While it is a point of agreement in contemporary republican political theory that property ownership is closely connected to freedom as non-domination, surprisingly little work has been done to elucidate the nature of this connection or the constraints on property regimes that might be required as a result. In this paper, I provide a systematic model of the boundaries within which republican property systems must sit and explore some of the wider implications that thinking of property in these terms may (...) have for republicans. The boundaries I focus on relate to the distribution of property and the application of types of property claims over particular kinds of goods. I develop this model from those elements of non-domination most directly related to the operation of a property regime: (a) economic independence, (b) limiting material inequalities, and (c) the promotion of common goods. The limits that emerge from this analysis support intuitive judgments that animate much republican discussion of property distribution. My account diverges from much orthodox republican theory, though, in challenging the primacy of private property rights in the realization of economic independence. The value of property on republican terms can be realized without private ownership of the means of production. (shrink)

Corporations wield power in today’s economies, and political theories of the corporation argue about the legitimacy conditions of corporate power. This paper argues in favour of a double-fiduciary theory for corporations. Based on a concession theory of markets, it sees all markets as authorized by states (in the name of society), for the purpose of creating economic value, or wealth. Hence corporations, as much as non-incorporated firms, have a fiduciary duty to the state/society to create wealth, in the competitive structure (...) of the market. However, their pursuit of wealth often creates unbalanced relations of power between corporations and their stakeholders, which can at some point be classified as instances of domination. Therefore, corporations need to be subjected to a second fiduciary duty, i.e. not to dominate others in the economy. This duty is also, in the final instance, owed to the state/society. In an era when everyone can incorporate their business, states/societies can be interpreted as having, through corporate law, mandated shareholders as ‘proximate beneficiaries’, to incentivize corporations to create wealth. Now states/societies need to think about how to prevent corporations from dominating others. New mechanisms of accountability towards stakeholders and/or citizens as proximate beneficiaries are needed. Only in this way can corporations be effectively held to account for both of the fiduciary duties which characterize their normative status. (shrink)

Recent work in republican political theory has identified various forms of domination in the structures and relations of capitalist societies. A notable absence in much of this work is the concept of exploitation, which is generally treated as a predictable outcome of certain kinds of domination. This paper argues that the concept of exploitation can instead be conceived as a form of structural domination, understood in republican terms, and that adopting this conception has important implications for republican attempts to theorize (...) modern capitalist societies. Building on existing domination accounts of exploitation, we argue that exploitation is a form of structurally constituted domination that enables a systemic illegitimate extraction of value. However, in contrast to competing accounts, domination is understood here in the republican terms of subjection to arbitrary power. We show that conceiving of domination in these terms not only makes the concept easily accessible from within a republican framework, but has advantages over competing accounts. Our argument also demonstrates why using the concept of exploitation will be useful for republican theorists. We show that a polity based on exploitative relations of production is antithetical to key republican commitments. These asymmetric power relationships undermine the economic and political independence of citizens and, crucially, constrain the political and economic ends that a polity will be effectively able to pursue. As such, exploitation should be a central preoccupation of republican political economy. (shrink)

“Structural Injustice” refers to injustices that can't be attributed to particular actions by bad actors. This article surveys Iris Marion Young's influential account of structural injustice; lays out some considerations related to the concept's use as an analytical tool; and critically surveys Young's account of individual responsibility for structural injustice.

For several decades, public political discourses on ‘welfare dependency’ have failed to recognise that welfare states are not the source of economic dependence, but rather reconfigure economic dependencies in a specific way. This article distinguishes four senses of ‘economic dependence’ that can help to clarify what is missing from these discourses, and what is at stake in political and legal decisions about how we may economically depend upon one another. While feminist, republican and egalitarian philosophical work has examined the problems (...) of dependence on states, in families and in markets, the present approach adds a further dimension to our cultural and political concerns with economic dependence: it argues that it is reasonable and useful to consider the economic dependence of the economically powerful. Doing so requires a clarification of the ‘varieties of dependence’ that exist in contemporary societies and economies, and the recognition that legal and political choices regarding social and economic justice are often about choosing between varieties of dependence, not about escaping dependence entirely. Classical republicanism was deeply concerned with citizen participation and the balance between popular and elite power, but 19th-century radical republicans thought that these goals must be approached differently in market societies in which enormous power is exercised outside the state. The solidarists cautiously embraced the state as a mechanism for regulating the market in order to ensure equal liberty. In the past few years, calls for integrating ethics modules in engineering curricula have multiplied. Despite this positive trend, a number of issues with these ‘embedded’ programs remains. First, learning goals are underspecified. A second limitation is the conflation of different dimensions under the same banner, in particular confusion between ethics curricula geared towards addressing the ethics of individual conduct and curricula geared towards addressing ethics at the societal level. In this article, we propose a tripartite framework to overcome these (...) difficulties. Our framework analytically decomposes an ethics module into three dimensions. First, there is the ethical dimension, which pertains to the learning goals. Second, there is the moral dimension, which addresses the moral relevance of engineers’ conduct. Finally, there is the political dimension, which scales up issues of moral relevance at the civic level. All in all, our framework has two advantages. First, it provides analytic clarity, i.e. it enables course instructors to locate ethical dilemmas in either the moral or political realm and to make use of the tools and resources from moral and/or political philosophy. Second, it depicts a comprehensive ethical training, which enables students to both reason about moral issues in the abstract, and to socially contextualize potential solutions. (shrink)

Precarious work is a growing and alarming phenomenon. This paper analyses two of its distinctive normative features. First, precarity increases the risks workers face, blurring their capacity for prospection and lessening their security in accessing the opportunities associated with their jobs. Second, precarious work challenges workers’ collective action capacity. I will argue that both features threaten workers’ republican freedom. I develop the second point by presenting a conception of solidarity between workers and then showing how precarious work erodes it. On (...) the one hand, when the labour market is dualised, precarity is distributed unevenly and the risks undergone by groups of workers are different. Thus, dual labour markets create a potential conflict of interest between the preferences of different groups, insiders and outsiders. On the other hand, various economic changes hinder workers from acting based on shared purposes due to increased coordination costs. To the extent that workers’ power depends on their bonds and collective action, primarily through unions, the eclipse of their solidarity leaves them powerless and thus increases their domination. Finally, I consider various scenarios that could boost workers’ collective power. (shrink)

In this paper I discuss the power of corporations as epistemic agents. Corporations need to hold certain forms of knowledge in order to develop and produce goods and services. Intellectual property is meant to incentivize them to do so, in ways that orient their activities towards the public good. However, corporations often use their knowledge strategically, not only within markets, but also in the processes that set the rules for markets. I discuss various historical examples, including the so-called “tobacco strategy” (...) of creating doubt about scientific evidence, and argue that as long as corporations are set up as profit-oriented entities, it is a dangerous strategy to provide them with too much epistemic power. I suggest various policies for reigning in this form of corporate power, for example regulations on PR activities. I then turn to the power of digital corporations, which is based on their collection and analysis of data. These kinds of companies, and the technologies they use, make the control of corporations as epistemic agents all the more urgent for democratic societies. (shrink)

This article offers an account of how modern economic arrangements are conducive to domination. Republicans differ over how and when markets generate injustice. On one hand, agential Pettitian republicanism regards the market as comparable to natural phenomena, akin to the weather. Financial market domination cannot be adequately described as purely agential as no one player or group can shape or crash it. On the other hand, structural republican accounts – including recent Marxian accounts addressing the difficulties of establishing republican freedom (...) within capitalist societies – go too far in reducing the role of agents and objecting outright to the structural process of financialization as producing class-based domination. This article takes up the case of pre-2008 securitisation markets as a way of investigating how market players engaged in a social practice may possess a coordinated capacity to arbitrarily interfere with debtholders (such as mortgage holders) and so to dominate. Such agents dominate without acting as a group agent. This analysis extends the structural domination literature by demonstrating the centrality of social practices as sites of domination and of potential reform. Social practices are formed by agential choices made within incentive structures. To achieve non-domination, incentives should be the target of reform. (shrink)

In recent years, an interdisciplinary debate on the social and political role of business corporations has evolved. With this special issue, we would like to facilitate a comprehensive discussion of three questions that are especially pertinent in that debate: (1) How is the social and political agency of corporations to be understood? (2) How should the power of corporations be analyzed? (3) Under which conditions would the social and political roles of corporations be legitimate? In this introduction to the special (...) issue, we start with a short outline of the debate. In the next step, we provide an overview of the five contributions. We conclude by summarizing what can be learned from those contributions with respect to the three research questions. (shrink)

The article explores the normative concerns raised for gig workers by algorithmic management (AM), by embracing an ethnographically sensitive approach to philosophical inquiry. Inspired by Michel de Certeau’s concept of ‘tactics’, the article suggests interpreting workers’ attempts to ‘trick the algorithm’ and escape some of AM’s constraints as ways to reclaim agency, in the absence of suitable organizational conditions for its affirmative exercise. The kind of agency specifically deployed by workers in cooperative settings is referred to as ‘contributive agency’, broadly (...) defined as workers’ control over their contribution in multiple dimensions – epistemic, relational, participatory and protective. Contributive agentic capacities are not mere properties of agents, but organizationally mediated capacities that can be more or less enabled or constrained depending on the contributive context. It is argued that below a certain threshold, AM’s agency-constraining features are objectionable and desirable agency-enabling organizational conditions are identified in the four dimensions. Modern individuals grapple with a paradoxical reality: their lives are characterized by a strong feeling of independence as well as by an intense social interconnection. This article argues that despite an increased discussion of dependence in contemporary social and political philosophy, current ways of theorizing it have disregarded the concrete form that our social dependence takes under capitalist relations. I maintain that without integrating the critique of political economy, we risk offering a defense of dependence that remains unaware of important (...) axes of domination. In particular, I suggest recuperating Marx’s notion of objective dependence, which has been insufficiently discussed in the existing literature. Finally, drawing on recent developments in critical theory, I put forward a normative critique of dependence. I contend that the issue with modern societies is that they promote alienated and reified relations of dependence, transforming the basis of our social freedom into an objective form of domination. -/- .
