The article deals with the features of the interpretation of political justice in the concept of John Rawls. The emergence of the concept of justice by American researcher John Rawls would mark a new stage in the scientific study of the problem of justice. He raises the question of the lack of development of modern capitalism in terms of solving social, political and economic problems. According to Rawls’s concept, the future society should not only be effective, as the theorists and (...) practices of industrial society have called for, but also fair. First of all, for the existence of justice, an unbiased system of ordering institutions is needed. The main subject of justice, according to Rawls, is the basic structure of society, under which he understands the whole set of the most important social, legal, political and economic institutions, the main function of which is the distribution of advantages and burdens arising from the social cooperation of members of the society. From Rawls’s point of view, justice issues are on the agenda when there is a need for a public assessment of the activities of the relevant institutions in order to balance legitimate competing interests and harassment of members of society. In other words, the problem of legitimacy arises when the legitimate rights of people come into contact with each other. Justice in the first place begins with the choice of the fundamental principle of the political, social and legal system of society, which should regulate all further institutional reforms. J. Rawls defines political justice as «the constitutionality of justice», that is, in his understanding, the validity of the functioning of the political sphere, the organization of public administration and the political regime. This chapter discusses the Rawlsian project of public reason, or public justification-based 'political' liberalism, and its reception. After a brief philosophical rather than philological reconstruction of the project, the chapter revolves around a distinction between idealist and realist responses to it. Focusing on political liberalism’s critical reception illuminates an overarching question: was Rawls’s revival of a contractualist approach to liberal legitimacy a fruitful move for liberalism and/or the social contract tradition? The last section contains a largely negative answer to that (...) question. Nonetheless the chapter's conclusion shows that the research programme of political liberalism provided and continues to provide illuminating insights into the limitations of liberal contractualism, especially under conditions of persistent and radical diversity. World Crisis and Underdevelopment examines the impact of poverty and other global crises in generating forms of structural coercion that cause agential and societal underdevelopment. It draws from discourse ethics and recognition theory in criticizing injustices and pathologies associated with underdevelopment. Its scope is comprehensive, encompassing discussions about development science, philosophical anthropology, global migration, global capitalism and economic markets, human rights, international legal institutions, democratic politics and legitimation, world religions and secularization, and moral philosophy in its many varieties.

This article problematizes the republican reliance on contemporary ‘states as they are’ as protectors and guarantors of the republican notion of freedom as non-domination. While the principle of freedom as non-domination constitutes an advance over the liberal principle of freedom as non-interference, its reliance on the national, territorial, legal-technical and extra-economic contemporary state prevents the theoretical uncovering of its full potential. The article argues that to make the most of the principle of freedom as non-domination, a strong Athenian element is (...) required. The democratic confederalist project that is being experimented with by Syrian Kurds in the cantons of Rojava, it is maintained, can contribute theoretically and practically to this republican ideal through its democratic and participatory mechanisms, despite fundamental challenges it has to face. The paper is an intervention in the dispute about the moralism of the recent realist trend in political philosophy. It is particularly focused on analysing the debate on this subject between Niklas Erman and Eva Möller (2015a; 2015b) and Robert Jubb and Enzo Rossi (2015a; 2015b). Examining the main arguments of both parties, I argue that realists (i.e., Jubb and Rossi) lost the debate, that realism is, in fact, moralism in disguise, and that its main methodological request – giving up (...) „pre-political” moral principles and values in political philosophy – is „unrealistic” (i.e., unfeasible). In keeping with the radical openness of his theory of democracy, Habermas avoided pre-determining the ideal mode of economic organization for his favoured model of deliberative democracy. Instead of attempting a full-blown derivation, in this article, I propose adapting the Rawlsian method of comparing different political–economic regimes as candidate applications of his theory of justice to Habermas’s theory of deliberative democracy. Although both theorists are seen as endorsing liberal democratic world views, from the perspective of political economy, the corollary of (...) their conceptions of democracy would arguably veer elsewhere: in Rawls’s case, into the territory of property-owning democracy or democratic socialism, and in Habermas’s, into any political–economic regime which guarantees the real exercise of full political and discursive liberties against the background of legitimate lawmaking. The ultimate aim of this article is to discuss whether a concrete conception of democratic socialism, if any, is compatible with Habermas’s theory of deliberative democracy. (shrink)

The Rawls–Habermas debate is having a revival. In this article I argue that both philosophers develop different freestanding conceptions of political legitimacy, and show how they diverge when it comes to how political legitimacy can be justified. Habermas is looking for a deeper justification than Rawls will allow for. I then proceed to show how the different meta-ethical positions yield two different versions of democratic theory, focusing in particular on rights and popular sovereignty. I demonstrate how both conceive of the (...) co-originality of private and public autonomy, and subsequently take issue with Habermas’ reading of Rawls. I argue that Rawls should not be understood as a natural rights theorist, that Habermas misunderstands the role of the original position, and that Rawls cannot be considered a strong constitutionalist. Thus, the real difference between Rawls and Habermas revolves around their different conceptions of political legitimacy. (shrink)

Jürgen Habermas’s opus magnum, Auch eine Geschichte der Philosophie, synthesises his impressive work of the last half century. His thesis is that the modern project of the normativity of “rational freedom” can be reconstructed as a learning process of the conflictual dialogue between reason and faith, philosophy and religion in the West. Furthermore, under conditions of a world society, cross-cultural communication across lifeworlds, based on such normative principles, is possible. I argue that Habermas’s argument recapitulates a claim first made in (...) The Phenomenology of Spirit by Hegel, who presented the normativity of modernity through a narrative unfolding between two epistemological standpoints, namely, that of consciousness and “we.” Just like Hegel, in order to defend the idea of a Lernprozess, Habermas too must presuppose a unified subject called “we;” furthermore the development of such subjectivity unfolds in a homogeneous temporal process that is then assumed to be the same for all mankind. I call this a form of “historicism,” and juxtapose recent historical writing that presents the narrative of modernity and the emergence of world-society as a much more diverse and fractured process than Hegel’s and Habermas’s methodology. “Die Einbeziehung der Anderen,” I argue, must involve including the voices of those others who do not experience the normative of modernity as a process like the one unfolding between faith and reason in the West. Nevertheless, I conclude that this plea for a more complex narrative that “provincialises Europe,” is not a rejection of the normative legacy of modern rationality and freedom that are based on the ideals of fallibilism, refutability and revisability through a rational community of inquirers. This article addresses the problem of inter-normative engagement, of constructing dialogical interaction across substantive normative difference. Focusing on how this affects democratic and pluralistic contexts, it argues that a social-practice-based approach to normativity and reasoning offers unique resources to understand and frame such encounters. It specifically draws on pragmatism and the work of Richard Rorty to reframe normativity, authority, identity, and reason, linking these understandings to recent trends to deliberative political inclusivism in democratic theory. The upshot is that framing inter-normative (...) engagement as calls to responsive engagement between diverse systems of normative authority offers real insights for constructing and maintaining ongoing democratic engagements in a non-hierarchical manner. I show how a notion of the political as emerging reality which does not derive from any other logic — as a phenomenon devoid of foundations, of predetermined elements — features in Habermas’s theory of society. There is certainly nothing obvious about such a claim, insofar as the political is conceived, across his entire oeuvre, in relation to the public sphere, which is presented as a social space in which the functions and properties he attributes to language in general are (...) made explicit and catalysed. It appears the public sphere coincides with the constitutive rules of universal pragmatics. More generally, the motif of the public sphere is bound up with topics which all curb the political “mode” — i.e., the validity attributed to political statements (1), the weight given, in myriad ways, to morality in the public sphere (2), and the concern to preserve science and complexity no matter what (3). I examine each one in turn, in order to demonstrate how, precisely, through the limits imposed on them, they enable us to grasp the specificity of the public sphere as political instance and, from this basis, identify a place for the political in Jürgen Habermas’s theory.
