We intend to analyze the plausibility of the two kind of ethical justifications that are most commonly used in order to defend the concept of an “intellectual property” of copyrights. Firstly, we will examine justifications of property based on natural law, like the one originally provided by John Locke. We will argue, with the help of authors like Lysander Spooner, that the same arguments that Locke uses for property in general are entirely applicable to intellectual property, although this is certainly (...) a peculiar kind of property. Secondly, we will examine whether or not we can apply to intellectual property the same two arguments that Utilitarian authors use for justifying property in general: the “tragedy of the commons” argument and the scarcity argument. We will claim that the first one is fully pertinent here, and that the second one is not: but this is a problem of that kind of justification of property in general, and not a problem of intellectual property as such. The current discussion on the role of the universities often starts off with a perspective on the university as a scientific and/or pedagogical institution and consequently runs into a conflict between both logics in which each element is somehow devalued from the other perspective. Therefore, it may be productive to analyse the university from a standpoint in between, a perspective of knowledge as such. In order to conceptualise such a third perspective of knowledge, the history of the European university is (...) reconstructed and interpreted as a process of reflection on the ‘spiral of knowledge’. This article aims to trace back the history of how Chinese Government attempted to strengthen its national power by learning from the USA, Western Europe and Japan since the mid-nineteenth century, as well as to analyse the influences Westernisation had on the development of China’s modern education. In this process, the Chinese Government overseas-study scholarships played a key role in speeding up China’s learning from the West, and assisted numerous students in experiencing Western modernisation while they studied abroad. By examining (...) this historical retrospect, some findings are concluded from this research. First, several significant conflicts between China and foreign countries stimulated Chinese officials deeply to learn the knowledge and skills of Western navy, military, sciences, technologies and philosophies. Second, Chinese scholars also began to reflect and criticise the influence of these Westernised reforms on Chinese traditional culture and values. (shrink)

Significant developments in the global economy and information technology have been accompanied by a transformation in the nature and process of knowledge production and dissemination. Concepts such as the knowledge economy or creative economy have been formulated to accommodate the new and complex developments in knowledge, creativity, economy, and technology. While much of the current literature on the knowledge and creative economy substantially reflects the economic impact of knowledge and creativity, previous studies have rarely touched upon the role of translation (...) in this development. By discussing the role of translation as a generative process in the creative economy and its implications for crossing boundaries in education, this paper argues that translation plays a significant role in the creation of a hybrid milieu. This dynamic cultural hybridity is stimulated by the circulation of knowledge and information via translation, but is also, per se, a driver inviting greater engagement of ideas and knowledge given that translated works always require retrospective interpretations along with changing social and cultural mores.
