Lawful euthanasia involves State endorsed termination of human life. Apart from a period of less than 9 months, in the Northern Territory, euthanasia has been illegal in Australia. Many of Australia’s parliaments have regularly considered introducing the practice and they continue to do so. In this context, this paper considers another type of State endorsed termination of human life: capital punishment. These took place in Australia from 1788 to 1967. The practice was abolished nationwide by 1985 and the Commonwealth passed (...) laws, in 2010, to prevent its reintroduction. This paper does not consider all of the arguments for or against euthanasia or capital punishment and nor does it argue that the two practices are identical. Instead, it argues that introducing euthanasia without careful consideration of the arguments and experiences of capital punishment would risk repetition of past mistakes. The paper considers whether introducing euthanasia would be inconsistent with arguments accepted as grounds for the abolition of capital punishment. It focuses, on the irrevocable argument. This is the argument that death is irrevocable and that the risk of an innocent person being executed should never be taken. The paper argues that, any criteria which might be adopted by the State as sufficient to justify euthanasia, would run the risk of people outside that criteria being euthanised. The paper argues that capital punishment and euthanasia each pose disproportionate risks to minority and vulnerable groups. The paper also argues that, the evidence of pain and suffering endured by the condemned in their execution require careful consideration in relation to arguments for euthanasia as a means to a quick and pain free “good death.” It considers the evidence that demonstrates that, like execution, euthanasia in practice can be slow and painful. The paper then argues that requiring health professional to administer lethal injections in acts of euthanasia would be inconsistent with the approach taken in Australia and the United States to the identification of those willing to administer the death penalty. The paper concludes that many of the key arguments which resulted in the abolition of the death penalty in Australia support the continued prohibition of euthanasia in Australia and ought to be addressed by proponents of change but its primary aim is to encourage further examination of the extent to which learnings relevant to the current euthanasia debate can be gained by examining the arguments and experience of capital punishment. Abstract:This article provides a novel interpretation of the so-called transition to self-consciousness in The Phenomenology of Spirit, where Hegel argues that the failure of the protagonist consciousness to formulate an understanding of the world in terms of forces and laws necessitates the shift to an investigation of its own self-conscious subjectivity. The author argues that we can make sense of the transition by attending to Hegel's account of the metaphysical structure of forces and laws, on the one hand, and the (...) structure of self-consciousness, on the other. Following this approach, she argues that the transition represents the realization by the protagonist consciousness that the object of phenomenological inquiry must be metaphysically self-determining (or "infinite," in Hegel's terminology). The standpoint of self-consciousness accordingly emerges because the protagonist consciousness takes itself qua subject to exhibit the requisite self-determining structure. In addition to making sense of the transition to self-consciousness, this line of argumentation illuminates Hegel's subsequent focus on the activity of "desire.". (shrink)

Since ancient times, legal systems have held owners responsible for harm caused by their property. Across 4 experiments, we show that children aged 3–7 also hold owners responsible for such harm. Older children judge that owners should repair harm caused by property, and younger children may do this as well. Younger and older children judge that owners should apologize for harm, even when children do not believe the owners allowed the harm to occur. Children are also as likely to hold (...) owners responsible for harm caused by property as for harm caused by the owners themselves. The present findings contribute to psychological accounts of ownership by showing that ownership not only confers rights to control property, but also responsibility for harm caused by property. The findings also contribute to our understanding of the attribution of responsibility, and challenge accounts claiming that directly causing harm, or allowing it to happen, is a prerequisite for responsibility. The findings provide support for an account claiming that property is an extension of its owner, and likewise reveal that responsibility for harm caused by property is an early developing aspect of the psychology of ownership. 2018 APA, all rights reserved). Early in his career, Karl Marx complained that “Philosophers have hitherto only interpreted the world in various ways; the point is to change it.” Philosophers Robert Frodeman and Adam Briggle have recently issued this same complaint against their contemporaries, arguing that philosophy has become an isolated, “purified” discipline, detached from its historical commitments to virtue and to public engagement. In this paper I argue that they are wrong about contemporary philosophy and about its history. Philosophy hitherto has always been characterized (...) both by a concern with practical engagement and by serious misgivings about such engagement. I show that reluctance to engage with practical affairs was a feature of philosophy long before the advent of the modern university and that a wide range of contemporary philosophers are concerned with virtue and public engagement. Finally, I argue that Frodeman and Briggle’s own account of contemporary philosophy makes it unsuitable both as the subject of their title (“When Philosophy Lost Its Way”) and as the object of their call to action. In this paper, I discuss the debate on Kant and nonconceptual content. Inspired by Kant’s account of the intimate relation between intuition and concepts, McDowell (1996) has forcefully argued that the relation between sensible content and concepts is such that sensible content does not severally contribute to cognition but always only in conjunction with concepts. This view is known as conceptualism. Recently, Kantians Robert Hanna and Lucy Allais, among others, have brought against this view the charge that it neglects the (...) possibility of the existence of essentially nonconceptual content that is not conceptualised or subject to conceptualisation. Their critique of McDowell amounts to nonconceptualism. However, both views, conceptualist and nonconceptualist, share the assumption that intuition is synthesised content in Kant’s sense. My interest is not in the validity of the philosophical positions of conceptualism or nonconceptualism per se. I am particularly interested in the extent to which the views that McDowell and Hanna and Allais respectively advance are true to Kant, or can validly be seen as Kantian positions. I argue that although McDowell is right that intuition is only epistemically relevant in conjunction with concepts, Hanna and Allais are right with regard to the existence of essentially nonconceptual content (intuitions) independently of the functions of the understanding, but that they are wrong with regard to non-conceptualised intuition being synthesised content in Kant’s sense. Kantian conceptualists (Bowman 2011; Griffith 2012; Gomes 2014) have responded to the recent nonconceptualist offensive, with reference to A89ff./B122ff. (§13)—which, confusingly, the nonconceptualists also cite as evidence for their contrary reading—by arguing that the nonconceptualist view conflicts with the central goal of the Transcendental Deduction, namely, to argue that all intuitions are subject to the categories. I contend that the conceptualist reading of A89ff./B122ff. is unfounded, but also that the nonconceptualists are wrong to believe that intuitions as such refer strictly to objects independently of the functions of the understanding, and that they are mistaken about the relation between figurative synthesis and intellectual synthesis. I argue that Kant is a conceptualist, albeit not in the sense that standard conceptualists assume. Perceptual knowledge is always judgemental, though without this resulting in the standard conceptualist claim that, necessarily, all intuitions or all perceptions per se stand under the categories (strong conceptualism). I endorse the nonconceptualist view that, for Kant, perception per se, i.e. any mere or ‘blind’ intuition of objects (i.e. objects as indeterminate appearances) short of perceptual knowledge, does not necessarily stand under the categories. Perception is not yet perceptual knowledge. In this context, I point out the common failure in the literature on the Transcendental Deduction, both of the conceptualist and nonconceptualist stripe, to take account of the modal nature of Kant’s argument for the relation between intuition and concept insofar as cognition should arise from it.
