One of the enduring concerns of moral philosophy is deciding who or what is deserving of ethical consideration. This special issue of Philosophy and Technology investigates whether and to what extent machines, of various designs and configurations, can or should be considered moral subjects, defined here as either a moral agent, a moral patient, or both. This essay responds to the machine question in the affirmative, arguing that artifacts, like robots, AI, and other autonomous systems, can no longer be legitimately excluded from moral consideration. The demonstration of this thesis proceeds in four parts or movements. The first and second parts approach the subject by investigating the two constitutive components of the ethical relationship—moral agency and patiency. In the process, they each demonstrate failure. This occurs not because the machine is somehow unable to achieve what is (...) considered necessary and sufficient to be a moral agent or patient but because the characterization of agency and patiency already fail to accommodate others. The third and fourth parts respond to this problem by considering two recent alternatives—the all-encompassing ontocentric approach of Luciano Floridi’s information ethics and Emmanuel Levinas’s eccentric ethics of otherness. Both alternatives, despite considerable promise to reconfigure the scope of moral thinking by addressing previously excluded others, like the machine, also fail but for other reasons. Consequently, the essay concludes not by accommodating the alterity of the machine to the requirements of moral philosophy but by questioning the systemic limitations of moral reasoning, requiring not just an extension of rights to machines, but a thorough examination of the way moral standing has been configured in the first place. This essay sounds out Derrida's plurivocal term of frequencies as well as Nancy's understanding of resonance to argue that ghosts live in the ear. Heeding how the different nuances of this term bear on Derrida's reading of Hamlet, it not only seeks to understand the significance of the ghost's rhythmic appearance:disappearance in Shakespeare's play, but indeed, how it comes to frequent Derrida's Specters of Marx.

Curiosity is not prominent in investigations on democratic development. Nor is curiosity discussed in democratic education discourses. However, this article contributes to the present Special Issue the idea that the connection of curiosity and democracy should not be ignored. First, I show that curiosity’s connection with democracy has, regrettably, been largely bypassed in fields related to democratic theory and pedagogy. Then, I elaborate on how the emerging scholarship on curiosity’s intricacies makes it easier to perceive how fruitful the study of (...) curiosity’s role in democratic theory and education would be. In light of this recent rethinking of curiosity, I claim that studying a complex and ambiguous notion of curiosity (along with an equally complex and ambiguous epistemic restraint) is important for studying and advancing democracy and for enriching democratic citizenship education. The aim of this article is to highlight and discuss two problems of the biological philosophy of technology. In particular, I will analyse the work of André Leroi-Gourhan and Gilbert Simondon, and I will show that the meaning of the analogy between technical and natural objects that underlies the approach of the biological philosophy of technology remains problematic and the biological approach to technology is very effective for analysing tools and machines, but is not sufficient to describe the so-called information (...) technologies. In the last part of the article, I will argue that, in order to understand information technologies, it is necessary to integrate the biological approach to technology with a grammatological approach. I will try to show that, next to the tool and the machine, there is a third category of technical objects that can be better described using the notion of “writing” proposed by one of the masters of the so-called French Thought, Jacques Derrida. In a friendly interdisciplinary debate, we interrogate from several vantage points the question of “personhood” in light of contemporary and near-future forms of social AI. David J. Gunkel approaches the matter from a philosophical and legal standpoint, while Jordan Wales offers reflections theological and psychological. Attending to metaphysical, moral, social, and legal understandings of personhood, we ask about the position of apparently personal artificial intelligences in our society and individual lives. In this article, I engage with Derrida’s deconstructive reading of theories of performativity in order to analyse Max Weber’s sovereignty–legitimacy paradigm. First, I highlight an essential articulation between legitimacy and sovereign ipseity (understood, beyond the sole example of State sovereignty, as the autopositioned power-to-be-oneself). Second, I identify a more originary force of legitimation, which remains foreign to the order of performative ipseity because it is the condition for both its position and its deconstruction. This suggests an essential fallibility of the (...) performative, which implies a ‘mystical’ legitimacy and a paradoxical, divisible and self-differential representation of sovereignty. The structural differentiality of legitimacy and sovereignty signifies an irreducible coloniality of law and language, but also suggests the possibility of an unconditional resistance located in the radical interpretability of the law, beyond determined representations of powers, dominations, sovereignties or resistances. This reflection is triggered by a reading of Cynthia Weber’s theory of ‘performative states’, describing sovereignty under the form of an impossible ontology, which leads me to elaborate the notion of legitimation-to-come as a non-ontological ‘concept’: this notion of unconditional legitimacy, beyond sovereignty, binds beliefs and phantasms to the unpresentable force of the event. Pursuing the efforts of scholars such as Rob Walker and Cynthia Weber, I sketch the implications of this archi-performative legitimacy regarding the methodological protocols of International Relations and sociology, in view of elucidating the persistent ontological presuppositions of these disciplines. This essay addresses the other side of the robot ethics debate, taking up and investigating the question “Can and should robots have rights?” The examination of this subject proceeds by way of three steps or movements. We begin by looking at and analyzing the form of the question itself. There is an important philosophical difference between the two modal verbs that organize the inquiry—can and should. This difference has considerable history behind it that influences what is asked about and how. (...) Second, capitalizing on this verbal distinction, it is possible to identify four modalities concerning social robots and the question of rights. The second section will identify and critically assess these four modalities as they have been deployed and developed in the current literature. Finally, we will conclude by proposing another alternative, a way of thinking otherwise that effectively challenges the existing rules of the game and provides for other ways of theorizing moral standing that can scale to the unique challenges and opportunities that are confronted in the face of social robots. The task of this essay is to respond to the question concerning robots and responsibility—to answer for the way that we understand, debate, and decide who or what is able to answer for decisions and actions undertaken by increasingly interactive, autonomous, and sociable mechanisms. The analysis proceeds through three steps or movements. It begins by critically examining the instrumental theory of technology, which determines the way one typically deals with and responds to the question of responsibility when it involves technology. (...) It then considers three instances where recent innovations in robotics challenge this standard operating procedure by opening gaps in the usual way of assigning responsibility. The innovations considered in this section include: autonomous technology, machine learning, and social robots. The essay concludes by evaluating the three different responses—instrumentalism 2.0, machine ethics, and hybrid responsibility—that have been made in face of these difficulties in an effort to map out the opportunities and challenges of and for responsible robotics. This paper examines Derrida's treatment of the quasi-transcendental structure of hospitality, particularly as it pertains to religious traditions, conceptions of human rights, and modern secularism. It begins by looking to the account Derrida presents in 'Hostipitality', focusing especially on his treatment of the work of Louis Massignon. It then proceeds to an exploration of Kant’s concept of cosmopolitanism and some of its contemporary descendants before returning to Derrida’s treatment of hospitality by way of his critique of this Kantian heritage. The (...) paper argues both that religious traditions exhibit (though, perhaps, often not explicitly) the kind of structures of openness to difference to which Derrida’s notion of hospitality refers, and that modern Western conceptions of secularism too easily preclude understanding and fostering those aspects of religious traditions which can contribute to more peaceful coexistence in pluralistic environments. In this paper we explore the phenomenon of writing online. We ask, ‘Is writing by means of online technologies affected in a manner that differs significantly from the older technologies of pen on paper, typewriter, or even the word processor in an off‐line environment?’ In writing online, the author is engaged in a spatial complexity of physical, temporal, imaginal, and virtual experience: the writing space, the space of the text, cyber space, etc. At times, these may provide a conduit to (...) a writerly understanding of human phenomena. We propose that an examination of the phenomenological features of online writing may contribute to a more pedagogically sensitive understanding of the experiences of online seminars, teaching and learning. In this essay we investigate several moments in Simone de Beauvoir's philosophical and literary texts in which she refers to echoes and echoing. We notice that echoes help Beauvoir to figure and amplify the ethical character of her concept of ambiguity, which is so central to her thought. We argue that, for Beauvoir, literature has privileged access to the ambiguity of existence and therefore maintains a special status in exposing us to alterity and bringing us face to face with ethical (...) responsibility. Considering her literary portrayals of echoing helps to explain why, despite her life-long philosophical engagement, Beauvoir preferred not to call herself a philosopher. Finally, Beauvoir's phenomenological insight is that in order to carry ethical resonance, the form of a written work must mirror the fundamentally ambiguous or echolalic ontological structure of human existence. For Derrida, the technological, automatic and mechanical could never simply be defined as external or opposed to the voluntary, conscious and spiritual. The articulation and repeatability of the trace means that there is something machinic that is inseparable from the possibilities of meaning, choice and faith. This paper will draw on various texts – including ‘Faith and Knowledge’, Without Alibi and On Touching – to explore the mutual unravelling of machine and flesh in the Christian doctrine of the incarnation. It (...) will argue that the incarnation should not be interpreted as the self-emptying of God, but as the productive resistance of the immanent world to being appropriated by a discourse of transcendence. Taking account of Derrida's engagement with Nancy, it will explore a deconstruction of Christianity that is not ‘mere Christian hyperbole’, but the ruin of salvation itself. (shrink)

I explore the limits of corporate responsibility standards – for example Social Accountability 8000 (SA 8000), the Global Reporting Initiative, the Fair Labor Association workplace code – by looking at these initiatives through Derrida's aporias of justice as set out in 'Force of Law: The "Mystical Foundation of Authority"'. Based on a discussion of SA 8000, I uncover the unavoidable aporias that are associated with the use of this standard. I contribute to the literature on corporate responsibility standards in general (...) and SA 8000 in particular by showing (a) that attempts to standardise corporate responsibility can only be successful insofar as we recognise that compliance with SA 8000's rules requires a 'fresh judgement' every time they are applied, (b) that SA 8000 should not be pushed down the supply chain as such coercion does not require a truly responsible decision by suppliers and eventually leads to moral mediocrity and (c) that the necessarily time-consuming reflections about the singular contexts within which SA 8000 is applied challenge the urgent need for implementing this standard. This paper has been inspired by Jacques Derrida’s statement revealing that his philosophical writings were mostly devoted to paper. “I have the impression,” he said, “(the impression!—what a word, already) that I have never had any other subject basically, paper, paper, paper” (Derrida, 2005, p. 41). My paper addresses this thrice repeated noun as a name not so much of a material object on which we scribble, but as a space between the spirit and the letter, a space which turns (...) out to be ineradicable even at the time of paper’s alleged eradication in the e-textual age, which may be called a fin de livre culture. This end of the book, I argue, is a highly provisional declaration of the beginning of a paperless era of digitized media, which are not quite capable of eradicating various traces and spectres of paper haunting their own theorizations. This article elaborates on Christopher Norris's claim that certain aspects of Derrida's work are amenable to formalisation in modal-logical terms. Norris contends that any adequate analysis of the logic behind Derrida's work must provide an account of the notions of possibility, necessity, and necessary possibility, particularly as they are related to Derrida's notion of iterability. This article examines the further hypothesis that Derrida's understanding of modality, according to which possibilities must be accounted for even if they are never realised, might (...) even better be described in terms of possible worlds. In possible-worlds semantics, the conceptual meaning of a statement is constituted by the set of alternative contexts in which that statement is true. This article argues, however, that possible-worlds semantics would be unthinkable without the experience that one referent can be substituted for another. The possibility of this experience is best described in Derridean terms. Read through Derrida's thought of the trace, the properly semantic substitutions may come to be seen as dependent on the substitution of the thing for itself; on what Derrida calls ‘the substitution of the unique for the unique’. Derrida's early reluctance to spell out political implications of deconstruction gave way during the course of the 1980s to a series of analyses of political concepts and issues. This article identifies the principal intellectual strategies of Derrida's political engagements and provides a detailed account of his concept of ‘democracy to come’. Finally, it suggests several points of contact between Derrida and recent liberal political philosophy, as well as some areas in which deconstructive analyses require further refinement if fruitful exchange is (...) to occur. This paper concerns the issue of the continual arrival of irregular immigrants in Malta and the problems that ensue. The view generally held is that we need to respond to the needs of irregular immigrants by providing services. However, with reference to some of Jacques Derrida's ideas, I argue in this paper that the other /immigrant is not there for us to respond to by creating services to cater for her needs. Through the presence of the irregular immigrant, we are (...) made to question who we are, and are faced with our own vulnerability. We become 'other' to ourselves. This paper uses Derrida's ideas of tensions, trembling, borders and limited and unlimited hospitality, to lay the way for some suggestions of how the education of children can be influenced. In a time when educational discourse rotates around performativity, this paper suggests that space should be made in education for astonishment, surprise and enigmatic experience. (shrink)

Generally, regulation is thought of as a constant that carries with it both a formative and conservative power, a power that standardises, demarcates and forms an order, through procedures, rules and precedents. It is dominantly thought that the singularity and formalisation of structures like rules is what enables regulation to achieve its aim of identifying, apprehending, sanctioning and forestalling/pre-empting threats and crime or harm. From this point of view, regulation serves to firmly establish fixed and stable categories of what norms, (...) customs, morals and behaviours are applicable to a particular territory, society or community in a given time. These fixed categories are then transmitted onto individuals by convention, ritual and enforcement through imperatives of law (and technology) that mark certain behaviours as permissible and others as forbidden, off bounds. In this manner, regulation serves a programming (i.e., a calculable or determinable) purpose. It functions as a pro-active management or as a mastery of threats, risks, crimes and harms that affect a society and its security both in the future and in the present. Regulation for instance, will inscribe and codify what it determines to constitute crime or harm such as pornography, incitement of terrorism, extremist speech, racial hatred etc. These determined or calculated/calculable categories will then be enforced and regulated (e.g. through automated filtering) in order to ensure a preservation of public order within society. Drawing mainly from deconstruction, this article situates law and technologies within a wider ecological process of texts, speech and writing i.e., communication. In placing regulation within disseminatory and iterable processes of communication, this article complicates, destabilises and critiques the dominant position of determinability and calculability within the regulatory operations of law. The idea of aporia, according to the author, leads to the transformation of Derrida’s philosophy on the basis of a new kind of universalism. This new universalism is based on the principles of relation and difference; it involves the concept of“radically Other” (in particular, in the modes of particularity and singularity) into the field of the Universal. As an essential factor of binarism’s deconstruction, an aporia leads to undermine a paradigm of choice. Derrida substitutes this paradigm with an attitude to (...) “impossible” interdependence of concepts, which, according to traditional approach, are treated as incompatible. -/- The author proves that universalistic potential of Derrida’s thought reveals itself in application of transcendental approach to the problem of universal. Nevertheless, in case of Derrida it is quasi-transcendentalism that unites in itself moments of critics and radicalization of Kantian and Husserlian types of transcendental approach. -/- The paper proves that the idea of aporia has fundamental significance for constituting quasi-transcendental universalism. Interconnectedness (up to identity) of concepts of aporia and experience is evinced, as well as fundamental link between the concept of aporia and basic quasi-transcendental structure of “conditions of possibility/conditions of impossibility”. Within the problem of aporia, as is shown, inherently transcendental overlap between theoretical and practical dimensions is taken place. As is detected, in the discourse of aporia there appears a rethinking of Universal/Particular (Singular) relation: traditional contraposition is transformed into oscillation and overlapping (this rethinking is proper for the transcendental approach). -/- The results of the study, set forth in the article, allow historico-philosophical conclusion about presence, significance and peculiarity of the motive of universality in Derrida’s quasi-transcendentalism. Often remaining implicit, this motive, however, appears to be the driving force for deconstructive thinking. (shrink)

The following essay explores critical post-humanism as elaborated by Stephan Herbrechter. Avoiding the simplistic, deterministic accounts of new technological developments—whether they predict impending apocalypse or future communication systems in which all of humanity becomes perfectly and peacefully united—Herbrechter's analysis reminds us that the democratization of subjects requires an ongoing, persistent deconstruction of the anthropocentric values all too often linked to recent trends in social media, artificial intelligence, genetic enhancements, predictive analytics, digital surveillance, and so on.

Event of Signature formulates a new philosophical problem which focuses on the handwritten signature as sign of legal identification. Author Michaela Fišerová works with three metaphysical expectations, which are shared in discourses of graphology and forensic analysis. The first expectation tends to reveal the signer's soul: a handwritten signature "naturally" mirrors the unique psychological qualities of the signer. The second expectation tends to guarantee the originality of the signer's trace: a handwritten signature proves physical contact between the signed document and (...) the writing tool "authentically" moved by the signer's hand. The third expectation tends to recognize the signer's legal identity: a handwritten signature is expected to reproduce the signer's personal style, which enables identification by legal authorities. In a methodologically inventive and semiotically-based dialogue with Derrida's deconstruction, Fišerová situates this triple expectation in the interval between life and law. Challenging coverage of this topic finally shows that none of the metaphysical expectations will ever be fulfilled in the event of manual signing. Legal uses of handwritten signature are characterized by the complex aporia of repeating the unrepeatable. (shrink)

Investigates, by way of Derrida's engagements with Kant, how the foundations of modern constitutionalism can be differently conceived to address some of the challenges of the twenty-first century.

This paper considers two among the several points of intersection in the work of Roberto Esposito and Jacques Derrida. First, and most obviously: in the context of conceptualizing community, and more broadly, Esposito and Derrida have elaborated concepts of immunity and auto-immunity to refer to auto-destructive modes of defense which profoundly threaten what – seemingly – ought to have been safeguarded through their mechanism. The second point of proximity is the use both make of figures of maternity and birth in (...) these conceptualizations. This comparison not only illuminates the differing philosophical commitments of Derrida and Esposito but also offers a means of challenging the fate of sexual difference in the work of Esposito. Each thinker, according to Heidegger, essentially thinks one thought. Plato thinks the idea. Descartes thinks the cogito . Spinoza thinks substance. Nietzsche thinks the will to power. If a thinker does not think a thought, then he or she is not a thinker. He or she may be a scholar or a professor, a producer or a consumer, a fan or a fake, but he or she would not be a thinker. Thus, if Heidegger is a thinker, he essentially thinks (...) one thought. What is Heidegger’s one thought? It is neither life nor death, neither me nor you. It is neither technology nor art. It is neither spirit nor language. Heidegger’s one thought is being—or more precisely, the question of the meaning of being. And what is being? This study is an intervention in postcolonial theorising through a critique of technologies of representation. It examines the effects of technologically-mediated representation in a postcolonial condition that the Philippines has exemplified. New media technologies are mechanisms of representations that embody the logic of spectrality presented in Jacques Derrida’s later work. Spectrality, which brings doubts, ephemerality, and instability to dominant discourses and modes of representation, provides a chance for change.Spectres are effects of technologically-mediated representation that articulate the infinite demand for justice (...) under conditions of enduring inequality. As quasi-transcendental elements of deconstruction, spectres are not reducible to either human or technical intervention; they express the relation of humans to technologies, in which representation is central to the mediation of political authority. This technological representation is the condition of what Derrida calls “iteration,” or the transformation of hegemonic authority through the very repetition of its fundamental terms of identification. The examination of emancipatory new media technologies in a postcolonial condition is inspired by the work of Jacques Derrida, in his deconstructive reading of Marx’s spectres. However, the writings of Habermas and Adorno have offered an implicit appraisal of the ontology of spectres. Habermas’s theory of the public sphere and Adorno’s negative dialectics are discourses that unwittingly solicit spectres. The account of the postcolonial condition in the Philippines works through the questions of universality, subalternity, and the right to theory that are raised by the project of Western critical theory.
