The article starts with the observation of an ambivalence inherent to the politics of juridification. On the one hand, some spheres of the life-world such as the family and the school are often places of exploitation, degradation and humiliation and therefore seem to require the implementation of legal protection for their members. At the same time, the demand for rights seems somehow to grasp too little, would be inadequate or even counterproductive. How can this ambivalence be politically dealt with? I (...) first briefly reconstruct Jürgen Habermas' concept of juridification. I believe that Habermas works with an image of the family and the school as communicatively constituted and juristically uncompromised milieux, which proves to be highly questionable. In a second step I consider Axel Honneth's theory of the absolutization of legal freedom as offered in his recent work Freedom's Right. Honneth sidesteps several problematic implications of the Habermasian thesis of colonization, but still tends to underestimate the dominant patriarchal power relations in the spheres of the family and the school. Finally, I pursue Honneth's own suggestion that a new notion of politics is required for understanding contemporary struggles for recognition, which overcomes the statist tendencies of liberalism. I therefore propose to shift the perspective on the phenomenon of juridification, viewing it instead from the standpoint of the agents themselves, by turning to Wendy Brown's feminist theory on the paradoxes of rights. In den neueren Forschungen zur marxschen Werttheorie wird einhellig und mit besonderem Nachdruck darauf hingewiesen, dass abstrakte Arbeit eine gesellschaftliche Eigenschaft der Arbeitsprodukte ist. Häufi g verstehen die Autoren unter dem mehrdeutigen Adjektiv jedoch Verschiedenes. Im folgenden Beitrag zeige ich, dass schon Marx zu unterscheidende Sachverhalte im Sinn hatte, als er die gesellschaftliche Dimension der Wertsubstanz hervorhob: ihren Bezug zur gesellschaftlich notwendigen Durchschnittsarbeitszeit, ihren Bezug zum gesellschaftlichen Bedarf und die Geschichtlichkeit der warenproduzierenden Gesellschaft. Ich denke, wir müssen auf der Linie (...) von Marx einen Schritt weiterdenken. Die Hauptthese des Beitrags ist, dass die marxsche Werttheorie an Überzeugungskraft gewinnt, sobald den drei Bedeutungen des Adjektivs gesellschaftlich eine weitere zur Seite gestellt wird: die gesellschaftliche Wertschätzung. Inwiefern sich diese These durch anderweitige anerkennungstheoretische Überlegungen im Kapital untermauern lässt, wird abschließend diskutiert. (shrink)

Philosophy has certainly evoked love, but always as a passion, an emotion, a feeling, and rarely as an action, exercise or even as a test. This article aims to develop a Lacanian approach to bioethics. Point of departure is the fact that both psychoanalysis and bioethics are practices of language, combining diagnostics with therapy. Subsequently, I will point out how Lacanian linguistics may help us to elucidate the dynamics of both psychoanalytical and bioethical discourse, using the movie One flew over the Cuckoo’s Nest and Sophocles’ tragedy Antigone as key examples. Next, I will explain the ‘topology’ of the bioethical landscape with the help of Lacan’s (...) three dimensions: the imaginary, the symbolical and the real. This will culminate in an assessment of the dynamics of bioethical discourse with the help of Lacan’s theorem of the four discourses. Bioethics, I will argue, is not a homogeneous discourse. Rather, four modalities of bioethical discourse can be distinguished, all of them displaying specific weaknesses and strengths, opportunities and threats. This will be elucidated with the help of two case studies, namely the debates on human reproductive technologies and on the use of animals as biomedical research models. (shrink)

The genomics “revolution” is spreading. Originating in the molecular life sciences, it initially affected a number of biomedical research fields such as cancer genomics and clinical genetics. Now, however, a new “wave” of genomic bioinformation is transforming a widening array of disciplines, including those that address the social, historical and cultural dimensions of human life. Increasingly, bioinformation is affecting “human sciences” such as psychiatry, psychology, brain research, behavioural research (“behavioural genomics”), but also anthropology and archaeology (“bioarchaeology”). Thus, bioinformatics is having (...) an impact on how we define and understand ourselves, how identities are formed and constituted, and, finally, on how we (on the basis of these redefined identities) assess and address some of the more concrete societal issues involved in genomics governance in various settings. This article explores how genomics and bioinformation, by influencing research agendas in the human sciences and the humanities, are affecting our self-image, our identity, the way we see ourselves. The impact of bioinformation on self-understanding will be assessed on three levels: (1) the collective level (the impact of comparative genomics on our understanding of human beings as a species), (2) the individual level (the impact of behavioural genomics on our understanding of ourselves as individuals), and (3) the genealogical level (the impact of population genomics on our understanding of human history, notably early human history). This threefold impact will be assessed from two seemingly incompatible philosophical perspectives, namely a “humanistic” perspective (represented in this article by Francis Fukuyama) and a “post-humanistic” one (represented by Peter Sloterdijk). On the basis of this analysis it will be concluded that, rather than focussing on human “enhancement” by adding or deleting genes, genome-oriented practices of the Self will focus on using genomics information in the context of identity-formation. Genomic bioinformation will increasingly be built into our self-images and used in order to tailor and adapt our practices of Self to our “personalised” genome. We will keep working on ourselves, no doubt, not by modifying our genomes, but rather by fine-tuning our behaviour. What we are experiencing is a bioinformatisation of the life-world. Genomics-based technologies will increasingly pervade our daily lives, our autobiographies and narratives, as well as our anthropologies, rather than our genomes as such. (shrink)

An exploration of the milieu and its discourses provides insights as to the sense of the founding work of German sociology, Ferdinand Tönnies’ Gemeinschaft und Gesellschaft, the political context in which historicist economics were transformed into sociology, explicit and implicit influences behind sociology in the writings of von Stein, Rodbertus, Wagner and Schmoller, the response of the ‘socialists of the lectern’ to Tönnies’ sociology, and differing (...) responses to the debate between the historicist human sciences and rational theory. Against the background of recent developments in neuroscience, the paper shows how, for Hegel, the theoretical, practical and evaluative functions of the mind are grounded in something like a natural normativity, based on the interaction of the body's inner world with the outer world. These forms of organic homeostasis are the basis for further kinds and levels of norms, and deviations from these norms, which result in mental pathologies, provide insights into the complexity of spirit.

Georg Wilhelm Friedrich Hegel developed the concept of institutionalized education, which reflected public schooling and its legitimacy in the context of rapid transformation of European feudal societies to modern societies. The concept of school reflects the Hegelian theory of Bildung and the concept of modern society. What makes Hegel’s philosophy interesting is his conviction that the processes of Bildung can take place only in the context of social institutions and in the highly organized forms of human interaction regulated by those (...) institutions. Hence the development of an individual, according to Hegel, depends exclusively on institutionalized forms of interaction. In modern society, pedagogical institutions have a specific function: on the one hand, schooling is essentially an institutional form of initiating the process of Bildung in which an individual acquires culture and applies it to life—a life which consequently becomes consciously led by an individual self; on the other, schooling is essentially a way for modern society to ensure its self-preservation by preparing the individual to respond to the demands of civic society so that she or he can take part in the economic production and reproduction of modern society. There are several reasons for this. Firstly, he was involved in the intellectual life of his time, and many of the themes which engaged him have now lost their urgency. Secondly, because he wanted to connect every topic into a single, coherent system, and because the (...) transition from one topic to the next usually depends on some problem which cannot be solved unless the transition is made, some of the problems he unearths seem fairly insubstantial. Finally, his desire to philosophize without making any presuppositions means that he is reluctant to state the problems which he is trying to solve in advance. Any problem involves presuppositions, both of facts and about the meaning and coherence of the words or concepts used in stating it. Problems arise within Hegel's system, therefore, and they do so in a guise appropriate to their context. To some extent, the appreciation of the problems presupposes an understanding of the system.
