This article provides a theoretical critique from a particular ‘ideal type’ ethical perspective of professional codes in general and the United Kingdom Central Council for Nursing, Midwifery and Health Visiting (UKCC) Code of professional conduct (reprinted on pp. 77-78) in particular. Having outlined a specific ‘ideal type’ of what ethically informed and aware practice may be, the article examines the extent to which professional codes may be likely to elicit and engender such practice. Because of their terminological inexactitudes and confusions, (...) their arbitrary values and principles, their lack of helpful ethical guidance, and their exclusion of ordinary moral experience, a number of contemporary professional codes in health and social care can be arraigned as ethically inadequate. The UKCC Code of professional conduct embodies many of these flaws, and others besides. Some of its weaknesses in this respect are anatomized before some tentative suggestions are offered for the reform of codes and the engendering of greater ethical awareness among professionals in the light of greater public ethical concerns and values. Throughout the development of an "ethic of care" different from an "ethic of justice," the relationship between the two has been problematic. Are they theories between which one must choose? Are they complementary? Are they domain-specific? In support of my view that neither is adequate by itself, I here examine the private domain of care of the dying by intimates, and find there important issues both of care and of justice.

In her Nobel speech in 2019, Olga Tokarczuk presented the category of tenderness as a new way of narrating the contemporary world. This article is a proposal for the analysis and interpretation of tenderness in ethical and aesthetic terms. (1) From an ethical perspective, tenderness is interpreted as an extension and complement of feminist relational ethics, i.e., the ethics of care. In the proposed approach, tenderness is a broader and more universal quality than care in the feminist understanding. This article (...) opens with a brief discussion of feminist interventions in ethics, with particular emphasis on the ethics of care. Next, the differences between care and tenderness are enumerated and described, in order to show how tenderness can serve as an extension and complement of the feminist ethic of care. These considerations are guided by the question of why tenderness is a better—more appropriate and more responsive to contemporary challenges—moral guidepost than care. (2) From the aesthetic perspective, tenderness is the negation of a contemplative, distanced, impersonal, and rational view of reality. As an aesthetic imperative, tenderness implies engaged experience of the beauty of reality in all of its manifestations. Therefore, in the last part of the article, existential tender attunement is described in aesthetic terms, as a position serving to sensitize others to the beauty and complexity of the post-anthropocentric world. To begin to answer the question of whether every moral truth could be known by any one individual, this paper examines David Chalmers’ views on the scrutability of moral truths in Constructing the World. Chalmers deals with the question of the scrutability of moral truths ecumenically, claiming that moral truths are scrutable on all plausible metaethical views. I raise two objections to Chalmers’ approach. The first objection is that he confl ates the claim that moral truths are scrutable from PQTI (...) with the claim that moral truths are scrutable from nonmoral truths. The upshot of this objection is that Chalmers has not in fact shown the scrutability of moral truths from the scrutability base from which he proposed to do so, PQTI. The second objection concerns his handling of moral sensibility theory, which fails to take into account certain features of the emotions—features which generate what I term synchronic and diachronic emotional co-instantiation problems. The upshot of this objection is that we have good reason to deny that any one individual could ascertain all moral truths, if moral sensibility theory is true, no matter how idealized the emoter. El objetivo de esta colaboración es, en primer lugar, dar noticia de algunas coordenadas básicas de la discusión contemporánea acerca del lenguaje y la diferencia de los sexos, prestando especial atención a la acusación de esencialismo con la que se descalifican los contendientes entre sí. En segundo lugar, quiero llamar la atención acerca de la insuficiencia de las razones esgrimidas por el discurso feminista de la diferencia y por el discurso de la complementariedad cultural, que en última instancia vienen a (...) favorecer —en total oposición, sin duda, a los deseos de sus valedores— una perpetuación de la discriminación de las mujeres1. En tercer lugar, esbozo unas pautas para la eliminación de algunos elementos sexistas que todavía subsisten en la lengua española. -/- El trabajo se articula en cuatro secciones: 1) El debate contemporáneo sobre el esencialismo; 2) El discurso biológico sobre la diferencia sexual; 3) La construcción cultural de la diferencia sexual; y finalmente, 4) La búsqueda de un nuevo lenguaje. El propósito unificador que otorga sentido al conjunto radica en el empeño por ganar en comprensión de lo que es el ser humano mediante la reflexión filosófica sobre la diferenciación sexual que se detecta, se expresa o se crea, a través o en el lenguaje. La perspectiva que adopto —desde una óptica preferentemente hispánica, pero prestando especial atención a la cultura angloamericana— es decididamente filosófica, y aspira a integrar armónicamente aportaciones multidisciplinares, datos y planteamientos teóricos procedentes de las ciencias biomédicas y de las humanidades. Esta actitud supone una concepción de la filosofía que, lejos de un eclecticismo acrítico, busca encontrar las razones de la verdad en la confrontación de opiniones opuestas, sabedora con la mejor tradición que todos los pareceres formulados seriamente, en cierto sentido, dicen algo verdadero. Una segunda consecuencia de la adopción de esta perspectiva filosófica es que he evitado convertir el trabajo en una investigación lexicográfica de la lengua española, limitando ésta exclusivamente al final de la última sección. This Dissertation argues for a care-centrically grounded account of relational personhood and widely realized diachronic personal identity. The moral distinction between persons and non-persons is arguably one of the most salient ethical lines we can draw since many of our most fundamental rights are delineated via the bounds of personhood. The problem with drawing such morally salient lines is that the orthodox, rationalistic definition of personhood, which is widespread within philosophical, medical, and colloquial spheres, excludes, and thereby de-personifies, a large (...) number and a great variety of human beings such as neonates, young children, the elderly who suffer from dementia, individuals with severe cognitive disabilities, and patients in vegetative states. The reconceptualization of personhood necessary for a more inclusive definition ought to originate with an appropriate moral grounding. To this end, this Dissertation grounds the notion of personhood in the care ethical sphere, thereby emphasizing the role of care relations in the maintenance of the moral consideration of vulnerable individuals. This Dissertation argues that grounding the concept of a person in care relations entails a relational account of personhood, which, along with the insights of the Extended Mind and Social Manifestation Theses, leads to an extended and externalized understanding of diachronic identity, which allows fragile people to be held in their personal identities even if they themselves lack the capacities usually associated with moral personhood. As we trace a person’s identity through time, we track the various relational properties, which constitute personal narratives and thus act as a glue that binds such dynamic and often unique properties into stable, trackable narratives. Since care relations are morally relevant on a care-centric account of personhood, what is lost in cases where such care relating ceases is not merely of sentimental value, but of great moral importance as well. Morally meaningful care relations are not replaceable, and, by extension, neither are the narratives that are constituted by such unique and irreplaceable instances of relating. This Dissertation argues that the constitutive care relational nature of personal narratives makes such narratives irreplaceable and is precisely what makes persons so morally precious. (shrink)
