A number of thinkers have been wondering about the moral obligations humans have, or will have, to intelligent technologies. An underlying assumption is that “moral machines” are decades in the offing, and thus we have no pressing obligations now. But, in the context of technology, we are yet to consider that we might owe moral consideration to something that is not a member of the moral community but eventually will be as an outcome of human action. Do we have current (...) actual obligations to technologies that do not currently exist? If there are obligations to currently non-existing technologies, we must confront what might be called the Non-Identical Machines Problem. Can we harm or benefit an entity by making it one way rather than another? This paper presents the problem and argues that it is more challenging than the standard Non-Identity Problem. (shrink)

According to various “harm-based” approaches to the non-identity problem, an action that brings a particular child into existence can also harm that child, even if his or her life is worth living. In the third chapter of The Non-Identity Problem and the Ethics of Future People, David Boonin surveys a variety of harm-based approaches and argues that none of them are successful. In this paper I argue that his objections to these various approaches do not impugn a harm-based approach that (...) How can we rationally make peace with our past moral failings, while committing to avoid similar mistakes in the future? Is it because we cannot do anything about the past, while the future is still open? Or is it that regret for our past mistakes is psychologically harmful, and we need to forgive ourselves in order to be able to move on? Or is it because moral mistakes enable our moral growth? I argue that these and other answers do not (...) properly resolve the problem of temporal asymmetry in our attitudes toward moral imperfection, and I defend an alternative response, centered on our personal attachments and our biographical identity. Appealing to self-interest is a common way of justifying the rationality of religious faith. For instance, Pascal’s wager relies upon the expected value of choosing the life of faith being infinite. Similarly, many contemporary arguments for the rationality of faith turn on whether it is better for an agent to have faith rather than lack it. In this paper, I argue, contra Pascal, that considerations of self-interest do not make choosing faith rational because they fail to take into account the (...) way the self is transformed by faith. In this paper I intend to analyse the meaning of harm as well as the strength of the reasons against harming provided by harm-states. I will argue that there are two kinds of harms: absolute harms and relative harms. Also, I will argue that when certain harm has been completely covered by considering such harm as absolute, the consideration of such harm as –also– relative is displaced. Such considerations should be taken into account when the suffered harms cannot be entirely (...) explained by considerations regarding absolute harms. If these claims are right, we will have guidelines to measure, among other things, the agent´s moral responsibility in different kind of cases. -/- En este trabajo me propongo analizar tanto qué significa sufrir un daño como la fuerza de las razones en contra de dañar que se derivan de los estados de daño. I develop a theodicy (Non-Identity Theodicy) that begins with the recognition that we owe our existence to great and varied evils. I develop two versions of this theodicy, with the result that some version is available to the theist regardless of her assumptions about the existence and nature of free will. My defense of Non-Identity Theodicy is aided by an analogy between divine creation and human procreation. I argue that if one af rms the morality of vol- untary human procreation, (...) one should af rm the morality of divine creation; conversely, deny- ing the morality of divine creation commits one to denying the morality of human procreation. We all could have had better lives, yet often do not wish that our lives had gone differently, especially when we contemplate alternatives that vastly diverge from our actual life course. What, if anything, accounts for such conservative retrospective attitudes? I argue that the right answer involves the significance of our personal attachments and our biographical identity. I also examine other options, such as the absence of self-to-self connections across possible worlds and a general conservatism about value.

The non-identity problem is usually considered in the forward-looking direction but a version of it also applies to the past, due to the fact that even minor historical changes would have affected the whole subsequent sequence of births, dramatically changing who comes to exist next. This simple point is routinely overlooked by familiar attitudes and evaluative judgments about the past, even those of sophisticated historians. I shall argue, however, that it means that when we feel sadness about some historical tragedy, (...) or think of one possible course of history as better than another, these judgments and attitudes can be understood in terms of two opposing perspectives on the past: an impersonal standpoint concerned only with how much value each course of history contains, and a person-centred standpoint concerned with harms and benefits to the people who had actually existed. The Rachels–Temkin spectrum arguments against the transitivity of better than involve good or bad experiences, lives, or outcomes that vary along multiple dimensions—e.g., duration and intensity of pleasure or pain. This paper presents variations on these arguments involving combinations of good and bad experiences, which have even more radical implications than the violation of transitivity. These variations force opponents of transitivity to conclude that something good is worse than something that isn’t good, on pain of rejecting the good altogether. The soul-making theodicy seeks to explain how belief in the existence of God is compatible with the evil, pain and suffering we experience in our world. It purports to meet the problem of evil posed by non-theists by articulating a divine plan in which the occurrence of evil is necessary for enabling the greater good of character building of free moral agents. Many philosophers of religion have levelled strong objections against this theodicy. Many economists and philosophers assume that status quo bias is necessarily irrational. I argue that, in some cases, status quo bias is fully rational. I discuss the rationality of status quo bias on both subjective and objective theories of the rationality of preferences. I argue that subjective theories cannot plausibly condemn this bias as irrational. I then discuss one kind of objective theory, which holds that a conservative bias toward existing things of value is rational. This account can fruitfully explain (...) some compelling aspects of common sense morality, and it may justify status quo bias. (shrink)

In this paper we challenge the moral consensus against selection for disability. Our discussion will concern only those disabilities that are compatible with a life worth living from the point of view of the disabled individual. We will argue that an influential, impersonal argument against selection for disability falls to a counterexample. We will then show how the reach of the counterexample can be broadened to make trouble for anyone who objects to selection for disability. If we are right about (...) the problems for objections to selection for disability, why are objections are so widespread? We suggest that intuitions are being skewed against selection for disability by certain quirks in the usual ways of presenting the issue. Nevertheless, we must confess to finding our own result surprising. (shrink)

In De Rerum Natura III 963-971, Lucretius argues that death should not be feared because it is a necessary part of the natural cycle of life and death. This argument has received little philosophical attention, except by Martha Nussbaum, who asserts it is quite strong. However, Nussbaum's view is unsustainable, and I offer my own reading. I agree with Nussbaum that, as she construes it, the cycle of life argument is quite distinct from the better-known Epicurean arguments: not only does (...) it start from different premises, but it is a completely different type of argument. However, thus construed, it is deeply problematic. It relies on premises that are much more at home in Stoic than in Epicurean ethics, and Lucretius' appeal to nature in this argument contradicts what he says elsewhere in De Rerum Natura. I consider why Lucretius offers what appears to be such a flawed argument, and I propose a reading on which the cycle of life argument could be offered consistently by an Epicurean. The cycle of life argument, unlike the better-known arguments, does not attempt directly to show that death is not a bad thing. Instead, it targets certain destructive attitudes towards one's life that result in one fearing death. By helping relieve the interlocutor of these attitudes, the argument aims at reducing his fear of death. (shrink)

Ultimately this book provides a theory of intergenerational justice that is both intellectually robust and practical with wide applicability to law and policy.

Abstract: The natural lottery is a metaphor about the way luck affects the allocation of personal attributes, talents, skills, and defects. Susan Hurley has argued that it is incoherent to regard individual essential properties (IEPs) as a matter of lottery luck. The reason is that a lottery of identity-affecting properties generates the ‘non-identity problem’. For this reason among others she suggests substituting lottery luck with ‘thin luck’, i.e. luck as non-responsibility, which would allow us to coherently regard IEPs as a (...) matter of luck.I argue that we are not not-responsible for our IEPs. Therefore, the coherent range of ‘thin luck’ is not broader than that of lottery luck. Moreover, justice theorists need to be worried about the non-identity problem only to the extent that IEPs affect life prospects and it is far from evident that they do. After addressing some connected aspects of Hurley's analysis, I discuss the type of reasons that justify seeking to expand domain of justice and the ways of doing this, for instance by abandoning lottery luck. I close by suggesting, however, that if Parfit's view of ‘what matters about identity’ is correct, its application to the case of identity-affecting lotteries may prove the expansion of the domain of justice superfluous, as IEPs belong to it as it is. Is it fair to leave the next generation a public debt? Is it defensible to impose legal rules on them through constitutional constraints? From combating climate change to ensuring proper funding for future pensions, concerns about ethics between generations are everywhere. In this volume sixteen philosophers explore intergenerational justice. Part One examines the ways in which various theories of justice look at the matter. These include libertarian, Rawlsian, sufficientarian, contractarian, communitarian, Marxian and reciprocity-based approaches. Many atheists argue that because gratuitous evil exists, God (probably) doesn’t. But doesn’t this commit atheists to wishing that God did exist, and to the pro-theist view that the world would have been better had God existed? This doesn’t follow. I argue that if all that evil still remains but is just no longer gratuitous, then, from an atheist perspective, that wouldn’t have been better. And while a counterfactual from which that evil is literally absent would have been impersonally better, (...) it wouldn’t have been better for anyone, not even for those who suffered such evils. The nonidentity problem is a deep puzzle challenging the moral intuition that what is bad must be bad for someone. The first part of the paper constructs a new theory of harming, whereas the second part builds on the conclusions of the first to offer a new solution to the NIP. The first part discusses the neglected question of when a burden inflicted in the context of overall benefitting can be discretized as a separate entity—only when it can, is it (...) possible to identify the burden as harm, and only then is it possible to harm in bringing into overall good existence. The second part explains how, in those cases where creating is indeed harming, we can use the logic of concept expansion to construct a concept of wronging that applies to creation cases. (shrink)

This paper aims at answering some of the objections to the NIP’s criticism of the idea of rights of future persons. Those objections usually adopt different perspectives depending on how they understand differently the nature of the correlativity between rights and duties – some adopt a present-rights-of-future-persons view, others a future-rights-of-future-persons view, others a transitive present-rights-of-present-persons view, and others still an eternalist view of rights and persons. The paper will try to show that only a non-transitive present-rights-of-present-persons view can survive (...) the challenges posed by the notion of correlativity inherent in the NIP, and thus preserve rights language when discussing the future. This view is proved also more suitable for the legal and political realms, where policies and law-making are usually more concerned with present addressees and short term effects. (shrink)

Many are committed to the idea that the present generation has obligations to future generations, for example, obligations to preserve the environment and certain natural resources for those generations. However, some philosophers want to explain why we have these obligations in terms of correlative rights that future persons have against persons in the present. Attributing such rights to future persons is controversial, for there seem to be compelling arguments against the position. According to the “nonexistence” argument, future persons cannot have (...) rights (and so should not be attributed rights) because they do not exist. According to the “no-satisfaction” argument, future persons cannot have a right to resources that do not exist at the time of their existence because such a right could not, in principle, be satisfied. In this paper, I will argue that an eternalist ontology of time provides the resources for satisfactorily responding to both the nonexistence and the no-satisfaction arguments. (shrink)

This article introduces a non-human version of the non-identity problem and suggests that such a variation exposes weaknesses in several proposed person-focused solutions to the classic version of the problem. It suggests first that person-affecting solutions fail when applied to non-human animals and, second, that many common moral arguments against climate change should be called into question. We argue that a more inclusive version of the person-affecting principle, which we call the ‘patient-affecting principle’, captures more accurately the moral challenge posed (...) by the non-identity problem. We argue further that the failure of person-affecting solutions to solve non-human versions of the problem lend support to impersonal solutions to the problem which avoid issues of personhood or species identity. Finally, we conclude that some environmental arguments against climate change that rely on the notion of personal harm should be recast in impersonal terms. (shrink)

Argues from the rationality of nostalgia, affirmation, and regret to a principle of ‘specificity’: it can be rational to respond more strongly to facts that provide us with reasons than to the fact that such reasons exist.

The multiverse theodicy says that because God can without cost create an infinite number of universes, the standards of acceptability that a conceivable universe must meet to be worthy of divine creation are significantly laxer than is typically supposed in discussions of the problem of evil. While the prospect of a theistic multiverse arguably helps the theist to explain suffering, I argue that it also poses a serious skeptical worry. Given the alleged laxity of the standards that a universe must (...) meet to be worthy of inclusion in a theistic multiverse, there is reason to think that God would be justified in creating a great many deceptive universes that, while good overall, are inhabited by creatures who are radically mistaken in their beliefs. And these deceptive universes would arguably be no less abundant than the nondeceptive universes. After developing this skeptical challenge, I assess some possible theistic responses. One of the more promising responses I consider argues that in order to secure the great good of true friendship between God and creatures, God has reason to exclude deceptive universes from the multiverse even when those universes have great intrinsic value. Abstract More than some other fields of ethics, climate ethics is related to pressing real-world problems. Climate ethicists have a responsibility to be precise about the status of the problems they discuss. The non-identity problem (NIP) plays are a prominent role in the climate ethics literature. In a widely discussed statement, Derek Parfit claimed that a risky climate policy is not harmful for (distant) future people. But this ignores the “insignificant-causal-factors rejoinder”. The Parfitian assertion is still treated as serious problem (...) to theories of climate justice in key philosophical texts, and this may mislead climate policy decision-makers. Philosophers should acknowledge that the NIP, when applied to climate change, is “just” a thought experiment and should communicate it in this way to people outside the philosophical community. It is sometimes argued that if God were to exist, then the actual world would be the best possible world. However, given that the actual world is clearly not the best possible world, then God doesn’t exist. In response, some have argued that the world could always be improved with the creation of new people and that there is thus no best possible world. I argue that this reasoning gives rise to an instance of Parfit’s mere addition paradox and should (...) thus be rejected. Others (Robert Adams, in particular) have argued that the actual world may, in fact, be the best possible world, at least for all actual people. Mitochondrial replacement techniques are designed to allow couples to have children without passing on mitochondrial diseases. Recently, Giulia Cavaliere and César Palacios-González argued that prospective parents have the right to use MRTs to pursue genetic relatedness, such that some same-sex couples and/or polygamous triads could use the process to impart genetic relatedness between a child and more of its caregivers. Although MRTs carry medical risks, Cavaliere and Palacios-González contend that because MRTs are identity-affecting, they do not cause harm to an (...) existing human being, and our intuitions otherwise arise from the non-identity problem. Here, I review several attempts to address the non-identity problem, and propose a solution to the problem. Furthermore, I argue that regardless of one’s stance on whether MRTs are identity-affecting, the use of MRTs to pursue genetic relatedness alone falls outside the scope of the medical profession, as they involve substantive medical risk for no medical benefit. This thesis explores possibilities that arise from regarding theodicy as the activity of descriptive understanding of Christian belief and practice as found in the classical theistic framework. First, any theodicy as an activity is analysed in terms of the role of philosophy, the place of epistemology, the basis of theology, and the taking of an apologetic stance. It is then argued that traditional approaches to theodicy suffer from methodological weaknesses which derive from formulating theodicy in terms of unbelief, and from (...) strictly theoretical analysis. The superiority of philosophical description is argued as better suited to understanding religious belief as held in the community of believers, with especial reference to relationships that hold between language and reality. A critical exploration follows of the approach to theodicy of a proponent of philosophical description, D.Z. Phillips, and consideration is given to the status of evaluations made by believers. In the light of this critique, two attempts are made to describe the shape of Christian theodicy using the interperson model of theological language. The first attempt, based on a description of actual interpersonal relationships, is found eventually to be open to serious objections. A second attempt is then made, based not only on interpersonal language, but using a distinction between "surface" and "depth" in religious language, and by arguing for the presence of an epistemological "direction" in religious belief. On this basis, a Theodicy of Dependence is developed as best describing the shape of Christian belief held in a world which is frequently hostile. (shrink)

When attempting to determine which of our acts affect future generations and which affect the identities of those who make up such generations, accounts of personal identity that privilege psychological features and person affecting accounts of morality, whilst highly useful when discussing the rights and wrongs of acts relating to extant persons, seem to come up short. On such approaches it is often held that the intuition that future persons can be harmed by decisions made prior to their existence is (...) mistaken as identity is a most fragile thing with even the smallest differences in the conditions under which we procreate affecting not the interests of distinct future persons, but the identities of those who will come to exist in the future. Within this paper I reject this view, holding that a subscription to these two accounts need not result in the conclusion that virtually all acts relating to possible persons are permitted. Further, I argue that such accounts may in fact allow a great deal more scope for the determination of prenatal harms than accounts of personal identity that privilege physical features. Finally, by interpreting claims regarding causal identity such as Parfit’s Time Dependence Claim in terms of Counterpart Theory I suggest that a solution to the non-identity problem can be found in the acceptance of, as relevant in prenatal cases, three kinds of objective similarity relations: Biological, Environmental and Decisional counterpart relations. This paper develops a future-oriented and person-centred normative argument based on expectancies that is immune to most of the problems identified in the rights of future persons. The argument unfolds in four parts. The first draws on the notion of expectancies present in inheritance law and maintains that it is possible to formulate a rule of prospective beneficiaries that correlates with entitlements and legitimate claims without necessarily acquiring the status of rights. The second extends expectancies to future persons and concludes (...) that the latter can be considered present holders of such currently binding entitlements. The third section raises the question of whether democracies are bound to a principle of fidelity towards expectancies in such a way that outweighs current people’s rights in cases of conflicts. The response does not prove particularly future-beneficial in such cases. However, section four clarifies why expectancies still carry a crucial moral weight in democracies, one that is not sufficiently established by depersonalised forms of future-oriented ethics. A theory of intergenerational justice consists in the study of the moral and political status of the relations between present and past or future people, more specifically, of the obligations and entitlements they can potentially generate. The challenges that justify talking about responsibilities between generations are myriad. And the disputes they prompt can focus on the past just as much as on the present, even though the fact that the human species has reached a state of technological progress that enables (...) it to have an irredeemable impact on the planet and perhaps even endanger future human existence tends to make concerns about the future more pressing. Debates on intergenerational justice are twofold. The first revolves around the issue of whether claims of justice across generations whose members' lifetimes do not necessarily overlap could be justified. And the second revolves around the specific conception of justice in play, that is, around the nature of the standard that must be applied as well as around the identification of the contents of the duties that present generations supposedly have vis-à-vis past or future generations. This survey article depicts the conceptual and argumentative framework in which these debates are set. It aims to outline certain of the main features shared by the most influential contemporary theories of intergenerational justice, and the problems inherent in them. It concludes by suggesting that, even though the idea of succeeding generations is merely an abstraction, there are specific empirical states of affairs that require different theoretical responses to intergenerational justice. I argue that, given certain prominent views of personal identity and prudence, the nonidentity problem, or a very similar problem, can arise postconception. I clarify and defend this claim by considering the implications of these views for prenatal injury.
