Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

This paper offers a solution to the problem of understanding how a fallacious argument can be deceptive by “seeming to be valid”, or (better) appearing to be a better argument of its kind than it really is. The explanation of how fallacies are deceptive is based on heuristics and paraschemes. Heuristics are fast and frugal shortcuts to a solution to a problem that sometimes jump to a conclusion that is not justified. In fallacious instances, according to the theory proposed, this (...) jump overlooks prerequisites of the defeasible argumentation scheme for the type of argument in question. Three informal fallacies, argumentum ad verecundiam , argumentum ad ignorantiam and fear appeal argument, are used to illustrate and explain the theory. (shrink)

Informal logic is an attempt to develop a logic that can assess and analyze the arguments that occur in natural language discourse. Discussions in the field may address instances of scientific, legal, and other technical forms of reasoning, but the overriding aim has been a comprehensive account of argument that can explain and evaluate the arguments found in discussion, debate and disagreement as they manifest themselves in daily life — in social and political commentary; in news reports and editorials in (...) the mass media ; in advertising and corporate and governmental communications; and in personal exchange. This volume reflects the development and theoretical foundation of a new paradigm for critical thinking based on inquiry. The field of critical thinking, as manifested in the Informal Logic movement, developed primarily as a response to the inadequacies of formalism to represent actual argumentative practice and to provide useful argumentative skills to students. Because of this, the primary focus of the field has been on informal arguments rather than formal reasoning. Yet the formalist history of the field is still evident (...) in its emphasis, with respect to both theory and pedagogy, on the structure and evaluation of individual, de-contextualized arguments. It is our view that such a view of critical thinking is excessively narrow and limited, failing to provide an understanding of argumentation as largely a matter of comparative evaluation of a variety of contending positions and arguments with the goal of reaching a reasoned judgment on an issue. As a consequence, traditional critical thinking instruction is problematic in failing to provide the reasoning skills that students need in order to accomplish this goal. Instead, the goal of critical thinking instruction has been seen largely as a defensive one: of learning to not fall prey to invalid, inadequate, or fallacious arguments. (shrink)

In The Uses of Argument, Stephen Toulmin proposed a model for the layout of arguments: claim, data, warrant, qualifier, rebuttal, backing. Since then, Toulmin’s model has been appropriated, adapted and extended by researchers in speech communications, philosophy and artificial intelligence. This book assembles the best contemporary reflection in these fields, extending or challenging Toulmin’s ideas in ways that make fresh contributions to the theory of analysing and evaluating arguments.

Free speech fallacies are errors of meta-argument. One commits a free speech fallacy when one argues that since there are apparent restrictions on one’s rights of free expression, procedural rules of critical exchange have been broken, and consequently, one’s preferred view is dialectically better off than it may otherwise seem. Free speech fallacies are meta-argumentative, since they occur at the level of assessing the dialectical situation in terms of norms of argument and in terms of meta-evidential principles of interpreting how (...) and why people follow (or fail to follow) argumentative rules. Our plan here is to begin with a brief explanation of meta-argument and meta-argumentative fallacy. We will then turn to the variety of forms of the free speech fallacy, which we will explain as meta-argumentatively erroneous. (shrink)

In this article I address the following question: When are reformulations in argumentative criticisms reasonable and when do they become fallacious straw men? Following ideas developed in the integrated version of pragma-dialectics, I approach argumentation as an element of agonistic exchanges permeated by arguers’ strategic manoeuvring aimed at effectively defeating the opponent with reasonable means. I propose two basic context-sensitive criteria for deciding on the reasonableness of reformulations: precision of the rules for interpretation (precise vs. loose) and general expectation of (...) cooperativeness (critical vs. constructive). On the basis of analysis of examples taken from online political discussions, I argue that in some contexts, especially those that are critical and loose, what might easily be classified as a straw man following conventional treatment should be taken as a harsh, yet reasonable, strategic argumentative criticism. As more and more sophisticated software is created to allow the mining of arguments from natural language texts, this paper sets out to examine the suitability of the well-established and readily available methods of corpus linguistics to the study of argumentation. After brief introductions to corpus linguistics and the concept of meta-argument, I describe three pilot-studies into the use of the terms Straw man, Ad hominem, and Slippery slope, made using the open access News on the Web corpus. The presence (...) of each of these phrases on internet news sites was investigated and assessed for correspondence to the norms of use by argumentation theorists. All three pilot-studies revealed interesting facts about the usage of the terms by non-specialists, and led to numerous examples of the types of arguments mentioned. This suggests such corpora may be of use in two different ways: firstly, the wider project of improving public debate and educating the populace in the skills of critical thinking can only be helped by a better understanding of the current state of knowledge of the technical terms and concepts of argumentation. Secondly, theorists could obtain a more accurate picture of how arguments are used, by whom, and to what reception, allowing claims on such matters to be evidence, rather than intuition, based. The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. In this chapter, we outline the range of argument forms involving causation that can be found in everyday discourse. We also survey empirical work concerned with the generation and evaluation of such arguments. This survey makes clear that there is presently no unified body of research concerned with causal argument. We highlight the benefits of a unified treatment both for those interested in causal cognition and those interested in argumentation, and identify the key challenges that must be met for a (...) full understanding of causal argumentation. This is a critical appreciation of Govier’s 2006 ISSA keynote address on the fallacy of composition, and of economists’ writings on this fallacy in economics. I argue that the “fallacy of composition” is a problematical concept, because it does not denote a distinctive kind of argument but rather a plurality, and does not constitute a distinctive kind of error, but rather reduces to oversimplification in arguing from micro to macro. Finally, I propose further testing of this claim based on examples (...) involving public vs. private debt in economics; oligarchic tendencies in politics, and the emergence of societal wholes in sociology. This article provides a brief selective overview and discussion of recent research into natural language argumentation that may inform the study of human reasoning on the assumption that an episode of argumentation issues an invitation to accept a corresponding inference. As this research shows, arguers typically seek to establish new consequences based on prior information. And they typically do so vis-à-vis a real or an imagined opponent, or an opponent-position, in ways that remain sensitive to considerations of context, audiences, and (...) goals. Deductively valid inferences remain a limiting case of such reasoning. In view of these insights, it may appear less surprising that allegedly “irrational” behavior can regularly be produced in experimental settings that expose subjects to standardized reasoning tasks. Arguing that our attachment to Aristotelian modes of discourse makes a revision of their conceptual foundations long overdue, the author proposes the consideration of unacknowledged factors that play a central role in argument itself. These are in particular the subjective imprint and the dynamics of argumentation. Their inclusion in a four-dimensional framework and the focus on thesis validity allow for a more realistic view of our discourse practice. Exhaustive analyses of fascinating historical and contemporary arguments are provided. These range from (...) Columbus’s advocacy of the Western Passage to India, over the trial of King Louis XVI during the French Revolution, to today’s highly charged controversies surrounding euthanasia and embryo research. Excavating foundational issues such as the purpose of argument itself and the contested role of argument as a generator of knowledge, the book culminates in a discussion of the relationship between rationality and reasonableness and criticizes the restrictions of ‘rational’ argument relying on fixed logical, economic or cultural criteria that in reality are mutable. Here, a true, open argument requires the infusion of Paul Lorenzen’s principle of ‘transsubjectivity’, which recognizes but transcends the partiality of the individual and which can be seen in the pragmatic and expanding consensus that humanity can control itself to safeguard the future of a fragile, damaged world. I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

In this paper I focus on the fallacy known as Complex Question or Many Questions. After a brief introduction, in Sect. 2 I highlight its pragmatic dimension, and in Sect. 3 its dialectical dimension. In Sect. 4 I present two accounts of this fallacy developed in argumentation theory, Douglas Walton’s and the Pragma-Dialectics’, which have resources to capture both its pragmatic and its dialectical nature. However, these accounts are unsatisfactory for various reasons. In Sect. 5 I focus on the pragmatic (...) dimension of the fallacy and I suggest amendments to the accounts mentioned drawing on the study of the phenomenon of presupposition in theoretical pragmatics. I argue that the central notion in the definition of the fallacy is that of an informative presupposition. In Sect. 6 I focus on the dialectical dimension of the fallacy. This dimension needs to be explicitly acknowledged in the definition of the fallacy in order to distinguish it from a different, non-dialectical, fallacious argumentative move involving presuppositions. This paper applies dialectical argumentation structures to the problem of analyzing the ad baculum fallacy. It is shown how it is necessary in order to evaluate a suspected instance of the this fallacy to proceed through three levels of analysis: an inferential level, represented by an argument diagram, a speech act level, where conditions for specific types of speech acts are defined and applied, and a dialectical level where the first two levels are linked together and fitted into formal dialogue (...) structures. Causal reasoning is one of our most central cognitive competencies, enabling us to adapt to our world. Causal knowledge allows us to predict future events, or diagnose the causes of observed facts. The dialectical approach to teaching critical thinking is centred on a comparative evaluation of contending arguments, so that generally the strength of an argument for a position can only be assessed in the context of this dialectic. The identification of fallacies, though important, plays only a preliminary role in the evaluation to individual arguments. Our approach to fallacy identification and analysis sees fallacies as argument patterns whose persuasive power is disproportionate to their probative value.

In light of recent developments in argumentation theory, we begin by considering the account that Aristotle gives of what he calls sophistical refutations and of the usefulness of being able to recognise various species of them. His diagnosis of one of his examples of the grouping that he labels epomenon is then compared with a very recent account of the matter, which, like Aristotle, calls on us to attribute a mistake or confusion to anyone who uses this kind of argument. (...) From examination of three other examples that Aristotle himself supplies of epomenon, it appears that there are cases of inferences of this kind that we need not, and perhaps cannot, avoid making. The suggestion is made that this is because the whole family of what Peirce calls abductions have important characteristics in common with epomenon. (shrink)

The hypothesis of a theoretical unity between On Sophistical Refutations and Prior Analytics presents a major challenge to scholars attempting to unify the criteria of analysis. This paper examines this problem and proposes a middle ground between the perspectives of Woods and Boger to address this crucial question: If a unitary and coherent theory of deduction exists, why does not the technical apparatus of syllogistic modes for analyzing fallacies appear in SE? This paper makes useful contributions to the discussion on (...) the internal unity of Aristotle's logical writings on around categorical syllogistics and the doctrine of sophistical refutations. The paper discusses the place and the status of fallacies in Arnauld and Nicole’s Port-Royal Logic, which seems to be the first book to introduce a radical change from the traditional Aristotelian account of fallacies. The most striking innovation is not in the definition of a fallacy but in the publication of a new list of fallacies, dropping some Aristotelian ones and adding more than ten new ones. The first part of the paper deals with the context of the book’s (...) publication. We then show the influence of Cartesian and Augustinian/Pascalian philosophy on the whole book, especially their common critical views about logic, dialectic and their traditional academic teaching. The third part of the paper discusses the two chapters on fallacies. It focuses on their place in the book and their relation with its general orientation, before turning to their content, closely connected with some major concerns of the time. (shrink)

This essay addresses the collapse/incoherence problem for normative frameworks that contain both fundamental values and rules for promoting those values. The problem is that in some cases, we would bring about more of the fundamental value by violating the framework’s rules than by following them. In such cases, if the framework requires us to follow the rules anyway, then it appears to be incoherent; but if it allows us to make exceptions to the rules, then the framework “collapses” into one (...) that doesn’t make use of rules in the first place. The chapter begins with an examination of happiness and truth as fundamental values in Mill’s work, which lead into parallel versions of the collapse/incoherence problem in ethics and epistemology. It then sets out the collapse problem for rule-consequentialist approaches in ethics, truth-directed accounts of justification in epistemology, and epistemological approaches to argument cogency. The chapter closes with discussion of two potential solutions to the problem. (shrink)

We have noticed a pattern of arguments that exhibit a type of irrationality or a particular informal logical fallacy that is not fully captured by any existing fallacy. This fallacy can be explored through three examples where one misattributes a cause by focusing on a smaller portion of a larger set—specifically, the last or least known—and claiming that that cause holds a unique priority over other contributing factors for the occurrence of an event. We propose to call this fallacy the (...) “last straw fallacy” and will argue why these examples actually warrant a new logical name. Finally, we will show how these cases point to a deeper insight about the contexts in which we typically invoke this type of reasoning and some significant harmful consequences of doing so. (shrink)

In this paper I discuss appeals to nature, a particular kind of argument that has received little attention in argumentation theory. After a quick review of the existing literature, I focus on the use of such arguments in the public controversy over the acceptabil-ity of genetically-modified organisms in the food industry. Those who reject this biotechnology invoke its unnatural character. Such arguments have re-ceived attention in bioethics, where they have been analyzed by distinguishing different meanings that “nature” and “natural” might (...) have. I argue that in many such appeals to nature the main deficiency of these arguments is semantic, in particular, that these words cannot be assigned a determi-nate meaning at all. In doing so, I rely on semantic externalism, a widely accepted theory of linguistic meaning. (shrink)

This essay begins with a brief description of my approach to the study of argumentation and fallacies which is empirical, historical-textual, dialectical, and meta-argumentational. It then focuses on the fallacy of composition and elaborates a number of conceptual definitions and distinctions: argument of composition; fallacy of composition; arguments and fallacies of division; arguments that confuse the distributive and collective meaning of terms; arguments from a property belonging to members of a group to its belonging to the entire group; several nuanced (...) schemes for arguments of composition; and several principles for the evaluation of such arguments. I then call attention to the fact that some scholars have claimed that the basic argument for global warming commits the fallacy of composition, and undertake a critical analysis of this claim. I show that the global-warming argument is not a fallacy of composition, but is rather a deductively valid argument of composition from the temperature of the parts to the temperature of the whole earth; moreover, I criticize the meta-argumentation of these scholars by showing that the global-warming argument is not similar to the one for global pollution, which is indeed fallacious; finally, I argue that these scholars confuse the global-warming argument with the argument claiming that all effects of global warming are harmful, which is indeed incorrect as a hasty generalization. Hamblin’s Fallacies remains one of the crucial documents in the development of informal logic and argumentation theory. His critique of traditional approaches to the fallacies (what he dubbed ‘The Standard Treatment’) helped to revitalize the study of fallacies. Recently I had occasion to reread Fallacies and came to the conclusion that some of my earlier criticisms (1989, 1990) had missed the real force of what was going on there, that I and others have perhaps not fully appreciated what Hamblin is (...) up to. In this paper, I plan to revisit Fallacies and make manifest its coherence. (shrink)

Following a linguistic-descriptivist approach, Marianne Doury has studied debates about “parasciences”, discovering that “parascientists” frequently argue by “appeal to Galileo” ; opponents object by criticizing the analogy, charging fallacy, and appealing to counter-examples. I argue that Galilean appeals are much more widely used, by creationists, global-warming skeptics, advocates of “settled science”, great scientists, and great philosophers. Moreover, several subtypes should be distinguished; critiques questioning the analogy are proper; fallacy charges are problematic; and appeals to counter-examples are really indirect critiques of (...) the analogy. The paper relates two different fields of research: the historiography of generative linguistics and argumentation theory, a central topic of which is the investigation of fallacies. Relating the two fields is a challenge: Since fallacies seem to be at the heart of the historiography of generative linguistics, any thorough evaluation of its present state of the art also involves accounting for fallacies. The paper applies Kertész and Rákosi’s p-model of plausible argumentation to a case study on heated discussions in the (...) historiography of generative linguistics. As a result, basic properties of fallacious argumentation are revealed and delimited from plausible argumentation in linguistic historiography. In addition, the paper also draws generalizable conclusions that may affect the historiography of other human sciences as well. (shrink)
