Habermas emphasizes the importance for critical thinking of ideas of truth and moral validity that are at once context-transcending and immanent to human practices. in a recent review, Peter Dews queries his distinction between metaphysically construed transcendence and transcendence from within, asking provocatively in what sense Habermas does not believe in God. I answer that his conception of “God” is resolutely postmetaphysical, a god that is constructed by way of human linguistic practices. I then give three reasons for why it (...) should not be embraced by contemporary critical social theory. First, in the domain of practical reason, this conception of transcendence excludes by fiat any “Other” to communicative reason, blocking possibilities for mutual learning. Second, due to the same exclusion, it risks reproducing an undesirable social order. Third, it is inadequate for the purposes of a critical theory of social institutions. (shrink)

Violence is one of the most pervasive problems in the world today. Despite all efforts to apply the powers of reason in order to contain, if not completely eliminate violence, violence proves to be capable of escaping capture and re-emerging in new and unexpected forms. Reason and rationality appear to be powerless against violence. The paper explores some philosophical issues that shed new light on the persistence of violence in the modern world. It argues that the failure of modernity to (...) recognize and come to grips with the process of construction that constitutes the basis of our relationship with reality plays a critical role in the continued survival of violence. Can autonomous reasoning be shared? According to many philosophical perspectives, from Kantian ethics to libertarian theories, this question seems incoherent – the purpose of an individual being able to think rationally for herself, to determine what she finds important and advance her own ends in accordance, seems to lose its appeal if she must engage in this process jointly with others and result in having the same concerns, perspectives, and goals in common. A crucial motivation for many accounts of autonomy (...) is to safeguard the individual’s will from the influence or interference of the other, and enable her to authentically express the identity and life she freely chooses for herself. This paper seeks to briefly address the question of what comes next after postmode nity as an educational intellectual movement. Building particularly on Habermas, it is claimed that there is no alternative to Modernist thought in its recent reconstructive variants. The inherent dual-impulse of Modernity offers both an ongoing communicative-critical basis to critique knowledge and values as well as to safeguard principles that are necessary for sustaining a coheent understanding of education.

The aim of this essay is to analyse the potential for political emancipation that lies within Kant’s conception of Aufklärung, in critical dialogue with enlightenment critics and specialised Kantian literature. My thesis is that Kant’s concept of enlightenment is intrinsically political and so it must be studied from the point of view of his political philosophy, which was fully developed in the decade of the 1790s. From this standpoint, I propose we study the role and place of Aufklärung within Kant’s (...) central political thesis, to wit: that only the united will of the people can be a legitimate authority. The book addresses the broad issue of sustainability of our civilization and seeks to contribute to the ongoing discussion of what many see as its systemic crisis. There is a broad agreement that new creative ideas, initiatives, and solutions are essential for dealing with the current problems. However, despite this recognition, we still know very little about the process of creation and how it works. As a result, our civilization fails to harness the enormous creative potential of humanity. This failure, (...) the book argues, is the main source of our current problems—languishing economy, deteriorating environment, continued violence, the deficit of democracy, and the lack of new fundamental breakthroughs in science. It examines some of these problems and demonstrates the connection between them and our failure to embrace the process of creation. The book offers a perspective that sheds light on the process of creation. It pays special attention to the theoretical contributions of Jean Piaget and the ongoing discussions of knowledge production that help us understand better how the process of creation works. The central argument of the book is that in order to solve our current problems and ensure the sustainability of our civilization well into the future we must embrace the process of creation and make it the central organizing principle of our social practice. Essays explore the significance of Julia Kristeva’s concept of intimate revolt for social and political philosophy. Over the last twenty years, French philosopher, psychoanalyst, and novelist Julia Kristeva has explored how global crises threaten people’s ability to revolt. In a context of widespread war, deepening poverty, environmental catastrophes, and rising fundamentalisms, she argues that a revival of inner psychic experience is necessary and empowering. “Intimate revolt” has become a central concept in Kristeva’s critical repertoire, framing and permeating her understanding of (...) power, meaning, and identity. New Forms of Revolt brings together ten essays on this aspect of Kristeva’s work, addressing contemporary social and political issues like immigration and cross-cultural encounters, colonial and postcolonial imaginations, racism and artistic representation, healthcare and social justice, the spectacle of global capitalism, and new media. The paper has elaborated the idea of ‘Verticality’, propounded by Peter Sloterdijk for looking in to the domains of self-perfection and the stages of vertical ascension. This essay uses Schmitt's work to cast new light on the relevance of the American legal tradition known as ‘legal realism’ for the history and analysis of human rights. It does so by exploring several of Schmitt's most famous criticisms of international law and human rights, and then suggests how they might correspond with a widespread critical legal tradition in the 1920s and 1930s. This essay describes in detail two fundamental features of this tradition: historicism and realism. It concludes by (...) suggesting that a return to some of these earlier law writers and texts might be a more substantive way to develop a constructive critical position in the fields of human rights and international law than an overreliance on the politically provocative (and problematic) rhetorical flourishes of Carl Schmitt. In his 1969 Trevelyan Lectures, Franco Venturi argued that Kant's response to the question ?What is Enlightenment?? has tended to promote a ?philosophical interpretation? of the Enlightenment that leads scholars away from the political questions that were central to its concerns. But while Kant's response is well known, it has been often misunderstood by scholars who see it as offering a definition of an historical period, rather than an attempt at characterizing a process that had a significant implications. This article (...) seeks (1) to clarify, briefly, the particular question that Kant was answering, (2) to examine ? using Jürgen Habermas? work as a case in point ? the tension between readings that use Kant's answer as a way of discussing the Enlightenment as a discrete historical period and those readings that see it as offering a broad outline of an ?Enlightenment Project? that continues into the present, and (3) to explore how Michel Foucault, in a series of discussions of Kant's response, sketched an approach to Kant's text that offers a way of reframing Venturi's distinction between ?philosophical? and ?political? interpretations of the Enlightenment. ??Thanks to an invitation from Karlis Racevskis, an earlier version of this article was delivered as the George R. Jurgen Habermas is a second-generation social philosopher of the Frankfurt school, the birthplace of critical theory. He suggests that modernity is a project of substituting rationality for religion. In his analysis, such a succession is the result of a process of social evolution, in which each developmental stage has its basic concepts and modes of understanding subjective, objective, and social worlds. For him, the salient feature of rationality consists of differentiation between various validity claims of truth, truthfulness, and sincerity which (...) are indistinguishable in religious language. The rationalization of religion, hence, progresses in terms of a differentiation between validity claims, a decentration of human understanding, the disenchantment of the world, and the linguistification of the sacred. Habermas proposes a universal pragmatics in which two modes of language use are separated: instrumental-strategic, and communicative. He thinks that the failure of the enlightenment movement to replace religion with reason stems from its preoccupation with instrumental reason and language use, dispensing with communicative rationality; and the remedy lies in communicative rationality. In recent decades, the concept of religion, and specifically its application to non-Western historic cultural formations has come unter critical scrutiny. This paper applies the analysis of semantic fields to three works by the medieval Japanese Buddhist monk Dōgen (1200–1253), who came to be revered as founder of the still extant Sōtō school of Zen Buddhism. By putting his notion of the ‘Buddha Way’ (butsudō) into strong relief, it provides a basis for comparison with modern concepts of religion. The conclusion (...) is that Dōgen’s ideas conform to a surprisingly large extent with modern ideas. This may be one reason for his popularity in modern times. But Dōgen should not be taken to represent the general world-view of medieval Japan. Further comparative analyses of other corpora remain necessary to gauge the applicability of‘religion’ as a category for the analysis of medieval Japanese culture. (shrink)

Zygmunt Bauman has devoted considerable amount of attention to the discussion of the educational challenges in liquid modernity. While a good deal of professional attention has been given to Bauman’s concept in various fields and disciplines, his views on education have received relatively little response by educational theorists and practitioners. The aim of this article is to assess Bauman’s prognosis and diagnosis for education in liquid modernity and argue that even if one generally accepts Bauman’s portrayal of current society, his (...) educational view must presuppose ‘solid’ elements if it is to remain consistent. The article offers some critical reflections with regard to these themes by appealing in particular to the notion of self-critical appropriation, as it is employed in the work of Jurgen Habermas. It is with this notion that it is possible to overcome inconsistencies in Bauman’s educational views and form the basis for understanding how to account for the development of authentic personhood in the social climate of liquid modernity. Supported by Ian Hacking’s concept of “intervention,” and Charles Taylor’s concept of “intentionality,” this article argues that doubting is acting, and that doubting is therefore subject to the same demands of responsibility as any other action. The argument is developed by using medical practice as a test-case. The central suggestion is that the demand of acting responsibly limits doubt in medicine. The article focuses on two such limitations to doubt. Firstly, the article argues that it is irresponsible to doubt that (...) our actions can harm other people. Secondly, the article argues that it is irresponsible not to strive for coherence between our utterances of doubt and our other actions. Incoherence here can cause “cultural impoverishment.” In a larger context this article also argues that medicine can enrich our epistemology, because medical knowledge displays important traits of knowledge that are downplayed in traditional epistemology derived from mathematics and physics. In particular, medicine makes it possible to get the relation between ethics and epistemology into sharper focus. The endpoint in medical epistemology is “responsible action,” and not certainty in and of itself. (shrink)

U radu identificiramo transformacije od individualizacije i lokalizacije praksi nad konkretnom tjelesnošću do zbirnih političkih praksi nad tijelom-populacijom. Na taj način otvaramo genealoški, a ne historicistički pristup problemu erozije paleosimbolike i pojave diskurzivnosti tijela kroz diskontinuitet tijela i teksta. U procesima sveopće društvene deritualizacije, a ponajprije javne komunikacije, koja označava racionalizaciju zapadnjačkog društva, krajem 18. stoljeća pojavile su se nove forme iskaza: medicinski, psihijatrijski, pravni, pedagoški, psihološki, koji se grupiraju u tekst/znanje/moć. Oslanjajući se na analitiku moći Michela Foucaulta, u radu (...) analiziramo način na koji se paralelno s procesom deritualizacije kažnjavanja tijela deritualizirala čitava praksa iskazivanja: kroz pojavu nove tehnologije koja je bila uspostavljena putem mehanizama moći čiji su ulog bila ljudska tijela. U radu zaključujemo da jedna od genealoških linija umnožavanja praksi razdvajanja tijela i teksta od kraja 18. stoljeća vodi k jednom novom tijelu – k društvu. (shrink)

This thesis has two principal aims: to demonstrate the centrality of memory to the philosophy and aesthetics of T. W. Adorno, and to assess its philosophical significance. Although in recent years Adorno's work has been the object of increased scrutiny within Anglo-American philosophical circles, as yet little sustained attention has been devoted to the concept of memory within Adorno's oeuvre. However, in Dialectic of Enlightenment Adorno and Horkheimer proclaimed that it is "by virtue of this memory of nature in the (...) subject" that "enlightenment is universally opposed to domination. "Given that all of Adorno's work is concerned to redeem enlightenment from domination, the importance of a philosophical interpretation of the concept of memory is pivotal for an engagement with the legacy of Adorno's thought today. It will be argued that, for Adorno, memory always operates in relation to reification. The construal of this relation enjoins the consideration of a number of significant categories within Adorno's work: notably tradition, experience, mimesis and utopia; and further, it serves to situate and distance Adorno from those thinkers - Kant, Hegel, Heidegger and Benjamin - with whom he incessantly engages. Finally, by focusing on the relation between memory and reification, one can gauge the stakes of the Habermasian critique of Adorno, for it is Adorno's understanding of reconciliation as the "remembrance of nature in the subject" that is the crux of the agon between Habermas and Adorno. I will argue that it is Habermas's failure to fully engage with the ramifications of Adorno's concept of memory that vitiates his critique, and indeed, that this failure provides the means for an Adornian critique of Haberman. It will be argued that memory is not an object of Adornian thought, but rather, that it provides the utopian texture of that thought. (shrink)

This article seeks to identify and address the normative void that resides at the heart of postmodernist-feminist theory, and to propose a philosophical framework – beyond postmodernism, but incorporating its central insights – for thinking through the normative questions with which feminists are inevitably confronted in their engagements with positive law. Two varieties of postmodernist-feminism are identified and critically analysed: the ‘corporeal feminism’ of Elizabeth Grosz and Judith Butler, which seeks to ground feminist critical practice in the irruptive capacities of (...) the material body considered as an arte fact of social construction; and the deconstructionist feminism of Drucilla Cornell, for whom ‘the feminine’ is an indeterminate but disruptive force beyond its construction in law and in other social sites. The first component of the argument elaborated here is that each of these approaches ultimately reduces to a form of aestheticism which is incapable of generating a worthwhile and workable feminist approach to the restructuring of politics and law. The second component of the argument involves a return to aesthetics, in particular to the philosophical aesthetics of Kant’s Critique of Judgement. Kant’s aesthetic philosophy, it will be suggested, yields a framework of concepts which, duly re-manipulated, could speak to the very concerns that have inspired postmodernist-feminism: how to attend to (bodily) particularity while avoiding the dangers associated with ‘essentialism’; and how to theorise the propensity of the unrepresentable power of the feminine to exceed both embodied human capacities and the confining rein of socially privileged rationalities. Crucially, however it also responds to a set of preoccupations – those of the feminist lawyer – that cannot be accommodated by postmodernism: how to translate embodied experience into (legal) norms; generalise from the particular; seek consensus; and codify an endless potentiality in the form of law. This study presents a discourse on the question of incompletion and simultaneously inaugurates the development of a critical approach to contemporary social and political questions concerning selfhood, thought and community in terms of incompletion. Such a strategy has taken place on two main levels in this work. Firstly, there is a close textual reading and analysis of texts where the question of incompletion has been engaged with. Secondly, there is a historical/social analysis of existing institutions, this is a secondary analysis (...) of how the United Nations can be conceived in terms of completion or incompletion in relation to the quest for community. A major part of the close textual reading deals with French post-structuralist writers such as Bataille, Derrida, Foucault and Jean Luc Nancy. These writers are of interest in this work to the extent that they think central problematics of the philosophical tradition as necessarily and unavoidably incomplete. An important tension in the work of these writers is explored by showing that they theorise the central concepts of the self, thought and community as being impossible to resolve in any reachable present and yet they also do not abandon these central problematics either. The theoretical task entails bridging the gap between the deconstructive and the constructive, the nihilistic and the utopian within poststructuralism itself, and this, paradoxically, is to attempt an agitated reconciliation. Such a reconciliation may only act to deepen the difficulties to be found within the thought of such writers, but the theorization of incompletion does ultimately seek to both comprehend and critique contemporary difficulties surrounding the questions of community and selfhood. This paper critically reviews phenomenological philosophy of the body in light of postmodern and postcolonial critiques of universalism. It aims to recast the notion of the lived body in plural rather than singular terms. It does so within the context of phenomenology and dance, using cultural anthropology to highlight the sense in which bodies are culturally and corporeally specific. The notion of corporeal specificity is applied to the perception of dance, paying particular attention to questions of power and hegemony. A position joining critical theory with the Marxist critique of imperialism informs the following discussion on the perceived shortcomings of Chibber’s study in its avowed claim to disavow postcolonial theory. Chibber’s insistence on reading Subaltern Studiesaspostcolonial theory is unsustainable in that it fails to address the epistemological premises of a theory adopted and not initiated by the project. Whereas Chibber does ably contest assertions made by Subaltern Studies concerning the special conditions of India halting capitalism’s universalising drive, his concentrated but (...) narrowly-focused and repetitive criticism disregards prior work contiguous to his own specialism as well as disciplines other than the social sciences. Thus the explanatory power of Uneven and Combined Development in understanding the internal conditions of societies conscripted into capitalism is cast aside, as are the resources of Marxist cultural criticism in writing a metanarrative of these consequences inallof their aspects: economic, social, cultural and experiential – omissions that paradoxically are to the fore in postcolonial theory. Utopia – the word is simultaneously evocative of hope and dread. As a concept it is stupendously problematic, and yet despite its alleged passing into irrelevance, utopia still remains a household word. Why is this so?Utopia has been reduced to a category. We place a solution in the category of the utopian or, conversely, the not-utopian. Without fail, discussions involving utopia will eventually veer toward debates on whether a book, project, or building is utopian or not.Utopia reduced to such a (...) category invokes both a problematic universality and a convoluted end of history – perhaps nowhere more so than in the field of architecture. However, if we begin with the problem to which the solution is a response rather than the solution being proposed, we soon realize that utopia is more complicated than a simple image of a perfect future.The study at hand re-interrogates the utopian concept. The question is not what architecture is utopian, but how and why architecture is utopian. Utopia is reinterpreted as a concept predicated on survival and a desire for a better way of living, rather than on immortality and perfection. Utopia in this sense is monstrous; its function is to challenge the presuppositions that define the horizons of our imagination, and to show us that the future is not predetermined: the future is fundamentally open.What assumptions, then, are formative of how architects relate to the future and utopia when projections of that future perfect have become irrelevant?If the projection of a perfect future is impossible, yet intimately associated with the architect, utopia becomes paradoxical for architects. Utopian desire is instead expressed in other ways, consciously or unconsciously. The study argues that the present worldview is dominated by what is here dubbed the Network-image; we think of everything in terms of networks, privileging connections over form, and the architect is again assuming a new role for herself as a manager, rather than an expert.Networks offer different ways of working with architecture. Rather than specifying the forms of the future, architects can and do work by defining and elaborating protocols that enable and cultivate connections which, according to the prevalent narrative, build transversal collectives that can potentially transform the world.However, there are other implications linked to these new opportunities. Any network is governed by multiple protocols, and the architect as manager becomes inscribed in a logic of control. There is an implicit notion that architects can produce architecture that is self-governing, participatory, and implicitly egalitarian through designing protocols. This assumption urgently needs to be interrogated.The discussion in this study centers on the need to challenge the Network-image itself, and not only to take our role in it as given. The dissertation is an argument for considering the how of imagining the future with more scrutiny, and it offers a set of principles and a terminology for discussion to enable further research on the subject. This article aims to contribute to the academic debate on the general crisis faced by law schools and the legal professions by discussing why juristic practice is a matter of experience rather than knowledge. Through a critical contextualisation of Vilhelm Lundstedt’s thought under processes of globalisation and transnationalism, it is argued that the demise of the jurist’s function is related to law’s scientification as brought about by the metaphysical construction of reality. The suggested roadmap will in turn reveal that the (...) current voiding of juristic practice and its teaching is part of the crisis regarding what makes us human. (shrink)
