The main guiding assumption of this paper is that there is need for a taxonomy of ethical sentences that does not overgenerate, yet can make useful contributions to debates about certain controversial sentences . After surveying the recent literature and concluding that no extant taxonomy that satisfies both of these conditions is available to us, I propose and explain a novel taxonomy which does satisfy them. I then defend my proposal from five potential objections.

This paper is divided into two parts. In the first one I distinguish between weak and strong Anti-Archimedeanisms, the latter being the view that metaethics, just as any other discipline attempting to work out a second-order conceptual, metaphysical non-committed discourse about the first-order discourse composing normative practices, is conceptually impossible or otherwise incoherent. I deal in particular with Ronald Dworkin’s famous exposition of the view. I argue that strong Anti-Archimedeanism constitutes an untenable philosophical stance, therefore making logical space for the (...) practice of a discipline such as metaethics—conceived as ethically neutral. This makes space, concurrently, for neutral conceptual jurisprudence. In the second part of the article, I attempt to show two things. On the one hand, that Dworkin’s widely discussed ‘challenge of disagreements’ to legal positivism is founded upon strong Anti-Archimedeanism. On the other hand, that having rejected strong Anti-Archimedeanism we should consequently reject the challenge as a serious challenge to positivism. This move, of course, does not thereby imply that accounting for legal disagreements is not an important jurisprudential task. But it marks—contra Dworkin—that there is no principled or a priori impossibility of doing so within a positivist framework. (shrink)

Quasi-realist expressivists have developed a growing liking for minimalism about truth. It has gone almost unnoticed, though, that minimalism also drives an anti-Archimedean movement which launches a direct attack on expressivists’ non-moral self-image by proclaiming that all metaethical positions are built on moral grounds. This interplay between expressivism, minimalism and anti-Archimedeanism makes for an intriguing metaethical encounter. As such, the first part of this dissertation examines expressivism’s marriage to minimalism and defends it against its critics. The second part then turns (...) to the anti-Archimedean challenge to expressivism and shows how to ward off this challenge by securing expressivism’s non-moral, metaethical status without having to abandon minimalism about truth. On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. The metaethical subjectivist claims that there is nothing more to a moral disagreement than a conflict in the desires of the parties involved. Recently, David Enoch has argued that metaethical subjectivism has unacceptable ethical implications. If the subjectivist is right about moral disagreement, then it follows, according to Enoch, that we cannot stand our ground in moral disagreements without violating the demands of impartiality. For being impartial, we’re told, involves being willing to compromise in conflicts that are merely due to (...) competing desires—the parties to such conflicts should decide what to do on the basis of a coin flip. I suggest that Enoch is mistaken in his conception of what it means to be impartial. Once impartiality is properly construed, standing one’s ground in desire-based conflicts, whether or not moral values are at stake in the conflict, is consistent with being impartial. I defend a view on which impartiality can be understood in terms of features of our desiring attitudes. An agent acts impartially in desire-based conflicts whenever she is motivated by a final desire that aims at promoting the wellbeing of persons in a way that is insensitive to the identities of persons and their morally arbitrary features like their gender or skin color. Based on the account, I explain where Enoch’s discussion of the argument goes wrong, as well as why responses to the argument from Enoch’s critics have so far missed the mark. (shrink)

To enhance the plausibility of naturalistic moral realism, David Copp develops an argument from epistemic defeaters aiming to show that strongly a priori synthetic moral truths do not exist. In making a case for the non-naturalistic position, I locate Copp’s account within the wider literature on peer disagreement; I identify key points of divergence between Copp’s doctrine and conciliatorist doctrines; I introduce the notion of ‘minimal moral competence’; I contend that some plausible benchmarks for minimal moral competence are grounded in (...) substantive moral considerations; and I discuss two forms of spinelessness that Copp’s moral naturalism could result in. It appears that utilitarian arguments in favor of moral vegetarianism cannot justify a complete prohibition of eating meat. This is because, in certain circumstances, forgoing meat will prevent no pain, and so, on utilitarian grounds, we should be opportunistic carnivores rather than moral vegetarians. In his paper, ‘Puppies, pigs, and people: Eating meat and marginal cases,’ Alastair Norcross argues that causal impotence arguments like these are misguided. First, he presents an analogous situation, the case of chocolate mousse a-la-bama, in order (...) to argue that we, individually, are not causally impotent. Second, Norcross offers a threshold argument in which he argues that while we may individually be causally impotent, when we adopt moral vegetarianism in concert with others, we become causally potent in preventing harms by factory farming. We argue that Norcross's responses ultimately fail to address the causal impotence objection. The former argument fails because it vastly oversimplifies the world in which we find ourselves. Given the size of factory farming, the reasonable conclusion is that we are in fact powerless to prevent harms to animals in factory farms in many or most cases. The latter argument fails because even if collective action will have an impact on factory farming, this does not provide us with an argument against being carnivores in certain circumstances. Metaethical expressivism faces the perennial objection that its commitment to non‐cognitivism about moral judgment renders the view revisionary of our ordinary moral thought. The standard response to this objection is to say that since the expressivist's theoretical commitments about the nature of moral judgment are independent of normative ethics, the view cannot be revisionary of normative ethics. This essay seeks to evaluate the standard response by exploring several senses of independence that expressivism might enjoy from normative ethics. I develop a (...) taxonomy on which, at least by the expressivist's own lights, normative ethics is not dependent on non‐cognitivism about moral judgment in a way that might render that claim itself normative ethical. The argument will require us to formulate a theory of moral subject matter according to the expressivist, a matter of independent interest. Although this discussion will essentially vindicate the standard response to the perennial objection, it will also highlight a major limitation thereof. This is that even for the expressivist, the taxonomic independence of non‐cognitivism about moral judgment from normative ethics does not guarantee its moral independence from normative ethics; that is, showing that non‐cognitivism about moral judgment is not a moral claim is not itself to show that it is not a morally relevant claim. I conclude by arguing that the question of moral dependence, usually discussed under the heading of objectivity, is ultimately first‐order moral rather than taxonomic, and so can only be resolved on first‐order moral grounds. This dissertation is a defence of metaphysical ethical naturalism according to which there is a moral reality which is part of the natural world. The implication of this view is that moral properties, such as moral goodness, justice, compassion and so forth are part of the natural world, and inquiries concerning these moral entities are conducted in similar empirical ways of reasoning to that in which scientific inquiries are conducted. I defend metaphysical ethical naturalism by a variety of explanationist argument (...) in the tradition of Cornell realism. I examine preceding proposals for this argument, and focus on one version of it, which I call ‘the abductive argument for moral realism’. Although there was a suggestion about the abductive argument, the argument has not been discussed enough in the literature. This dissertation is a defence and discussion about the abductive argument which has not been properly examined. The defence of the argument requires the examination of how first-order ethical theory can be developed in the similar empirical ways scientific theories are developed. This will be an attempt to show the analogy between scientific inquiries and ethical inquiries. Describing the analogy between science and ethics, I will argue that the analogy can be best explained in terms of the approximate truth of normative theory which implies the existence of mind-independent natural moral properties. This article is concerned with the interconnection between three arguments: the Moral Explanatory Dispensability Argument, the Epistemic Explanatory Dispensability Argument, and the Companions in Guilt Argument. Silvan Wittwer has recently argued that the Epistemic EDA is self-effacing, whereas the Moral EDA is not. This difference between them is then leveraged by Wittwer to establish that there is a significant disparity between these arguments and that this disparity undermines attempts to use the CGA as a means of refuting the Moral EDA. (...) After explaining the connections between these arguments, I provide three different responses to Wittwer’s analysis. First, I develop a plausible case in favor of the conclusion that the Moral EDA is also self-effacing. Second, I defend the Epistemic EDA from the charge of self-effacement and respond to Wittwer’s assertion that my preferred method of escaping his argument is dialectically inappropriate. Finally, I explain how some arguments recently articulated by Richard Rowland and Ramon Das support my objections to Wittwer’s self-effacement argument. (shrink)

“Morality is relative to culture” is a descriptive claim; many people in many different cultures have different moral beliefs. When one adopts moral relativism, however, the claim accrues a normative dimension, in that what follows from relativity is the flattening out of rightness, of one moral belief being better than another regardless of culture. But in practice, humans rarely, if ever, actually behave as if certain things or beliefs are not better than others, as evidenced in everything from foreign policy (...) to religion to consumption choices.
