This paper examines some of the ways that equality in political status is threatened by corporate political speech. I offer a critique of Citizens United v Federal Election Commission which emphasizes a democratic equality approach to law and politics.

Nearly a decade ago, Ingrid Robeyns formulated a distributive justice doctrine known as economic limitarianism. This article posits that Robeyns’ limitarianism is a politically plausible, practically feasible and morally justifiable doctrine. The doctrine effectively addresses concerns regarding incentives, efficacy and unequal opportunities. The article identifies a problem of scope or extensity, which it refers to as an asymmetric argument. The article proposes that this issue can be resolved by fully extending limitarianism to non-democratic states. This extension is justified by the (...) relationship between surplus money and political inequality, which can be explained through various avenues, including causal and constitutive explanations, structural injustice and systemic causation. While this list of avenues is not exhaustive, it is representative of the possible avenues that can be explored. Fully extending the doctrine to non-democratic states would enhance its robustness. Chater & Loewenstein argue that i-frame research has been coopted by private interests opposed to system-level reform, leading to ineffective interventions. They recommend that behavioural scientists refocus on system-level interventions. We suggest that the influence of private interests on research is problematic for wider normative and epistemic reasons. A system-level intervention to shield research from private influence is needed.

In this essay we argue against preventing people from amassing extreme wealth via increased taxation. The first argument in favor of such a proposal, recently advanced by Ingrid Robeyns (2018), states that billionaires’ resources would be better spent addressing morally important goals such as meeting disadvantaged people’s needs and solving collective action problems. In response to this claim, we argue that billionaires are typically in a better position to benefit the poor and to solve collective action problems than public officials. (...) The second argument in favor of preventing extreme wealth accumulation, advanced by Robeyns and Robert Reich (2018), states that billionaires have an inappropriate amount of influence in public life, which undermines political equality. We argue that corporate leaders tend to be more accountable to their fellow citizens than public officials. We then consider and criticize the objection that billionaires’ success is typically a result of public investment, which entitles public officials to enforce taxes that demand a return on the public investment. In recent years, much public attention has been devoted to the existence of pay discrepancies between men and women at the upper end of the income scale. For example, there has been considerable discussion of the ‘Hollywood gender pay gap’. We can refer to such discrepancies as cases of millionaire inequality. These cases generate conflicting intuitions. On the one hand, the unequal remuneration involved looks like a troubling case of gender injustice. On the other, it’s natural to feel uneasy when (...) confronted with the suggestion that multi-millionaires are somehow being paid inadequately. In this paper, we consider two arguments for rectifying millionaire inequality, clarifying their appeal but also identifying the obstacles that each will have to surmount in order to succeed. In this article, I offer an account of what one of the short-term political aims of proponents of greater equality ought to be. I claim that the strengthening of reflective capacity—citizens’ ability to impose a temporary level of distance from their commitments, to consider alternatives to them, and to evaluate their origins and validity—ought to be one key aim of egalitarian politics under present political conditions. I then propose activist-led education programs as one desirable means to deliver this end of (...) strengthened reflective capacity. Where activist-led education provides plentiful informational resources and opportunities to practice deploying one’s reflective capacity, and also emphasizes and encourages intellectual humility, it seems well placed to help bring about this aim. Activist-led education programs are commonly subject to what I term the indoctrination worry, but I try to show that there are not good grounds for concluding in advance of further study that the delicate balancing of ends that permissible activist-led education requires is either categorically unachievable, or avoidable in the way these objectors often press. The argument thus provides presumptive grounds for considering the proliferation of suitably organized activist-led education programs an important component of a broader strategy of egalitarian social change. Despite the prominence of thresholds and limits in theories of distributive justice, there is no general account of their role within such theories. This has allowed an ongoing lack of clarity and misunderstanding around threshold views in distributive justice. In this thesis, I develop an account of the conceptual structure of such views. Such an account helps understand and characterize threshold views, can subsume what may seem to be different debates about such views under one conceptual header, and can be (...) used to further examine and develop patterns of justice that draw on thresholds. In light of this account, I propose a novel characterization of sufficientarianism which sheds new light on the distinctiveness of sufficientarianism as a distributive principle and on the common objections to sufficientarianism. Moreover, I examine and defend limitarianism, which is the view that people should not have more than a certain amount of wealth. In particular, I argue in favour of limitarianism as a midlevel principle for guiding institutional design and individual actions and, furthermore, as a specification of what a just allocation of wealth requires under epistemic constraints. A public sphere where people can fund any political speech from their private holdings is epistemically defective. The argument has four steps. First, if political speech is unregulated, the rich predictably contribute a disproportionate share. Second, wealth tends to correlate with substantive political perspectives. Third, greater quantities of speech by the rich can “drown out” the speech of the (...) poor, because of citizens’ limited attention span for politics. Finally, the normative problem with all this is that it reduces the diversity of arguments and evidence citizens become familiar with, reducing the quality of their political knowledge. The clearest implication of the argument is in favour of strict contribution limits and/or public funding for formal political campaigns, but it also has implications for more informal aspects of the public sphere. Economic disparities often translate into disparities in political influence, rendering political liberties less worthy to poor citizens than to wealthier ones. Concerned with this, Rawls advocated that a guarantee of the fair value of political liberties be included in the first principle of justice as fairness, with significant regulatory and distributive implications. He nonetheless supplied little examination of the content and grounding of such guarantee, which we here offer. After examining three uncompelling arguments in its favor, we complete a more (...) promising yet less explored argument that builds on the value of self-respect. We first inspect the conditions and duties that securing self-respect entails. We then look into how uneven allocations of the value of political liberties bear, expressively and due to the power imbalances they yield, on such conditions and duties. (shrink)

The main aim of this paper is to act as a corrective to the comparatively deafening silence of egalitarian political philosophy’s response to the Great Recession. The paper thus provides an accessible analysis of a new strand of empirical research into the causes of the crisis. This new literature, which has largely gone unnoticed by the broader philosophical community, maintains that the main driver of financial instability is income and wealth inequality coupled with income stagnation at the bottom of the (...) income distribution. Building on this empirical research, the paper puts forward six connections between egalitarian political philosophy broadly construed, and the findings of the new literature it surveys. These connections are understood as operating in two directions: that is, they both provide reasons for egalitarians to play a larger role in debates concerning the moral aspects of financial instability, and also offer valuable insights to egalitarians to reorient their position concerning central facets of their arguments. While a large social-choice-theoretic literature discusses the aggregation of individual judgments into collective ones, there is much less formal work on the transformation of judgments in group communication. I develop a model of judgment transformation and prove a baseline impossibility theorem: Any judgment transformation function satisfying some initially plausible conditions is the identity function, under which no opinion change occurs. I identify escape routes from this impossibility and argue that the kind of group communication envisaged by deliberative democats must be (...) "holistic": It must focus on webs of connected propositions, not on one proposition at a time, which echoes the Duhem-Quine "holism thesis" on scientific theory testing. My approach provides a map of the logical space in which different possible group communication processes are located. (shrink)

Managers often have discretion in interpreting their ethical requirements, and they should seek democratic guidance in doing so. The undemocratic nature of managerial ethical discretion is shown to be a recurring problem in business ethics. Joseph Heath’s market failures approach (MFA) is introduced as a theory better positioned to deal with this problem than other views. However, due to epistemic uncertainty and conceptual indeterminacy, the MFA is shown to allow a much wider range of managerial discretion than initially appears. The (...) paper explores how this range can be narrowed down with democratic input, comparing models based on formal state institutions and on the informal public sphere. A case study from the pharmaceutical industry illustrates the merits of the informal public sphere approach. (shrink)

Taking Kant’s philosophy of right as my starting point, I defend the view that just exercise of political power requires economic redistribution. Against the common view that Kant’s political thinking has no economic implications, I argue that republican interpretations of his philosophy of right succeed in reconstructing a cogent argument in favor of public poverty relief. I also argue that the economic implications of Kant’s theory extend beyond public support of the poor. As freedom-enabling institutional structures, states are obliged to (...) remove hindrances to democratic self-legislation. It is reasonable to consider economic inequality as such a hindrance, and so public provisions for the poor is not enough. In order to exercise political power in a just way, public authorities must also take measures to reduce the gap between the richest and the poorest. (shrink)

We explore the desirability of an idea that has not received the attention it deserves by political philosophers: that governments should bring privately-owned fossil fuel companies into public ownership with a view to managing their wind-down in the public interest – often simply referred to as ‘nationalising the fossil fuel industry’. We aim to make a conditional case for public ownership of fossil fuel companies. We will assume certain conditions about government motivations and capacities that are similar to assumptions made (...) generally in the philosophical and economic analysis of climate policies: that the government is suitably motivated, has effective control over the companies it acquires, and is able to sustain this motivation and control for long-enough to wind-down acquired companies in the public interest. We argue that bringing fossil fuel companies into public ownership, under these conditions, allows the government to take ten actions that are in the public interest, which will enhance social justice, enable a fair division of burdens and benefits, and strengthen democracy. We consider four plausible objections. While some of these point to the need for further research, they do not undermine our claim that nationalising the fossil fuel industry is a policy option that merits serious consideration. (shrink)

Digital privacy scholars tend to bemoan ordinary people’s limited knowledge of and lukewarm interest in what happens to their digital data. This general lack of interest and knowledge is often taken as a consideration in favor of legislation aiming to force internet companies into adopting more responsible data practices. While we remain silent on whether any new laws are called for, in this paper we wish to underline a neglected consequence of people’s ignorance of and apathy for digital privacy: their (...) potential to encourage capture by industry interests. In particular, we argue that such laws may be at increased risk of capture because they are unlikely to be democratically responsive. We make this claim on a twofold basis: first, well-known theoretical mechanisms explaining how the absence of responsiveness leads to capture, identified in prior political science and political philosophy literature, yield the prediction that digital privacy legislation is likely to be unresponsive and thus captured; second, empirical data concerning the European Union’s digital privacy laws, with a special focus on the General Data Protection Regulation, appears to confirm these predictions: the bloc’s (world’s?) flagship privacy protection law seems more responsive to corporate than citizen interests. Ingrid Robeyns argues that there is a point at which increasing one’s income no longer increases one’s quality of life. Her argument states that given better uses for this money, namely restoring political equality and meeting urgent needs, it is morally wrong for individuals to have surplus money, which is money beyond that which is needed to live a good life. Therefore, Robeyns argues that surplus money should be taxed at a rate of 100%. The original argument only applies to (...) individuals with excess wealth. However, there is no reason why it should be restricted only to people. In Citizens United v. Federal Election Commission, the United States Supreme Court ruled that corporations have free speech rights, building on previous cases that gave corporations protection under the Fourth, Fifth, Seventh, and Fourteenth Amendments. Given that corporations have rights similar to people, should they be held to the same consideration of surplus economic value? Just as Robeyns argues that super-rich individuals have surplus money, so do mega-corporations have wealth beyond their use. I call this argument “corporate limitarianism”. In this paper, I apply Robeyns’ arguments for economic limitarianism, namely the democratic argument and the argument from unmet needs, to corporations. In the case of urgent needs, I also look at the expanded causal role of mega-corporations in creating and contributing to these issues and how it supports the corporate limitarianism argument. This paper provides a defence of a lifetime limit on how much a person can receive in the form of gifts and inheritances, that is, a person's accessions. I argue that any accessions above that limit should be taxed at a rate of 100%. The analysis shows how this proposal can bring into equilibrium the core values and other goals at stake in the design of taxation on inheritances and gifts. To counter the low level of support for inheritance taxation (...) in general, the analysis must include a proposal concerning what will be done with the tax revenues. I propose turning the accession tax revenues into an unconditional citizen's stake that is granted to young adults. Such an institutional design would create additional value by reducing unfair inequalities between age groups. (shrink)

In der vorliegenden Arbeit wird eine normative Analyse und Verteidigung der Erbschaftssteuer unternommen. Zunächst wird eine egalitaristische Argumentation für die Steuer entfaltet. Aufgrund ihrer progressiven Struktur ist die Erbschaftssteuer ein geeignetes Instrument, um der wachsenden ökonomischen Ungleichheit entgegenzuwirken und letztlich verschiedene egalitäre Ideale (politische Gleichheit, Chancengleicheit etc.) zu befördern. Anschließend wird untersucht, wie aus normativer Perspektive zu beurteilen ist, dass der Erblasser bei Erhebung der Steuer nicht mehr lebt. Die restliche Arbeit besteht in einer Auseinandersetzung mit den wichtigsten Einwänden gegen (...) die Erbschaftssteuer. So wird oft behauptet, diese verletze die natürlichen Eigentumsrechte des Erblassers bzw. des Erben und sie ignoriere zudem die Verdienstansprüche des Erblassers. Schließlich sei die Steuer aus diversen "familien-basierten" Erwägungen abzulehnen. Nicht nur werden diese Einwände erfolgreich zurückgewiesen; ferner wird gezeigt, dass einige der, diesen Argumenten zugrundeliegenden, Prinzipien selbst zur Verteidigung einer egalitären Erbschaftssteuer (also einer Erbschaftssteuer, die aus egalitären Prinzipien folgt) herangezogen werden können. According to limitarianism, it is morally impermissible to be too rich. We consider three main challenges to limitarianism: the redundancy objection, the inconclusiveness objection, and the commitment objection. As a distributive principle, we find that limitarianism fails to overcome the three objections—even taking recent theoretical innovations into account. Instead, we suggest that the core commitment of limitarianism can be drawn from the excess intuition. It entails that at some point, people's claims to retain wealth become qualitatively different: they become preposterous (...) from the point of view of interpersonal morality and justification. Extreme wealth, we argue, adds a distinctive expressive reason to worry about inequality and insufficiency, compounding these other distributive injustices. In retaining or wasting excess wealth while others have too little, the wealthy send a message of complete disregard for the interests of their co-citizens. They express that their disadvantaged compatriots have a diminished moral standing. (shrink)
