Current bans on sports and drugs rest on inadequate grounds. Prohibitions on drugs in sports should rely more on what it is permissible to ban, not on what "must" be banned. Further permissible prohibitions should enjoy democratic support at levels.

Though many scholars have made claims as to the nature of sport, this article argues that these claims tend to narrowly focus on modern ideas derived primarily from Western competitive sport. Thus, most notions of sport fail to capture how various historical and non-Western cultures valued sport. In an attempt to provide a broader and more durable description of the nature of sport, this article argues that sports are fundamentally about telling a story about ourselves. These stories are meaningful narratives. (...) Meaningful narratives, the article argues, exist in three ways: the individual, the collaborative, and the collective. By seeing sport as inherently about ‘a story we tell ourselves about ourselves’, the article concludes that not only do philosophers realize a more complete understanding of what sport is about but also receive and apply this understanding to normative debates within sport ethics. But we add a new argument that we believe places the moral burden on those who favor doping in sports. We also defend our position against some important concerns that might be raised against it. Two of the major arguments against performance-enhancing drugs (PEDs), appealing to fairness and the protection of athletes’ health, have serious flaws. First, there is no relevant moral distinction between the use of PEDs and the use of other performance enhancers that introduce unfairness and that we accept nonetheless. Second, prohibiting PEDs for athletes’ own good ignores the fact that adult athletes are constantly making tradeoffs to improve performance and pursue excellence, including sacrificing their health. We should not paternalistically impose our (...) values on them. On the other side, arguments to allow ‘safe’ PEDs provide no normative criterion to determine the acceptable level of risk, thus begging the question. The reasonable athlete argument solves both sets of problems: it justifies a ban on some performance-enhancing drugs based on health and fairness, while avoiding paternalism, and it also establishes a non-arbitrary standard to determine which drugs ought to be allowed. First, if unsafe PEDs were allowed, some athletes would refuse to take them out of concern for their health. This is a reasonable decision even though it would put them at a competitive disadvantage against athletes who choose to use unsafe PEDs. It would be unfair for clean athletes to suffer a competitive disadvantage for acting reasonably. Therefore, PEDs that pose significant health risks should be prohibited for all athletes. Second, it would be unreasonable for athletes to refuse, on principle, relatively safe and effective PEDs, so a blanket prohibition is also unjustified. Which drugs and which doses to allow should be determined not by athletes’ actual choices but by the hypothetical choices of the reasonable athlete. The resulting sport-specific drug policy would carve a justifiable middle path between complete prohibition and complete permission. (shrink)

ABSTRACT It is argued that sport, like science or medicine, is a valued human practice and is characterised as much by the moral manner in which its participants conduct themselves as by the pursuit of its own skills, standards and excellences. Virtues, such as justice, honesty and courage, are not only necessary to pursue its goals but to protect it from being corrupted by external interests. After explicating the practice view of sport in contrast to the sociological view, the nature (...) of competition in sport is discussed before examining two related issues: winning at all costs and the taking of performance-enhancing drugs. Until recently, the problem of traumatic brain injury in sports and the problem of performance enhancement via hormone replacement have not been seen as related issues. However, recent evidence suggests that these two problems may actually interact in complex and previously underappreciated ways. A body of recent research has shown that traumatic brain injuries, at all ranges of severity, have a negative effect upon pituitary function, which results in diminished levels of several endogenous hormones, such as growth hormone and gonadotropin. (...) This is a cause for concern for many popular sports that have high rates of concussion, a mild form of TBI. Emerging research suggests that hormone replacement therapy is an effective treatment for TBI-related hormone deficiency. However, many athletic organizations ban or severely limit the use of hormone replacing substances because many athletes seek to use them solely for the purposes of performance enhancement. Nevertheless, in the light of the research linking traumatic brain injury to hypopituitarism, this paper argues that athletic organizations’ policies and attitudes towards hormone replacement therapy should change. We defend two claims. First, because of the connection between TBI and pituitary function, it is likely many more athletes than previously acknowledged suffer from hormone deficiency and thus could benefit from hormone replacement therapy. Second, athletes’ hormone levels should be tested more rigorously and frequently with an emphasis on monitoring TBI and TBI-related issues, rather than simply monitoring policy violations. (shrink)

In 1984, a number of US cyclists used blood transfusions to boost their performance at the Los Angeles Olympic Games. The cyclists broke no rules and dominated the Games, yet were later maligned as cheaters and dopers?they had, it seemed, violated some important norm, albeit one which was neither an official rule nor otherwise easily identifiable. Their case illustrates the moral ambiguity that arises when a performance enhancement is employed in a sport that has not addressed it. This article takes (...) up the crucial question posed by such moral ambiguity: is it ethical to enhance performance through a substance or technology when no rules exist to prohibit it? We first examine ordinary ethical obligations that athletes carry based on their status as moral agents. We conclude that such obligations provide some guidance, but cannot resolve the issue. We then examine arguments that take sport as a unique social practice that presents its own moral obligation not to use performance enhancers. We argue that these ?spirit of sport? arguments, developed by McNamee and Loland and Hoppeler cannot resolve the issue either. We conclude that when the rules governing sport are silent on the issue of performance enhancement the constraints on its ethical use are limited at best. (shrink)

Sport doping is not a recent phenomenon. Athletes have used many forms of performance enhancements going back to antiquity. Within the sport philosophy literature, sport doping is entangled in a multitude of ethical discourses, some denouncing, and some supporting, doping in sport. Our aim is to use a systematic approach to classify ethical discourses put forward by scholars focused on doping. To take stock of these ethical discourses, and to advance the sport philosophy literature on doping, this paper provides an (...) empirical account of the types of arguments used in the peer-reviewed sport philosophy literature. This empirical account is intended to provide a map of the ethical discourses in circulation, to highlight the most common arguments, and to show where other types of arguments are absent or less well developed. To map the ethical discourses, the authors use an ethical discourse typology from a university-based ethical reasoning program. (shrink)

This paper considers the relevance of human genetics as a case study through which links between bioethics and sport ethics have developed. Initially, it discusses the science of gene-doping and the ethics of policy-making in relation to future technologies, suggesting that the gene-doping example can elucidate concerns about the ethics of sport and human enhancement more generally. Subsequently, the conceptual overlap between sport and bioethics is explored in the context of discussions about doping. From here, the paper investigates the ethics (...) of gene-doping, arguing that a straightforward mapping of medical ethics onto sport ethics is not justified. In conclusion, it argues that gene-doping is consistent with a broader ethics of enhancement within elite sports. Moreover, the increased legitimacy of lifestyle medicine in society is likely to reduce the relevance of an anti-doping programme that is concerned with protecting the integrity of an alleged natural athlete. "Sport, Tradition and Freedom" entails a philosophical examination of the relationship between traditions of rationality and understandings of freedom in sport. Chapter One introduces the ideas of freedom and virtue. Chapter Two involves a critical and historical exploration of the traditions of conservatism, liberalism and Marxism and the effects that these traditions have had on accounts of freedom in sport. Chapter Three examines the issue of freedom in sport from a social critical-formalist perspective, particularly addressing the influence that the process (...) of commodification in advanced capitalism has had on sport. It also endeavours to suggest that the virtues, as explained by Alisdair Maclntyre, are important to the protection of formal freedom in sport, from the effects of advanced capitalism. Chapter Four examines the link between the modern liberal tradition and the virtue tradition. This link is made via the ideas of self-determination and authentic social unions which both traditions share. This chapter also investigates the influence that these various traditions have had on the framing and solution to issues in sport, using the drug issue as a paradigm case. The conclusion suggests that it may be profitable to explore the rationality of less dominant traditions in society when investigating sport. Inquiry revealed that many traditions of understanding in sport rely heavily on elements from political traditions in society. Freedom in sport has been linked to conservative notions of a craft, to liberal notions of play and the independent individual and to accounts of freedom which support the dominant capitalist institutions of society. The examination by social critical theorists of the freedom of authentic social practices and the location of this freedom in the formal rules of sport, provided an alternative to these previous explanations which had located freedom in either the attitude of the player or the economic institutions of society. On the formalist view of sport, freedom is located in the pursuit of gratuitous difficulty, which the rules of sport make possible. The protection of this freedom from social abrogation involves virtue, the formation of authentic social unions, and judgement in sporting participation. The concluding chapter suggested that the protection of formal freedom and the importance of judgement and "seeing without illusion" in sport is critical to issues such as feminism, professionalism and creativity in sport. (1) Background: The World Anti-Doping Agency (WADA) utilizes three criteria to include a technology in the List of Banned Substances and Methods—performance enhancement, health, and the spirit of sport. The latter is arguably the most fundamental one, as WADA justifies the anti-doping mission by appealing to it. (2) Method: Given the interrelationship among the notions of “human nature,” “natural talent,” and “sport,” I investigate what view of human nature underpins the “spirit of sport” criterion. To do so, I focus on (...) both WADA’s official documents and scholarly formulations of the spirit of sport (that align with that of WADA). (3) Results: I show that the value attributed to excellence and effort in WADA’s formulation of the “spirit of sport” criterion has its roots in the notion of human nature of the work ethic that resulted from the secularization of the Protestant ethic. (4) Conclusion: Drawing on my analysis of the “spirit of sport” criterion, I pose critical questions concerning the justification of WADA’s anti-doping campaign and a tentative solution to move forward in the debate.
