The conviction that political recognition is accomplished through the extension and completion of the Enlightenment project of toleration is shared by some of the most influential political theorists of our time. John Rawls, Charles Taylor and Will Kymlicka all formulate the issue of recognition as if it were a corollary of the principle of toleration based in equal liberty or dignity. This raises important issues which political thought must confront and engage with. Above all, it means reconsidering the primacy of (...) Enlightenment critique for our understanding of ourselves, our world and our encounter with others. In this article I examine the liberal conviction that tolerance (in the sense of a commitment to individual autonomy) best promotes recognition of cultural diversity. I argue that two weaknesses haunt the liberal project and undermine this belief. They prevail because of a failure adequately to address the question of recognition in its normative, ontological and symbolic aspects. In contrast, I argue that philosophical hermeneutics affords a critical perspective on democratic theory and practice that must be taken up and extended following the experience of identity politics. This essay outlines a normative theory of reparations for transitional democracies. The article situates the theory within current critical‐theory debates on recognition and redistribution, and it argues that any model of reparations should aim to achieve what Nancy Fraser calls “status parity.” Such a model should be conceptualized according to a typology of acknowledgment along one axis (symbolic and material) and a typology of recipients (individual and collective) along the other. Liberal attempts to defend faith schooling have been conditional on the ability of faith schools to serve as a context for individual choice. A recent critique of these attempts claims that religious parents would find such moderate faith schooling unacceptable. This article sets forth a new liberal defence of faith schools drawing heavily on the distinction between political and comprehensive liberalism. Since political liberalism's understanding of personal autonomy does not include the ability to make choices, the political liberal defence of (...) faith schools can accommodate denominational schools that limit the ability of students to choose or change their religion. Indigenous cultural possessions constitute a diverse global issue. This issue includes some culturally important, intangible tribal objects. This is evident in the Australian copyright cases viewed in this study, which provide examples of disputes over traditional Indigenous visual art. A proposal for the legal recognition of Indigenous cultural possessions in Australia is also reviewed, in terms of a new category of law. When such cultural objects are in an artistic form they constitute the tribe's self-presentation and its mechanism of cultural (...) continuity. Philosophical arguments for the legal recognition of Indigenous intellectual `property' tend to assume that the value of Indigenous intellectual property is determinable on external criteria. The emergence of global bioethics is connected to a rise of interest in ethics in general (both in academia and in the public sphere), combined with an increasing awareness of the interrelatedness of peoples and their ethical dilemmas, and the recognition that global problems need global solutions. In short, global bioethics has two distinguishing features: first, its global scope, both geographically and conceptually; and second, its focus on justice (communal and individual).

The belief that human rights are culturally relative has been reinforced by recent attempts to develop more plausible conceptions of human rights whose philosophical foundations are closely aligned with culture-specific ideas about human nature and/or dignity. This paper contests specifically the position that a conception of human rights is culturally relative by way of contesting the claim that there is an African case in point. That is, it contests the claim that there is a unique theory of rights. It analyses (...) three examples of what often passes as African conception of human rights arguing that they have little or nothing to do with human rights, are simply inadequate or are not African in the sense at issue in a cultural relativism. Along the way, it distinguishes between two meanings of the term African contending that to the extent that the practice of prizing the ‘community’ higher than any other value is definitive of African, the idea of African human rights remains suspect. Habermas endorses democracy as a way to rescue modern life from the economic and bureaucratic compulsion that Weber saw as an inescapable condition of modernity. This rescue mission requires that Habermas subordinate democracy to people's true interests, by liberating their political deliberations from incursions of money or power that could interfere with the formation of policy preferences that clearly reflect those interests. But Habermas overlooks the opaque nature of our interests under complex modern conditions, and the difficulty of even knowing (...) what the modern state is doing—let alone judging whether what it is doing serves our interests well. These overlooked sources of public ignorance buttress Weber's more pessimistic understanding of democracy, and like the theatrics surrounding popular sovereignty, public ignorance both enables and masks the autonomy that allows state officials and non‐state opinion leaders to shape public policy undemocratically. Among the theorists commonly associated with the communitarian critique of liberalism of the 1980s (Charles Taylor, Michael Sandel, Michael Walzer, and Alasdair MacIntyre), MacIntyre is the one who offers the most radical set of challenges to ways of thinking that typify contemporary liberalism. But does MacIntyre's thought add up to a fully worked‐out political philosophy? The specifically political implications of MacIntyre's contributions to moral philosophy are surprisingly underdeveloped in MacIntyre's most influential writings, notwithstanding the rhetorical force of his polemics against (...) liberalism. In Between Facts and Norms Habermas both accepts the place of distinctively ethical considerations about ‘the good’ in political deliberation, and advances a particular view of the nature and justification of ethical judgments. Whilst welcoming the former, this paper criticises the latter, with its focus on issues of identity and self-understanding, and suggests instead a broadly Aristotelian alternative. The argument proceeds, first, through a detailed engagement with Habermas’s theoretical claims about ethical reasoning in politics, in which it is argued that (...) he fails to show how different ethical possibilities can be critically evaluated, and second, through the analysis of a practical example, that of a political choice being made between different kinds of capitalism. Here the paper draws on recent work in comparative political economy on the institutional differences between varieties of capitalism, and uses this to contrast the implications of Habermas’s conception of ethics, according to which what would matter is the congruence between economic institutions and a political community’s historically shaped identity, with those of its preferred alternative, which requires a comparison between the different conceptions of the good that each kind of capitalism institutionally favours, and collective judgments about their respective contributions to human well-being. In his criticisms of the German youth movement and the emergence of fascism across Europe during the early 1920s, Max Scheler draws a distinction between the different senses of political apathy that give rise to mass political movements. Recent studies of mass apathy have tended to treat all forms of apathy as the same and as a consequence reduced the diverse expressions of mass violence to the same, stripping mass movements of any critical function. I show in this paper that (...) Scheler’s distinction provides the means by which to locate the various origins of mass violence and the practical means by which to address this violence that preserves the liberating potential of collective political movements. Liberal approaches to multiculturalism and cultural nationalism have met with severe criticism in recent years. This article makes the case for an alternative, Aristotelian approach developed in the work of the ‘founding father’ of culture, J. G. Herder. According to Herder, culture is worthy of political recognition because it contributes to the realization of our common but contradictory human telos. Only a plurality of cultures, each realizing a unique balance of our contradictory needs, can bring wholeness to our common nature. (...) RESUMEN En este artículo se presenta una reflexión crítica de la propuesta ética liberal de Charles Taylor y su viabilidad en el contexto político de las sociedades liberales actuales. Una conformación social y política liberal se entiende como aquella donde se promueven y se defiende mayores libertades en esquemas de derechos individuales junto con la exigencia del respeto a esas garantías individuales. Sin embargo, el contexto político liberal, siendo el más idóneo en las sociedades actuales, presenta varios problemas éticos que (...) Taylor ya ha identificado como malestares de la modernidad, tales como el exceso de individualismo, la primacía de la razón instrumental y la fragmentación y polarización de la sociedad. Ante estos retos y conflictos que surgen por el propio liberalismo, la ética de Taylor es una alternativa posible para comprenderlos y gestionarlos desde un civismo ético y la promoción de metas comunes. ABSTRACT This article presents a critical reflection on the liberal ethical proposal of Charles Taylor and its viability in the political context of current liberal societies. A liberal social and political configuration is understood as one in which greater liberties are promoted and defended in individual rights schemes together with the requirement of respect for those individual guarantees. However, the liberal political context although the most suitable in current societies, presents several ethical problems that Taylor has already identified as the malaise of modernity: excess of individualism, primacy of instrumental reason and fragmentation and polarization of the society. Faced with these challenges and conflicts arising from the liberalism itself, Taylor's ethics is a possible alternative to understand and manage them from an ethical civility and the promotion of common goals. This paper seeks to reflect, from a political philosophy point of view, about the integration possibilities of religion in public sphere –specifically Islam– in plural and democratic societies. In this article, we will confront ideas of Occidental thinkers –such as Rawls, Habermas and Taylor– with Muslim scholars such as Sachedima and An-Na’im.

Para quienes tengan interés en la filosofía moral y política contemporánea la obra de John Rawls es sin discusión una parada necesaria. De hecho, la tesis de Robert Nozick según la cual resulta imposible hacer filosofía moral y política sin considerar el marco ofrecido por Rawls, aunque parezca extrema, resulta bastante acertada. En gran medida el impacto de la obra de Rawls radica en su interés por ofrecer una teoría sustantiva de la justicia, teoría que hundiendo sus raíces en la (...) tradición de la filosofía sea capaz de orientarnos al momento de abordar las discusiones contemporáneas sobre justicia social. -/- En los trabajos que componen este libro el lector podrá encontrar una discusión actualizada sobre aquellos elementos que definen la base moral y política que Rawls presentó como fundamento de su teoría de la justicia. Al mismo tiempo, estos ensayos intentan construir un puente entre la justicia como equidad y otras tradiciones de la filosofía moral y política contemporánea. Para lograr este último fin, varios de los trabajos que aquí se presentan consideran las ideas de reconocimiento y autorrespeto como claves de interpretación de la obra de Rawls. (shrink)

The idea of ‘community’ dominates politics in Northern Ireland in both popular and political discourse and in academic writing, policy and legislation. Depending upon particular understandings of the notion of community different arguments are made about the policies that need to be implemented to develop the peace process. This has had a fundamental impact on areas such as legislation over parades and the development of a Bill of Rights for Northern Ireland. This essay critically looks at understandings of ‘community’; how (...) it becomes used in political discourse and in policy development and the character of its relationship with ideas about safety and security. This paper critically examines the language drawn on to describe socially responsible activities (CSR) in the context of the corporate web page. I argue that constructions of CSR are made plausible and legitimised according to the context of the expression. The web site is a genre of communication which addresses a broad and discerning audience; hence fractures in the institutionalised nature of argument may be apparent. The focus of this paper is to examine how the rhetoric of CSR is legitimised (...) and to develop a framework of argumentation repertoires that operate in this context. (shrink)

El estudio de la obra de Arturo A. Roig pone en evidencia su carácter de "clásico" de la filosofía "nuestroamericana". En efecto, el filósofo ha instituido categorías nuevas, redefinido otras más tradicionales, explorado vías para enriquecer el acervo filosófico con saberes provenientes de otras formas discursivas, escritas o populares trasmitidas por el lenguaje oral, y formado un discipulado prestigioso. Esta producción en su integridad, aun los estudios sobre la Historia de las Ideas Latinoamericanas, fue concebida por su autor como ancilla (...) emancipationis, una "filosofía del concernimiento" en términos de la Filosofía Intercultural. Como homenaje al Maestro Arturo A. Roig se comunica aquí un breve desarrollo teórico que incorpora las categorías de "a priori antropológico" y "moralidades emergentes", así como las redefiniciones de "ciudadanía" y "dignidad humana", a una investigación filosófica intercultural en curso sobre las "ciudadanías interculturales emergentes", resultante de las migraciones que constituyen el "fenómeno biopolítico mayor de nuestro tiempo". The study of Arturo A. Roig's work highlights his character as a "classic" of Our American philosophy. Indeed, the philosopher has instituted new categories, redefined more traditional ones, he has also explored new ways to enrich the philosophical wealth with the knowledge coming from other discursive forms, whether written or popular traditions transmitted orally, and he has built a prestigious discipleship. The totality of his production, even his studies on the History of Latin American Ideas, has been conceived as an ancilla emancipationis, "a philosophy of concern", as Intercultural Philosophy formulates it. Thus, as a homage to the Master Arturo A. Roig this contribution exposes a brief theoretical development incorporating as well the categories "anthropological a priori" and "emerging moralities", as the redefinitions of "citizenship" and "human dignity", to an actual philosophical enquiry on the "emerging intercultural citizenship" which results from the international migrations.
