Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

This contribution discusses some problems of Pragma-Dialectics and explains them by its consensualistic view of the function of argumentation and by its philosophical underpinnings. It is suggested that these problems can be overcome by relying on a better epistemology and on an epistemological theory of argumentation. On the one hand Pragma-Dialectics takes unqualified consensus as the aim of argumentation, which is problematic, (Sect. 2) on the other it includes strong epistemological and rationalistic elements (Sect. 3). The problematic philosophical underpinnings of (...) Pragma-Dialectics, specifically Critical Rationalism as well as Logical Constructivism and Dialogic Logic of the Erlangen School, are among the sources of this incoherence (Sect. 4). A detailed critique of the Pragma-Dialectical discussion rules shows the negative consequences of this foundation and indicates how they could be avoided (Sects. 5, 6). (shrink)

This book contains a representationalist theory of self-consciousness and of the phenomenal first-person perspective. It draws on empirical data from the cognitive and neurosciences.

Douglas Diekema has argued that it is not the best interest standard, but the harm principle that serves as the moral basis for ethicists, clinicians, and the courts to trigger state intervention to limit parental authority in the clinic. Diekema claims the harm principle is especially effective in justifying state intervention in cases of religiously motivated medical neglect in pediatrics involving Jehovah’s Witnesses and Christian Scientists. I argue that Diekema has not articulated a harm principle that is capable of justifying (...) state intervention in these cases. Where disagreements over appropriate care are tethered to metaphysical disagreements, it is moral-metaphysical standards, rather than merely moral standards, that are needed to provide substantive guidance. I provide a discussion of Diekema’s harm principle to the broader end of highlighting an inconsistency between the theory and practice of secular bioethics when overriding religiously based medical decisions. In a secular state, ethicists, clinicians, and the courts are purportedly neutral with respect to moral-metaphysical positions, especially regarding those claims considered to be religious. However, the practice of overriding religiously based parental requests requires doffing the mantle of neutrality. In the search for a meaningful standard by which to override religiously based parental requests in pediatrics, bioethicists cannot avoid some minimal metaphysical commitments. To resolve this inconsistency, bioethicists must either begin permitting religiously based requests, even at the cost of children’s lives, or admit that at least some moral-metaphysical disputes can be rationally adjudicated. Dialogues and dialectics have come to playan important role in the field of ArtificialIntelligence and Law. This paper describes thelegal-theoretical and logical background of this role,and discusses the different services into whichdialogues are put. These services include:characterising logical operators, modelling thedefeasibility of legal reasoning, providing the basisfor legal justification and identifying legal issues,and establishing the law in concrete cases. Specialattention is given to the requirements oflaw-establishing dialogues.

I first provide an analysis of Joel Feinberg’s anti-paternalism in terms of invalidation of reasons. Invalidation is the blocking of reasons from influencing the moral status of actions, in this case the blocking of personal good reasons from supporting liberty-limiting actions. Invalidation is shown to be distinct from moral side constraints and lexical ordering of values and reasons. I then go on to argue that anti-paternalism as invalidation is morally unreasonable on at least four grounds, none of which presuppose that (...) people can be mistaken about their own good: First, the doctrine entails that we should sometimes allow people to unintentionally severely harm or kill themselves though we could easily stop them. Second, it entails that we should sometimes allow perfectly informed and rational people to risk the lives of themselves and others, though they are in perfect agreement with us on what reasons we have to stop them for their own good. Third, the doctrine leaves unexplained why we may benevolently coerce less competent but substantially autonomous people, such as young teens, but not adults. Last, it entails that there are peculiar jumps in justifiability between very similar actions. I conclude that as liberals we should reject anti-paternalism and focus our efforts on explicating important liberal values, thereby showing why liberty reasons sometimes override strong personal good reasons, though never by making them invalid. This paper discusses various problems of explanations by mechanisms. Two positions are distinguished: the narrow position claims that only explanations by mechanisms are acceptable. It is argued that this position leads to an infinite regress because the discovery of a mechanism must entail the search for other mechanisms etc. Another paradoxical consequence of this postulate is that every successful explanation by mechanisms is unsatisfactory because it generates new ``black box'' explanations. The second – liberal – position that is advanced in (...) this paper regards, besides explanations by mechanisms, also the discovery of bivariate correlations as a first step of an explanation by mechanisms as meaningful. It is further argued that there is no contradiction between causal analysis and the explanation by mechanisms. Instead, explanations by mechanisms always presuppose the analysis of causal structures (but not vice versa). The final point is that an explanation by mechanisms is not inconsistent with the Hempel-Oppenheim scheme of explanation. (shrink)

The introduction of the modern diagnostic and therapeutic procedures to the medical practice provided a new challenge for the medicine. The art of medicine, with its default purpose of acting for the benefit of health, is therefore required to derive from technological progress effectively and rationally. As a result, the medical ethics has been engaged with the rules of economy and management of deficit medical procedures as well as their rational and fair distribution. The above suggests, that medics, given these (...) recourses, should approach each patient with a consideration to their therapeutic rights. However, the physicians cannot just concentrate on the good of one particular patient, but must take into account joint responsibility for the good of a potential patient. This makes medical ethical dilemmas similar to the ethical issues of business. The notion of responsibility is the key for discriminating these two kinds of ethics. (shrink)

In A Theory of Justice (1971), John Rawls introduces the concept of “reflective equilibrium.” Although there are innumerable references to and discussions of this concept in the literature, there is, to the present author's knowledge, no discussion of the most important question: Why reflective equilibrium? In particular, the question arises: Is the method of reflective equilibrium applicable to the choice of this method itself? Rawls's drawing of parallels between Kant's moral theory and his own suggests that his concept of “reflective (...) equilibrium” is on a par with Kant's concept of “transcendental deduction.” Treating these two approaches to justification as paradigmatic, I consider their respective merits in meeting the reflexive challenge, i.e., in offering a justification for choice of mode of justification. My enquiry into this topic comprises three parts. In this first part, I raise the issue of the reflexivity of justification and question whether the reflexive challenge can be met within the framework of A Theory of Justice. (shrink)

Studie pojednává o analýze a navrhovaném řešení problému „hodnotové neutrality" vědy německým kritickým racionalistou Hansem Albertem. Především Albert odmítá dvě vyhrocené pozice: novopozitivistickou ignoraci hodnotících soudů i jejich existencialistickou adoraci. Naopak se prostřednictvím takzvaných přemosťovacích principů snaží překlenout propast mezi poznáním na jedné straně a rozhodnutím na straně druhé. V návaznosti na Maxe Webera uznává princip hodnotové neutrality ve vědě, ovšem pouze v oblasti jejího objektového jazyka, neboť věda jako technologický systém výpovědí má pouze informativní, nikoli normativní charakter. To však (...) nevylučuje hodnocení v rovině předmětů věd a v rovině hodnotové báze věd. Dále se tato studie věnuje otázce hodnoty vědy o sobě a nakonec krátkému seznámení s Albertovým pojetím kritického racionalismu jako návrhu „způsobu života". (shrink)

In a recent paper in this journal, David Botting defended pragma-dialectics against epistemological criticisms by exponents of the epistemological approach to argumentation, i.e. Harvey Siegel, John Biro and me. In particular, Botting tries to justify with new arguments a Functional Claim, that the function of argumentation is to resolve disputes, and a Normative Claim, that standpoints that have the unqualified consensus of all participants in a dispute will generally be epistemically sound. In this reply it is shown that Botting’s arguments (...) are fallacious, that the two Claims are false and that the epistemological approach to argumentation, of course, outclasses pragma-dialectics epistemically and is at least as good as it in other respects. Die Einleitung unseres Kapitels bietet eine grundsäzliche Charakterisierung der Soziologie und zeichnet einige wichtige historische Entwicklungslinien der Philosophie der Soziologie (PdS) nach. Im Hauptteil werden zentrale ontologische sowie ausgewählte explanatorische Themen der PdS vorgestellt. Im Schlussteil sollen einige aktuelle Diskussionen umrissen werden.

The paper consists of three parts. The aim of the first part is to depict the concept of science in the analytic philosophy of science to point out its characteristic defects. The second part shows how the constructive philosophy of science is able to avoid these defects by honouring not special modes of research but speicial modes of foundation of results in research with its criteria for science. The third part finally refutes the main counter-arguments of analytic philosophy of science (...) against the constructive. (shrink)

A semantic solution to the liar paradox (“This statement is not true”) is presented in this article. Since the liar paradox seems to evince a contradiction, the principle of non-contradiction is preliminarily discussed, in order to determine whether dismissing this principle may be reason enough to stop considering the liar paradox a problem. No conclusive outcome with respect to the value of this principle is aspired to here, so that the inquiry is not concluded at this point and the option (...) to explore an alternative, semantic, solution remains open. This proposed solution is focused on what the liar paradox expresses and what it fails to express. (shrink)

Naturwissenschaften, Mathematik und Logik waren für Nelson von zentraler Bedeutung. Er pflegte bereits als Jugendlicher intensive Kontakte zu Naturwissenschaftlern und Mathematikern. Dadurch erhielt er Anregungen, die von Anfang an seine philosophischen Ansätze beeinflussten. Inspiriert von der Kant-Fries’schen Philosophie und der Axiomatik der Mathematik, konzipierte Nelson seine Philosophie als exakte Wissenschaft. Wie Kant und Fries betrachtete Nelson die Suche nach den allgemeinen Prinzipien der Naturwissenschaften als Hauptaufgabe der Naturphilosophie. Ergebnis dieser kritischen Analyse ist ein System von metaphysischen Grundsätzen der Naturwissenschaft. Nelson (...) übernimmt Kants Lehre von den Grundsätzen des reinen Verstandes. Keine empirisch gefundene Gesetzmäßigkeit könne diesen Grundsätzen widersprechen. Für die Gesetze der Newton’schen Mechanik hätten, so meint Nelson, Kant und Fries diesen Nachweis erbracht. Deshalb formulierte Nelson das sogenannte Postulat der Mechanistik, gemäß dem alle Naturerscheinungen auf mechanische Vorgänge zurückgeführt werden können. Das starre Festhalten an diesem Postulat veranlasste ihn zur Ablehnung bedeutsamer physikalischer Konzeptionen (z. B. des auf der Elektrodynamik basierenden Relativitätsprinzips, des Nahwirkungskonzepts und des Atommodells). Das „Relativitätsprinzip der Elektrodynamik“ lehnte er mit dem Argument ab, es verhindere die Anwendung der dritten Analogie der Erfahrung, da es den Verzicht auf den Begriff der Gleichzeitigkeit von Naturerscheinungen erzwinge. Eine kritische Nelson-Rezeption muss der Historizität etlicher Thesen Nelsons Rechnung tragen, aber zugleich die Bedeutsamkeit von Kernaussagen Nelson’scher Naturphilosophie im Hinblick auf die modernen Naturwissenschaften untersuchen. Das ist auch die Zielrichtung des vorliegenden Beitrages. Der erste Teil beleuchtet Nelsons wissenschaftliches Umfeld. Einerseits wird untersucht, welche Wissenschaftler Nelson beeinflussten, andererseits soll dargestellt werden, welcher Personenkreis an der Fortentwicklung der Nelson’schen Naturphilosophie beteiligt war. Beispielhaft sollen daran anschließend zwei Themenbereiche aus seinem reichhaltigen Werk disktiert werden, denen besonders im Hinblick auf aktuelle philosophische Diskussionsschwerpunkte Bedeutsamkeit zukommt. Im zweiten Teil werden nämlich Nelsons Betrachtungen zum Verhältnis von Freiheit und Naturnotwendigkeit sowie seine Unterscheidung zwischen wissenschaftlicher und ästhetischer Naturbetrachtung besprochen. Der Beitrag beansprucht nicht, die Rezeptionssgeschichte und den Inhalt von Nelsons Naturphilosophie sowie die aktuelle Bedeutsamkeit seiner Thesen im Detail darzustellen aufzuarbeiten. Vielmehr geht es darum, Ansätze für eine zeitgemäße Interpretation Rezeption aufzuzeigen und anhand von Beispielen zu erörtern. (shrink)

Transcendental Pragmatics and Discourse Ethics. Elements and Perspectives of Apel's Discourse-Philosophy. The author follows Apel's intellectual biography and shows the conception of a critique of meaning qua ‘reflection upon the discourse within the discourse’ to be the centre of Apel's language-pragmatic ‘Transformation of Philosophy’. Beginning with an explication of the situation of a speaker/thinker, especially of the situation of a philosophising speaker/thinker, Apel reconstructs a two fold apriori of communication: Every thought is situated within the context of a particular, historically (...) evolved, community of language and interaction. At the same time, however, the validity-claims of thoughts transcend the context of their origin towards an unlimited community of argumentation. On the basis of the first apriori Apel criticises the methodical solipsism as well as the objectivism of modern philosophy and theory of science. Drawing upon the second apriori he develops a universalist critique of meaning of relativism and contextualism. In the sixties and seventies Apel worked out a differentiated theory of the – more or less – communicatively cognizing humanities and set it apart from the theory of the causal-explanatory natural sciences, thus challenging the objectivism of a Theory of Unified Science. Building upon this work Transcendental Pragmatics, as developed by Apel and others, sets philosophy primarily two tasks: firstly, a internal reconstruction of argumentative discourse as the situation of speech and thought which seeks to elucidate the conditions of the meaningfulness, i. e. the presuppositions, of discourse. These presuppositions comprise, thus Apel with Habermas, the four validity-claims to intelligibility, sincerety/credibility, truth and normative rightness/legitimacy. Their moral content consists, thus Apel, not only in the recognition of the equality of all beings capable of discursive reasoning but also in their recognition of a co-responsibility for the realizability of discourses and of responsibility. The author argues that the existence of a co-responsibility of this kind is indisputable because the discursive claims to validity are intertwined with a set of ‘primordial promises of dialogue’. Only with the elucidation and explication of these promises can the reconstruction of the internal conditions of discourse be completed.The second task of a pragmatics of argumentation isthe strict resp. actual reflection of the thinker upon the presuppositions of the discourse in which he currently engages. This reflection has a Socratic character and can only be done in the form of discussion and debate with critics of the reconstruction. In this context, the author proposes a method of Socratic reflection upon the presuppositions of dialogue which suspends the usual, theoretically oriented, attitude of the scientist and the philosopher in favour of an actual reflective attitude. Within a dialogue with a sceptic who doubts one of the results of the internal reconstruction of dialogical presuppositions, say X, it is tested whether his doubt as to the unrestricted validity of X can be understood as a sincere contribution to the current dialogue or whether this particular sceptical thesis does not make sense, because it is incompatible with the role of a sincere participant of argumentation which, after all, the sceptic cannot refuse to claim for himself.Finally the author explains Apel's characterization of the tension between “Discourse and Responsibility”. In the course of discussions with Max Weber, Lawrence Kohlberg, Hans Jonas et al., Apel formulates and justifies an ethics of responsibility and gives an affirmative answer to the crucial question of whether the fulfilment of the moral obligations connected with the recognition of co-responsibility can be demanded within the non-dialogical circumstances of social reality. Apel's answer employs the idea of counter-strategies which are morally legitimate in virtue of their being worthy of argumentative consensus. (shrink)

Summary I try to apply Lakatos's metacriterion of the rationality of normative philosophies of science to normative political theories, stressing that Lakatos's metacriterion is not only an extension of Popper's idea of tests by potentially falsifyingdescriptive basic judgments to tests by potentially falsifyingnormative judgments. Rather, its application is a test by demonstrating the tested theory's capability of reconstructing its own history as rational. Finally I argue that the tradition of utilitarian political theories is fittest to be confirmed by a Lakatosian (...) test. (shrink)

Anknüpfend an den Beitrag von U. Steinvorth in Heft 1/1980 wird die Auffassung vertreten, daß die moderne allgemeine Wissenschaftstheorie bisher keine überzeugende Antwort auf die Frage nach dem Status der Politischen Wissenschaft und ihrer theoretischen Erzeugnisse gegeben hat. In diesem Beitrag wird in Auseinandersetzung mit Steinvorth u. a. hervorgehoben: Analog zu der These, daß in der Politik Vernünftigkeit nicht auf Rationalität reduziert werden darf, ist es weder möglich noch wünschenswert, für alle spezifischen politischen Wertungen einen Erklärungstyp zu begründen oder als (...) verbindlich vorzuschreiben. Die Wissenschaftstheorie muß sich in bezug auf die Frage nach dem Status "politischer" Theorien mit einem Theorietypus beschäftigen, der ein neues Abgrenzungskriterium voraussetzt, nämlich einen spezifischen Satz von Prinzipien und Regeln zur Konstruktion politikwissenschaftlicher Theorien. The pre-discoursive agreement. Theory of scientific truth and procedural justification. — On basis of the constructive philosophy of science, the attention is focussed to the pre-discoursive elements of discoursive theories of truth. By using a pragmatic approach it is shown that foundation of those pre-discoursive elements, like discourse rules or the basic terminology, is possible though the discourse rules are not available at this level. Propositions which can be shown in the presented theory to be true, always describe a know-how (...) instead of a knowledge about the world. As a result, the relevance of the presented analysis for prototheories of scientific disciplines is investigated. (shrink)

Popper has proposed a ?theory of situational rationality? as a basis for the social sciences. This theory of rational action is reconstructed and its methodological and substantial implications discussed. It is shown that methodologically Popper's idea of rational action leads to a version of theoretical instrumentalism which is incompatible with his general philosophy of science, and that substantially it implies an unacceptable theory of social institutions. Instrumentalism can be avoided by a more contentful theory of human action encompassing ?non?rational? or (...) ?irrational? kinds of action; Popper's theory of institutions might be improved through a more comprehensive theory of collective action. Science is considered as an open system that constitutes a sub-entity of the total system "society" and whose functions include the production, systematization, communication and application of knowledge. Since this system is made up of individuals and groups, its functions are dependent on psychological factors. This fact serves as a starting point for a psychology of science, which can contribute to optimizing scientific practice by treating the heuristic, organizational, technological, and normative aspects of scientific activity.

Normative research has nearly vanished from the academic ‘mainstream’ in accounting. Due to its prescriptive and value-driven approach, normative accounting research has been stigmatized as being unscientific and largely replaced by positive studies. We put this stigma into perspective. We first conceptualize the ‘positive-normative’ distinction and identify this dichotomy in accounting research history. We then challenge the dogmatic confinement of science to descriptive (positive) approaches. Moreover, we debate the basic conditions for normative accounting research and conclude that methodological and epistemological (...) pluralism in accounting research may help address a wide range of potential research questions. We point out that normative research approaches are essential in an applied science such as accounting, lest practical implications and prescriptions are to be the exclusive domain of accounting practice. The starting point of the following considerations is a case study concerning the discovery of Halley's comet and the theoretical description of its path. It is shown that the set of objects involved in that system and the time interval during which their paths are observed are determined in a theory dependent way – thereby making use of the very theory later used for that system's theoretical description. Metatheoretical consequences this fact has with respect to the structuralist view of empirical (...) theories are discussed in detail. German Den Ausgangspunkt der folgenden Überlegungen bildet eine Fallstudie, die der Entdeckung und theoretischen Beschreibung des Halleyschen Kometen gewidmet ist. Es wird gezeigt, dass bei diesem System die Menge der involvierten Objekte und die Zeitintervalle, über die sich die Beobachtung der Bahnen dieser Objekte erstreckt, in theorieabhängiger Weise bestimmt werden – und zwar in Abhängigkeit von genau derjenigen Theorie, die anschließend zur theoretischen Beschreibung des Systems eingesetzt wird. Metatheoretische Konsequenzen, die sich aus diesem Umstand insbesondere für das strukturalistische Theorienkonzept ergeben, werden im Detail analysiert. (shrink)

The constitutive role of technology in the constructive theory of science. Consequences for the philosophy of technology. Technology plays an important role in the constructivistic reconstructions of the natural sciences. However, there is no indepth view or thorough explication of the term "technology" and its connotations and relations in those exercises. Technology, there, is seen as a more or less evident part of the lifeworld's A priori of the natural sciences. This paper is dedicated to the reconstruction of the function (...) of technology in the argumentations chains and proto-theories which shall, in the constructivistic (methodical) theory of sciences, provide the methodical fundament of the sciences. In a second step, the aspects of technology are identified which are indispensable to fulfil the functions of technology in the argumentation chains mentioned above. Finally, these aspects are related to current debates in the philosophy of technology. (shrink)

Verfasser behandelt die Frage, ob die Naturwissenschaften ihre gegenwärtige Hauptfunktion, die Lieferung technikrelevanter Erkenntnisse, wirksamer als bisher erfüllen könnten, wenn sie sich nicht nur während revolutionärer Perioden, sondern ununterbrochen theoretisch pluralistisch entwickeln würden. Zuerst wird gezeigt, warum die Naturwissenschaften unter der Forderung nach maximaler Effektivität stehen, anschließend, daß diese Forderung durch einander abwechselnde pluralistische und nichtpluralistische Entwicklungsphasen in höherem Grade erfüllt wird als durch eine permanent pluralistische Entwicklung. Daraus wird geschlossen, daß eine Ersetzung der bisherigen Entwicklungsdynamik in den Naturwissenschaften durch (...) eine permanent pluralistische wenig Realisierungschancen hat. Mit Hilfe der Effektivitätsforderung wird ferner erklärt, warum auch während evolutionärer Perioden in einem gewissen Ausmaß theoretischer Pluralismus besteht, insbesondere, warum in der Praxis neue Theorien bei Mißerfolgen nicht strikt eliminiert werden, sondern Bewährungsfristen erhalten. Applied sociology will be understood in the following discussion as a unique and original form of sociology; i.e., in its logic and practice distinguished from traditional sociology it is understood as an explanatory body of knowledge and an intellectual discourse about intentional/purposeful social action and behavior. The application of sociology proper to such substantive fields as family, art, law and sport, commonly called applied sociology, which reproduce the body of sociological knowledge just a second time, is not part of such (...) understanding. Applied sociology in its original sense has its own logic in which purpose, implementation and the process of social-problem solution are crucial. It will in the end lead to an applied action or implementation theory. It is, to paraphrase Lazarsfeld, the methodology of “sociology in action” (1960). (shrink)

This paper deals with the connection between law and morality. Such a connection is relevant for political theory, since demonstrating that law necessarily implies a claim to justice would require fundamental rights to be considered the horizon of any legal system, instead of being considered as dependent on the axiological context of liberal democracies. The paper approaches the controversy starting from an overview of the work of the German philosopher Robert Alexy, in particular his attempt to establish an analytical link (...) between law and morality, and to this end considers law as a speech act with a claim to correctness. It then examines the critique put forward by Joseph Raz, that points out the lack of objectivity of this claim to correctness. In order to establish a moral foundation for law, the paper argues that it is necessary to take account of Karl-Otto Apel's attempt to establish the transcendental foundation of language, as well as of Habermas' critique of that attempt. In conclusion, it is argued that the debate about a possible link between law and morality sheds new light on contemporary debates on liberal justification in political theory. (shrink)

Vor dem Hintergrund einer weitreichenden Neuorientierung, die der praktischen Vernunft in der Methodologie , in der Sprachphilosophie und in der strukturalen Wissenschaftstheorie den Primat einräumt, werden die Aporien rationalistischdezisionistischer Konzeptionen deutlicher sichtbar. In diesem Papier wird der argumentative Ursprung von Feyerabends Kritik an Rationalität und Wissenschaft als auf einer - angesichts der 'praktischen Wende' der neueren Wissenschaftsphilosophie - überholten Wissenschaftsauffassung basierend analysiert. Feyerabends Zurückweisung der Wissenschaft erscheint dann weder als Konsequenz seiner Vernunftkritik noch als Bruch in seiner Argumentation; er vollstreckt (...) vielmehr die Gegenstandsverfehlung der methodologistischen Wissenschaftstheorie unverdeckt. Článek poukazuje na problém, do jaké míry je smysluplné rozlišovat přírodní vědy, sociální vědy a humanitní vědy, respektive co mají tyto vědy společného potud, pokud je lze skutečně nazývat vědou. Jde o následující otázky: Jaký je rozdíl mezi humanitními a sociálními vědami? Je možné vést ostrou demarkační linii mezi humanitními a přírodními vědami a jejich metodami? Co vlastně opravňuje dotyčný systém výpovědí k tomu nazývat se vědou? Je osudem humanitních věd "kvantitativní smrt" či je naopak možné vedle hi-tech úspěšných exaktních (...) věd považovat humanitní vědy za nepostradatelné know-how pro přežití lidské společnosti? Odpovědi na tyto otázky se budou opírat o definici sociální vědy Maxe Webera, požadavek autonomie metod humanitních věd klasické hermeneutiky, univerzální hermeneutiku Hans-Georga Gadamera, scientistický návrh novopozitivismu a v neposlední řadě o řešení problému hodnotové neutrality vědy Hanse Alberta. Summary To understand the present situation we must know something about its history. The ‘Rise of the West’, which grew out of the ‘European Miracle’, is a special case of cultural evolution. The development of science is an important element in this process. Cultural evolution went hand in hand with biological evolution. Evolutionary epistemology illuminates the achievements and the evolution of cognitive sensory apparatus of various species. Man's cognitive sensory apparatus is adapted to the ‘mesocosmos’, the world of medium-sized dimensions. (...) The biological structures constitute the hardware of the cognitive sensory apparatus, while certain expectations and theories, which are ontogenetically apriori, constitute the corresponding system software. A distinction is introduced between ‘primary theories’ (linked to the sensory apparatus) and ‘secondary theories’. The latter are the result of attempts to meet the demand for an explanation of phenomena that cannot be explained in terms of ‘primary theories’. Two subsets of ‘secondary theories’ are compared: spiritualistic-personalized theories and scientific theories. From the historical point of view the scientific secondary theories are but a special subset of the class of secondary theories. From the systematic point of view it is instructive to focus on a comparison of the two subsets: what do they have in common? in what respects do they differ? The rise of scientific thinking is closely linked to the ‘European Miracle’. How (and when and why) did the West grow rich? To answer this question we must first produce an explanation of the principle: theories about the consequences of institutional arrangements. Then we can give a historical explanation of why this development took place in Europe and only there. It is claimed that the secret of success, economic wealth and the first approximations to relatively free societies, was the taming of the state, the taming of cleptocracy (independent of the nature of the agency having cleptocratic appetites, be it princes or parliaments). The taming of the state is a pre-democratic achievement. Finally, the consequences of institutional arrangements for scientific progress and innovation are examined. Only if the system is market-like, will it link individual effort with reward and, through the competitive process, encourage the wide dissemination and use of new ideas. There is no tradeoff between freedom on the one hand and economic success and the growth of scientific knowledge on the other. Freedom and the ensuing flexibility is the key to the past and to the future. (shrink)

RESUMO O artigo pretende mostrar o sentido da noção de transcendental no interior do método reconstrutivo de Jürgen Habermas. Para isso, ele procura apresentar em primeiro lugar a diferença entre a argumentação transcendental como argumentação anticética e a prova transcendental em Kant e, em seguida, a diferença entre Habermas e Apel sobre a possibilidade de uma fundamentação última da racionalidade comunicativa. Segundo minha interpretação, há razões de ordem lógica para a recusa da fundamentação última em Habermas, mas também razões ligados (...) à historicidade da compreensão da razão. ABSTRACT The article aims to show the meaning of the notion of "transcendental" inside the reconstructive method of Jürgen Habermas. For such, first of all, it attempts to present the difference between the transcendental argumentation as anti-skeptical argumentation and the transcendental proof in Kant and, then, the difference between Habermas and Apel about the possibility of an ultimate foundation of communicative rationality. According to my interpretation, there are reasons of logical order for the refusal of the ultimate foundation in Habermas, but also reasons related to the historicity of understanding of reason. In this paper it is argued that much can be gained for the analysis and evaluation of arguing when fallacies are not, or not only, conceived of as flawed premise–conclusion complexes but rather as argumentative moves which distort harmfully an interaction aiming at resolving communication problems argumentatively. Starting from Normative Pragmatics and the pragma-dialectical concept of fallacy, a case study is presented to illustrate a fallacy which is termed the 'revelation argument' because it is characterized by an interactor's revealing her (...) thoughts and/or emotions to the addressees and claiming that these would have justificatory or refutatory potential with respect to the problem discussed. Although the revelation argument may not be a paradigm case of resolution- hindering moves, it is an extreme case of flawed reasoning that illustrates plainly the advantages of a communicational perspective on arguing and fallacies. A philosophical position may be characterized in different ways. Here we try to say how the naturalist answers certain . The questions come from very different areas; the spectrum of subjects is therefore quite mixed. There are, however, aspects of order: We start with (questions about) abstract subjects like logic, mathematics, metaphysics, then turn to problems of realism. And since in general naturalists are realists, the following questions on truth, laws of nature, origin of the universe, cosmology, evolution, body-mind-problem, freedom (...) of the will, religion, moral, and pseudoscience, are answered against a realistic background. German Eine philosophische Haltung kann man auf verschiedene Weisen charakterisieren. Hier versuchen wir zu sagen, wie der Naturalist auf bestimmte Kernfragen antwortet. Die Fragen stammen aus sehr verschiedenen Gebieten; das Themenspektrum ist deshalb recht bunt. Es gibt aber durchaus Ordnungsgesichtspunkte: Wir beginnen mit (Fragen zu) eher abstrakten Gegenständen wie Logik, Mathematik, Metaphysik, kommen dann zu Problemen des Realismus. Und da Naturalisten im Allgemeinen Realisten sind, werden die anschließenden Fragen über Wahrheit, Naturgesetze, Weltentstehung, Kosmologie, Evolution, Leib-Seele-Problem, Willensfreiheit, Religion, Moral und Pseudowissenschaften vor einem realistischen Hintergrund beantwortet. En su libro Una ética sin fundamentos, Nicolás Zavadivker sostiene que la teoría ética y metaética de Mario Bunge pretende fundamentar las normas morales en premisas fácticas, sin hacer uso de valores. El presente trabajo discute esa tesis y sostiene que la teoría de Bunge busca construir y evaluar un sistema de valores y de normas, de forma rigurosa y sin arbitrariedad, a partir de conocimientos fácticos y valores de los evaluadores. Dado que la teoría de Bunge incluye valores entre (...) sus premisas argumentativas, es incorrecto categorizarla como una posición fundacionista que prescinde de valores. (shrink)

Computer tools are increasingly used to support the analysis of argumentative texts. Generic support for argumentation analysis is helpful, but catering to the requirements of specific theoretical approaches has additional advantages. Although the pragma-dialectical method of analyzing argumentative texts is widely used, no dedicated computational support tools exist. An outline is presented for the development of such tools, that starts with the formal approximation of the pragma-dialectical ideal model of a critical discussion.

Topical Themes in Argumentation Theory brings together twenty exploratory studies on important subjects of research in contemporary argumentation theory.
