In this paper I discuss a number of different relationships between two kinds of obligation: those which have individuals as their subject, and those which have groups of individuals as their subject. I use the name collective obligations to refer to obligations of the second sort. I argue that there are collective obligations, in this sense; that such obligations can give rise to and explain obligations which fall on individuals; that because of these facts collective obligations are not simply reducible (...) to individual obligations; and that collective obligations supervene on individual obligations, without being reducible to them. The sort of supervenience I have in mind here is what is sometimes called ‘global supervenience’. In other words, there cannot be two worlds which differ in respect of the collective obligations which exist in them without also differing in respect of the individual obligations which exist in them. Deep personal relationships involve deep mutual understanding and strong mutual affection. This paper focuses on whether having deep personal relationships is one of the elements of well-being. Roger Crisp put forward thought experiments which might be taken to suggest that having deep personal relationships has only instrumental value as a means to other elements of well-being. The different conclusion this paper draws is that having deep personal relationships is an element of well-being if, but only if, the other people involved (...) have qualities that merit affection for these people. The main body of this paper assesses a leading recent theory of fairness, a theory put forward by John Broome. I discuss Broome's theory partly because of its prominence and partly because I think it points us in the right direction, even if it takes some missteps. In the course of discussing Broome's theory, I aim to cast light on the relation of fairness to consistency, equality, impartiality, desert, rights, and agreements. Indeed, before I start assessing Broome's theory, I discuss (...) two very popular conceptions of fairness that contrast with his. One of these very popular conceptions identifies fairness with the equal and impartial application of rules. The other identifies fairness with all-things-considered moral rightness. (shrink)

Argues for an interpretation of Iris Murdoch on which her account of moral reasons has Platonic roots, and on which she gives an ontological proof of the reality of the Good. This reading explains the structure of Sovereignty, how Murdoch's claims differ from a focus on "thick moral concepts," and how to find coherent arguments in her book.

The concept of well-being is increasingly gaining acceptance as an object of science, and many different types of well-being measures have been developed. A debate has emerged about which measures are able to capture well-being successfully. An important underlying problem is that there is no unified conceptual framework about the nature of well-being—a hotly debated topic of philosophical discussion. I argue that while there is little agreement about the nature of well-being in philosophy, there is an important agreement on some (...) important principles relevant for its measurement. I argue that well-being science has good reasons to accommodate these principles, but currently fails to do so. (shrink)

In hard cases of comparison, people are faced with two options neither of which is conceived of as better, worse, or equally good compared to the other. Most philosophers claim that hard cases can indeed be distinguished from cases in which two options are equally good, and can be characterized by a failure of transitive reasoning. It is a much more controversial matter and at the heart of an ongoing debate, whether the options in hard cases of comparison should be (...) interpreted as incomparable, on par, or roughly equal. So far, however, none of these claims and interpretations have been tested. This paper presents the first empirical investigation on hard cases, intransitive reasoning, and incomparability. Our results reveal that hard cases present real-world dilemmas in which a significant majority of people violate transitivity. After suggesting a way of operationalizing the notion of incomparability, we provide empirical evidence that the options in some hard cases are not considered to be incomparable. Theories of rough equality or parity seem to provide better interpretations of our results. (shrink)

In this paper, I hope to provide an account of the conditions of moral realism whereby there are still significant metaphysical commitments made by the realist which set the view apart as a distinct position in the contemporary meta-ethical landscape. In order to do so, I will be appealing to a general account of what it is for realism to be true in any domain of experience, whether it be realism about universals, realism about unobservable scientific entities, realism about artifacts, (...) and so forth. Moral purism is a commonly held view on moral worthiness and how to identify it in concrete cases. Moral purists long for a moral world in which (business) people—at least sometimes—act morally worthy, but in concrete cases they systematically discount good deeds as grounded in self-interest. Moral purism evokes moral cynicism. Moral cynicism is a problem, both in society at large and the business world. Moral cynicism can be fought by refuting moral purism. This article takes issue with moral purism. (...) The common strategy to tackle moral purism is to reject the exclusion thesis which states that self-interest and the ‘pure’ moral motive (and thus moral worthiness) exclude each other. We develop a different strategy. We argue that moral purists are mistaken in the way they judge moral worthiness in concrete cases. They employ the wrongprocedureand the wrongcriteria.We develop a proper procedure and proper criteria. We build on Kant, who we argue is unfairly regarded as the champion of moral purism. In order to see how Kant can develop a consistent (non-purist) philosophy, the exclusion thesis must be embedded in Kant’s transcendental philosophy. Properly embedded, Kant turns out to be both anti-purist and anti-cynical. (shrink)

Many international declarations state that human beings have a human right to health care. However, is there a human right to health care? What grounds this right, and who has the corresponding duties to promote this right? Elsewhere, I have argued that human beings have human rights to the fundamental conditions for pursuing a good life. Drawing on this fundamental conditions approach of human rights, I offer a novel way of grounding a human right to health care.

Non-reductive moral realism is the view that there are moral properties which cannot be reduced to natural properties. If moral properties exist, it is plausible that they strongly supervene on non-moral properties- more specifically, on mental, social, and biological properties. There may also be good reasons for thinking that moral properties are irreducible. However, strong supervenience and irreducibility seem incompatible. Strong supervenience entails that there is an enormous number of modal truths (specifically, truths about exactly which non-moral properties necessitate which (...) moral properties); and all these modal truths must be explained. If these modal truths can all be explained, then it must be a fundamental truth about the essence of each moral property that the moral property is necessarily equivalent to some property that can be specified purely in mental, social and biological terms; and this fundamental truth appears to be a reduction of the moral property in question. The best way to resist this argument is by resorting to the claim that mental and social properties are not, strictly speaking, natural properties, but are instead properties that can only be analysed in partly normative terms. Acceptance of that claim is the price of non-reductive moral realism. (shrink)

ABSTRACT I offer an approach to the problem of life’s meaning which poses a radical challenge to some of the familiar terms of this debate. First, I defend an expansive form of naturalism which involves a rejection of the common assumption that naturalism and theism are logically incompatible and offers a framework from which to rethink some of the central concepts operative in discussions of life’s meaning. Second, I defend a ‘desire solution’ to the problem of life’s meaning. My initial (...) inspiration is Richard Taylor’s version of such a position as articulated in his book Good and Evil. I argue that this solution is best articulated from within an expansive naturalist framework, raise some doubts about Taylor’s metaphysics, and make a connection with the Nietzschean problem of nihilism. I argue for a perfectionist reading of Mill’s account of the good life, by using the failures of development recorded in his Autobiography as a way to understand his official account of happiness in Utilitarianism. This work offers both a new perspective on Mill’s thought, and a distinctive account of the role of aesthetic and emotional capacities in the most choiceworthy human life. I consider the philosophical purposes of autobiography, Mill’s disagreements with Bentham, and the nature of competent judges and (...) the pleasure they take in higher culture. I conclude that Millian perfectionism is an attractive and underappreciated option for contemporary value theory. (shrink)

After describing the disorder of psychopathy, I examine the theories and the evidence concerning the psychopaths’ deficient moral capacities. I first examine whether or not psychopaths can pass tests of moral knowledge. Most of the evidence suggests that they can. If there is a lack of moral understanding, then it has to be due to an incapacity that affects not their declarative knowledge of moral norms, but their deeper understanding of them. I then examine two suggestions: it is their deficient (...) practical reason or their stunted emotions that are at fault. The evidence supports both explanations. I conclude with an overview of the debate concerning whether they are morally or legally responsible for their actions. (shrink)

This paper deals with the core version of the Trolley Problem. In one case many people favor an act which will bring about the death of one person but save five other persons. In another case most people would refuse to “sacrifice” one person in order to save five other lives. Since the two cases seem similar in all relevant respects, we have to explain and justify the diverging verdicts. Since I don’t find current proposals of a solution convincing, I (...) propose an alternative one according to which —but not —violates two forms of equality. I also test the underlying egalitarian principle against other cases. I argue that it offers a good explanation and also a normative justification of our intuitive verdicts about the cases. (shrink)

In this paper, I explain the demands of filial obligations from act and rule consequentialism. More specifically, I defend a rule-consequentialist explanation of filial obligations, and identify a few factors in relation to the determination of filial demands; they include the costs of internalization of filial obligations, and the proportions of the young and the old generations in a population pyramid. I believe that in a society with an aging population, we may accept a strong view of filial obligation. Towards (...) the end of the paper, I explain that rule-consequentialism is compatible with certain special views of filial obligations, such as the gratitude theory and the special goods theory; these theories represent ways in which adult children and their parents may obtain special goods from engaging in the relationship. Our understanding of emotional labor, while conceptually and empirically substantial, is normatively impoverished: very little has been said or written expressly about its ethical dimensions or ramifications. Emotional labor refers to efforts undertaken by employees to make their private feelings and/or public emotion displays consistent with job and organizational requirements. We formally define emotional labor, briefly summarize research in organizational behavior and social psychology on the causes and consequences of emotional labor, and present a normative analysis of its moral limits (...) focused on conditional rights and duties of employers and employees. Our focus is on three points of conflict involving rights and duties as they apply to the performance of emotional labor: when employees’ and organizations’ rights conflict, when employees’ rights conflict with their duties, and when organizations’ rights conflict with their duties. Many philosophers with hedonistic sympathies (e.g., Mill, Sidgwick, Sumner, Feldman, Crisp, Heathwood, and Bradley) have claimed that well-being is necessarily experiential. Kagan once claimed something slightly different, saying that, although unexperienced bodily events can directly impact a person’s well-being, it is nonetheless true that any change in a person’s well-being must involve a change in her (i.e., either in her mind or in her body). Kagan elaborated by saying that a person’s well-being cannot float freely of her such that it (...) is affected by events that do not affect her (Kagan 1992, 169–189). These two claims—that well-being is necessarily experiential and that changes in well-being must involve changes in the person—are two different ways of specifying the general intuition that a person’s well-being must be strongly tied to her. This general intuition imposes an adequacy constraint on welfare theorizing: To be adequate, a welfare theory cannot allow that someone can be directly benefited by events that are not strongly tied to her. Call this the strong-tie requirement. The strong-tie requirement is easily satisfied by welfare hedonism, but it poses problems for desire-fulfillment welfare theories and objective-list welfare theories. Though a great deal has been written about desire-fulfillment welfare theories in relation to the strong-tie requirement, not as much has been written about objective-list welfare theories in relation to the strong-tie requirement. This paper argues that objective-list welfare theories can satisfy the strong-tie requirement, though probably only if they take a perfectionist form, as opposed to a brute-list form. (shrink)

Philosophical accounts of human well-being face a number of significant challenges. In this paper, I shall be primarily concerned with one of these. It relates to the possibility, noted by Martha Nussbaum and Amartya Sen amongst others, that people’s desires and attitudes are malleable and can ‘adapt’ in various ways to the straitened circumstances in which they live. If attitudes or desires adapt in this way it can be argued that the relevant desires or attitudes fail to provide a reliable (...) basis for evaluating well-being. This is, what I shall call the ‘adaptation problem’. Nussbaum and Sen have—in different ways used this argument to motivate their versions of the ‘capability approach’. However, questions remain about the implications of adaptation for philosophical accounts of well-being. (shrink)

: This paper explicates and defends the thesis that individual rational judgment, of the kind required for justification, whether in cognition or in morals, is fundamentally socially and historically conditioned. This puts paid to the traditional distinction, still influential today, between ‘rational’ and ‘historical’ knowledge. The present analysis highlights and defends key themes from Kant’s and Hegel’s accounts of rational judgment and justification, including four fundamental features of the ‘autonomy’ of rational judgment and one key point of Hegel’s account of (...) ‘mutual recognition’. These themes are linked to Kant’s and Hegel’s transformation of the modern natural law tradition. This paper examines the plausibility of an attention-based version of moral perceptualism (amp). According to amp, our perception of moral properties is characterized by perceptual attentional patterns that reflect a sensitivity to morally salient features. First, I argue that the explanation for the empirical evidence offered to support amp primarily hinges on cognitive processes rather than perceptual ones. Second, while I acknowledge the critical importance of attention in recognizing moral properties, I contend that we must expand amp’s explanatory scope to (...) address the question of what drives this attention. I propose an account of our (in)sensitivity to wrongness that builds on amp’s core statement. In this account, the notion of salience structure of information, defined by the varying accessibility of both perceptual and cognitive representations, plays a central explanatory role. (shrink)

Normative ethics usually presupposes background accounts of human agency, and although different ethical theorists might have different pictures of human agency in mind, there is still something like a standard account that most of mainstream normative ethics can be understood to rest on. Ethical theorists tend to have Rational Man, or at least some close relative to him, in mind when constructing normative theories. It will be argued here that empirical findings raise doubts about the accuracy of this kind of (...) account; human beings fall too far short of ideals of rationality for it to be meaningful to devise normative ideals within such a framework. Instead, it is suggested, normative ethics could be conducted more profitably if the idea of unifying all ethical concerns into one theoretical account is abandoned. This disunity of ethical theorizing would then match the disunited and heuristic-oriented nature of our agency. (shrink)

My starting point in this paper is that expansive naturalism is a defensible position. I spell out what this position involves, and grant with Iris Murdoch that we should take seriously the idea that the world in which we are immersed has an irreducibly spiritual dimension. I consider what it could mean to think of spiritual reality in supernaturalist terms, agree with the naturalist that dualistic supernaturalism is to be rejected, and ask whether one can legitimately reject this model as (...) both a naturalist and a theist. This paper addresses questions of friendship and political community by investigating a particular complex case, comradeship in the life of the soldier. Close attention to soldiers’ accounts of their own lives, successes and failures shows that the relationship of friendship to comradeship, and of both to the success of the soldier’s individual and communal life, is complex and tense. I focus on autobiographical accounts of basic training in order to describe, and to explore the tensions between, two positions: (1) Becoming (...) a soldier is a corrupting loss of individuality and moral sensitivity, and friendship is resistance to it. (2) Becoming a soldier is one form of flourishing, and comradeship—the soldier’s distinctive form of friendship—is one of its constitutive virtues. I draw particularly on George Orwell’s account of basic training and fighting in the Spanish Civil War, and on Tim O’Brien’s account of basic training and fighting in Vietnam. (shrink)

This article brings together two debates in bioethics more substantively than has been the case until now. One is the methodological debate over "principlism," i.e., the theoretical framework for analyzing and solving ethical problems proposed by Beauchamp and Childress in Principles of Biomedical Ethics. The other is the normative debate about reproductive ethics, i.e., procreative rights and obligations in a time of pervasive opportunities for making detailed choices about the properties and capacities of future people. The obvious point of bringing (...) the debates together is to show how they can illuminate each other in fruitful ways consistent with the method of reflective equilibrium endorsed in PBE. Furthermore, discussions of reproductive ethics is almost absent in PBE, making it an interesting "test case" on how principlist theory can have an impact on and be affected by confrontations with new practices and considerations in biomedicine. Reproductive ethics is especially interesting due to the so-called non-identity considerations, which pose a challenge to common morality views on harm to and respect for persons. My focus is mainly on some methodological points about the import of concrete normative discussions for formulating basic normative principles. However, I unfold a number of substantial points in order to demonstrate this. It is my impression that most writers on principlism underestimate the effect of engaging with concrete problems. Specifically, I conclude that reflecting on procreative obligations provides strong reasons for specifying the basic principles in ways that uncover new dimensions of them and not just new applications. _Key words: _principlism, reproductive ethics, non-identity problem, nonmaleficence, respect for persons. Convencido de que sería como mínimo quijotesco volver a intentar una vez más refutar el egoísmo sobre la base de sus propios supuestos, persigo la meta más modesta de desacreditar el egoísmo de forma contundente. How much should adult children sacrifice to care for their chronically ill parents? If parents commit crimes, should their children report them to the authorities? What are the demands of filial obligation in these cases? Traditionally, Confucians have favoured a somewhat stringent view of filial obligation. By this view, adult children have to provide long‐term care to their parents as well as place their parents' interests over any concerns of justice, should the two happen to conflict. I will call these (...) stringent views the principles of filial caregiving and filial favoritism. In this paper, I will use Scanlon's Contractualism to analyze the two principles, and juxtapose the Contractualist analysis with the Confucian filial piety. By doing this, we sharpen Confucianism's critical elements, and highlight the coherence of Contractualism with this ethical ideology from a non‐analytic tradition. (shrink)
