‘Sentience’ sometimes refers to the capacity for any type of subjective experience, and sometimes to the capacity to have subjective experiences with a positive or negative valence, such as pain or pleasure. We review recent controversies regarding sentience in fish and invertebrates and consider the deep methodological challenge posed by these cases. We then present two ways of responding to the challenge. In a policy-making context, precautionary thinking can help us treat animals appropriately despite continuing uncertainty about their sentience. In (...) a scientific context, we can draw inspiration from the science of human consciousness to disentangle conscious and unconscious perception (especially vision) in animals. Developing better ways to disentangle conscious and unconscious affect is a key priority for future research. (shrink)

Which animals have conscious experiences? Many different, diverse and unrelated behaviors and cognitive capacities have been proposed as tests of the presence of consciousness in an animal. It is unclear which of these tests, if any, are valid. To remedy this problem, I develop a list consisting of eight desiderata which can be used to assess putative tests of animal consciousness. These desiderata are based either on detailed analogies between consciousness-linked human behavior and non-human behavior, on theories of consciousness or (...) on methods from human consciousness science. If a test or set of tests satisfies more of these desiderata, passing it provides stronger evidence of consciousness. Moreover, one can design future tests of animal consciousness with the intention of satisfying these desiderata to ensure their evidential strength. (shrink)

Animal welfare scientists face an acute version of the problem of inductive risk, since they must choose whether to affirm attributions of mental states to animals in advisory contexts, knowing their decisions hold consequences for animal welfare. In such contexts, the burden of proof should be sensitive to the consequences of error, but a framework for setting appropriate burdens of proof is lacking. Through reflection on two cases—pain and cognitive enrichment—I arrive at a tentative framework based on the principle of (...) expected welfare maximization. I then discuss the limitations of this framework and the questions it leaves open. (shrink)

This goal of this thesis in the philosophy of nature is to move us closer towards a true biological science of consciousness in which the evolutionary origin, function, and phylogenetic diversity of consciousness are moved from the field’s periphery of investigations to its very centre. Rather than applying theories of consciousness built top-down on the human case to other animals, I argue that we require an evolutionary bottomup approach that begins with the very origins of subjective experience in order to (...) make sense of the place of mind in nature. To achieve this goal, I introduce and defend the pathological complexity thesis as both a framework for the scientific investigation of consciousness and as a lifemind continuity thesis about the origins and function of consciousness. Future global food insecurity due to growing population as well as changing consumption demands and population growth is sometimes suggested to be met by increase in aquaculture production. This raises a range of ethical issues, seldom discussed together: fish welfare, food security, human health, climate change and environment, and public concern and legislation, which could preferably be seen as pieces in a puzzle, accepting their interdependency. A balanced decision in favour of or against aquaculture needs to take at least these (...) issues into consideration. It is further argued that in the parallel discussion on increased livestock production animal welfare is an inevitable element both in relation to current legislation in many countries but also in relation to our perception of moral, whereas awareness of fish welfare is low. Both EU legislation and labelling concerning fish is mainly limited to environmental aspects. It is argued that EU shows a split perception of fish, on the one hand acknowledging scientific evidence of fish capacities but on the other excludes fish from detailed legislation. Combining the claim of the Treaty of Lisbon to pay full regard to animal welfare and scientific evidence fish are sentient it is concluded that fish welfare need to be considered in any farming practice and any ethical consideration of increased aquaculture. This might be facilitated taking a basis in our own vulnerability and interdependence, combined with moral responsibility to show sentient beings a ‘loving kindness’—an extension of Cora Diamond’s argument regarding mammals. In this chapter we discuss some of the central ethical issues specific to eating and harvesting fish. We survey recent research on fish intelligence and cognition and discuss possible considerations that are distinctive to questions about the ethics of eating fish as opposed to terrestrial and avian mammals. We conclude that those features that are distinctive to the harvesting and consumption of fish, including means of capture and the central role that fishing plays in many communities, do not suggest that (...) eating fish is less morally problematic than eating terrestrial of avian animals. Absence of evidence arguments are indispensable to comparative neurobiology. The absence in a given species of a homologous neural architecture strongly correlated with a type of conscious experience in humans should be able to be taken as a prima facie reason for concluding that the species in question does not have the capacity for that conscious experience. Absence of evidence reasoning is, however, widely disparaged for being both logically illicit and unscientific. This paper argues that these concerns are unwarranted. There (...) is no logical barrier to formulating cogent absence of evidence arguments; indeed, accepting such arguments is part of what it is to be committed to falsifiability as a critical aspect of the scientific method. Absence of evidence arguments can always be blocked, however, by assuming that psychological properties are ‘multiply realizable’. While we take multiple realizability to be highly likely at some level of analysis, we argue that it is question-begging to assume that it exists at every level of analysis, and thus it should not automatically be thought to undermine absence of evidence reasoning in the animal consciousness debate. Using the example of pain and focusing on homologies at the level of information processing tasks, we show how, in the science of consciousness, an absence of evidence might well serve as evidence of absence. Touch pools are popular open-topped fish tanks often found in aquariums where visitors may interact with animals, by touching and sometimes even feeding them, for educational and recreational purposes. However, although animal interactions are becoming increasingly popular in recent years, the welfare impact on the animals and the educational effectiveness of such interactions is under debate. Awareness concerning the different, and sometimes controversial, aspects connected with such interactions has spread. The aim of this paper is to investigate the ethical issues (...) arising from the presence of touch pools in aquariums and facilities alike. In particular, possible sources of moral conflicts between five interested parties will be identified and discussed: biodiversity; aquariums; staff involved with touch pools; individual animals used in the touch pools; visitors interacting with animals in touch pools. In order to assess the framework of ethical demands from different parties, it will be used an analytical tool provided by a revised version of the Ethical Matrix. (shrink)

This chapter addresses the extent to which nonhuman animals are conscious. Most important perhaps is what criteria should be used in making such a determination.

Fish farming is one of the fastest growing sectors of agriculture, attracting considerable attention to the question of whether existing farming regulations and animal welfare laws are adequate to deal with the expanding role of fish in feeding humans. The role of fish as model organisms in scientific research is also expanding -- a majority of research biology departments now keep zebrafish for the purposes of genome biology, and they are used widely used for basic neuroscience research. However, due to (...) their diversity and distance from mammalian biology, fish pose difficult questions for the application of legal and ethical principles of animal welfare. Innovation in fisheries is a global development that focuses on a broad range of aims. One example is a project that aims to develop technology for key phases of the demersal fishery operation to improve product quality and safeguard fish welfare. As this step to include welfare is novel, it raises questions associated with stakeholder acceptance in a wider aim for responsible innovation. How do stakeholders (a) value fish and their welfare and (b) consider the relation between welfare and other (...) relevant values? To address these questions, an approach combining desk research with an empirical study was used. The desk study analysed the ethical and biological arguments for whether fish welfare should be accounted for in this context. The empirical study explored how fish and their welfare are perceived by Norwegian professionals in this industry, by conducting semi-structured interviews and subsequently analysing the results based on a labelling method we developed. The desk study showed a consensus that welfare should be considered in its own right, while at face value the interviews presented a rather instrumental view on this theme. However, analysis of the interview results leads to a more nuanced picture, where fish and their welfare are viewed from the perspective of respect for nature. Despite the apparent divergence between stakeholder opinions and the literature on the importance of welfare, we present three steps that enables professionals to be responsive to both the (moral) views of stakeholders and accounting for welfare in the innovation process fisheries. Animal models are used in experiments in the behavioural neurosciences that aim to contribute to the prevention and treatment of cognitive and affective disorders in human beings, such as anxiety and depression. Ironically, those animals that are likely to be the best models for psychopathology are also likely to be considered the ones that are most morally problematic to use, if it seems probable that (and if indeed they are initially selected as models because) they have experiences that are similar (...) to human experiences that we have strong reasons to avoid causing, and indeed aim to alleviate (such as pain, anxiety or sadness). In this paper, against the background of contemporary discussions in animal ethics and the philosophy of animal minds, we discuss the views that it is morally permissible to use animals in these kinds of experiments, and that it is better to use less cognitively complex animals (such as zebrafish) than more complex animals (such as dogs). First, we criticise some justifications for the claim that human beings and more complex animals have higher moral status. We argue that contemporary approaches that attribute equal moral status to all beings that are capable of conscious strivings (e.g. avoiding pain and anxiety; aiming to eat and play) are based on more plausible assumptions. Second, we argue that it is problematic to assume that less cognitively complex animals have a lesser sensory and emotional experience than more complex beings across the board. In specific cases, there might be good reasons to assume that more complex beings would be harmed more by a specific physical or environmental intervention, but it might also be that they sometimes are harmed less because of a better ability to cope. Determining whether a specific experiment is justified is therefore a complex issue. Our aim in this chapter is to stimulate further reflection on these common assumptions behind the use of animal models for psychopathologies. In order to be able to draw more definite conclusions, more research will have to be done on the influence of cognitive complexity on the experience of (human and non-human) animals. (shrink)
