Como tesis de este artículo se plantea que la filosofía heideggeriana posibilita meditar en torno a la experiencia del reconocimiento del otro. Después de poner en cuestión algunas de las críticas dirigidas a Heidegger debido a su énfasis sobre el ámbito ontológico, se aborda el sentido del concepto de reconocimiento y su nexo con la noción de cercanía, para culminar en la identificación de la cercanía con el lenguaje. Esta identificación dará a la experiencia del reconocimiento un carácter particular (óntico- (...) ontológico), que permitirá comprender su “esencia”. La pregunta por la condición de posibilidad del reconocimiento conducirá al concepto de “pre-sentimiento”, no abordado por Heidegger pero posibilitado por su filosofar. Se concluye con la concepción del reconocimiento como condición estructural de la existencia humana. (shrink)

This essay offers a defense of ‘intellectual authority’, primarily by pointing out the untoward implications of its conceptual opposite, ‘institutional authority’, in a wide variety of contexts. An opening discussion explores conditions for the possibility of intellectual authority in legal, humanistic, and aesthetic disciplines. Social science literature documenting and describing the biasing influence of institutional authority is then canvassed and analyzed in some detail. In this article we present a training program based on the empirical research conducted in the project 'argumentational integrity'. After a brief sketch of the problem dimensions concerning unfair argumentation we give an overview of the training concept and the underlying empirical research. Exemplification of the instructional design is given for the second and the fifth training dimension (standards of argumentational integrity and reactions to unfair contributions). Finally we indicate how the training is to be evaluated and present initial results (...) demonstrating that in comparison with an untrained control group participants in the training significantly improve their skills in identifying and naming argumentative rule violations. Gibbard''s theory of rationality is evolutionary in terms of its result as well as its underpinning argument. The result is that judgments about what is rational are analyzed as being similar to judgments of morality — in view of what Darwin suggests concerning the latter. According to the Darwinian theory, moral judgments are based on sentiments which evolve to promote the survival and welfare of human societies. On Gibbard''s theory, rationality judgments should be similarly regarded as expressing emotional attachments to (...) behavioral norms which originate and function to coordinate social interaction. Consequently, Gibbard''s theory of rationality might be used to illuminate Darwin''s theory of morality, and vice versa. Additionally, as argued in the present essay, both can be further elaborated, and defended, by developing related themes in philosophical ethics: viz., connected with Hume and 20th-century emotivists. The main problem is that this general Darwinian approach faces widespread opposition nowadays, not only in ethics but in philosophy of science. The purpose of this essay is to analyze Gibbard''s theory, critically and constructively, with emphasis on the pertinent commonalities in Darwin, Hume and the emotivists, while also critically addressing their common enemies. The pervasive methodological orientation is to relate this analysis to (philosophy of) science in general, and biological science in particular. (shrink)

Die vorgeschlagenen Antworten sind nicht nur für Personen aus der Fachdidaktik, sondern auch aus der (...) Philosophie und der Schullehrpraxis aller Fächer interessant. Methodological nationalism in sociological theory is unfit for the current globalized era, and should be discarded. In light of this contention, the present article discusses Max Weber’s view of language as a way to relativize the frame of the national society. While a “linguistic turn” in sociology since the 1960s has assumed that the sharing of language—linguistic community—stands as an intersubjective foundation for understanding of meaning, Weber saw linguistic community as constructed. From Weber’s rationalist, subjectivist, individualist viewpoint, linguistic community was (...) a result of social actions, not a prior entity as assumed by German metaphysical organicism (and historicist holism). Indeed, Central Europe in Weber’s era was a battlefield of linguistic nationalism(s); in contrast to the national societies of the Cold War period, national borders were unstable and ultimately the multiethnic empires of the region were dismantled after World War I into ethnolinguistic nation-states. Experience of this contemporary reality brought Weber to the core of the relationship between language and politics: A language community is an imaginary one demarcated not by language itself but by conscious opposition against outsiders, with monolingual contexts within borders created artificially by homogenizing policies like linguistic standardization and national education—the first modernity of language. In this way, Weber felt, language can be a means to domination. (shrink)

The author of the article assumes that any human activity is normative. In the case of philosophical discourse, the normative ground is its indispensable condition, which makes it possible to compare the foundations of philosophy and other scientific disciplines. The norm (law) has, on the one hand, descriptive content related to the description of the noumenal world, and, on the other, prescriptive content related to the counterfactuality of what ought to be. The author emphasizes that the functional aspect of a (...) norm is that it is a means of socially integrating the behavior of people and social groups into a whole. Due to the requirements and requirements of society, social groups are transformed into standards, models, standards of modal and obligatory behavior of the representatives of these groups, performing the function of motivation, orientation and legitimacy. In the second part of the article, the author focuses on a narrower understanding of discourse as speech, dialogue, discussions, which presuppose argumentation based on certain principles, rules, rules and regulations. This interpretation of discourse is peculiar to representatives of the ethics of discourse (K.-O. Apel, Y. Habermas, D. Böhler, V. Kulman, G. Gronke, etc.). Within ethics, principles, imperatives, rules, norms and guidelines both normalize the discourse and substantiate this discourse. Adherence to these principles, rules, norms, and guidelines ensures the normative coherence of discourse as the instance of consensus building on the basis of revealing the performative contradiction of the statement. The normative coherence of discourse is also the basis for its functioning as a meta-institution of justification of social (moral, legal) norms and legitimation of institutions of deliberative democracy in a society of communication and dialogical civilization. Summarizing, the author formulates generalized requirements-guidelines that make it possible to implement the principles, norms and rules of discourse as a meta-institutional instance of society. This article shows how Jürgen Habermas and Claude Lefort try to explain the relationship between universality and particularity in modern democratic societies, politics and civil society. It will demonstrate that Habermas defends a substantive kind of universality that is opposed to particular positions and thus to real politics. This article further argues that Lefort’s lesser known theory of negative universality is better at combining a universal and a particular perspective. It claims that where Habermas requires citizens to transform their particular (...) interests, Lefort emphasizes that individual actors should acknowledge their particular position and interests when invoking universal principles. The article further argues that their disagreement leads to a different interpretation of ideology, politics, power, civil society, human rights, popular sovereignty, elections and the state. The author distinguishes two concepts of practical reason: (a) practical reason as a source of practical principles, and (b) practical reason as the theory of thought operations connected with action. He proves that there is no practical recognition in the sense (a). We can deal with actions only on the basis of dichotomic semantics. Critical analyses of some theories of practical reason are presented (Kant, Lorenzen, Apel, Alexy). Hermeneutic phenomenology is absent in 4 EAC literature . The aim of this article is to show that hermeneutic phenomenology as elaborated in the work of Heidegger is relevant to 4 EAC research. In the first part of the article I describe the hermeneutic turn Heidegger performs in tandem with his ontological turn of transcendental phenomenology, and the hermeneutic account of cognition resulting from it. I explicate the main thesis of the hermeneutic account, namely that cognition is interaction with the (...) world, followed by a discussion of the modes of cognition distinguished in the hermeneutic account. In the second part of the article I discuss the implications of this account with respect to the status and meaning of first, second and third person perspective of cognition. The article concludes with the draft and discussion of an exploratory model of hermeneutic cognition. (shrink)

The reconstructive theory of the procedural legitimacy of modern law developed on the basis of the theory of discourse ethics has limited itself solely to the deontological, moral‐normative aspects of the validity claims of legal norms and judgments. However, teleological and axiological aspects are also intertwined with legal validity claims and with the procedures in which legal norms and judgments are produced. The discursive‐procedural concept of legitimacy seems to require as its support, instead of the theory of discourse ethics, a (...) general theory of practical discourses or, more generally, of rational collective will‐formation. The aim of this paper is to restore the interdependent or complementary relationship between self and others against the universalistic one (as I call it) that Kant, for example, once insisted on, by reexamining the concept of so-called private language. I shall consider some views in speech act theory and pragmatics, since there has often been discussion about such a private occurrence as the speaker's sincerity. For example, Jürgen Habermas situates it in the speaker's internal nature as will be seen (...) later. In my opinion, alter ego is an ego because we can empathize (einfühlen) with it, and yet it is alter ego because it has some private experiences which we cannot perfectly comprehend. (shrink)

Since the emergence of neo-evolutionism in the 1960s, various critiques of the theory of social or socio-cultural evolution have been forwarded, including notably those of Immanuel Wallerstein, Alain Touraine and Anthony Giddens who decisively reject the idea of evolution. Within this context, Jürgen Habermas's theory of socio-cultural evolution has also become a specific object of critique, the best known in the English-speaking world being, perhaps, Michael Schmid's critique. While the latter is ultimately based on neo-Darwinistic assumptions which allow a non-Marxist (...) alternative to be pitted against Habermas's position, a significant immanent critique has been taking shape during the late 1970s and 1980s the contours of which are at present starting to become visible, despite the fact that as yet it is nowhere developed and presented in a systematic manner. I have in mind here the work of younger authors belonging to the circle around Habermas, such as Johann Arnason, Axel Honneth, Hans Joas, Günter Frankenberg, Ulrich Rödel, and Klaus Eder, who have not only developed a critique of Habermas but are also engaged in developing an alternative to him within the framework of critical theory. "Ethical Leadership" in modern multicultural corporations is first the consideration of different personal and cultural value systems in decision-making processes. Second, it is the assignment of responsibility either to individual or organisational causalities. The task of this study is to set the stage for a distinction between rational entities and the arbitrary preferences of individuals in economic decision making processes.Defining rational aspects of behaviour in economics will lead to the formal structures of organisational systems, which are independent of concrete but (...) varying values. Luhmann''s Theory of systems of communication describes the internal dynamic forces of economic communication processes in terms of formal structures. On the other hand Habermas'' Theory of discourse integrates the previous relationship between individual subjectivity and rational behaviour. Habermas gives an indication of how to separate subjective values and meaning from rational arguments in rational communication processes. The translation of these theoretical structures into practical applications for decision making processes and decision taking acts links the ethical, or value-oriented, context precisely to both individual and organisational areas of responsibility. The article introduces the concept of ‘argumentational integrity’ as the basis for developing ethical criteria by which contributions to argumentative discussions can be evaluated; the focus is on the derivation, definition, and specification of the concept. The derivation of the concept starts out from a prescriptive use of ‘argumentation’, entailing in particular the goal of a rational as well as a cooperative solution. In order to make this goal attainable, contributions to argumentative discussions must meet certain conditions. It is assumed (...) that participants are not only intuitively aware of these conditions, but in fact expect of themselves and others that they will not consciously violate the conditions. This assumption leads to the most general definition of the norm of argumentational integrity: Speakers must not knowingly violate the argumentative conditions. On the basis of an empirical study drawing upon classifications of unethical strategies in popular rhetorical texts, the general norm is then specified in the form of 11 ‘standards of fair argumentation’. Der Beitrag analysiert Techniken öffentlicher Gesundheitskommunikation und skizziert im Ausblick Minimalbedingungen für ihre ethische Vertretbarkeit. Dazu wird erstens an einem aktuellen Beispiel veranschaulicht, wie mittels Text und Bild die Öffentlichkeit überzeugt werden soll, ein bestimmtes Gesundheitsverhalten an den Tag zu legen. Zweitens werden anhand der internationalen Ethik-Debatte fünf Grundtypen von Techniken in der Gesundheitskommunikation (Information, Argumentation, Persuasion, Manipulation und Zwang) rekonstruiert und entlang von Mittel, Zweck, Folgen für Adressaten sowie Implikationen für Autonomie aus ethischer Sicht unterschieden. Am besonders ambivalenten Beispiel (...) der Persuasion wird dann drittens diskutiert, welche ethischen Fallstricke es bei Gesundheitskommunikation zu bedenken gibt. Schließlich zeigen wir argumentativ auf, dass es in sensiblen bioethischen Themenfeldern wichtig ist, zwischen verschiedenen Techniken der Gesundheitskommunikation analytisch zu differenzieren. In this article I confront Jürgen Habermas' deliberative model of democracy with Claude Lefort's analysis of democracy as a regime in which the locus of power remains an empty place. This confrontation reveals several structural similarities between the two authors and explains how the proceduralization of popular sovereignty provides a discourse-theoretical interpretation of the empty place of power. At the same time, Lefort's insistence on the open-ended nature of the democratic struggle also points towards an unresolved tension at the core (...) of Habermas' model between the cognitive nature of deliberation on the one hand and the freedom of moral and political agents on the other. A proper solution of this tension requires a full appreciation of the ineliminable gap between actual and ideal deliberation. Because actual deliberation can never result in an ideal consensus, the actual exercise of democratic power should be understood as an unavoidable interruption of deliberation. Central to the discourse ethics advanced by Jürgen Habermas is a principle of universalization (U) amounting to a dialogical equivalent of Kant's Categorical Imperative. Habermas has proposed that ?U? follows by material implication from two premises: (1) what it means to discuss whether a moral norm ought to be . adopted and (2) what those involved in argumentation must suppose of themselves if they are to consider a consensus they reach as rationally motivated. To date, no satisfactory derivation of ?U? (...) from these two premises has been presented. Thus the present study attempts to show how one can, without begging the question, arrive at ?U? by assuming a suitable explication of these two premises, supplemented with a fairly innocuous assumption about the context of discourse. If the argument is sound, then ?U? brings both deontological and consequentialist intuitions together with a notion of solidarity that requires an intersubjective account of insight. (shrink)

Die Polizei stellt eine Autoritätsinstanz des öffentlichen Raums dar. Um ordnend auf diesen Raum einwirken zu können, macht sie situativ von zugeschriebenen Handlungsvollmachten Gebrauch. In diesen Momenten folgt sie einer Logik des Durchsetzens. In der Gegenwart ist demgegenüber zu beobachten, dass die allermeisten Autoritäten der Logik des Befähigens folgen – dies zeigt sich beispielsweise in der Schule, der Kirche, dem Krankenhaus oder der privaten Erziehung. Viele Polizistinnen und Polizisten im aktiven Dienst sind mit Autoritätsbildern sozialisiert worden, die ebenfalls der Logik (...) des Befähigens folgen. In ihrem Dienst können sie sich aber herausgefordert sehen, ihrer Autorität Ausdruck zu verleihen, indem sie auf die Logik des Durchsetzens zurückgreifen. Gerade wenn es dabei zu notwendigen Gewaltanwendungen kommt, kann dies bleibende Spuren an den Polizistinnen und Polizisten hinterlassen. Mit dem Autoritätsbegriff lassen sich diese ethischen und seelsorglichen Nachwirkungen kaum erfassen. Es stellt sich die Frage, ob der Polizeiberuf vor dem Hintergrund der gewandelten Autoritätsbilder nicht auch in Teilen als ein Professionsberuf einhergehend mit einer zur Reflexion ermutigenden Professionsethik verstanden werden kann. En este trabajo se discuten los aportes de la teoría sociológica contemporánea al debate filosófico y científico de la ontología, para ello son cotejados los componentes ontológicos de la Teoría General de Sistemas Sociales de Niklas Luhmann, lla Teoría de la Acción Comunicativa de Jürgen Habermas y la Actor-Network Theory de Bruno Latour.

One of the most powerful accounts of the necessary connection between law and morality grounded on the openness of communication is provided by Robert Alexy, who builds a discourse theory of law on the basis of Habermas’ theory of general practical discourse. In this article I argue that the thesis based on the openness of legal discourse is problematic in that it does not provide a convincing account of the differentiation of legal discourse from other practical discourses. I offer (...) an understanding of the institutionalisation of legal discourse as the tacit commitment of the participants to their shared normative experience and in particular in: 1) the possibility of containing normative force in space, 2) the possibility of transforming word into deed, 3) the possibility of grasping and controlling time and 4) the possibility of transforming deed into word. That commitment of participants in legal discourse is revealed as a set of fundamental assumptions embedded in all legal utterances, which provide the necessary bedrock that makes communication possible. It also provides a basis for the institution of legal discourse, to the effect that their problematisation signifies a departure from the latter. (shrink)

The article considers the relationships among three arguments that purport to establish the intrinsically contradictory or paradoxical nature of the modern project aiming at the equal consideration of all. The claim that the inevitable historical insertion of universal-egalitarian norms leads to always particular and untransparent interpretations of grammatically universal norms may be combined with the claim that the logic of determination of political communities tends to generate exclusions. The combination of these two claims lends specific force to the third argument (...) according to which equal consideration perpetually requires the non-egalitarian project of understanding (excluded) individuals on their own terms. Hence, taking off from a recent debate between Christoph Menke and Jürgen Habermas, I argue that the former is right to diagnose an aporetic self-reflection in egalitarian universalism, while agreeing with the latter about the indispensability of deliberative democratic frameworks for the defence of both egalitarian and non-egalitarian norms. This paper points out the way in which ‘educational’ and ‘communicative action’ are to be related. It is shown that earlier attempts to put Habermas’ ideas to use have led to a dead end because they do not realize clearly that the new basic notion introduced by Habermas, namely ‘communicative action’, is the expression of a ‘communicative turn’. It is argued that Habermas' concept expresses a radical new attempt to grasp the intersubjective character of social action. Next implications of this (...) communicative turn for the concept of education as a social praxis are indicated. Education can be conceived of as a praxis responding to the vulnerability of a communicative self. (shrink)

This contribution discusses some problems of Pragma-Dialectics and explains them by its consensualistic view of the function of argumentation and by its philosophical underpinnings. It is suggested that these problems can be overcome by relying on a better epistemology and on an epistemological theory of argumentation. On the one hand Pragma-Dialectics takes unqualified consensus as the aim of argumentation, which is problematic, (Sect. 2) on the other it includes strong epistemological and rationalistic elements (Sect. 3). The problematic philosophical underpinnings of (...) Pragma-Dialectics, specifically Critical Rationalism as well as Logical Constructivism and Dialogic Logic of the Erlangen School, are among the sources of this incoherence (Sect. 4). A detailed critique of the Pragma-Dialectical discussion rules shows the negative consequences of this foundation and indicates how they could be avoided (Sects. 5, 6). (shrink)

The author analyses several selected speeches of Italian politicians: the founder of the Forza Italia party, Silvio Berlusconi; the founder and leader of the Five Stars Movement, Beppe Grillo; and the current Prime Minister of Italy, Matteo Renzi. The study makes it possible to evaluate whether the conditions for the ideale Sprechsituation of Jürgen Habermas are fulfilled in analysing the public discourse. Particular attention will be given to the relationship between the persuasiveness of the communication and the problem of legitimacy.

Is the idea that the self‐determination of all citizens influences progress towards democracy not merely a dream that breaks itself against the hard historical reality of political societies? Is not the same fate reserved for all pedagogical innovations in democratic education that depend on this great dream? It is commonplace to assert this logic to demonstrate the inapplicability of the ideas of both democracy and of democratic education. Though this argument is prominent and recurring in the history of political and (...) educative ideas, in response we can ask ourselves if the gap between the ideal and the reality is effectively insuperable and must be considered an incontestable fact. The double objective of this article is to determine explicitly the meaning and extent of this gap in the context of democracy and of education and to demonstrate that this gap is neither static nor permanent, but is susceptible to being narrowed, from generation to generation. This article comments on Sylvia Walby’s critique of the politics of difference and the relativist tendencies she sees represented in some contemporary feminist positions. While the general direction of Walby’s intervention is not disputed, the theoretical architecture of her text as well as the way she develops her argumentation are critically assessed. Problems in the architecture of the text concern the unclear interconnection between epistemological questions, questions of moral philosophy/political theory and practical politics. The critique focuses on three aspects: on (...) problems connected with Walby’s use of the Habermasian notion of ‘argumentation’, on difficulties related to an incoherent use of the notion of ‘difference’ and on the inadequate way in which she constructs oppositions between theories. The article lays out some of the theoretical backgrounds of the debates Walby refers to, in order to enhance a more specific comparison and critique of positions. (shrink)

The contemporary proliferation of “filter bubbles” and “echo chambers” seems to render obsolete the notion of a public sphere in the singular. In my article, I would like to argue against this view: Following Jürgen Habermas, “the public sphere” can be understood as the concomitant horizon of communicative action, while the latter permeates society as a whole. On the basis of this socio-philosophical approach, the omnipresent tendencies toward fragmentation appear as reactive attempts to ward off this socially established and context-transcending (...) context of discussion. Habermas himself, however, has never adopted this perspective. Instead, he interprets the various symptoms of the decline of the public sphere—including its fragmentation—as the result of a “colonization of the lifeworld” by economic, bureaucratic, and technological system logics. However, on the basis of the concept of “systematically distorted communication,” which was still crucial for Habermas’s early work, it is possible to reconstruct how the lifeworld context of communicative action, out of which the public sphere emerges, is not only corroded and cut through from the outside by system logics but also exhibits its own dialectic of the refusal of discourse and the overcoming of this refusal. The fragmentation of the public sphere that we are confronted with today can be theoretically interpreted and politically addressed as a precarious standstill of this dialectic. (shrink)

Erling Skjei's criticisms (Inquiry 28, this issue) of my account of communicative action in The Theory of Communicative Action are based on a misunderstanding of the role of the analysis of speech acts in that work. I begin by restating the terms of my analysis, and after dealing with Skjei's objections to my claims for the explanatory power of illocutionary acts, draw attention to a problem with imperatives that I haven't yet done justice to.

In response to William Rehg’s and Barbara Fultner’s criticisms, I clarify and extend some arguments found in my book Reflection Revisited. I first redescribe how Hegel’s critique of Kant’s theory of reflection opens up the possibility for an intersubjective reflection. Habermas, I argue, can exploit such a theory of reflection since it is immune from the problems attendant on a ‘theory of consciousness’. Second, I address how by means of meta-discourses temporal claims can be formalized for the pragmatics Habermas is (...) developing. Finally, I take up Fultner’s suggestion that Robert Brandom provides a fruitful point of comparison with Habermas’s theory, and argue that norms are in fact formed and critiqued on the basis of - as Brandom describes - the modal capabilities or incompatibilities of their entailments. The idea of radical pedagogy is connected to the ideals of social justice and democracy and also to the ethical demands of love, care and human flourishing, an emotional context that is sometimes forgotten in discussions of power and inequality. Both this emotional context and also the emphasis on politics can be found in the writings of Paolo Freire, someone who has provided much inspiration for radical pedagogy over the years. However, Freire did not create any explicit ethical foundation for (...) radical pedagogy. This paper argues that, when constructing normative grounds for radical pedagogy, Habermas’s discourse ethics can be an important source, with the caveat that discourse ethics on its own is not sufficient grounding enough where radical pedagogy is concerned. Habermasian critical theory should be supplemented with Axel Honneth’s theory of recognition, as Freire’s focus on love and human flourishing corresponds well with Honneth’s theory’s three modes of recognition: love, rights and respect (solidarity stemming from mutual relations of respect). This paper discusses the conditions for legitimate expert arrangements within a democratic order and from a deliberative systems approach. It is argued that standard objections against the political role of experts are flawed or ill-conceived. The problem that confronts us instead is primarily one of truth-sensitive institutional design: Which mechanisms can contribute to ensuring that experts are really experts and that they use their competencies in the right way? The paper outlines a set of such mechanisms. However, the challenge exceeds (...) that of producing epistemically optimal expert deliberations because a deliberative political system must also fulfil the ethical and democratic requirements of respect and inclusion. Yet, epistemic concerns justify expertise arrangements in the first place, and measures taken to make the use of expertise compatible with these requirements have to balance the potential rewards from expertise against potential deliberative costs. In the final part of the paper, the regulatory framework of a best practice expert advice system is tentatively analysed to illustrate the applicability and critical potential of our approach. Epistemic democrats are rightly concerned with the quality of outcomes and judge democratic procedures in terms of their ability to ‘track the truth’. However, their impetus to assess ‘rule by experts’ and ‘rule by the people’ as mutually exclusive has led to a meagre treatment of the role of expert knowledge in democracy. Expertise is often presented as a threat to democracy but is also crucial for enlightened political processes. Contemporary political philosophy has so far paid little attention to our (...) reliance on experts and has not sufficiently addressed the question of how expertise can be used to improve the epistemic quality of democratic decision making. We believe this lack of interest is spurred by a too hasty acceptance of arguments dismissive of the political role of experts. The article examines a series of often-cited epistemic objections and concludes that several of them are overstated or misconceived, yet they all reflect real difficulties that need to be addressed. On this background, we tentatively outline a set of mechanisms that can contribute to alleviating the irreducible problem of epistemic asymmetries and ensuring that experts really are experts and use their expertise in the right way.
