The global city is a contested site of economic innovation and cultural production, as well as profound inequalities of wealth and life chances. These cities, and large cities that aspire to ‘global’ status, are often the point of entry for new immigrants. Yet for political theorists (and indeed many scholars of global institutions), these critical sites of global influence and inequality have not been a significant focus of attention. This is curious. Theorists have wrestled with the nature and demands of (...) global justice, but have for the most part supposed that the debate is between statist and cosmopolitan formulations. Questions of redistribution, immigration, humanitarian obligations, coercion at borders, and territorial rights have correspondingly been cast as either the domain of sovereign territorial states, or of the nascent web of supranational institutions that might bind those states and peoples, morally and legally. Examining some of these issues and arguments through the lens of the global city casts them in a new and informative light, and buttresses an associative turn in thinking about global justice. The relationship between Prospero and Miranda is fairly typical for Shakespeare’s way of portraying parental authority and filial obligation. A strong and authoritative father, an absent mother and a rebellious daughter are character types reused in many of his plays. In The Tempest, authority, power and ownership, be it political or domestic, are important themes. In criticism, Prospero is frequently discussed through the prism of his attitude to his “subordinates”—Ariel, Caliban and Miranda—and the play’s narrative is interpreted in the context (...) of the theatre of power. Parental authority, a social construct, is a dynamic thing, and the Renaissance patterns discernible in Shakespeare’s plays are refashioned and changed in contemporary adaptations and appropriations of his plays. Informed by New Historicism and Cultural Materialism in relation to gender studies, this article seeks to examine the changing dynamics of the Prospero-Miranda relationship in three films—Derek Jarman’s, Paul Mazursky’s, and Julie Taymor’s —as well as Philip Osment’s 1988 play This Island’s Mine. Focusing on the issue of authority, power and ownership, the article aims at showing how stereotypical social and gender roles resonate with various political contexts of power. (shrink)

G.A. Cohen and David Estlund claim that, because of their fact-dependent nature, constructivist theories of justice do not qualify as moral theories about fundamental values such as justice. In this paper, I defend fact-dependent, constructivist theories of justice against this fact-independency critique. I argue that constructivists can invoke facts among the grounds for accepting fundamental principles of justice while maintaining that the foundation of morality has to be non-empirical. My claim is that constructivists ultimately account for the normativity of fact-dependent (...) principles by referring to a fact-independent, moral conception of the person, which is not a principle of justice.1. The paradoxes and dilemmas of social choice theory can be taken as an argument against a certain view of democracy: For the identity theory democracy represents a collective actor standing for aggregated individual interests. According to a second model of society, democracy has its normative basis in structural traits of interaction and cooperation. Within the formal theory of politics both the Arrow-Theorem and the Liberal Paradox undermine the identity theory and give us reasons for the second, the normative theory which (...) takes democracy as being constituted by structural rules. There is a gap between self-interest and morality that is caused not only by individual shortcomings but also by the interdependence of the outcome of individual action with the actions of others. If the others can be expected to be ethical this uncertainty about the others’ behaviour is reduced but not eliminated. Failure of economic motivation will be followed by failure of ethical motivation. Christianity or monotheistic religion in general comes into the picture to assure ethical behaviour of being advantageous (...) in the long run. In the 1930s, socialist economists used the assumptions of equilibrium theory to argue that a central planner could coordinate supply and demand from above. This argument led Hayek, over the years, to try to explain the limitations of equilibrium theory and, conversely, to explain how capitalism functioned without the assumptions of equilibrium being met. In a changing world of agents who are ignorant of the future, how is a functioning market “order” possible? One answer can be found in Hayek's argument (...) that evolved rules make people's future behavior more predictable and, more to the point, that they contain previously accumulated knowledge that provides the building blocks for future economic growth. Hayek's evolutionary theory was flawed, however, in failing to explain how people can know which rules are responsible for their success or failure so that they persist in using those rules and pass them forward in time. However, markets provide immediate feedback about success and failure through profits and losses. An evolutionary explanation of the economy would have permitted Hayek to dispense with the metaphor of general equilibrium, which was increasingly irrelevant to his understanding of economic order. A biochemical pathway is a sequence of chemical reactions in a biological organism. Such pathways specify mechanisms that explain how cells carry out their major functions by means of molecules and reactions that produce regular changes. Many diseases can be explained by defects in pathways, and new treatments often involve finding drugs that correct those defects. This paper presents explanation schemas and treatment strategies that characterize how thinking about pathways contributes to biomedical discovery. The debate over gun control has taken place in complete isolation from geographical considerations. It focuses on, for the most part, whether legalization would bring about more or fewer accidental deaths, and murders of innocents, than prohibition, and in the USA on the precise meaning of the second amendment to the Constitution. However, these deliberations, argue the authors of the present paper, can be enriched by incorporating into them a spatial context. The transhumanist movement is much more than a simple utopia, a new school of thought or a fashionable ideology; as a matter of fact, it is a scientific and philosophical project that is already underway, and defends the use of the most advanced emerging new technologies —from biogenetics to computing, from nanotechnology to cognitive sciences, to robotics and Artificial Intelligence— with the clear goal to exponentially increase the physical, cognitive, sensory, moral and emotional capabilities of human beings. Transhumanism entails a (...) change in the anthropocentric paradigm defended by humanism, and aims to break through the limits of nature, which until recently we deemed insurmountable, in order to create a new species that is more evolved than the Homo sapiens: the Homo excelsior, a posthuman species which is superior to ours, composed by exceptionally gifted beings that have been genetically selected, designed and improved and which —according to the transhumanist imaginary— will dominate the posthuman future and will be happier, more virtuous, long-lived and intelligent than us. In this article, we propose technological humanism as an intermediate formula in the doctrinal debate between bioprogressive and bioconservative legal philosophers, so as to make possible the development of scientific research and the advancement of new technologies, although without ever having to sacrifice dignity and liberty, which are inherent qualities of the human being (who has to be viewed, in Kantian terms, as an end in itself). We present a high-level declarative programming language for representing argumentation schemes, where schemes represented in this language can be easily validated by domain experts, including developers of argumentation schemes in informal logic and philosophy, and serve as executable specifications for automatically constructing arguments, when applied to a set of assumptions. This new rule language for representing argumentation schemes is validated by using it to represent twenty representative argumentation schemes.

Our relationship with technology has become co-dependent and somehow a personal and an intimate one. Generally speaking, we tend to think that we experience the world around us as it is, but that is not what we really do. In a lifetime, we learn and store knowledge, but we only use from it what we think and feel it will help us to realize the most important projects in our lives. Therefore, we invent things that have the purpose to make (...) our lives easier, just to have time to manage and work on the other part of life – the non-material part of it -, that concerns the personal development of human. First of all, that is or that should be the idea for developing technology, but on second thoughts, we somehow fail to adapt to it, and from that it deceives us – transforming itself in an insecurity, like high-tech products that are too hard to use, or too unreliable to be counted on, the lack of necessary knowledge in order to use it, the costs. Even if we have these technologies as available, we manage to lose ourselves, by becoming more into it than into us and those around us. We like to think we possess knowledge, that we are experts in some areas, we hold and keep lectures on ethics, moral values, efficient communication, but all become a strategic action – from ones that have the power to others that need guidance and confirmation for looking good for others, to win over, convince or convert new adepts to the proposed ideas of ones that have the power, to court those in power, to please everyone, except yourself. But all of that leads to failure – a self-failure, an inner weakness – and we are becoming our own adversaries, which are silent ones. But if technology is so worthy, why we do not manage so well on moral and ethical aspects? (shrink)

In this paper, I examine the conflicts between autonomy and justice. The problem of justice in healthcare concerns both micro-allocation and macro-allocation. The latter has to do with distributive justice: who should get what healthcare resources at whose expense. The current debate about healthcare reform brings up two competing models of distributive justice from political philosophy. The libertarian theory holds to the ideal of individual responsibility and choice, viewing taxation for the purpose of providing goods to those who cannot afford (...) them as a form of unjustified coercion. The liberal theory holds that society should ensure that all members are provided with basic goods that correct for inequalities that deprive them of human dignity. Even though both theories value individual choice, these theories provide opposing answers to the question of whether taxes should be collected and used for the purpose of ensuring universal access to healthcare. In my paper, I show that neither theory can respect patient choice in healthcare and achieve distributive justice. Libertarians ignore the realities of the healthcare system and why a free market where patients choose and pay for what they want cannot exist. Liberals face the problem that the choices that patients make can lead to over-consumption of healthcare at the expense of other goods important to society. (shrink)

There are three main approaches to scientific explanation in the philosophical literature. The unification approach claims that science explains by fitting the particular facts and events within a general theoretical framework. The mechanistic approach claims that science explains by identifying mechanisms. According to the manipulationist approach an explanation ought to be such that it can be used to answer a “what-if-things-had-been-different question.” The article examines whether these three approaches are compatible or not in the case of the social sciences, and (...) it concludes by defending explanatory pluralism. En este artículo sostengo que por más “fascinante” que resulte para muchos filósofos la posibilidad de dirigir los nacimientos, ésta requiere de una crítica ética. Sostengo también que el carácter ético de la eugenesia depende de las distintas biotecnologías (por selección o por manipulación genética) con los que ella puede realizarse, de los distintos modos (terapéutica o de diseño) y los diferentes niveles (en la línea somática o en la germinal). Se trata de una cuestión multívoca, cuya diferenciación es analizada (...) desde una “ética situacional” atenta a los siguientes aspectos: nuestra responsabilidad ante el conocimiento genómico, los riesgos de la manipulación genética, la libertad versus el determinismo de los sujetos intervenidos, la equidad social y el equilibrio entre el interés eugenésico y la atención a otros males que aquejan al mundo actual. La conclusión final es que, a pesar de ciertos problemas éticos, conviene aceptar la eugenesia hecha por selección y por manipulación de enfermedades monogénicas y, en cambio, seguir cuestionando la eugenesia frente a enfermedades polígénicas y el diseño de los hijos y de la especie humana. The essay "The Problem of Global Distributive Justice in The Law of Peoples by John Rawls" is concerned with the question of distributive claims of justice in the global realm. The conception of international justice developed by John Rawls in his book The Law of Peoples offers a very limited kind of distribution of goods beyond state borders, where the matter of the distribution of wealth is restricted to a single state. The Rawlsian point of view is frequently objected to (...) by proponents of so-called cosmopolitanism, like Thomas Pogge or Charles Beitz, who argue for globalizing Rawlsian justice as fairness. Five objections that may be raised against the Rawlsian idea of limiting the scope of distributive justice are analysed: the consistency problem; the status of the principles of the law of peoples; the method of justification; the self-sufficiency of states; and tolerance. This essay considers how Paul Ricoeur’s philosophy, including his philosophical hermeneutics and narrative theory, could be employed to facilitate dialogue and understanding between feminists from different contexts. Authors such as bel hooks and Hélène Cixous frame feminist tenets of liberation from sexual oppression and validation of the body as a source of knowledge. Weaving together Ricoeur’s writing and theories with the work of two feminist scholars, Trinh T. Minh-ha and Grace M. There is a disparity between the multitude of apparently successful expert system prototypes and the scarcity of expert systems in real everyday use. Modern tools make it deceptively easy to make reasonable prototypes, but these prototypes are seldom made subject to serious evaluation. Instead the development team confronts their product with a set of cases, and the primary evaluation criterion is the percentage of correct answers: we are faced with a “95% syndrome”. Other aspects related to the use of the (...) system are almost ignored. There is still a long way to go from a promising prototype to a final system.It is maintained in the article that a useful test must be performed by future users in a situation that is as realistic as possible. If this is not done claims of usefulness cannot be justified. It is also stated that prototyping does not make “traditional” analysis and design obsolete, although the contents of these activities will change.In order to discuss the effects of using the systems a distinction between expert systems as media, tools and experts is proposed. Let's think such problems as cloning, transgenic organisms, Human Genom Project, DNA diagnostics and therapy, the geneticalisation of society etc. While the gene manipulation develops rapidly the necessary social control is missing. Regarding the social co-ordination of gene technology, the decision-makers still excessively trust in the institution of market and in the experts' competence.

L’interprétation d’un acte de violence de masse est toujours délicate puisqu’elle confère un certain statut au groupe visé. Ce statut peut devenir un facteur important dans la décision de la communauté internationale de reconnaître ou non l’indépendance d’un groupe et de son territoire. Cet article examine le cas de la reconnaissance du Kosovo par la communauté internationale, en février 2008, et soutient que cette reconnaissance a été rendue possible par l’utilisation d’arguments basés sur le statut collectif de victime de nettoyage (...) ethnique détenu par la population albanaise du Kosovo. L’article comble le fossé entre, d’un côté, la théorie de la sécession comme réparation, et de l’autre, les travaux sur la violence de masse contre les groupes ethnonationaux. L’analyse montre que la pratique de la reconnaissance étatique a été réorientée vers un critère restrictif lié au type de violence subie par le groupe réclamant l’indépendance. Dans cette optique, le territoire devient une forme tangible de compensation pour les injustices subies, ce qui tranche par rapport à la pratique antérieure de la reconnaissance étatique dans l’ex-Yougoslavie et ailleurs.The interpretation of an act of mass violence is always a contentious issue since it confers a certain status to the targeted group. This status may become an important factor in the international community’s decision to recognize or not the independence of a group and its territory. This article examines the case of Kosovo’s February 2008 recognition by the international community and argues that this recognition was made possible by the summoning of arguments based on Kosovo Albanians’ collective status as victims of ethnic cleansing. The article bridges the gap between on the one hand the Remedial Right theory of secession, and on the other hand, works on mass violence against ethnonational groups. The article shows that the practice of state recognition was reoriented towards a restrictive criterion linked to the type of violence sustained by the group claiming independence. Under this interpretation, territory becomes a tangible form of compensation for suffered injustices, which contrasts with earlier practice of state recognition in the former Yugoslavia and elsewhere. This essay aims to correct a prevalent misconception about Paul Ricoeur’s hermeneutics, which understands it to support a conception of human understanding as finite as Heidegger did, but in a more “conceptuallyconservative” way. The result is that Ricoeur’s work is viewed as incapable of addressing the most pressingproblems in contemporary Continental metaphysics. In response, it is argued that Ricoeur is in fact the firstto develop an infinite hermeneutics, which departs significantly from Heideggerian finitude. This positionis demonstrated by tracing the itinerary (...) from Heidegger’s account of aletheia to Ricoeur’s account ofattestation. The conclusion, then, not only clears Ricoeur of the stated charges, but also presents a moreviable path for the future of hermeneutics. (shrink)

The fast recovery of Germany's economy after World War II—the so‐called “German miracle”—can be explained by the market‐oriented economic policies pursued in the 1950s, based upon the ideas of Ordoliberalism. The slounng growth rates and increasing economic difficulties since the 1970s seem to have resulted from the extension of interventionist and redistributionist policies beyond those sanctioned by Ordoliberalism. The roots of the German economic decline are political: already in the 1950s, a broad consensus existed about the need to integrate market‐oriented (...) economic policy with a highly redistributory welfare state in a “social market economy.”. Whereas conventional analyses characterize environmental problems as examples of market failure, proponents of free-market environmentalism (FME) consider the problem to be a lack of markets and, in particular, a lack of enforceable and exchangeable property rights. Enforcing property rights alleviates disputes about, as well as the overuse of, most natural resources. FME diagnoses of pollution are much weaker, however. Most FME proponents suggest that common-law tort suits can adequately protect private property and ecological resources from pollution. Yet such claims have (...) not been substantiated. The rise of the sitar from a limited accompaniment instrument used in the regional courts of Northern India to an internationally recognized cultural icon underscores its importance both as an instrument and a cultural symbol—the sitar mirrors India’s social complexity. This story encapsulates the social, political and economic trauma resulting from the dismantling of Mughal empire to the partition of Pakistan, reflecting contesting social narratives and Hindu/Muslim cultural heritages through the distinctive musical styles modern India. A musical instrument and material (...) object of contested origins, the sitar extends from wood, gourd, wire, and ivory into complex social and cultural networks. I argue that the sitar, as object, cannot be reduced to either an empirical or phenomenological entity; it is a space of potentiality, the actualization of a virtual object. I examine the sitar as both byproduct and narrative, demonstrating how it defies attempts to limit its constantly rupturing borders with imposed cognitive frames, and how materiality and philosophical systems can inform ethnographic practice.
