I introduce and argue for the importance of a cognitive state that I call alief. An alief is, to a reasonable approximation, an innate or habitual propensity to respond to an apparent stimulus in a particular way. Recognizing the role that alief plays in our cognitive repertoire provides a framework for understanding reactions that are governed by non‐conscious or automatic mechanisms, which in turn brings into proper relief the role played by reactions that are subject to conscious regulation and deliberate (...) control. Philosophical cognitivists have argued for more than four decades that emotions are special types of judgments. Anti-cognitivists have provided a series of counterexamples aiming to show that identifying emotions with judgments overintellectualizes the emotions. I provide a novel counterexample that makes the overintellectualization charge especially vivid. I discuss neurophysiological evidence to the effect that the fear system can be activated by stimuli the subject is unaware of seeing. To emphasize the analogy with blind sight , I call this phenomenon blind (...) fright . Cognitivists may reply that blindfright is nothing but an unconscious judgment subcortically elicited. This reply is in line with the strategy commonly employed by cognitivists against their critics. I call it the Elastic Strategy, because it consists of ‘stretching’ the notion of judgment in order to accommodate counterexamples. This strategy, I argue, turns cognitivism into a theory that is at worst unfalsifiable and at best trivially true. The final portion of my article aims to rescue cognitivism from the damage done by the Elastic Strategy. I distinguish three varieties of cognitivism, one concerned with what emotions essentially are (Constitutive Cognitivism), one concerned with what causes emotions (Etiological Cognitivism) and one concerned with what emotions represent (Representational Cognitivism). I conclude that what cognitivism has to offer to emotion theory are primarily insights concerning the causes and representational content of emotions. The constitutive identification of emotions with judgments, on the other hand, does more harm than good. (shrink)

As a cognitivist about emotions, Socrates takes the fear of death to be a belief that death is a bad thing for the one who dies. Socrates, however, thinks there are reasons for thinking death is not a bad thing at all, and might even be a blessing. So the question considered in this paper is: how would Socrates explain the fact that so many people believe death is bad?

Problems with representing friendship in painting and the novel and its more successful displays in drama reflect the fact that friends seldom act as inspiringly as traditional images of the relationship suggest: friends' activities are often trivial, commonplace and boring, sometimes even criminal. Despite all that, the philosophical tradition has generally considered friendship a moral good. I argue that it is not a moral good, but a good nonetheless. It provides opportunities to try different ways of being, and is crucial (...) to the processes through which we establish our individuality. (shrink)

This paper argues against the unity of the virtues, while trying to salvage some of its attractive aspects. I focus on the strongest argument for the unity thesis, which begins from the premise that true virtue cannot lead its possessor morally astray. I suggest that this premise presupposes the possibility of completely insulating an agent’s set of virtues from any liability to moral error. I then distinguish three conditions that separately foreclose this possibility, concentrating on the proposition that there is (...) more to morality than virtue alone—that is, not all moral considerations are ones to which some virtue is characteristically sensitive. If the virtues are not unified, the situationist critique of virtue ethics also turns out to be more difficult to establish than some have supposed. (shrink)

Ignorance is commonly assumed to be a lack of knowledge in Plato’s Socratic dialogues. I challenge that assumption. In the Protagoras, ignorance is conceived to be a substantive, structural psychic flaw—the soul’s domination by inferior elements that are by nature fit to be ruled. Ignorant people are characterized by both false beliefs about evaluative matters in specific situations and an enduring deception about their own psychic conditions. On my interpretation, akrasia, moral vices, and epistemic vices are products or forms of (...) ignorance, and a person who lacks knowledge is not necessarily ignorant. (shrink)

I argue that the principle of care, developed in care ethics, can be a better ground for civic solidarity than that of civic friendship. To make my argument, I present a preliminary categorization of extant discussion on civic solidarity as either falling under the commonality model or the relationship model. I argue that the reciprocity model of civic friendship proposed by Danielle Allen and Sibyl Schwarzenbach serves as a synthesis of the two models, constructing the most compelling theory of civic (...) friendship available.Despite the many virtues of the reciprocity model of civic friendship, I argue that the principle of care is practically prior and more appealing as a model of civic solidarity than that of civic friendship. In unpacking this argument, I present the concept of care as a political principle developed in care ethics and compare and contrast it with the concept of civic friendship. (shrink)

We can clarify a certain difficulty with regard to the phrase ‘the best and most perfect virtue’ in Aristotle’s definition of the human good in Nicomachean Ethics I 7 if we make use of two related distinctions: Donnellan’s attributive–referential distinction and Kripke’s distinction between speaker’s reference and semantic reference. I suggest that Aristotle is using the phrase ‘the best and most perfect virtue’ attributively, not referentially, and further that even though the phrase may refer to a specific virtue (semantic reference), (...) I examine the significance of the Stoic theory of pathē for Kant’s moral psychology, arguing against the received view that systematic differences block the possibility of Kant’s drawing anything more than rhetoric from his Stoic sources. More particularly, I take on the chronically underexamined assumption that Kant is committed to a psychological dualism in the tradition of Plato and Aristotle, positing distinct rational and nonrational elements of human mentality. By contrast, Stoics take the mentality of an adult human being to (...) be rational through and through, while recognising that this rationality is not normally in a state of health or excellence. I show how Kant’s account of affections—chiefly the “affects” and “passions” that he identifies as targets of a duty of apathy—draws substantive lessons from his Stoic sources, and how he accepts on his own terms the monistic principles of Stoic moral psychology. This article examines Elisabeth of Bohemia's account of the emotions. I argue that Elisabeth's objections against Descartes' ethics, which is often characterized as ‘Neo-Stoic’, show striking similarities to the arguments that the ancient Peripatetics made against classical Stoic approaches. Like the Peripatetics, she challenges the feasibility as well as the desirability of Descartes' ethical injunctions regarding emotional control. In particular, Elisabeth joins the Peripatetics in holding that certain external goods are essential for happiness and that the emotions are necessary for (...) motivating, guiding and correcting action. In aligning Elisabeth's thinking about the emotions with the Aristotelian tradition, I depart from various other interpretations, especially from those who see her position as a precursor of later feminist accounts, or as embodying a distinctively female perspective. The objective of this article is to see whether desire for recognition might contain an emancipatory aspect. Could this desire be a political ally? The argumentative strategy is to fully acknowledge the oppressive mechanisms at work before trying to find a way to other outcomes, including emancipation, with which desire for recognition has been associated in the tradition from Hegel. Through a re-interpretation of the master-and-slave dialectic, supplemented by sociological research on status expectations, I suggest a way out of the (...) vicious circle, where desire produced by power finds satisfaction through a preexisting other, resulting in an endless dynamic of compulsive conformity and regressive assertion of status. The hold of this dynamic must not be underestimated, yet, as I argue, both desire and what satisfies desire are liable to change, through struggle. The transformation of the generalized other, which provides recognition, is seen to be a crucial feature of all collective struggle. The very source of recognition is transformed, behind the backs of the actors, in turn affecting their desire. This can but must not lead to the emancipatory outcomes which are traditionally tied to recognition in the Hegelian tradition. (shrink)

When is it rational to commit suicide? More specifically, when is it rational for a Platonist to commit suicide, and more worryingly, is it ever not rational for a Platonist to commit suicide? If the Phaedo wants us to learn that the soul is immortal, and that philosophy is a preparation for a state better than incarnation, then why does it begin with a discussion defending the prohibition of suicide? In the course of that discussion, Socrates offers (but does not (...) necessarily endorse) two arguments for the prohibition of self-killing, at least in most circumstances, which have exerted a long and powerful influence over subsequent discussion of the topic, particularly in theist contexts. In the context of the Phaedo itself, however, this introductory conversation plays a crucial role in setting the agenda for the remainder of the dialogue and offering an initial discussion of the major concerns of the argument as a whole. In particular, the discussion of the nature of suicide is intimately bound up with Socrates¿ conception of true philosophy as a ¿preparation for death¿, the relationship between soul and body, and the immortality of the soul. My intention is to provide a reading of that passage (61e-69e) which asks whether the Phaedo can offer a philosophically satisfying distinction between suicide and philosophy and how it relates to other ancient philosophical attitudes to self-killing. I argue that Socrates does not think that being dead is always preferable to being alive, and that the religious views expressed in the passage are consistent with his general stance on the benevolence of the gods. This paper seeks to examine the plausibility of the concept of ‘Civic Friendship’ as a philosophical model for a conceptualisation of ‘belonging’. Such a concept, would hold enormous interest for educators in enabling the identification of particular virtues, attitudes and values that would need to be taught and nurtured to enable the civic relationship to be passed on from generation to generation. I consider both of the standard arguments for civic friendship: that it can be understood within the Aristotelian typology (...) as either a form of utility friendship or as a form of virtue friendship. I argue that civic friendship may not be the most appropriate model and that attempts to resolve the problems through looking on it as a political metaphor leave it unable to fulfil the function for which it was originally designed in Ancient Greece. Finally, I emphasize the need to carefully consider which particular metaphors we choose for civic relationships and how we subsequently use them. (shrink)

This paper explores in detail Gorgias' defense of rhetoric in Plato 's Gorgias, noting its connections to earlier and later texts such as Aristophanes' Clouds, Gorgias' Helen, Isocrates' Nicocles and Antidosis, and Aristotle's Rhetoric. The defense as Plato presents it is transparently inadequate; it reveals a deep inconsistency in Gorgias' conception of rhetoric and functions as a satirical precursor to his refutation by Socrates. Yet Gorgias' defense is appropriated, in a streamlined form, by later defenders of rhetoric such as Isocrates (...) and Aristotle. They present it as an effective reductio against a critique of rhetoric that depends on the "harm criterion." This is puzzling, since Plato 's own critique of rhetoric does not depend on the harm criterion. On the other hand, Plato does seem to embrace the harm criterion as a more general principle—as if pre-emptively embracing the reductio —in his arguments about the good in the Meno and Euthydemus. Nonetheless, Isocrates and Aristotle seem to be deliberately misreading Plato on rhetoric: where he intends to criticize its intrinsic nature, they respond as if he were merely complaining about its contingent effects. Given that it seems uncontroversial that Socrates displays considerable contempt towards rhetoric in theGorgias,the title of this paper might strike one as an oxymoron. Indeed, a reading of the text has more than once encouraged scholars to posit an Opposition between the elenctic procedures championed by Socrates and the rhetorical procedures of his interlocutors. At least three features have been highlighted that seem to indicate this contrast:1.the Socratic interest in short questions and answers versus his interlocutors’ use of long speeches(makrologia);2.the (...) Socratic interest in truth regardless of the opinion of the many, the latter seeming an important concern of the rhetorician;3.the supposed Socratic appeal to the intellectual powers of the interlocutor, which is usually contrasted with the appeal to the emotions which is distinctive of rhetoric. If the ancient Stoics conceived passion as a judgment or the consequence of a judgment referring to external reality, it is correct to define their conception of the psyche as ‘monistic’; it is very different if we consider that passion is due to another faculty independent of reason. In this second case, a scenario opens up in which a realistic and ‘reified’ conception of passion emerges. With reference to this, in theLetter113 Seneca discusses the paradoxical thesis of the ancient Stoic (...) scholars according to whom “the soul is an animal”, just as virtues and passions are. Through a series of close logical arguments, he shows the absurdities that can be reached in this way. By comparing this letter with theDe irawe can define the position of Seneca as a type of practical/operational imaginary dualism: the development of an original coherent form of monism. Not to give in to passion (for example to anger or libido) will not be just or not so much a psychological exercise of reason and will, but certainly a physical experience of resistance. (shrink)

Over the last decades we have seen an increased interest in forensic rhetoric in Plato's dialogues, notably in relation to hisApology. However, little interest has been paid to this strain of rhetoric in relation to theGorgias. In this article I focus on one notion, βοήθεια, as it was discussed in Plato'sGorgias. This notion had a wide currency in forensic rhetoric in classical Athens.

By briefly sketching some important ancient accounts of the connections between psychology and moral education, I hope to illuminate the significance of the contemporary debate on the nature of emotion and to reveal its stakes. I begin the essay with a brief discussion of intellectualism in Socrates and the Stoics, and Plato's and Posidonius's respective attacks against it. Next, I examine the two current leading philosophical accounts of emotion: the cognitive theory and the noncognitive theory. I maintain that the noncognitive (...) theory better explains human behavior and experience and has more empirical support than the cognitive theory. In the third section of the essay I argue that recent empirical research on emotional contagion and mirroring processes provides important new evidence for the noncognitive theory. In the final section, I draw some preliminary conclusions about moral education and the acquisition of virtue. (shrink)

It is often held that Plato did not have a viable account of interpersonal love. The account of eros—roughly, desire—in the Symposium appears to fail, and, though the Lysis contains much suggestive material for an account of philia—roughly, friendship—this is an aporetic dialogue, which fails, ultimately, to provide an account of friendship. This paper argues that Plato's account of friendship is in the Phaedrus. This dialogue outlines three kinds of philia relationship, the highest of which compares favourably to the Aristotelian (...) notion of love for another ‘for their own sake’. In contrast to the account of eros in the Symposium, this gives Plato an account of interpersonal love that meets some of the requirements laid down by Gregory Vlastos for a satisfactory account of interpersonal love. There is a long tradition in philosophy of blaming passions for our unhappiness. If only we were more rational, it is claimed, we would live happier lives. I argue that such optimism is misguided and that, paradoxically, people with desires, like us, cannot be both happy and rational. More precisely, if someone rational has desires he will not be fully happy, and if he has some desires that are rational and – in a yet-to-be-specified sense – demanding, he will be (...) frankly unhappy. Call this claim Rational Pessimism. The argument for Rational Pessimism can be considered as a variation on a Schopenhauerian argument that bluntly claims that, because desires involve lack and suffering, desiring souls like us cannot be happy. I argue that, even if Schopenhauer’s argument escapes most attacks that have been targeted against it, it faces decisive empirical objections. I argue that Schopenhauer’s argument can, however, be rescued if it is assumed that we are rational. (shrink)

On the one hand, Hume accepts the view -- which he attributes primarily to Stoicism -- that there exists a determinate best and happiest life for human beings, a way of life led by a figure whom Hume calls "the true philosopher." On the other hand, Hume accepts that view -- which he attributes to Scepticism -- that there exists a vast plurality of good and happy lives, each potentially equally choiceworthy. In this paper, I reconcile Hume's apparently conflicting commitments: (...) I argue that Hume's "Sceptical" pluralism about the character of the happiest life need not conflict with his "Stoic" advocacy of the supreme happiness of the true philosopher, given Hume's flexible understanding of how one might live as a true philosopher. Many transhumanists see their respective movement as being rooted in ancient ethical thought. However, this alleged connection between the contemporary transhumanist doctrine and the ethical theory of antiquity has come under attack. In this paper, we defend this connection by pointing out a key similarity between the two intellectual traditions. Both traditions are committed to the “radical transformation thesis”: ancient ethical theory holds that we should assimilate ourselves to the gods as far as possible, and transhumanists hold that we should (...) enhance ourselves beyond the physical and intellectual parameters of being human so as to become posthuman. By considering the two views in tandem, we develop an account of the assimilation directive that is palatable to contemporary readers and provide a view of posthumanism worth wanting. (shrink)

Since the Phaedo characterizes Socrates’s death as a punishment by Athens, many scholars argue that he could neither have been responsible for nor have intended his death, so that his death was not suicide. This is no mere semantic quibble: the question turns on issues of responsible and intentional action. I argue that the dialogues portray Socrates as committing suicide. To do so, I use a Platonic account of responsibility and intention to show how Athens and Socrates were jointly responsible (...) for Socrates’s death and that his intention was not only to do what justice requires but also to kill himself. In Talking to Strangers, Danielle Allen argues that democratic citizens will need to acquire new habits for contending with distrust in order to prolong the democratic experiment. Though Allen's solution recalls her reading of the Republic, it is to Aristotle, not Plato, that she turns for help theorizing those habits. Drawing upon the Nicomachean Ethics, she proposes arts or techniques that might substitute for and outpace justice by enabling democratic strangers to treat one another like friends. While I endorse Allen's (...) analysis of the problems posed by rising levels of distrust, I propose a different solution. First, I argue that the habits Allen describes would have to be virtues and not merely techniques in order to effect real political change. Then, second, I identify those habits as “piety” and “gratitude”—virtues which, I contend, are not so much substitutes for as supplements to justice. My argument thus elaborates Thomas Aquinas's account of justice and its “potential parts” in the Summa Theologiae. (shrink)

In Nicomachean Ethics X.7–8, Aristotle defends a striking view about the good for human beings. According to Aristotle, the single happiest way of life is organized around philosophical contemplation. According to the narrowness worry, however, Aristotle's contemplative ideal is unduly Procrustean, restrictive, inflexible, and oblivious of human diversity. In this paper, I argue that Aristotle has resources for responding to the narrowness worry, and that his contemplative ideal can take due account of human diversity.

This paper explores the potential for psychic conflict within Seneca's moral psychology. Some scholars have taken Seneca's explicit claim in De Ira that the soul is unitary to preclude any kind of simultaneous psychic conflict, while other interpreters have suggested that Seneca views all cases of anger as instances of akrasia. I argue that Seneca's account of anger provides the resources for accommodating some types of simultaneous psychic conflict; however, he denies the possibility of psychic conflict between two action-generating impulses, (...) thus rejecting the phenomena of genuine akrasia and enkrateia. Although superficially counterintuitive, Seneca's cognitivist account of anger, according to which anger is complex and requires assent to the propositions that ‘I have been wronged’ and ‘I ought to seek revenge’, renders his denial of akrasia and enkrateia more plausible. In this paper I argue that, according to Plato’s Statesman, true statesmen directly control, administer, or govern none of the affairs of the city. Rather, administration and governance belong entirely to the citizens. Instead of governing the city, the task of the statesman is to facilitate the citizens’ successful self-governance or self-rule. And true statesmen do this through legislation, by means of which they inculcate in the citizens true opinions about the just, the good, the fine, and the opposites of (...) these. (shrink)

The early Stoics diagnose vicious agents with various psychological diseases, e.g. love of money and love of wine. Such diseases are characterized as false evaluative opinions that lead the agent to form emotional impulses for certain objects, e.g. money and wine. Scholars have therefore analyzed psychological diseases simply as dispositions for assent. This interpretation is incomplete, I argue, and should be augmented with the claim that psychological disease also affects what kind of action-guiding impressions are created prior to giving assent. (...) This proposal respects the Stoic insistence that impression-formation, no less than assent, is an activity of reason. In so far as the wine-lover’s reason is corrupted in a different way from the money-lover’s, the two vicious agents will form different action-guiding impressions when faced with similar stimuli. Here I juxtapose the Stoic account of expertise, according to which experts form more precise action-guiding impressions compared to the amateur, in virtue of possessing a system of grasps (katalēpseis). So expertise enhances, whereas psychological disease degrades, the representational fidelity of the impressions that prefigure action. With these commitments, the Stoics can be seen to offer a nuanced and principled theory of cognitive penetration and to anticipate some recent proposals in epistemology and cognitive science. This article aims to shed light on both the foundations and the consistency of the position regarding akrasia Xenophon attributes to Socrates in the Memorabilia. As does Plato's Socrates, Xenophon's Socrates maintains that akrasia is impossible in the presence of knowledge. On the other hand, he differs from the platonic Socrates by granting to enkrateia, instead of knowledge, the role of foundation for virtue. If enkrateia is the very condition for acquiring knowledge and virtue, consequently the responsibility for countering akrasia (...) falls to enkrateia. (shrink)

The spirited part, thumos, plays a complex and often disputed role in Plato's account of the soul. The doctrine of the soul as specifically tri‐partitioned seems to depend on a substantial conception of thumos as fundamental and non‐reducible. Building on John Cooper's contribution in the discussion of the topic, this article aims to show that the role of thumos is characterised by an indispensable, deep‐rooted urge for dignified self‐preservation. The view is supported by Plato's own examples, and discussed with regards (...) to Myles Burnyeat's account of thumos as an essentially social phenomenon. The main claim is that in order to preserve the Platonist idea of thumos as fundamental one should discard Burnyeat's characterisation of thumos as unequivocally social, and instead advocate a view of thumos as concerned with a particular form of self‐preservation, which Cooper's account suggests, but does not fully elaborate. In Aristotle's views on cognition a series of terms – hupolêpsis, doxa, and epistêmê – play key roles. But it has not been noticed that each of these comes in two kinds – one unqualified and the other qualified. When these and their interrelations are properly explored, a deeply systematic picture of cognition emerges, in which doxa is best understood as ‘belief’, hupolêpsis as ‘supposition’, and epistêmê as a sort of belief, so that – contrary to orthodoxy – we can (...) have belief and knowledge of the same things at the same time. Many of these conclusions are shown to mark a continuity with Plato, in that neither thinker, it is argued, holds a so-called ‘two-worlds’ picture of cognition. (shrink)

ABSTRACT The Gorgias presents us with a mystery and an enigma: Who was Callicles? And, what was Plato trying to accomplish in this dialogue? While searching for the identity of Callicles, we gain a better understanding of Plato's purpose for this dialogue, which is to use justice as a means for staking out the boundaries of four types of rhetoric. This article argues that Plato uses the Gorgias to reveal the deficiencies of sophistic nomos-centered rhetorics and an unjust sophistic phusis-centered (...) rhetoric, opening the door for a “true” rhetoric that he articulates in the Phaedrus and a universal justice based on virtue that he describes in the Republic. I begin by describing certain central features of a prominent Anglophone approach to Platonic virtue over the last few decades. I then present an alternative way of thinking about virtue in Plato that shifts central concern away from moral psychology and questions about virtue's relationship to happiness. The approach I defend focuses on virtue, both as a supreme aim of a person's actions and as something whose nature needs to be determined.

La filosofía política platónica está atravesada por una marcada preocupación epistemológica, sobre cuya base Platón adopta el así llamado “intelectualismo socrático”, lo cual implica un rechazo tajante del actuar incontinente o _akrasía_. En el presente trabajo intentaremos mostrar que el propio Platón llevó adelante una revisión de dicha posición, ante todo debido a un cambio profundo en su concepción de la naturaleza humana en el diálogo _Leyes_.

Plato’s Politicus argues for a striking normative claim about the law: the ideal expert ruler will not only change the laws of the city when he thinks it best, but will also contravene them. The Eleatic Stranger’s argument for this conclusion reveals important features of Plato’s views on expertise in general, and political expertise in particular. Laws should not be inviolable for an expert ruler because no craft lays down inviolable rules for its practitioners. There are no inviolable rules of (...) action for experts because crafts are teleological: expert action aims only to produce some good. The expert ruler’s political action recognizes no constraints besides the aim of best promoting the good condition of the whole city. Plato believes that the statesman will do markedly better at promoting this end when unconstrained by even the best laws, and there is evidence that he will harm individual citizens in order to do so. Mientras que la corriente principal de la filosofía moral moderna da por supuesto que la situación típica en los juicios morales debiera ser la de certeza, la filosofía moral de Aristóteles está dominada por la idea de verosimilitud. Su concepto central, el de virtud, está doblemente penetrado por aquella idea, tanto en su aspecto psicológico como en el epistemológico: no sabemos con certeza, sino sólo con probabilidad, en qué consiste por ejemplo la acción generosa en general ni tampoco en el (...) caso concreto. Cette contribution vise à étudier les effets que l’amour des richesses a sur le caractère moral et les relations sociales, depuis les descriptions qu’en donne Platon au livre VIII de la République à travers le portrait de l’homme oligarchique, jusqu’à la déclinaison des quatre formes de l’avarice dans le traité des Caractères de Théophraste, dans lequel l’argent et les échanges marchands constituent par ailleurs un thème récurrent et structurant. On remonte avec Platon aux sources psychologiques de l’amour des richesses avant (...) d’en développer les conséquences morales, et, avec Théophraste plus particulièrement, les conséquences sur les relations de l’individu aux autres. In thePolitics, Aristotle maintains, contrary to his predecessors, that there is a distinctive mode of authority that husbands should exercise over their wives. He even coins a word for it: γαμιϰή, ‘the marital art’ or ‘marital rule’ (Pol. 1.3, 1253b8–10; 1.12, 1259a37–9). Marital rule is supposed to differ from the authority that fathers have over their children and from the kind of rule that citizens exercise over one another. Yet it is not clear whether there is any conceptual space between (...) political and paternal rule for marital rule to occupy. Where fathers rule and children are ruled, citizens take turns ruling and being ruled. Husbands, however, either share their rule with their wives, or they do not. If they do not, then marital rule seems indistinct from paternal rule; if they do, then it seems indistinct from political rule. To add to the confusion, Aristotle says that husbands properly rule their wives politically, but without alternating in positions of ruling and being ruled. On its face, this idea seems flatly contradictory. Political rule just is shared, reciprocal rule, and so if the husband rules permanently and his wife is merely ruled, then his rule cannot be political. So Aristotle's own description of marital rule appears inconsistent, and in any case it is difficult to see how marital rule could have the distinctive character that he insists it does. (shrink)

W tekście zajmujemy się przeobrażeniami, jakie na przestrzeni wielu stuleci zaszły w rozumieniu uprawnień. W związku z tym interesują nas też zmiany w roli nadawanej skorelowanym z nimi obowiązkom oraz sprawiedliwości. Wychodząc od pierwotnego (obiektywnego) sensu praw jako przedmiotu sprawiedliwości, przechodzimy do nowożytnego podmiotowego (subiektywnego) ich rozumienia. Twierdzimy, że konsekwencją opisywanej transformacji jest zmiana struktury uzasadnienia praw. Mamy na myśli to, że prawa, pierwotnie uzasadniane regułami sprawiedliwości i równoważne obowiązkom, stały się od sprawiedliwości niezależne, a nawet, że tę ostatnią zaczęto (...) rozumieć jako regułę urzeczywistniania autonomicznie ustanawianych benefitów (czyli substancjalnie wziętych praw). This project explores the topic of dependency of happiness on external goods in Nicomachean Ethics. In this project I defend the following thesis: the dependency of happiness on external goods, in EN, is interpreted in the light of its political self-sufficiency, and in the light of our political humanity; this dependency is of three kinds: 1) enhancing-instrumental, 2) constitutive, and 3) subsistent. The political self-sufficiency of happiness means that, the ultimate good of man, the good of the ruling science of (...) Politics, is self-sufficient based on the self-sufficiency of the city. According to Aristotle, every human being, by nature, is political. The nature of every human being is fundamentally relational. We are what we are, among and with others in the city. This constitutive political human nature functions best only in the city. Based on this political anthropology I interpret the dependency of the human political good on external goods in EN. In refutation of hedonism, Nozick offered a hypothetical thought experiment, known as the Experience Machine. This paper maintains that end-of-life-suffering of the kind that is resistant to state-of-the-art palliation provides a conceptually equal experiment which validates Nozick’s observations and conclusions. The observation that very many terminal patients who suffer terribly do no wish for euthanasia or terminal sedation is incompatible with motivational hedonism. Although irreversible vegetative state and death are equivalently pain-free, very many people loath the former even at the (...) price of the latter. This attitude cannot be accounted for by hedonism. Following these observations, the goals of palliative care are sketched along four circles. The first is mere removal or mitigation of noxious symptoms and suffering. The second targets sufferings that stymie patients’ life-plans and do not allow them to be happy, the third targets sufferings that interfere with their pursuance of other goods (palliation as a primary good). The fourth is the control of sufferings that do not allow the person to benefit from any human good whatsoever (“total pain” or critical suffering). Only in the fourth circle are people hedonists.
