Many of us agree that we ought not to wrong future people, but there remains disagreement about which of our actions can wrong them. Can we wrong individuals whose lives are worth living by taking actions that result in their very existence? The problem of justifying an answer to this question has come to be known as the non-identity problem.[1] While the literature contains an array of strategies for solving the problem,[2] in this paper I will take what I call (...) the harm-based approach, and I will defend an account of harming—which I call the existence account of harming—that can vindicate this approach. -/- Roughly put, the harm-based approach holds that, by acting in ways that result in the existence of individuals whose lives are worth living, we can harm and thereby wrong those individuals. An initially plausible way to try to justify this approach is to endorse the non-comparative account of harming, which holds that an event harms an individual just in case it causes her to be in a bad state, such that the state’s badness does not derive from a comparison between that state and some alternative state that the individual would or could have been in. However, many philosophers argue that the non-comparative account of harming is inadequate,[3] and one might be tempted to infer from this that any harm-based approach to the non-identity problem will fail. My proposal, which I call the existence account of harming, will show that this inference is faulty: we can vindicate the harm-based approach without relying on the non-comparative account of harming. A popular view of harming is the causal account (CA), on which harming is causing harm. CA has several attractive features. In particular, it appears well equipped to deal with the most important problems for its main competitor, the counterfactual comparative account (CCA). However, we argue that, despite its advantages, CA is ultimately an unacceptable theory of harming. Indeed, while CA avoids several counterexamples to CCA, it is vulnerable to close variants of some of the problems that beset CCA.

I consider the plausibility of discounting for kinship, the view that a positive rate of pure intergenerational time preference is justifiable in terms of agent-relative moral reasons relating to partiality between generations. I respond to Parfit's objections to discounting for kinship, but then highlight a number of apparent limitations of this approach. I show that these limitations largely fall away when we reflect on social discounting in the context of decisions that concern the global community as a whole, such as (...) those related to global climate change. This paper argues that non-identity actions are wrong because they _cause_ harm to people. While non-identity actions also typically benefit people, failure to act would similarly benefit someone, so considerations of benefit are ineligible to justify the harm. However, in some non-identity cases, failure to act would not benefit anyone: cases where one is choosing whether to procreate at all. These are the _hard_ non-identity cases. Not all "different-number" cases are hard. In some cases, we don't know whether acting would (...) result in more or fewer people; this paper argues that this _epistemic_ factor makes acting in these cases wrong. (shrink)

Is it fair to leave the next generation a public debt? Is it defensible to impose legal rules on them through constitutional constraints? From combating climate change to ensuring proper funding for future pensions, concerns about ethics between generations are everywhere. In this volume sixteen philosophers explore intergenerational justice. Part One examines the ways in which various theories of justice look at the matter. These include libertarian, Rawlsian, sufficientarian, contractarian, communitarian, Marxian and reciprocity-based approaches. Our pollution of the environment seems set to lead to widespread problems in the future, including disease, scarcity of resources, and bloody conflicts. It is natural to think that we are required to stop polluting because polluting harms the future individuals who will be faced with these problems. This natural thought faces Derek Parfit’s famous Non-Identity Problem ( 1984 , pp. 361–364). The people who live on the polluted earth would not have existed if we had not polluted. Our polluting (...) behaviour does not make these individuals worse off. It may therefore seem that we do not harm them by polluting. Parfit argues that we should replace person-affecting principles with an impersonal principle of beneficence, Principle Q ( 1984 , p. 360.). I argue that Principle Q cannot give an adequate account of our duties to refrain from polluting. I consider attempts to solve the Non-Identity Problem by denying that to harm someone an agent must make them worse off. I argue that such responses provide a partial solution to the Non-Identity Problem. They do show that we harm future individuals in a morally relevant sense by polluting. Nonetheless, this is only a partial solution. The Non-Identity Problem still suggests that our harm-based reasons not to pollute are less strong than we intuitively believe. Thus on its own an appeal to the claim that we harm future individuals is not able to give a fully satisfactory account of why we are required not to pollute. (shrink)

Scanlonian contractualism has difficulties to account for our moral obligations to future generations due to the nonidentity problem. A prominent solution is to refer to the more general standpoints or types of future persons in moral deliberation. This paper critically examines the “types-of-persons approach” and identifies two alternative versions that have been conflated so far. The types-of-persons approach could claim that the relevant reasons for objection are either (a) the reasons of types of persons, or (b) type-based reasons of token (...) persons. I explore these two options in more detail and argue that both are, in their own ways, incompatible with central features of Scanlonian contractualism. Consequently, the types-of-persons approach fails to offer a satisfactory solution to the nonidentity problem for Scanlonian contractualists. (shrink)

Consider a duty of beneficence towards a particular individual, S, and call a reason that is grounded in that duty a “beneficence reason towards S.” Call a person who will be brought into existence by an act of procreation the “resultant person.” Is there ever a beneficence reason towards the resultant person for an agent to procreate? In this paper, I argue for such a reason by appealing to two main premises. First, we owe a pro tanto duty of beneficence (...) to future persons; and second, some of us can benefit some of those persons by procreating. In support of the first premise I reject the presentist account of time in favor of the view that future persons are just as real as presently existing persons. I then argue that future persons are like us in all the morally relevant ways, and since we owe duties of beneficence to each other, we also owe duties of beneficence to future persons. In support of the second premise I offer an account of benefiting according to which an individual can be benefited by an action even if it makes her no better off than she would have been, had the action not been performed. This account of benefiting solves what I call the “non-identity benefit problem.” Finally, I argue that having a life worth living is a benefit, and some of us can cause some persons that benefit by causing them to exist. Can an act harm someone—a future someone, someone who does not exist yet but will—if that person would never exist but for that very action? This is one question raised by the non-identity problem. Many would argue that the answer is No: an action harms someone only insofar as it is worse for her, and an action cannot be worse for someone if she would not exist without it. The first part of this paper contends that the plausibility of the (...) ‘no harm’ argument stems from an equivocation. The second half argues for an account of harm that is both causal and contrastive. Finally, the paper contends that the contrastive account disarms the no harm argument and furthermore neutralizes a related argument that has been problematic for some previously proposed solutions to the non-identity problem. The paper explores how harm must be understood if intuitively attractive deontological principles concerning the infliction and prevention of harm are to be vindicated. It focuses especially upon how harm must be understood if it is to be plausible that preventing people from undergoing harm takes priority over improving the conditions of badly-off people who have not suffered harm.

This paper defends a deontological egalitarianism in the ethics of future generations. Concerns about the non-identity problem have been taken as a reason to develop sufficientarian approaches to intergenerational justice. This paper argues for a solution to the non-identity problem that refers to the claims of future persons. In principle, the content of these claims could be spelled out with a sufficientarian and an egalitarian approach. What speaks against sufficientarianism, however, is that the sufficiency threshold, unless it is set very (...) low, would have to be set arbitrarily. The hidden justification behind a higher threshold would be egalitarian. It draws its plausibility from the justified belief that future persons have a claim on us that we leave equally valuable shares of natural resources to them. (shrink)

In this paper, I criticize the response that the action nevertheless harms the actual child, as well as the response that it makes the counterfactual child worse off. Abstract More than some other fields of ethics, climate ethics is related to pressing real-world problems. Climate ethicists have a responsibility to be precise about the status of the problems they discuss. The non-identity problem (NIP) plays are a prominent role in the climate ethics literature. In a widely discussed statement, Derek Parfit claimed that a risky climate policy is not harmful for (distant) future people. But this ignores the “insignificant-causal-factors rejoinder”. The Parfitian assertion is still treated as serious problem (...) to theories of climate justice in key philosophical texts, and this may mislead climate policy decision-makers. Philosophers should acknowledge that the NIP, when applied to climate change, is “just” a thought experiment and should communicate it in this way to people outside the philosophical community.
