This paper argues that non-identity actions are wrong because they _cause_ harm to people. While non-identity actions also typically benefit people, failure to act would similarly benefit someone, so considerations of benefit are ineligible to justify the harm. However, in some non-identity cases, failure to act would not benefit anyone: cases where one is choosing whether to procreate at all. These are the _hard_ non-identity cases. Not all "different-number" cases are hard. In some cases, we don't know whether acting would (...) result in more or fewer people; this paper argues that this _epistemic_ factor makes acting in these cases wrong. (shrink)

Is it fair to leave the next generation a public debt? Is it defensible to impose legal rules on them through constitutional constraints? From combating climate change to ensuring proper funding for future pensions, concerns about ethics between generations are everywhere. In this volume sixteen philosophers explore intergenerational justice. Part One examines the ways in which various theories of justice look at the matter. Some authors have called for increased research on various forms of geoengineering as a means to address global climate change. This paper focuses on the question of whether a particular form of geoengineering, namely deploying sulfate aerosols in the stratosphere to counteract some of the effects of increased greenhouse gas concentrations, would be a just response to climate change. In particular, we examine problems sulfate aerosol geoengineering (SAG) faces in meeting the requirements of distributive, intergenerational, and procedural justice. We argue (...) that SAG faces obstacles to meeting the requirements of all three considered kinds of justice, because its impacts can harm some persons and communities much more than others; it poses serious risks to future generations; and SAG is especially prone to unilateral implementation. While we do not claim that SAG ought not to be implemented, we argue that it is the responsibility of proponents of SAG to recognize and address these ethical obstacles before advocating its implementation. Climate change is projected to have very severe impacts on future generations. Given this, any adequate response to it has to consider the nature of our obligations to future generations. This paper seeks to do that and to relate this to the way that inter-generational justice is often framed by economic analyses of climate change. To do this the paper considers three kinds of considerations that, it has been argued, should guide the kinds of actions that one generation should take (...) if it is to treat both current and future people equitably. In particular it examines the case for what has been termed pure time discounting, growth discounting and opportunity cost discounting; and it assesses their implications for climate policy. It argues that none of these support the claims of those who think they give us reason to delay aggressive mitigation policies. It also finds, however, that the second kind of argument can, in certain circumstances, provide support for passing on some of the costs of mitigation to future generations. (shrink)

Ultimately this book provides a theory of intergenerational justice that is both intellectually robust and practical with wide applicability to law and policy.

Democracy is prone to what may be called presentism – a bias in the laws in favor of present over future generations. I identify the characteristics of democracies that lead to presentism, and examine the reasons that make it a serious problem. Then I consider why conventional theories are not adequate to deal with it, and develop a more satisfactory alternative approach, which I call democratic trusteeship. Present generations can represent future generations by acting as trustees of the democratic process. (...) Some people feel distressed reflecting on human extinction. Some people even claim that our efforts and lives would be empty and pointless if humanity becomes extinct, even if this will not occur for millions of years. In this essay, I will attempt to demonstrate that this claim is false. The desire for long-lastingness or quasi-immortality is often unwittingly adopted as a standard for judging whether our efforts are significant. If we accomplish our goals and then later in life conclude that (...) these accomplishments were of no significance, then this is a sign that the desire for long-lastingness has crept into our standards. By recognizing this, and refraining from adopting an unreasonable standard to judge whether our efforts are significant, it will be to our advantage. Then, when we look back on life from an external perspective that encompasses times after humanity has become extinct, we will not conclude that our efforts amounted to nothing. Rather, we will conclude that many people made significant accomplishments that made their lives and the lives of other people better than they would have been if their goals had never been pursued. The aim of this paper is to consider whether some seats in a democratically elected legislative assembly ought to be reserved for representatives of future generations. In order to examine this question, I will propose a new democratic model for representing posterity. It is argued that this model has several advantages compared with a model for the democratic representation of future people previously suggested by Andrew Dobson. Nevertheless, the democratic model that I propose confronts at least two difficult problems. First, (...) it faces insoluble problems of representative legitimacy. Second, one might question whether this model provides a reasonably effective way to represent future interests compared with existing representative democratic institutions. Despite such problems, it is argued that political representation of posterity can be defended on the basis of fundamental ideas and ideals in recent theory of deliberative democracy. The first reason for this is that in a number of cases democratic decisions cannot be regarded as normatively legitimate from the point of view of deliberative democracy, unless posterity is given a voice. The second reason is that representation of posterity can contribute to more rational and impartial deliberations and decisions in legislative assemblies. (shrink)

In 2001, 178 of the world's nations reached agreement on a treaty to combat global climate change brought on by anthropogenic emissions of greenhouse gases. Despite the notable omission of the United States, representatives of the participants, and many newspapers around the world, expressed elation. Margot Wallström, the environment commissioner of the European Union, went so far as to declare, “Now we can go home and look our children in the eye and be proud of what we have done.”In this (...) article, I argue for two theses. First, the rhetoric and euphoria surrounding the 2001 deal is misplaced. This is not, as is often said, because the Kyoto agreement is too demanding but rather because it is much too weak. In particular, the Kyoto agreement does little to protect future generations. On the contrary, (at best) it seems to be a prudent wait-and-see policy for the present generation, narrowly defined. Hence, even those countries who have endorsed the Kyoto agreement should be wary of looking their children in the eye, and none should relish facing their children's children.Second, the failure of the Kyoto agreement can be explained in terms of the underlying structure of the problem. Climate change involves the intersection of a complex set of intergenerational and intragenerational collective action problems. This structure, and in particular its intergenerational aspect, has not been adequately appreciated. Yet until it is, we are doomed to an ineffectual environmental policy. (shrink)

There is an awakening of interest in links between geography and moral philosophy, or ethics. This paper reviews a range of issues where common ground might be found on this new disciplinary interface. These issues include the historical geography of moralities, the notion of moral geographies, inclusion and exclusion in the context of the bounding of spaces, and the moral significance of distance and proximity, as well as the more familiar concern with social justice. Environmental ethics provides a link with (...) the physical side of the subject. Some suggestions are made as to the possible contribution of geography to the understanding of moral issues. In this paper, the author offers a synoptic view of different theories of intergenerational justice, along two dimensions (savings/dissavings) and three modalities (prohibition, authorisation, obligation). After presenting successively the indirect reciprocity, the mutual advantage, the utilitarian and the Lockean approaches, special attention is given to the egalitarian theory of intergenerational justice. Two key differences between the egalitarian view on intergenerational justice and the sufficientarian interpretation of sustainability are highlighted.

The ethical matrix is a participatory tool designed to structure ethical reflection about the design, the introduction, the development or the use of technologies. Its collective implementation, in the context of participatory decision-making, has shown its potential usefulness. On the contrary, its implementation by a single researcher has not been thoroughly analyzed. The aim of this paper is precisely to assess the strength of ethical matrixes implemented by a single researcher as a tool for conceptual normative analysis related to technological (...) choices. Therefore, the ethical matrix framework is applied to the management of high-level radioactive waste, more specifically to retrievable and non-retrievable geological disposal. The results of this analysis show that the usefulness of ethical matrixes is twofold and that they provide a valuable input for further decision-making. Indeed, by using ethical matrixes, implicit ethically relevant issues were revealed—namely issues of equity associated with health impacts and differences between close and remote future generations regarding ethical impacts. Moreover, the ethical matrix framework was helpful in synthesizing and comparing systematically the ethical impacts of the technologies under scrutiny, and hence in highlighting the potential ethical conflicts. This paper approaches the choice between the open and closed nuclear fuel cycles as a matter of intergenerational justice, by revealing the value conflicts in the production of nuclear energy. The closed fuel cycle improve sustainability in terms of the supply certainty of uranium and involves less long-term radiological risks and proliferation concerns. However, it compromises short-term public health and safety and security, due to the separation of plutonium. The trade-offs in nuclear energy are reducible to a chief trade-off between (...) the present and the future. To what extent should we take care of our produced nuclear waste and to what extent should we accept additional risks to the present generation, in order to diminish the exposure of future generation to those risks? The advocates of the open fuel cycle should explain why they are willing to transfer all the risks for a very long period of time (200,000 years) to future generations. In addition, supporters of the closed fuel cycle should underpin their acceptance of additional risks to the present generation and make the actual reduction of risk to the future plausible. J. Baird Callicott has thrown down the gauntlet once again in the monism?pluralism debate in environmental ethics. In a recent article he argues that his ?communitarianism? (combined with a limited intertheoretic pluralism) is sufficient to get the advantages of pluralism advocated by his critics, while at the same time retaining the framework of moral monism. Callicott's attempt to set the record straight on the monism?pluralism debate has once again derailed us from answering the most important question in this discussion: how (...) do we achieve a compatibilism among ethical theories which will inform better environmental practices? But if Callicott got it wrong, then who is getting it right? Arne Naess, whose work has heretofore been excluded from the mainstream discussion of this issue, has all along understood the heart of the monism?pluralism question. This paper updates the current state of the monism?pluralism debate, provides an answer to Callicott's latest challenge, and advances the thesis that all involved in this argument would do well to take a look at what Naess has to say on this issue. Despite the centrality of the topic for the debate on sustainability, future generations have largely been ignored by business ethics. This neglect is in part due to the enormous philosophical challenges posed by the concepts of future generations and intergenerational duties. This article reviews some of these difficulties and defends that much clarity would be gained from making a distinction between future generations and the next generations. It also argues that the concept of next generations offers a better starting point (...) for business ethics to incorporate the topic in its research agenda. We then suggest four potential pathways to explore this territory. The four approaches build on the notion of organizations as communities with memory and vision, on the narrative shape of organizational life, on the affinity of stakeholders with the next generation, and on systems of indirect reciprocity. These first two approaches are connected to communitarian approaches to business ethics, and the last two engage in a dialog with contractarian views and stakeholder theory. This paper reflects on the various possible nuclear power production methods from an ethical perspective. The production and consumption of nuclear power give rise to the problem of intergenerational justice; in other words, we are depleting a nonrenewable resource in the form of uranium while the radiotoxic waste that is generated carries very long-term potential burdens. I argue that the morally desirable option should therefore be to seek to safeguard the interests of future generations. The present generation has at least (...) two duties with regard to posterity: not to jeopardize the safety and security of future generations or impose any harm upon them and to sustain future well-being insofar as that is possible with the available energy resources. These duties are presented as pluralist prima facie duties thus implying that they could well be overruled by morally more compelling duties. If we are unable to fulfill both these prima facie duties simultaneously, it should be particularly the duty not to impose harm on posterity that should be the leading incentive behind nuclear power production. This supports the arguments in favor of the introduction of a new fuel cycle that can substantially reduce the waste lifetime and therefore also potential future burdens. However, the further development and application of this scientifically proven but not yet industrialized fuel cycle give rise to additional burdens for contemporaries. This paper examines the extent of the moral stringency of the no harm duty sought for situations in which future interest should guide us in our choosing of a certain technology. (shrink)

The standard argument for longtermism assumes that we should care as much about far future people as about our contemporaries. I challenge this assumption. I first consider existing interpretations of ‘temporal discounting’, and argue that such discounting seems either unwarranted or insufficient to block the argument. I then offer two alternative reasons to care less about far future people: caring as much about them as about our contemporaries would make our lives less authentic and less meaningful. If I’m right, this (...) undermines at least the strongest versions of longtermism. Plausibly, we should do much more for the far future than we’re currently doing. Still, we often ought to act for contemporaries’ sakes, even if longtermist actions would expectably do more good. (shrink)

The nuclear community frequently refers to the concept of “future generations” when discussing the management of high-level radioactive waste. However, this notion is generally not defined. In this context, we have to assume a wide definition of the concept of future generations, conceived as people who will live after the contemporary people are dead. This definition embraces thus each generation following ours, without any restriction in time. The aim of this paper is to show that, in the debate about nuclear (...) waste, this broad notion should be further specified and to clarify the related implications for nuclear waste management policies. Therefore, we provide an ethical analysis of different management strategies for high-level waste in the light of two principles, protection of future generations—based on safety and security—and respect for their choice. This analysis shows that high-level waste management options have different ethical impacts across future generations, depending on whether the memory of the waste and its location is lost, or not. We suggest taking this distinction into account by introducing the notions of “close future generations” and “remote future generations”, which has important implications on nuclear waste management policies insofar as it stresses that a retrievable disposal has fewer benefits than usually assumed. The normative aim of environmental justice poses two challenges to the management of agricultural systems: improvement of access for today's rural poor to vital ecosystem services ; and sustenance of critical ecosystem funds to enable future persons access to vital ecosystem services. The paper investigates whether, and how, these justices have been simultaneously enhanced by the Philippine farmer network MASIPAG. It compares evaluation data on MASIPAG and conventional farming systems within a normative framework based on the justice conceptions by Rawls (...) and Sen, and analyses the impact of certain determinants on both justices. John Rawls’ account of our obligations towards future generations has received considerable criticism in the environmental ethics literature relative to the scant few passages in which he discusses the issue. I argue that much of this criticism is warranted because Rawls’ Heads of Family strategy for grounding obligations to future generations is not only independently problematic, but also inconsistent with his general framework. Furthermore, the oft-suggested Time Travel strategy will not work either, and for just those reasons which Rawls gave. (...) However, I contend that the less often discussed “Universalizability Principle,” which Rawls discusses most prominently in Political Liberalism, is a plausible account of our obligations to future generations and is consistent with Rawls’ general framework. I then defend this Rawlsian account of our future-oriented obligations against objections in the environmental ethics literature such as those recently advanced by the consequentialist Tim Mulgan. As the increasing loss of ecosystem services severely affects life perspectives of today's poor and future populations, governing access to, and use of, ecosystem services in an intragenerational and intergenerational just way is an urgent issue. The author argues that theories of distributive justice should consider the distribution of access rights to ecosystem services. Three specific demands that a theory of distributive justice should fulfill to adequately cope with the distribution of access rights to ecosystem services, and show that Rawls??A (...) In this paper, I will be primarily concerned with moral issues regarding future people and the environment. When it comes to the future, we have deontological and epistemic limitations. The closer to the present, the higher the certainty and the knowledge we have about facts. Thus, when we intend to find moral clarity regarding a future scenario, we deal with an inverse relation between certainty and time. The main problem is that most ways of dealing with moral issues about future (...) scenarios do not address this relation, and rather focus on things that seem to simplify and clarify the uncertainties of the future. In response to this, I propose a different approach, one that operates neutrally and timelessly dealing with the uncertainties of the future while providing moral groundings that can help to clarify the future’s state of moral vagueness. It is common practice in intergenerational justice to set fixed thresholds determining what qualifies as justice. Static definitions of how much and what to save for future generations, however, overestimate human epistemological limits and predictive capacity in regard to uncertainty in social- and ecosystems. Long-term predictions cannot account for the inherent range of contingent variables at play, especially according to contemporary theories of punctuated equilibrium. It is argued that policies deliberately testing ecological limits as currently conceived must be excluded from (...) political calculations to minimize current actions from foreclosing future life quality and options. To better reduce harms to present and future generations and support the stability of just institutions (and the stable environments they depend on) as Rawls and others demand, polities can overcompensate resource allocation to environmental sustainability. Focus on reducing environmental harms benefits both current and future generations, reconciling distributive versus intergenerational justice trade-offs. (shrink)

This paper considers the prospects for a theory of intergenerational rights in light of certain ontologies of time. It is argued that the attempt to attribute rights to future persons or obligations to present persons towards future persons, faces serious difficulties if the existence of the future is denied. The difficulty of attributing rights to non-existent future persons is diagnosed as a particularly intractable version of the ‘problem of cross-temporal relations’ that plagues No-Futurist views like presentism. I develop a version (...) of the problem of cross-temporal relations regarding cross-temporal normative relations. I then consider and reject various solutions to the problem available to No-Futurists. The upshot of the discussion is that which ontology of time we choose sets constraints on the kinds of explanations we may offer for our future-directed obligations. (shrink)

Thirty years ago the American philosopher Holmes Rolston published a seminal article in Ethics announcing the birth of a new sub‐discipline in philosophy: environmental ethics. However, while environmental ethicists focused on meta‐ethical questions, the public needed answers to many political questions and dilemmas. This gave rise to some fascinating works in environmental political theory. This essay analyses their achievement – what has been solved and what still remains to be studied – focusing on three main topics: justice and the environment, (...) democracy and the environment, and globalism and the environment. What do the living owe those who come after them? It is a question nonsensical to some and unanswerable to others, yet tantalizing in its persistence especially among environmentalists. This article makes a new start on the topic of intergenerational justice by bringing together human rights and environmental justice arguments in a novel way that lays the groundwork for a theory of intergenerational environmental justice based in the human rights to clean air, water, and soil. Three issues foundational to such (...) a theory are explored here. First is the broad question of whether justice is applicable to future (or past) generations in any real sense, or do such issues fall under the rubric of superogation. Second, can environmental goods properly be contained in a theory of distributive justice at all, since, superficially at least, they seem different in kind than the usual objects of justice? I will discuss them as “emergent” goods in fact central to contemporary justice distributions. Third, what is the relationship of justice to rights, and how can environmental human rights be included in justice distributions? (shrink)

The Kantian categorical imperative process of rational reflection and reasoned social discourse is theoretically capable of forming the moral environmental maxims applicable to business. This article argues that rational environmental discourse demands that business has an imperfect duty to develop relevant unbiased information, and perhaps to disseminate this information through participation in business-public coalitions. For the environmental problem, this “rationality” particularly concerns our obligations toward future generations and distant people while recognizing that they cannot participate in current discourse, and the (...) rules for gathering and assessing the evidence that should govern our environmental preservations and enhancements. Both these concerns demand certain scientific information requirements, as well as logical decision criteria that are perceived as stable across both overlapping generations, and affected peoples. The criteria for Rawls’ “considered moral judgments” are shown to apply to resolutions of these business-related ethical conundrums. In a way similar to Kant’s anthropological examinations of humanity’s antisocial behaviors, this article also examines various biases that inhibit this social reasoning. (shrink)

Justice is a contested concept. There are many different and competing conceptions, i.e. interpretations of the concept. Different domains of justice deal with different fields of application of justice claims, such as structural justice, distributive justice, participatory justice or recognition. We present a formal conceptual structure of justice applicable to all these domains. We show that conceptions of justice can be described by specifying the following conceptual elements: the judicandum, the community of justice including claim holders and claim addressees, their (...) claims, the informational base for the assessment, the principles of justice, and on a more practical level, the instruments of justice. By specifying these conceptual elements of justice, it is possible to analyse and compare different conceptions of justice, to assess their internal consistency, to explore new definitions of justice in an analytical way, and to explicate an idea of justice in a manner that provides concrete links to the relevant context. Contemporary work on the links between geography and morality tends to focus on the spatial aspects of moral conduct. This paper argues that in addition to geographical space, geographical scale also plays a crucial role in the construction and maintenance of moral frameworks. Focusing on the emergence of the sustainable region in the UK, this paper argues that purportedly sustainable spaces, like the region, contain distinctive moral codes of socio-ecological conduct which are designed to guide actions and locational decisions within (...) regional space. Drawing on the case of regional development in the West Midlands, however, analysis shows that sustainable regions are characterised by not only a moral geography of space, but also a morality of scale. Combining recent work on moral geography with analyses of the political construction of geographical scale, this paper uses the case of post-war regional development in the West Midlands to show how the construction of moral landscapes is intimately tied to the production of particular moralities of scale and scales of morality. Anthropogenic climate change is expected to contribute to mass migration from many different regions. Heyward and Ödalen (2016) propose a tailor-made migration option for victims of total territorial loss: a Free Movement Passport for the Territorially Dispossessed (PTD). The PTD presents a significant advancement over standard proposals for individual migration in response to total territorial loss. However, I argue that the compensatory obligations of states are more restrictive than the PTD scheme assumes (sec. 5), and that the contents of the (...) right to compensation of the territorially dispossessed are not as far-reaching as required by it (sec. 6). In response to these difficulties, I argue that its purpose is better served by means of collective migration and propose a Passport for Territorially Dispossessed Collectives, which is also well positioned to serve as a framework for compensating a range of other climate-change related losses (sec. 9).
