Krause’s philosophy deserves to be memorized as the first link in a chain of thinking on animal rights that is still on the way today. Though Krause was not the first to talk of animal rights in the history of animal ethics, his theory of animal rights is pathbreaking in embedding a conception of animal rights in an all-encompassing metaphysical system. Game theory is the systematic study of interdependent rational choice. It should be distinguished from decision theory, the systematic study of individual (practical and epistemic) choice in parametric contexts (i.e., where the agent is choosing or deliberating independently of other agents). Decision theory has several applications to ethics (see Dreier 2004; Mele and Rawlings 2004). Game theory may be used to explain, to predict, and to evaluate human behavior in contexts where the outcome of action depends on what several agents (...) choose to do and where their choices depend on what others choose to do. (See the entry on game theory) Game theory consequently is relevant to ethics, and it is used in moral and political philosophy in a variety of ways. We shall concentrate on the influence and use of game theory in ethics and those parts of political theory involving norms or principles of justice, ignoring questions about political and legal institutions on the one hand and questions about issues dealing with moral virtues on the other. Moses Finley's reflections on ancient and modern democracy, explicitly directed against the liberal mainstream of political science, but also - avant la lettre - against the belittling of Greek democracy that has become fashionable among post-Marxist radicals, can be taken as a starting point for further discussion of historical as well as theoretical questions. The points at issue have to do with the belated recognition of democracy as a part of the Greek tradition, but also with the divided and contested (...) modern tradition that grew out of this new perspective on the past. The French Revolution is crucial to both aspects of the problem. Although it can be shown that the well-known attempts of the revolutionaries to appropriate classical models did not - in the short run - radically alter the image of ancient Greece, the very experience of the revolution - both as an exceptionally dramatic historical event and as a key episode in a more long-term process - was bound to change modern perceptions of the classical world. The new understanding of Greek democracy, made possible by the revolution but not inspired by it, was first articulated by the radical wing of 19th-century liberalism; but it could, in due course, serve to develop a critique of liberalism. The best way to conceive semiotical spaces that are not identical to single buildings, such as a cityscape, is to define the place in terms of the activities occurring there. This conception originated in the proxemics of E. T. Hall and was later generalized in the spatial semiotics of Manar Hammad. It can be given a more secure grounding in terms of time geography, which is involved with trajectories in space and time. We add to this a qualitative dimension which (...) is properly semiotic, and which derives from the notion of border, itself a result of the primary semiotic operation of segmentation. Borders, in this sense, are more or less permeable to different kinds of activities, such as gaze, touch, and movement, where the latter are often not physically defined, but characterized in terms of norms. Norms must be understood along the lines of the Prague school, which delineates as scale going from laws in the legal sense to simple rules of thumb. Such considerations have permitted us to define a number of semio-spatial objects as, most notably, the boulevard, considered as an intermediate level of public space, located between the village square and the coffee house presiding over what Habermas called the public sphere. Urbanity originates as a scene on which the gaze, well before the word, mediates between the sexes, the classes, the cultures, and other avatars of otherness. However, this scenario is seriously upset but the emergence of the cell phone and other technical devices, as well as by the movement of populations. (shrink)

This essay explores the various ways in which in the history of philosophy the imperative to return to nature has been understood. Against this background, it takes up the question as to how the concept of nature is to be determined in contemporary thought.

In this philosophical memoir I trace out the part that Roy Bhaskar's philosophy of science played in the development of a non-reductive account of realism in art and cultural theory in the 1970s and 1980s in the UK, and the part his Dialectic played in the theorization of the concept of the philistine developed by myself and Dave Beech between 1996 and 1998. Our de-positivization of the concept as a symptomatic negation of the bourgeois ‘aesthete’ drew extensively on Bhaskar's notion (...) of absence as a real absence. This in turn, allowed us to bring Bhaskar's realism and Theodor Adorno's Aesthetic Theory into alignment, where the philistine plays a similar, if undeveloped and untheorized role. Overall, the article marks a recognition of the continuing possibilities of Dialectic for a theory of negation in contemporary art and cultural theory. (shrink)

The erosion of educational authority is less than a crisis. The first two sections of this text involve the clarification of the concept of educational authority. It’s also an opportunity to refute critical theses derived from psychological or pedagogical writings that aim to purify educational acts all forms of authority. These approaches, which often characterise authority as a form of coercion, weaken the anthropological perspective, which is at the heart of the educational process. If authority is necessary, this is quite (...) simply because this never authorises present day behaviour. This study deals with responsibility as part of innovation. By nature, innovation gives birth to development for the organization and can only be at the core of any strategy within an ever-increasingly global economic context. However it also raises new questions stemming mostly from the impossibility to forecast the success of the innovations. More precisely, the questions raised by innovation also concern its consequences on society as a whole. Today, the innovator should understand his responsibility, the consequence of each innovation. (...) Moreover, common acceptance of the word ‘responsibility’ raises some questions about its use and how it should be understood. What does ‘responsibility’ mean? Who is responsible and for what? Through the notion of ‘care’, we aim at providing an evolution of responsible-innovation. The concept of ‘innovation-care’ is centered on people and more precisely focuses on taking care of them. The purpose of innovation-care is indeed to innovate and keep up with the level of productivity necessary to any organization while taking into account the essential interdependence between the status of the innovator and that of the citizen. [full article, abstract in English; abstract in Lithuanian] During the last few years, it has become usual to turn to some seventeenth century readings of the traditional idea of an original common possession of the earth for philosophical aid to explain and support the rights of persons in situations of extreme need, including refugees. Hugo Grotius’s conception of this idea is one of the most cited ones. In this paper, I hold that a Grotian reading of the idea of an (...) original common possession of the earth is not a fruitful principle if we want to elaborate a solid defence of the rights of the ones in need. I reconstruct and analyse the role this idea has in Grotius’s theory of private property and present objections to it from a Kantian perspective. (shrink)

Erhics committees and ethics consultants are becoming more involved in helping individuals make decisions and in advising institutions and legislatures about drafting policy. The role of these committees and consultants has been acknowledged in law, and their function is generally considered salutory and helpful. Ethics consultants and committees, furthermore, play a critical role in educating students and members of the hospital community and the public at large. More over, many ethicists engage in scholarky activities to expand the boundaries of our (...) understanding and, in turn, facilitate our capacity for helping. The role of the ethicist and of the ethics committee is thus manifold. Ethics committees and ethics consultants somehow “in competition” is a mistaken notion: when ethics committees, ethics consultants, and the community work smoothly together, much good can be accomplished. In this paper I: (1) Describe something of the present situation in the United States and briefly contrast this with the state of affairs in other nations of the industrialised world. I emphasise health care but also allude to other social conditions: health care is merely one institution of a society and, just as do its other institutions, the system of health care reflects the basic world-view of that society. (2) Sketch the world-view and the philosophy which underwrites the use (...) of a market system in distributing what are acknowledged to be critically important social goods like health care and higher education. I show that a well-functioning market can indeed be useful when it comes to distributing some, but not when distributing other goods. (3) Suggest that when competition and the market are used to ‘regulate’ health care, technology—instead of being used to benefit patients—is apt to be used primarily to maximise individual profit: it becomes a weapon between what is often painted as ‘warfare’ among health care providers and institutions. I argue that this state of affairs is based on an undue emphasis upon the demands of individual freedom to the detriment of the community. Finally (4) I suggest an alternative approach to balancing individual with communal interests, an approach which is neither based on a predominance of one with neglect of the other, nor on a dialectic balance between them, but rather upon an approach which sees both individual and communal interests as modifying forces in a complex homeostatic balance. Individual success, in any civilised sense of the term, is possible only in a viable and well-functioning community, and a well-functioning community is not possible without individual success: the two are inevitably interdependent and linked. This article explores the aportation of Adam Smith’s Considerations Concerning the First Formation of Languages to the rest of his work. It starts analyzing its internal structure in the light of its documented sources, of which it follows a linguistic model that is more constructive than referential. From the initial approach that language, first of all, communicates needs, the author connects this germ of the process of socialization with Smith’s published works, explaining them as a semiotic development of the fundamental (...) idea that the human being has not a definite Nature, but an open history in which he must make to himself. This paper examines how Western humanitarianism has attempted to work through its simultaneous commitment to individualized moral universalism and ambivalence about substantive global egalitarianism via what is identified as humanitarian sentimentalism, namely an ensemble of narrative and visual mechanisms designed to cultivate charitable moral sentiments among Euro-American publics toward victims of humanitarian crises in the global South. After briefly discussing how the aforementioned ambivalence is rooted in the founding philosophical principles of humanitarianism, the paper examines the visual economy of humanitarian (...) sentimentalism, constituted through four iconographic tropes found in the history of Western representation of humanitarian emergencies and injustices (personification, massification, rescue, and care), each of which aims to trigger sentimentalizing responses on the part of viewers. Hence, it is argued that if the Western humanitarian movement's dependence on visually based sentimentalism has been effective in generating a sense of concern for distant others, such concern has not been converted into a more radical and egalitarian set of political practices of global solidarity, which would aim structurally to transform the current world order in an egalitarian manner to tackle the systemic sources of humanitarian crises. A partir daí pretende-se mostrar que a unidade entre esses filósofos é apenas aparente. Pois, apesar das semelhanças, as diferenças que há entre as concepções e orientações metodológicas destes autores são suficientes para atestar que estamos diante projetos filosóficos muito distintos. Lorsque la philosophie a voulu penser la propriété et son origine, elle a fait de la nature le cadre approprié pour l’appréhender, y compris à des époques où la propriété, aussi bien privée que commune, était déjà régulée par un système de juridictions préexistant. La propriété et la question de sa légitimité ont alors été interrogées aux confins de l’articulation entre l’ordre du fait (s’incarnant notamment dans l’appropriation) et celui du droit. Néanmoins la mise au premier plan d’une nécessité naturelle (...) ainsi que l’inscription de l’appropriation dans un registre naturaliste ont pour vocation de soustraire la propriété à la problématique de la justice distributive. L’approche naturaliste de l’appropriation privative implique en outre un usage pragmatique de la norme juridique, renversant par là la « loi de Hume », alors même que cette norme pourrait être tout aussi légitimement mobilisée pour instaurer un devoir-être plutôt que pour instituer juridiquement un état de fait. The question of monogenesis vs. polygenesis of human languages was essentially neglected by contemporary linguistics until the appearance of the research on the genetics of human populations by L. L. Cavalli-Sforza and his collaborators, which brought to light very exciting parallels between the distribution of human populations and that of language families. The present paper highlights some aspects of the history of the problem and some points of the contemporary discussion. We first outline the “Biblical paradigm”, which persisted until the (...) 18th century even in scientific milieus. Then, we outline some aspects of the 19th century debate about monogenesis vs. polygenesis of languages and about the relationships between languages and human populations: in particular, we will discuss the views of Darwin on the one hand and of some linguists on the other (Schleicher, M. Müller, Whitney and Trombetti). It will be seen that their positions only partly coincide; at any rate, it will be shown that Darwin was partly inspired by the problems of the genealogy of languages and that the linguists, for their part, took account of Darwin’s views. Turning to today’s debate, we first present the positions of the linguists arguing for monogenesis, namely J. Greenberg and M. Ruhlen, as well as the criticisms raised against their methods by the majority of linguists. Other scholars, such as D. Bickerton or N. Chomsky, essentially argue, from different points of view, that the problem of monogenesis vs. polygenesis of languages is a “pseudo-problem”. We however think that, although the question cannot be reasonably solved by linguistic means, it cannot be discarded as meaningless: it is an anthropological rather than a linguistic problem. We present some reflections and suggestions, in the light of which the monogenetic hypothesis appears as more tenable than the polygenetic one. (shrink)

Standard game theory cannot explain the selection of payoff-dominant outcomes that are best for all players in common-interest games. Theories of team reasoning can explain why such mutualistic cooperation is rational. They propose that teams can be agents and that individuals in teams can adopt a distinctive mode of reasoning that enables them to do their part in achieving Pareto-dominant outcomes. We show that it can be rational to play payoff-dominant outcomes, given that an agent group identifies. We compare team (...) reasoning to other theories that have been proposed to explain how people can achieve payoff-dominant outcomes, especially with respect to rationality. Some authors have hoped that it would be possible to develop an argument that it is rational to group identify. We identify some large—probably insuperable—problems with this project and sketch some more promising approaches, whereby the normativity of group identification rests on morality. (shrink)

Prompted by Derrida's work on the animal-fable in eighteenth-century debates about political power, this article examines the role played by the fiction of the animal in thinking of pity as either a natural virtue (in Rousseau's Second Discourse) or as a natural passion (in Mandeville's The Fable of the Bees). The war of fables between Rousseau and Mandeville – and their hostile reception by Samuel Johnson and Adam Smith – reinforce that the animal-fable illustrates not so much the proper of (...) man as the possibilities and limitations of a moral philosophy that is unable to address the political realities of the state. The relationship of necessity is intimate: physicians have knowledge of their patients' histories and of their bodies which under other circumstances would be reserved to the most intimate of friends, and physicians and patients meet under more or less critical situations. On many occasions, care givers are faced with problems in which “drastic” types of treatment seem clearly inappropriate but “lesser” interventions still appear to be advisable, if not indeed mandatory. In the hospital setting, examples are frequent: the demented elderly patient, still very much capable of brief social interactions and still able to enjoy at least limited life, who although clearly not a candidate for coronary bypass surgery is, nevertheless, a patient in whom an intercurrent pneumonia deserves treatment; the severely (...) retarded youngster in whom appendectomy seems clearly warranted but for whom long-term dialysis seems ill-advised. The examples are legion, and their variety defies an easy, stereotypical solution. Why, one may ask, is the treatment of intercurrent pneumonia or operating on an acute appendix “clearly indicated” while coronary bypass and long-term dialysis “clearly” are not? The reactions of care givers in the past have often consisted of attempts to give half-hearted treatment or to treat fully even against their better judgment. The lack of conceptual guidelines that might help sort out such problems has inevitably led either to an inflexible absolutism in which all possible treatment to sustain life or no treatment at all is given or has resulted in a pathetic attempt to act but act minimally with the hope that such actions will be ineffective. In this paper, I want to try to put what has been termed the “care ethics” into a different perspective. While I will discuss primarily the use of that ethic or that term as it applies to the healthcare setting in general and to the deliberation of consultants or the function of committees more specifically, what I have to say is meant to be applicable to the problem of using a notion like “caring” as a fundamental precept in ethical decision (...) making. I will set out to examine the relationship between theoretical ethics, justice-based reasoning, and care-based reasoning and conclude by suggesting not only that all are part of a defensible solution when adjudicating individual cases, but that these three are linked and can, in fact, be mutually corrective. I will claim that using what has been called “the care ethic” alone is grossly insufficient for solving individual problems and that the term can be extremely dangerous. I will readily admit that while blindly using an approach based solely on theoretically derived principles is perhaps somewhat less dangerous, it is bound to be sterile, unsatisfying, and perhaps even cruel in individual situations. Care ethics, as I understand the concept, is basically a non- or truly an anti-intellectual kind of ethic in that it tries not only to value feeling over thought in deliberating problems of ethics, but indeed, would almost entirely substitute feeling for thought. Feeling when used to underwrite undisciplined and intuitive action without theory has no head and, therefore, no plan and no direction; theory eventuating in sterile rules and eventually resulting in action heedlessly based on such rules lacks humanity and heart. Neither one nor the other is complete in itself. There is no reason why we necessarily should be limited to choosing between these two extremes. (shrink)

This paper will discuss the role of compassion in ethics in general and in healthcare ethics in particular. My thesis is that compassion:1) as Rousseau pointed out, is a natural trait common to all higher animals ;2) can and does serve as one of the most important motivators and modulators of ethics in both theoretical and applied aspects;3) must be controlled by, and in turn control, reason if it is to serve its ethical as well as natural purposes; and4) as (...) a natural trait has survival value and, by virtue of being a natural trait, cannot be an obligation although there may very well be an obligation to do all that is necessary to nurture and not crush this sentiment. A quick survey of the literature reveals that authors disagree as to which sentiments are moral and which are not, they disagee as to how to distinguish between moral and other sentiments, and finally that often the same author will claim a sentiment is moral at some times but not at others. These difficulties arise, I argue, from an underlying concept of emotion that I call atomism. Viewing emotions as means of coordination among agents, rather than as psychic atoms, suggests (...) a radically different approach to the question of morality and affects, one where emotions pave the way for normative expectations. We investigate the limits of communication and leadership in avoiding coordination failure in minimum effort games. Our environment is challenging, with low benefits of coordination relative to the effort cost. We consider two leader types: cheap-talk leader-communicators who suggest an effort level, and first-mover leaders who lead by example. Both types of leadership have some ability to increase effort in groups with no history, but are insufficient in groups with a history of low effort. Using the strategy method for followers’ (...) responses, we attribute the persistence of coordination failure to the presence of followers who do not follow the leader. (shrink)

This paper offers an overview of consciousness and personal identity in eighteenth-century philosophy. Locke introduces the concept of persons as subjects of consciousness who also simultaneously recognize themselves as such subjects. Hume, however, argues that minds are nothing but bundles of perceptions, lacking intrinsic unity at a time or across time. Yet Hume thinks our emotional responses to one another mean that persons in everyday life are defined by their virtues, vices, bodily qualities, property, riches, and the like. Rousseau also (...) takes persons to be fundamentally determined by our socially-mediated emotional responses to one another, though unlike Hume or Locke, he has little interest in placing this account of persons alongside a larger discussion of the human mind and its operations. Developing this idea further, Kant argues that our moral commitments require that we must take ourselves to be free. The fundamental equality that Rousseau sought in the political order is, for Kant, a requirement that reason puts on all of us. (shrink)

El propósito de este artículo es discutir y comparar las concepciones de Rousseau y Kant sobre la paz perpetua. Como escritores de la Ilustración, ambos tuvieron el interés filosófico de establecer los fundamentos para un orden internacional justo que permitiera a las naciones coexistir y desarrollarse pacíficamente. En nuestro análisis nos centramos en las estrategias discursivas que ambos filósofos emplearon a fin de presentar y justificar sus proyectos. Asimismo, realizamos una comparación entre el procedimiento pragmático de Rousseau y la postura (...) moral de Kant. Con ello ponemos de relieve los defectos de la postura de Rousseau y presentamos la postura kantiana como un proyecto robusto que puede presentar una base normativa adecuada de cara al fin de la paz perpetua. Em maio de 1643, Elisabeth da Bohemia endereçou uma questão a Descartes que inaugurou uma Correspondência de seis anos, até a morte do filósofo. Ele dedica à Princesa o seu trabalho de maturidade metafísica (Princípios de Filosofia Primeira, 1644) e redige Paixões da Alma (1649) como um dos resultados do diálogo com a filósofa. O silenciamento dos últimos cem anos de historiografia sobre o legado de Elisabeth da Bohemia nesta troca epistolar causou distorções e, em alguns casos, lastreou o viés (...) como regra e como a história. Uma das consequências dessa distorção está na leitura de que a questão da filósofa consistiria em uma crítica ao dualismo substancial. Neste estudo busco oferecer uma interpretação da natureza da primeira questão, com o intuito de esclarecer o pensamento da filósofa e o seu papel no diálogo, de uma maneira compreensiva, sem subscrever o paradigma literário do solilóquio cartesiano, e seu viés na literatura filosófica. The idea of relational justice, which connects the world of Law with the relational turn of Sociology, of Pierpaolo Donati, while incorporating the economic notion of reciprocity of Luigino Bruni, attempts to analyze the legal reality based on three elements, typical of an interdisciplinary relational approach: institutionality, reciprocity and sociality. Therefore, the book Le nuove virtu del mercato nell’era dei beni comuni is a unique opportunity to present relational justice, specifying its meaning, in connection with the idea of virtue and, (...) more specifically, with good faith. This study refers, then, to relational justice, as a particular category of justice, as a present – or absent – feature in the legal relationship, and as an explanation for the closing of the virtuous circle of justice in the relationship. To deter is central for strategic thinking. Some of the more astute observations regarding the dynamics of deterrence were made during the Cold War by game theorists. This set the stage for how deterrence has come to be studied. A strong methodological element like the research on deterrence’s reliance on game theory requires examination in order to understand what sort of knowledge it actually yields. What sort of knowledge does one acquire when deterrence is viewed through game theoretic models? How (...) do they inform us about the phenomenon of deterrence? To understand the nature of a phenomenon through models requires idealization, which in turn presupposes assumptions. This licentiate thesis investigates the type of knowledge we attain when approaching deterrence from a game theoretic perspective. The two articles presented address two separate but related issues. The first article reviews a debate regarding which deterrence model best capture the phenomena of deterrence, i.e. how models can be compared to one and other. The article presents a framework for comparing models and then appraises how these different deterrence models inform us about deterrence. The second article uses one of the more central deterrence models in order to evaluate how and to what extent the naval operation Atalanta managed to deter the Somali piracy. (shrink)

This article shows that Rousseau political philosophy is inseparable from his social and educational ideas. I evince the relevance of freedom and equality both for the pedagogic sphere than for democracy. Rousseau defended social equality and the rule of law, which are essential dimensions of democratic societies. I argue that he is a pioneer of the notions of early childhood education. He is also precursor of the direct democracy from the political association; which is a base for social cohesion. I (...) argue that Rousseau ideas are useful reference for building an open republic. Then, I argue that these concepts are fundamental for a modern civic education, which is relevant considering the current conservative tendencies in the global crisis. (shrink)
