An encyclopedia article on the epistemic or knowledge condition for moral responsibility, written for the SEP.

My primary target in this paper is a puzzle that emerges from the conjunction of several seemingly innocent assumptions in action theory and the metaphysics of moral responsibility. The puzzle I have in mind is this. On one widely held account of moral responsibility, an agent is morally responsible only for those actions or outcomes over which that agent exercises control. Recently, however, some have cited cases where agents appear to be morally responsible without exercising any control. This leads some (...) to abandon the control-based account of responsibility and replace it with an alternative account. It leads others to deny the intuition that agents are responsible in these troublesome cases. After outlining the account of moral responsibility I have in mind, I look at some of the arguments made against the viability of this theory. I show that there are conceptual resources for salvaging the control account, focusing in particular on the nature of vigilance. I also argue that there is empirical data that supports the control account so conceived. (shrink)

Some harms are such that they cannot be prevented by a single individual because she lacks the requisite control. Because of this, no individual has the obligation to do so. It may be, however, that the harm can be prevented when several individuals combine their efforts. I argue that in many such situations each individual has a duty to join forces: to approach others, convince them to contribute, and subsequently make a coordinated effort to prevent the harm. A distinctive feature (...) of this proposal is that, in the first instance, it focuses on mobilizing others rather than on preventing the outcome. As it ultimately concerns a collective harm, the duty to join forces is irreducibly collective. Furthermore, once enough people have been mobilized, they have a collective obligation to prevent the harm that is irreducibly collective also because it applies to the collective as such. (shrink)

One popular theory of moral responsibility locates responsible agency in exercises of control. These control-based theories often appeal to tracing to explain responsibility in cases where some agent is intuitively responsible for bringing about some outcome despite lacking direct control over that outcome’s obtaining. Some question whether control-based theories are committed to utilizing tracing to explain responsibility in certain cases. I argue that reflecting on certain kinds of negligence shows that tracing plays an ineliminable role in any adequate control-based theory (...) of responsibility. (shrink)

I have presented a Frankfurt-style argument (Pereboom 2000, 2001, 2003) against the requirement of robust alternative possibilities for moral responsibility that features an example, Tax Evasion , in which an agent is intuitively morally responsible for a decision, has no robust alternative possibilities, and is clearly not causally determined to make the decision. Here I revise the criterion for robustness in response to suggestions by Dana Nelkin, Jonathan Vance, and Kevin Timpe, and I respond to objections to the argument by (...) In this paper, we set out to test empirically an idea that many philosophers find intuitive, namely that non-moral ignorance can exculpate. Many philosophers find it intuitive that moral agents are responsible only if they know the particular facts surrounding their action. Our results show that whether moral agents are aware of the facts surrounding their action does have an effect on people’s attributions of blame, regardless of the consequences or side effects of the agent’s actions. In general, it was (...) more likely that a situationally aware agent will be blamed for failing to perform the obligatory action than a situationally unaware agent. We also tested attributions of forgiveness in addition to attributions of blame. In general, it was less likely that a situationally aware agent will be forgiven for failing to perform the obligatory action than a situationally unaware agent. When the agent is situationally unaware, it is more likely that the agent will be forgiven than blamed. We argue that these results provide some empirical support for the hypothesis that there is something intuitive about the idea that non-moral ignorance can exculpate. (shrink)

The problem known as Buridan’s Ass says that a hungry donkey equipoised between two identical bales of hay will starve to death. Indecision kills the ass. Some philosophers worry about human analogs. Computer scientists since the 1960s have known about the computer versions of such cases. From what Leslie Lamport calls ‘Buridan’s Principle’—a discrete decision based on a continuous range of input-values cannot be made in a bounded time—it follows that the possibilities for human analogs of Buridan’s Ass are far (...) more wide-ranging and securely provable than has been acknowledged in philosophy. We are never necessarily decisive. This is mathematically provable. I explore four consequences: first, increased interest of the literature’s solutions to Buridan’s Ass; second, a new asymmetry between responsibility for omissions and responsibility for actions; third, clarification of the standard account of akrasia; and, fourth, clarification of the role of credences in normative decision-theory. It is intuitive that circumstantial ignorance, even when culpable, can mitigate blameworthiness for morally wrong behavior. In this paper I suggest an explanation of why this is so. The explanation offered is that an agent’s degree of blameworthiness for some action depends at least in part upon the quality of will expressed in that action, and that an agent’s level of awareness when performing a morally wrong action can make a difference to the quality of will that is expressed in (...) it. This explanation makes use of Holly Smith’s distinction between benighting and benighted actions as well as a notion developed here called “capture.”. (shrink)

Frankfurt-style cases purport to show that an agent can be morally responsible for an action despite not having any alternatives. Some critics have responded by highlighting various alternatives that remain in the cases presented, while Frankfurtians have objected that such alternatives are typically not capable of grounding responsibility. In this essay I address the recent suggestion by Seth Shabo that only alternatives associated with the ‘up to us’ locution ground moral responsibility. I distinguish a number of kinds of ability, suggest (...) which kinds of abilities ground the truth of the ‘up to us’ locution, and outline how these distinctions apply to the indeterministic buffer cases. Pereboom has formulated a Frankfurt-style counterexample in which an agent is alleged to be responsible despite the fact that there are only non-robust alternatives present (Pereboom, Moral responsibility and alternative possibilities: essays on the importance of alternative possibilities, 2003; Phil Explor 12(2):109–118, 2009). I support Widerker’s objection to Pereboom’s Tax Evasion 2 example (Widerker, J Phil 103(4):163–187, 2006) (which rests on the worry that the agent in this example is derivatively culpable as opposed to directly responsible) against Pereboom’s recent counterarguments (...) to this objection (Pereboom 2009). Building on work by Moya (J Phil 104:475–486, 2007; Critica 43(128):3–26, 2011) and Widerker (Widerker 2006), I argue that there is good reason to measure the robustness of alternatives in terms of comparative, rather than non-comparative likelihood of exemption, where the important factor for blame is whether the agent is “doing her reasonable best” to avoid blameworthy behaviour. I maintain that an agent only ever appears responsible when alternatives are robust in this sense. In Pereboom’s examples, both Tax Evasion 2, and his more recent version, Tax Evasion 3 (Pereboom 2009), I maintain the robustness of the alternatives, so understood, is unclear. We can clear up any ambiguity by sharpening the examples, and the result is that the agent appears responsible when the alternatives are made clearly robust, and does not appear responsible when alternatives appear clearly non-robust. The comparative nature of our judgements about blame, I maintain helps to explain the continuing appeal of the “leeway-incompatibilist” viewpoint. (shrink)

I consider three challenges to the traditional view according to which moral responsibility involves an epistemic condition in addition to a freedom condition. The first challenge holds that if a person performs an action A freely, then she thereby knows that she is doing A. The epistemic condition is thus built into the freedom condition. The second challenge contends that no epistemic condition is required for moral responsibility, since a person may be blameworthy for an action that she did not (...) know was wrong. The third challenge invokes the quality of will view. On this view, a person is blameworthy for a wrong action just in case the action manifests a bad quality of will. The blameworthy person need not satisfy an additional epistemic condition. I will argue that contrary to appearances, none of these challenges succeeds. Hence, moral responsibility does require a non-superfluous epistemic condition. (shrink)

In the article "What Sin Is: A Differential Analysis," Jesse Couenhoven delves into the definitions and categorizations of sin according to various Christian doctrines. The author critically examines traditional definitions, such as those provided by the Westminster Confession and catechisms, and argues that they fail to adequately distinguish between sin and evil, often conflating natural evils with sinful acts. Couenhoven also considers gray areas of ethical behavior, such as the actions of a schizophrenic who curses against God or the mistakes (...) made by medical residents that result in harm to patients, and questions whether these actions should be classified as sin. The primary question driving the article is how sin is differentiated from that which is "merely" evil. To address this, Couenhoven analyzes and evaluates three views of sin, testing their coherence with Christian beliefs and practices. The article aims to provide a more nuanced and sufficient understanding of sin within the Christian tradition, going beyond the necessary elements of the doctrine of sin to better identify and differentiate sin from evil. I explore the question of when an agent is derivatively, rather than directly, culpable for an undesirable outcome. The undesirable outcome might be a harmful incompetent or unwitting act, or it might be a harmful event. By examining various cases, I develop a sophisticated account of indirect culpability that is neutral about controversies regarding normative ethical issues and the condition on direct culpability.

According to the principle of alternative possibilities (PAP), a person is morally responsible for what he has done only if he could have done otherwise. Widerker (Philosophical Perspectives 14: 181-201, 2000) offers an intriguing argument for PAP as it applies to moral blameworthiness. His argument is known as the “What-should-he-have-done defense” of PAP or the “W-defense” for short. In a recent article, Capes (Philosophical Studies 150: 61-77, 2010) attacks Widerker’s argument by rejecting the central premise on which it rests, namely, (...) the premise that a person is blameworthy for his action only if in the circumstances it would be morally reasonable to expect him not to have acted as he did. In this paper, I show that Capes’ criticism does not undermine this premise and, to this extent, Widerker’s argument is safe from Capes’ attack. (shrink)

Assuming that an agent can be morally responsible for her forgetting to do something, we can use recent psychological research on prospective memory to assess the psychological assumptions made by normative accounts of the moral responsibility for forgetting. Two accounts of moral responsibility (control accounts and valuative accounts) have been prominent in recent debates about the degree to which agents are blameworthy for their unwitting omissions. This paper highlights the psychological assumptions concerning remembering and forgetting that characterise the accounts. The (...) paper then introduces and reviews recent empirical literature on prospective memory. Finally, it uses the literature to assess the various assumptions. One important implication is that a direct capacitarian control account implies implausible assumptions about the psychological capacity for remembering. A second important implication is that an indirect capacitarian control account and a valuative account highlight different but complementary aspects of remembering and forgetting. (shrink)

This paper presents a case for the claim that the infamous miners paradox is not a paradox. This contention is based on some important observations about the nature of ignorance with respect to both disjunctions and conditional obligations and their modal features. The gist of the argument is that given the uncertainty about the location of the miners in the story and the nature of obligations, the apparent obligation to block either mine shaft is cancelled.

Many people presume that you can permissibly support the good features of a symbol, person, activity, or work of art while simultaneously denouncing its bad features. This chapter refines and assesses this commonsense (but undertheorized) moral justification for supporting problematic people, projects, and political symbols, and proposes an analogue of the Doctrine of Double Effect called the Doctrine of Double Endorsement (DDN). DDN proposes that when certain conditions are met, it is morally permissible to directly endorse some object in virtue (...) of its positive properties while standing against its negative properties, even though it would be morally impermissible to directly endorse those negative properties themselves. These conditions include separability (the good and bad features must not be inextricably linked), proportionality (the positive value of the good features must be significantly greater than the negative value of the bad features), and constrained choice (there must not be other things that the agent could endorse instead that share the same positive features but are not saddled with the negative ones). The chapter applies these constraints to a number of practical issues, including (among others) voting for morally troubling candidates, supporting Confederate monuments, and consuming sexist art. I defend an iterated knowledge condition on responsibility for outcomes: one is responsible for a consequence of one's action only if one was in a position to know that, for all one was in a position to know, one's action would have that consequence.

It is widely believed that implicit bias is common and that it contributes, in part, to the perpetuation of systemic injustice. Hence, the existence of implicit bias raises the question: can individuals be blameworthy for their implicit bias? Here, I consider what it is about implicit bias that renders agents blameworthy. I defend the claim that, when individuals omit to engage in activities that could prevent the influence of implicit bias on their behavior, they may be blamed for their implicit (...) bias. The plausibility of my proposal depends on whether individuals are able to engage freely in such activities and on whether there exists an obligation not to be biased (broadly put). I will answer positively to the former question and open the way for an answer to the latter, and tougher, question. (shrink)

I raise three new objections against Robert Kane’s account of ultimate responsibility based on what he calls self-forming actions (sfa s). First, the ultimate responsibility that we have for our character is very limited, since, according to Kane’s model of character development, our character is shaped by sfa s for which we are only minimally responsible. Second, it is not desirable to rely on sfa s to shape our character. There are much better alternatives. Third, given what typically motivates our (...) sfa s, we only rarely satisfy the conditions on responsibility for the changes in character that our sfa s give rise to. (shrink)

I consider cases in which a person’s action causes a foreseeable harm, but does so through an unforeseeable causal path. According to a common view, the person is blameless for the harm in such cases. I argue that any defense of this common view incurs serious costs. I then show how a popular view about resultant luck can make the rejection of the common view palatable.

In this dissertation, I argue for a new conception of the epistemic condition on moral responsibility.

In the last 70 years there has been an explosion of philosophical and theological work on the nature of virtue and the process of virtue formation. Yet philosophers and theologians have paid little attention to the phenomenon of temptation and its role in developing virtue. Indeed, little analytic work has been done on the nature of temptation. This study aims to fill this gap in moral philosophy and theology by offering an analytic moral conception of temptation and explicating its connection (...) to the development of virtue. This project deploys a new iteration of an older methodology of integrating philosophy and theology that may now appropriately be called “analytic moral theology.” In discerning the nature of temptation and its role in virtue formation, theological sources provide foundational guidance. Analytic moral philosophy provides illumination, coherence, and conceptual robustness to the theological foundation. The argument developed follows in the footsteps of John Hick’s soul-making theodicy by contending that the development of virtue requires a world that permits of experiences of temptation. This conclusion is substantiated by a close moral analysis of the nature of temptation that builds on key works done in philosophical moral psychology, philosophy of action, and philosophical theology. The emerging conceptualization of temptation is then compared and contrasted with the closely related moral phenomenon of akrasia and weakness of will, and finally interfaced with a neo- Aristotelian conception of virtue development. In the end, Thomas Aquinas’s understanding of infused virtue is employed as a theological test of the thesis and conditions the scope of the thesis. In light of this constructive analysis of the nature of temptation and its argument for temptation’s role in acquiring moral virtue, this project makes a contribution to philosophical Christian ethics. God is often portrayed as being omnipotent, omniscient, and omnibenevolent. Many worry that these traits make it so God cannot possess free will. However, very little is said about why a God without freedom would be an issue. I argue that God does not need the kind of freedom we usually care about. I make a case that free will is important to us because it allows us to assign blame and praise to others. From here, I argue that being (...) able to blame God is unimportant, and that God can still be praised even without free will. (shrink)

This work develops a philosophically credible and psychologically realisable account of control that is necessary for moral responsibility. We live, think, and act in an environment of subjective uncertainty and limited information. As a result, our decisions and actions are influenced by factors beyond our control. Our ability to act freely is restricted by uncertainty, ignorance, and luck. Through three articles, I develop a naturalistic theory of control for action as a process of error minimisation that extends over time. Thus (...) conceived, control can serve to minimise the influence of luck on action and enable freedom in uncertainty. -/- In Article 1, Thor Grünbaum and I argue for a psychologically plausible account of the kind of control that is necessary for moral responsibility. We begin by establishing the relationship between agentive contribution and responsibility-level control. One way to determine whether one the right kind and degree of control to be morally responsible is to track one’s degree of contribution to an action. However, a psychologically plausible account of control in terms of agentive contribution may seem to contradict the types of functional-mechanistic explanations used in cognitive science. In cognitive psychology and cognitive neuroscience, personal-level capacities are explained by a set of sub-personal mechanisms. Often, such explanations leave no room for a contribution by the agent. By integrating insights from theories of cognitive control and incorporating them into a philosophical account of intentions, we propose a way of thinking about the distribution of cognitive control resources as something the agent does. -/- Article 2 argues that a classic argument concerning luck, originally aimed at libertarianism, generalises beyond any specific theory of free will, and regardless of whether determinism or indeterminism is true. I call this mental luck. Because we all make decisions under conditions of relative uncertainty and limited information, it is possible for an agent to make decisions that are contrary to their own motivation. In such situations, it may be a matter of luck whether the agent makes the right decision. Mentally lucky decisions are not rationally governed by attitudes within the agent's perspective, and thus, may be indistinguishable from unlucky ones. From the perspective of the agent, such decisions may resemble the outcome of a lottery. Therefore, mental luck poses a challenge to most prominent theories of free action and moral responsibility. -/- Finally, article 3 engages with the issue of resultant luck, namely luck in how things turn out. Resultant luck raises a challenge for theories of moral responsibility because its existence suggests that one may be responsible for factors beyond one’s control. Prominent responses to resultant luck led to a choice between internalism and scepticism. I argue that familiar cases of resultant luck are based on the assumption that actions are events. Instead, I propose an alternative ontology of action as an ongoing goal-directed process with a many-shots structure. Described this way, cases of resultant luck are not representative of ordinary action. The proposal of action as a many-shots process is consistent with predictive coding, a cognitive architecture which centres around error minimisation. Under this framework, cases of resultant more luck are no longer failures of action, but rather anticipated errors to be settled within the ordinary process of action. (shrink)
