The terms ‘compatibilism’ and ‘incompatibilism’ were introduced in the mid-20th century to name conflicting views about the logical relationship between the thesis of determinism and the thesis that someone has free will. These technical terms were originally introduced within a specific research paradigm, the classical analytic paradigm. This paradigm is now in its final stages of degeneration and few free-will theorists still work within it (i.e. using its methods, granting its substantive background assumptions, etc.). This chapter discusses how the ambiguity (...) of the terms ‘incompatibilism’ and ‘compatibilism’ took root as the classical analytic paradigm declined and why this matters to the contemporary debate. Among other things, I explain why the ambiguity of these anachronistic terms, though relatively innocuous when they were first introduced, is now encouraging theorists to tolerate and perpetuate serious philosophical errors (e.g. to conflate relations as different in kind and importance as correlation and causation, to promote uncontentiously invalid arguments, and to equivocate in ways that keep the free-will debate mired in pseudo-stalemates). I also suggest a new framework for anyone looking for relief from the confusion and deadlock created by quixotic attempts to redefine classical narratives and jargon so that they adequately describe the dialectical contours of the contemporary free-will debate. In addition, this new framework allows philosophers to start cross-pollinating work on free will and other famous problems of luck and control, e.g. the paradox of moral luck. According to one picture of the mind, decisions and actions are largely the result of automatic cognitive processing beyond our ability to control. This picture is in tension with a foundational principle in ethics that moral responsibility for behavior requires the ability to control it. The discovery of implicit attitudes contributes to this tension. According to the ability argument against moral responsibility, if we cannot control implicit attitudes, and implicit attitudes cause behavior, then we cannot be morally responsible for that (...) behavior. The purpose of this paper is to refute the ability argument. Drawing on both scientific evidence in cognitive science and philosophical arguments in ethics and action theory, I argue that it is invalid and unsound because current evidence is insufficient to establish the premises that implicit attitudes are uncontrollable, that they significantly cause behavior, that responsibility always requires ability, and that even if uncontrollable attitudes did fully cause behavior, this entails that the behavior they cause is uncontrollable. The rejection of the ability argument questions the priority of the unconscious over the conscious mind in cognitive science, deprioritizes ability in theories of moral responsibility in ethics, and provides a strong reason to uphold moral responsibility for implicitly biased behavior. The consequence argument is widely regarded as the most important argument for incompatibilism. In this paper, I argue that, although the consequence argument may be sound in its standard formulations, it does not support any thesis that could reasonably be called ‘incompatibilism’.

The consequence argument for the incompatibility of free action and determinism has long been under attack, but two important objections have only recently emerged: Warfield’s modal fallacy objection and Campbell’s no past objection. In this paper, I explain the significance of these objections and defend the consequence argument against them. First, I present a novel formulation of the argument that withstands their force. Next, I argue for the one controversial claim on which this formulation relies: the trans-temporality thesis. This thesis (...) implies that an agent acts freely only if there is one time at which she is able to perform an action and a distinct time at which she actually performs it. I then point out that determinism, too, is a thesis about trans-temporal relations. I conclude that it is precisely because my formulation of the consequence argument emphasizes trans-temporality that it prevails against the modal fallacy and no past objections. (shrink)

Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. The consequence argument is among the most influential arguments for the conclusion that free will and determinism are incompatible. Recently, however, it has become increasingly clear that the argument fails to establish that particular incompatibilist conclusion. Even so, a version of the argument can be formulated that supports a different incompatibilist conclusion, according to which free will is incompatible with our behavior being predetermined by factors beyond our control. This conclusion, though not equivalent to the traditional incompatibilist thesis that determinism (...) strictly precludes free will, is something many incompatibilists have had in mind all along and, indeed, is arguably the more central incompatibilist position. The consequence argument thus remains philosophically important, even if, as several of its critics have argued, it can't be used to establish the strict incompatibility of free will and determinism. In this essay, I explain why Gabriel De Marco's attempts to "solve" the invalidity problem for the Zygote Argument were non-starters. The first solution he describes was originally developed by Mickelson (2012/2015) and already adopted by Mele (2013), but De Marco presents it as his own (using an idiosyncratic labelling system). De Marco's second response fails because it is grounded in a patently invalid argument. Most importantly, De Marco (like Mele before him) fails to even mention that Mickelson wasn't interested (...) in the Zygote Argument per se, nor did she have the quixotic aim of providing "correct" definitions of anachronistic jargon like 'compatibilism' and 'incompatibilism' (for reasons explained in Mickelson's 2015 critique of Vihvelin's three-fold classification). Mickelson's invalidity objection served to highlight several novel and dialectically significant lessons, such as: it is surprisingly difficult to close the "explanatory gap" between incompossibilism and the standard causal luck explanation for incompossibilism without relying upon invalid arguments or question-begging assumptions. Indeed, there appears to be no argument in the free-will literature which does so -- i.e. there appears to be NO logically viable, non-question-begging argument for incompatibilism in the free-will literature as a whole! Philosophers like De Marco don't want to "fuss" over such fundamental philosophical errors or investigate the new avenues of research that have opened up by exposing them; he suggests that no one else should fuss over such things either. The chapter presents Anselm’s incompatibilist account of human freedom within the context of his theodicy and presents two arguments against his account. Both arguments aim to show there is a genuine conflict between his account of freedom and the role of God’s grace in making agents just. The first argument, the problem of harmonization, highlights the conflict within the soteriological context where an agent changes from being unjust to being just. The second argument, the problem of just creation, highlights the (...) conflict within the context of the creation of agents prior to the presence of evil. Holding fixed his incompatibilist account and the necessity of divine grace, the upshot of both arguments is that Anselm must endorse a version of Pelagianism. (shrink)

Helen Steward holds that an agent’s settling something does not require a conscious, full-fledged intention. Rather, sub-intentional acts can be instances of settling by the agent if that act is subordinated to the agent’s personal-level conscious systems. I argue that this position is mistaken, and that agential settling does in fact require a conscious intention. I argue for this claim by offering a case which on Steward’s position has counterintuitive implications. I consider a variety of ways in which Steward might (...) respond, and show how each response incurs serious dialectical burdens. I then propose my preferred view of agential settling which does not share the aforementioned counterintuitive claims. (shrink)

The advent of Frankfurt-style counterexamples in the early 1970s posed a problem not merely for incompatibilists, but for compatibilists also. At that time compatibilists too were concerned to hold that the presence of alternative possibilities was necessary for moral responsibility. Such a classical compatibilism, I argue in this paper, should not have been left behind. I propose that we can use a Kratzer-style semantics of ‘can’ to model ‘could have done otherwise’ statements in such a way that the truth of (...) such expressions is both (i) evidently consistent with determinism, and (ii) clearly such that Frankfurt-style counterexamples do not count as cases where the agent could not have done otherwise. This thesis investigates the conceptual relationship between laws of nature and free will. In order to clarify the discussion, I begin by distinguishing several questions with respect to the nature of a law: i) do the laws of nature cover everything that happens? ii) are they deterministic? iii) can there be exceptions to universal and deterministic laws? iv) do the laws of nature govern everything in the world? In order to answer these questions I look at three widely endorsed accounts (...) of laws: "Humean" regularity accounts, laws as relations among universals, and the dispositional essentialist account. I argue that there is nothing in the very nature of a law - in any of the accounts surveyed - that implies a positive answer to questions (i) and (ii). I show that this has important consequences for the free will problem. I then turn to the compatibility of free will and determinism. I focus on the Humean view and the dispositional essentialist account of laws. And the bulk of this discussion concerns the consequence argument, especially the question of whether the laws of nature are "up to us". I show that, on the dispositional conception of laws, there is no sense in which the laws of nature are up to us, contrary to the Humean view. However, this does not mean that there is no room for free will on the dispositional account. I argue that free will requires the laws of nature to be limited in scope, rather than being indeterministic. I conclude by showing that this allows one to resist the claim that indeterminism rules out free will. (shrink)

I refute Bailey's claim that his argument for incompatibilism is immune to Campbell's No Past Objection. In my refutation I stress a simple point, that nomological necessitation by future world states does not undermine one's freedom with respect to the present world state. My analysis reveals that the No Past Objection challenges van Inwagen's second consequence argument about as much as it does the others, and suggests that the (uncompromising) incompatibilist must pursue some of the options that Bailey regarded as (...) costly in order to overcome the No Past Objection.
