p, do you know that p partly because it is rational for you to act on p, or is it rational for you to act on (...) p partly because you know that p? And a structurally similar question can be asked regarding justification-action biconditionals. I argue that proponents of these biconditionals cannot give a satisfactory answer to these questions. This is because each direction of these biconditionals strongly supports an opposite order of explanation to the one that is supported by the other direction. Given the traditional assumption that metaphysical explanations—even partial ones—are asymmetric, I argue that these biconditionals should be rejected. While knowledge might be necessary for rational action, and it might be sufficient, it cannot be both. And the same goes for justification. (shrink)

Suppose that, for reasons of animal welfare, it would be better if everyone stopped eating chicken. Does it follow that you should stop eating chicken? Proponents of the “inefficacy objection” argue that, due to the scale and complexity of markets, the expected effects of your chicken purchases are negligible. So the expected effects of eating chicken do not make it wrong. -/- We argue that this objection does not succeed, in two steps. First, empirical data about chicken production tells us (...) that the expected effects of consuming *many* chickens are not negligible. Second, this implies that the expected effect of consuming one chicken is ordinarily not negligible. *Parity* between your purchase and other counterfactual purchases and *uncertainty* about others’ consumption behavior each tend to pull the expected effect of a single purchase toward the average large scale effect. While some purchases do have negligible expected effects, many do not. (shrink)

Typical philosophical discussions of physician-assisted death have focused on whether the practice can be permissible. We address a different question: assuming that pad can be morally permissible, how far does that permission extend? We will argue that granting requests for pad may be permissible even when the pad recipient can no longer speak for themselves. In particular, we argue against the ‘competency requirement’ that constrains pad-eligibility to presently-competent patients in most countries that have legalized pad. We think pad on terminally (...) ill, incapacitated patients can be morally permissible in cases where advance directives or suitable surrogate decision-makers are available, and should be legally permissible in such cases as well. We argue that this view should be accepted on pain of inconsistency: by allowing surrogate decision-makers to request withdrawal of life-sustaining care on behalf of patients and by allowing patients to request pad, we rule out any plausible justification for imposing a competency requirement on pad. We argue on consequentialist grounds for the transfer of Sandai, an orangutan, to an orangutan sanctuary. First, we show that satisfying his interest in being transferred brings far greater value than the value achieved by keeping him confined. Second, we show that he has the capacities sufficient for personhood. Third, we show that all persons have a right to relative liberty insofar as they have interests they can exercise only under conditions of relative liberty. Fourth, we show that individuals need (...) not be able to assume social obligations and duties in order to be rights holders. -/- Our argument reflects commitments, as we say, to consequentialist reasoning about moral problems. However, we note that influential representatives of the other dominant ethical traditions—the deontological and Aristotelian traditions—reach our conclusion, too. It makes no difference, in this instance, which ethical theory one adopts. Under all of them, Sandai is a person with an interest in relative liberty entitled to habeas corpus protection. (shrink)

Should the law recognize an elephant’s right to be released from solitary confinement? The New York State Court of Appeals—the highest court in the State of New York—will consider this question on May 18. At issue is an Asian elephant named Happy. But happy she is not. Every human being has a right to bodily liberty because they have strong interests that this right protects. Since Happy has the same strong interests, the Court should recognize Happy’s right to be freed (...) from solitary confinement. (shrink)

We present ethical reasons that the court should grant the Nonhuman Rights Project’s (NhRP) request for habeas corpus relief for Happy, an elephant. Happy has a basic interest in not being confined, an interest that should be legally protected just as the human interest in not being confined is legally protected. Since the decision in The Nonhuman Rights Project, Inc. v Breheny failed to weigh Happy’s interests properly, we ask this body to correct the error.

Esta coletânea é um tributo a Peter Frederick Strawson pelo centenário de seu nascimento (1919-2019). Diferentemente de outras coletâneas, esta propõe colocar em relevo a interlocução de Strawson com a tradição filosófica. Em outras palavras, por um lado, queremos evidenciar as discussões que Strawson travou com os seus contemporâneos (Austin, Quine, Russell e Wittgenstein), e, por outro, a influência que recebeu e as críticas que dirigiu àqueles que o precederam na história da filosofia (Aristóteles, Descartes, Hume, Kant). Poderíamos ter enriquecido (...) a lista acima com o nome de muitos outros filósofos com os quais Strawson teve contato, mas julgamos que o trabalho ficaria bastante extenso. Por esse motivo, optamos por aqueles nomes mais significativos que figuram na construção da história intelectual de Strawson. O presente volume reúne nove capítulos que levam como título o nome de Strawson e do filósofo com o qual ele dialogou ao longo de suas obras. Essa opção na nomeação dos capítulos por si só já permite colocar em evidência os principais filósofos pelos quais Strawson se interessou e com os quais se confrontou ao longo de seu trabalho filosófico. Com exceção do capítulo sobre Wittgenstein, que é uma versão revisada de um texto publicado anteriormente, todos os outros capítulos são inéditos e foram escritos especialmente para esta coletânea. O volume inclui na abertura a tradução de “Um fragmento de autobiografia intelectual”, de P. F. Strawson. People engage in pure moral inquiry whenever they inquire into the moral features of some act, agent, or state of affairs without inquiring into the non-moral features of that act, agent, or state of affairs. This chapter argues that ordinary people act rationally when they engage in pure moral inquiry, and so any adequate view in metaethics ought to be able to explain this fact. The Puzzle of Pure Moral Motivation is how to provide such an explanation. This chapter argues (...) that each of the standard views in metaethics has trouble providing such an explanation. Discussion of why reveals that a metaethical view can provide such an explanation only if it meets two constraints: it allows ordinary moral inquirers to know the essences of moral properties, and the essence of each moral property makes it rational to care for its own sake whether that property is instantiated. Theorists have had less success in analyzing the truth conditions of generics. Philosophers of language have offered a number of theories. This chapter surveys several semantic accounts of generics. However, the focus is on generics and experimental philosophy. It briefly reviews empirical work that bears on these semantic accounts. While generics constitute an interesting linguistic phenomenon worthy of study in their own right, the study of generics also has wide‐ranging implications for questions beyond the philosophy of language, including questions in (...) social psychology and cognitive science more generally. The chapter also reviews empirical work on the relationship between generics and cognition. Existing empirical work strongly supports the generics‐as‐defaults hypothesis: the hypothesis that generics reflect a cognitively default, fundamental mode of generalizing in humans. Finally, the chapter elucidates evidence that generic language and generic modes of generalizing play an important role in stereotyping and prejudice. (shrink)

The following essay stems from my interest in finding out whether Taminiaux’s appealing and well-argued reading of the Greek and Platonic connivance between theôria and poiêsis in contrast to the fragility and contingency of human practical judgments and the human intrigue of our worldly abode—a reading that in his view is retrieved by modern and contemporary German philosophers, including Heidegger—may be applied to Husserl’s transcendental phenomenology and reduction. In my view, Taminiaux’s original and piercingly acute reading of the history of (...) philosophy is above all due to his close and severe scrutiny of texts transmitted by the tradition, in dialogue with our experience of the “matters themselves.” Following this spirit, I risk an alternative reading of the phenomenological reduction, and specifically of its transcendental version, as an eminently practical—namely, ethical—achievement, driven by a practical virtue, responsibility. Epistemic states of uncertainty play important roles in ethical and political theorizing. Theories that appeal to a “veil of ignorance,” for example, analyze fairness or impartiality in terms of certain states of ignorance. It is important, then, to scrutinize proposed conceptions of ignorance and explore promising alternatives in such contexts. Here, I study Lerner’s probabilistic egalitarian theorem in the setting of imprecise probabilities. Lerner’s theorem assumes that a social planner tasked with distributing income to individuals in a population (...) is “completely ignorant” about which utility functions belong to which individuals. Lerner models this ignorance with a certain uniform probability distribution, and shows that, under certain further assumptions, income should be equally distributed. Much of the criticism of the relevance of Lerner’s result centers on the representation of ignorance involved. Imprecise probabilities provide a general framework for reasoning about various forms of uncertainty including, in particular, ignorance. To what extent can Lerner’s conclusion be maintained in this setting? (shrink)

Can fictional literature help us lead better lives? This essay argues that some works of literature can help us both change our personal narratives and develop new narratives that will guide our actions, enabling us to better achieve our goals. Works of literature can lead us to consider the hypothesis that we might beneficially change our future-oriented, personal narratives. As a case study, this essay considers Ben Lerner’s novel, 10:04, which focuses on humans’ ability to develop new narratives, and (...) which articulates a narrative that takes into account both everyday life and large-scale issues like the global, environmental crisis. In a political moment characterised by post-truth ideologically generated misinformation and algorithmically propagated discourse: questions of fact, of inquiry, of perspective are paramount. This work examines what it means to write literature or to do philosophy while encountering a world of diffuse truths. It asks how can we retain clarity without erasing the fact that perspectival knowledge is always already embedded, piecemeal, contextual? To answer this question, I turn to a more foundational one, that has plagued philosophy since Plato proclaimed, (...) “there is an old quarrel between philosophy and poetry” (Republic, 607b5–6). My thesis picks up on a central aspect of the quarrel, the claim that art doesn’t lead to truth. I ask: what is the nature of literary inquiry and how can literature distinguish itself as an autonomous form of intellectual inquiry, if it can at all? Beginning with David Foster Wallace’s “The Empty Plenum”, I argue for a novel ‘perspectival’ or ‘mystical’ interpretation of Wittgenstein’s Tractatus Logio-Philosophicus. Contrary to dominant literary scholarship, I claim that it is Wittgenstein’s Saying–Showing distinction that offers us a guide for conceiving of the true value of literary inquiry, and thereby provides us with a robust response to Plato. The ‘ancient quarrel’ can thus be addressed resolutely. What does literature offer? Literature is free to communicate where philosophy is unable—to show what philosophy cannot say. Using the examples of Davidson, Heidegger, Wallace, Wittgenstein, Borges and Lerner I flesh out the notion of showing in literature, and how it functions to induce a perspectival shift in order that the reader may see the world ‘aright’, whatever ‘aright’ may be. This dissertation may be best conceived as a contribution to the project of questioning the inherent power-dynamics and ideological biases that inform the disciplinary separation of literature and philosophy.
