Argumentation schemes [1–3] are a relatively recent notion that continues an extremely ancient debate on one of the foundations of human reasoning, human comprehension, and obviously human argumentation, i.e., the topics. To understand the revolutionary nature of Walton’s work on this subject matter, it is necessary to place it in the debate that it continues and contributes to, namely a view of logic that is much broader than the formalistic perspective that has been adopted from the 20th century until nowadays. With his book Argumentation schemes for presumptive reasoning, Walton attempted to start a dialogue between three different fields or views on human reasoning – one (argumentation theory) very recent, one (dialectics) very ancient and with a very long tradition, and one (formal logic) relatively recent, but dominating in philosophy. Argumentation schemes were proposed as dialectical instruments, in the sense that they represented arguments not only as formal relations, but also as pragmatic inferences in the sense that they depend on what the interlocutors share and accept in a given dialogical circumstance and affect their dialogical relation. In this introduction, the notion of argumentation scheme will be analyzed in detail, showing its different dimensions and its defining features which make them an extremely useful instrument in Artificial Intelligence. This theoretical background will be followed by a literature review on the uses of the schemes in computing, aimed at identifying the most important areas and trends, the most promising proposals, and the directions of future research. In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

Hamblin distinguished between formal and descriptive dialectic. Formal normative models of deliberation dialogue have been strongly emphasized as argumentation frameworks in computer science. But making such models of deliberation applicable to real natural language examples has reached a point where the descriptive aspect needs more interdisciplinary work. The new formal and computational models of deliberation dialogue that are being built in computer science seem to be closely related to some already existing and very well established computing technologies such as problem (...) solving and decision making, but whether or how dialectical argumentation can be helpful to support these systems remains an open question. The aim of this paper is to examine some real examples of argumentation that seem to hover on the borderlines between deliberation, problem solving and decision making. (shrink)

This thesis justifies the need for and develops a new integrated model of practical reasoning and argumentation. After framing the work in terms of what is reasonable rather than what is rational (chapter 1), I apply the model for practical argumentation analysis and evaluation provided by Fairclough and Fairclough (2012) to a paradigm case of unreasonable individual practical argumentation provided by mass murderer Anders Behring Breivik (chapter 2). The application shows that by following the model, Breivik is relatively easily able (...) to conclude that his reasoning to mass murder is reasonable – which is understood to be an unacceptable result. Causes for the model to allow such a conclusion are identified as conceptual confusions ingrained in the model, a tension in how values function within the model, and a lack of creativity from Breivik. Distinguishing between dialectical and dialogical, reasoning and argumentation, for individual and multiple participants, chapter 3 addresses these conceptual confusions and helps lay the foundation for the design of a new integrated model for practical reasoning and argumentation (chapter 4). After laying out the theoretical aspects of the new model, it is then used to re-test Breivik’s reasoning in light of a developed discussion regarding the motivation for the new place and role of moral considerations (chapter 5). The application of the new model shows ways that Breivik could have been able to conclude that his practical argumentation was unreasonable and is thus argued to have improved upon the Fairclough and Fairclough model. It is acknowledged, however, that since the model cannot guarantee a reasonable conclusion, improving the critical creative capacity of the individual using it is also of paramount importance (chapter 6). The thesis concludes by discussing the contemporary importance of improving practical reasoning and by pointing to areas for further research (chapter 7). (shrink)

This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement. Tailoring assistive systems for guiding and monitoring an individual in daily living activities is a complex task. This paper presents ALI, an assistive system combining a formal possibilistic argumentation system and an informal model of human activity: the Cultural-Historic Activity Theory, facilitating the delivery of tailored advices to a human actor. We follow an activity-centric approach, taking into consideration the human’s motives, goals and prioritized actions. ALI tracks a person in order to I) determine what activities were performed over a (...) period of time (activity recognition tracking), and II) send personalized notifications suggesting the most suitable activities to perform (decision-making monitoring). We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. This paper offers a new model of belief by embedding the Peircean account of belief into a formal dialogue system that uses argumentation schemes for practical reasoning and abductive reasoning. A belief is characterised as a stable proposition that is derived abductively by one agent in a dialogue from the commitment set (including commitments derived from actions and goals) of another agent. On the model (to give a rough summary), a belief is defined as a proposition held by an agent (...) that (1) is not easily changed (stable), (2) is a matter of degree (held more or less weakly or strongly), (3) guides the goals and actions of the agent, and (4) is habitually or tenaciously held in a manner that indicates a strong commitment to defend it. It is argued that the new model overcomes the pervasive conflict in artificial intelligence between the belief-desire-intention model of reasoning and the commitment model. (shrink)

In this paper we introduce a formalism for single-agent decision making that is based on Dynamic Argumentation Frameworks. The formalism can be used to justify a choice, which is based on the current situation the agent is involved. Taking advantage of the inference mechanism of the argumentation formalism, it is possible to consider preference relations, and conflicts among the available alternatives for that reasoning. With this formalization, given a particular set of evidence, the justified conclusions supported by warranted arguments will (...) be used by the agent’s decision rules to determine which alternatives will be selected. We also present an algorithm that implements a choice function based on our formalization. Finally, we complete our presentation by introducing formal results that relate the proposed framework with approaches of classical decision theory. (shrink)

Trust is a natural mechanism by which an autonomous party, an agent, can deal with the inherent uncertainty regarding the behaviours of other parties and the uncertainty in the information it shares with those parties. Trust is thus crucial in any decentralised system. This paper builds on recent efforts to use argumentation to reason about trust. Specifically, a set of schemes is provided, and abstract patterns of reasoning that apply in multiple situations geared towards trust. Schemes are described in which (...) one agent, A, can establish arguments for trusting another agent, B, directly, as well as schemes that A can use to construct arguments for trusting C, where C is trusted by B. Designing security measures often involves trade-offs between various types of objectives. Multiple stakeholders may have conflicting demands and may have different ideas on how to resolve the resulting design conflicts. This paper reports on an application of value-sensitive design. Based on argumentation theory and social values, the paper develops a structured approach for discussing design conflicts, called value-based argumentation. The application domain examined in the paper is concerned with physical safety and security issues that arise in cross-border shipments. We first (...) identify the kinds of dialogues that take place in this domain, in particular, audit dialogues to determine whether security measures comply with regulations. Based on argumentation theory we develop a formal language and a diagramming approach intended to facilitate parties in identifying, discussing and reaching agreement about security risks and corresponding mitigation measures. Trade-offs can be dealt with by making underlying values explicit. Using a stylized example, the approach was successfully taught to practitioners working with EU customs regulations. Practitioners generally found the approach helpful, in particular to bring out implicit underlying motivations. We conclude by discussing how our approach can be generalized to other kinds of dialogues involving design conflicts. (shrink)

Advancements and deployments of AI-based systems, especially Deep Learning-driven generative language models, have accomplished impressive results over the past few years. Nevertheless, these remarkable achievements are intertwined with a related fear that such technologies might lead to a general relinquishing of our lives’s control to AIs. This concern, which also motivates the increasing interest in the eXplainable Artificial Intelligence (XAI) research field, is mostly caused by the opacity of the output of deep learning systems and the way that it is (...) generated, which is largely obscure to laypeople. A dialectical interaction with such systems may enhance the users’ understanding and build a more robust trust towards AI. Commonly employed as specific formalisms for modelling intra-agent communications, dialogue games prove to be useful tools to rely upon when dealing with user’s explanation needs. The literature already offers some dialectical protocols that expressly handle explanations and their delivery. This paper fully formalises the novel Explanation–Question–Response (EQR) dialogue and its properties, whose main purpose is to provide satisfactory information (i.e., justified according to argumentative semantics) whilst ensuring a simplified protocol, in comparison with other existing approaches, for humans and artificial agents. Doug Walton, who died in January 2020, was a prolific author whose work in informal logic and argumentation had a profound influence on Artificial Intelligence, including Artificial Intelligence and Law. He was also very interested in interdisciplinary work, and a frequent and generous collaborator. In this paper seven leading researchers in AI and Law, all past programme chairs of the International Conference on AI and Law who have worked with him, describe his influence on their work.

This paper presents an analysis of argumentation in direct-to-consumer health product ads in Newsweek that brings out special features of the arguments used in the ads, including practical reasoning, chained arguments, enthymemes, and prolepsis. A way to help overcome deficiencies in techniques of tailored health communication in consumer health informatics is shown by using argumentation schemes, argument visualisation tools, and dialogue models to frame these persuasive communication messages. The evidence collected is shown to be useful to allow the health informatics (...) communicator and the person to whom message was directed to interact in a dialogue format where arguments can be put forward by both parties in a way that responds to the previous arguments and questions of the other party. We reported a series of experiments carried out to confront the underlying intuitions of value-based argumentation frameworks (VAFs) with the intuitions of ordinary people. Our goal was twofold. On the one hand, we intended to test VAF as a descriptive theory of human argument evaluations. On the other, we aimed to gain new insights from empirical data that could serve to improve VAF as a normative model. The experiments showed that people’s acceptance of arguments deviates from VAF’s semantics and is (...) rather correlated with the importance given to the promoted values, independently of the perceptions of argument interactions through attacks and defeats. Furthermore, arguments were often perceived as promoting more than one value with different relative strengths. Individuals’ analyses of scenarios were also affected by external factors such as biases and arguments not explicit in the framework. Finally, we confirmed that objective acceptance, that is, the acceptance of arguments under any order of the values, was not a frequent behavior. Instead, participants tended to accept only the arguments that promoted the values they subscribe. (shrink)

In this paper we show that an essential aspect of solving the problem of uncritical acceptance of expert opinions that is at the root of the ad verecundiam fallacy is the need to disentangle argument from expert opinion from another kind of appeal to authority. Formal and computational argumentation systems enable us to analyze the fault in which an error has occurred by virtue of a failure to meet one or more of the requirements of the argumentation scheme from argument (...) from expert opinion. We present a method for enhancing this capability by showing how arguments from expert opinion are related to, but different from, arguments from deontic authority. (shrink)

Eight structural criteria are developed as part of a dialogical method by testing them against seven examples of arguments from negative consequences. The aim is to provide a method for evaluating the arguments in the examples as fallacious or not. It is shown that any method that can be satisfactorily used to evaluate such examples needs to be based on two techniques. In this paper, we present a particular role for abductive reasoning in law by applying it in the context of an argumentation scheme for practical reasoning. We present a particular scheme, based on an established scheme for practical reasoning, that can be used to reason abductively about how an agent might have acted to reach a particular scenario, and the motivations for doing so. Plausibility here depends on a satisfactory explanation of why this particular agent followed these motivations in the (...) particular situation. The scheme is given a formal grounding in terms of action-based alternating transition systems and we illustrate the approach with a running legal example. Compliance is often achieved ‘by design’ through a coherent system of controls consisting of information systems and procedures. This system-based control requires a new approach to auditing in which companies must demonstrate to the regulator that they are ‘in control’. They must determine the relevance of a regulation for their business, justify which set of control measures they have taken to comply with it, and demonstrate that the control measures are operationally effective. In this paper we show how value-based argumentation (...) theory can be applied to the compliance domain. Corporate values motivate the selection of control measures (actions) which aim to fulfil control objectives, i.e. adopted norms (goals). In particular, we show how to formalize the audit dialogue in which companies justify their compliance decisions to regulators using value-based argumentation. The approach is illustrated by a case study of the safety and security measures adopted in the context of EU customs regulation. (shrink)

Argumentation schemes are forms of reasoning that are fallible but correctable within a self-correcting framework. Their use provides a basis for taking rational action or for reasonably accepting a conclusion as a tentative hypothesis, but they are not deductively valid. We argue that teleological reasoning can provide the basis for justifying the use of argument schemes both in monological and dialogical reasoning. We consider how such a teleological justification, besides being inspired by the aim of directing a bounded cognizer to (...) true belief and correct choices, needs to take into account the attitudes of dialogue partners as well as normative models of dialogue and communicative activity types, in particular social and cultural settings. The paper presents an analysis of the cultural embeddedness of arguments, raised as a part of the Bulgarian debate about the ratification of the Istanbul convention. The method I employed was the localization procedure of Generalized Argumentation theory. Through a qualitative analysis of empirical argumentation data, I identified arguments in favour of or against the ratification of the Istanbul convention. Information about the cultural background against which these arguments were raised, i.e. about Bulgarian culture, was gathered from the part of (...) the ninth wave of the European Social Survey that used the Portrait Value Questionnaire—an instrument for measuring human values, based on Schwartz’s theory of human values. By establishing a certain relationship between the arguments and the cultural background information, I came to the conclusion that the debate between the proponents and the opponents of the ratification represented a conflict between the basic values of universalism and tradition, and more particularly, between the lower-order values of equality and respect for tradition. This paper has three dimensions, historical, theoretical and social. The historical dimension is to show how the Ciceronian system of dialectical argumentation served as a precursor to computational models of argumentation schemes such as Araucaria and Carneades. The theoretical dimension is to show concretely how these argumentation schemes reveal the interdependency of rhetoric and logic, and so the interdependency of the normative with the empirical. It does this by identifying points of disagreement in a dialectical format through using argumentation schemes (...) and critical questions. The social dimension is to show how the Ciceronian dialectical viewpoint integrates with the use of computational tools that can be used to support the principle of reason-based deliberation and facilitate deliberative democracy. This paper builds a dialectical system of explanation with speech act rules that define the kinds of moves allowed, like requesting and offering an explanation. Pre and post-condition rules for the speech acts determine when a particular speech act can be put forward as a move in the dialogue, and what type of move or moves must follow it. A successful explanation has been achieved when there has been a transfer of understanding from the party giving the explanation to the (...) party asking for it. The dialogue has an opening stage, an explanation stage and a closing stage. Whether a transfer of understanding has taken place is tested by a dialectical shift to an examination dialogue. (shrink)
