With increased visibility of trans people comes increased philosophical interest in gendered language. This chapter aims to look at the research on gendered language in analytic philosophy of language so far, which has focused on two concerns: (1) determining how to define gender terms like ‘man’ and ‘woman’ such that they are trans inclusive and (2) if, or to what extent, we should use gendered language at all. We argue that the literature has focused too heavily on how gendered language (...) can harm trans people, and has not considered how trans people use gendered language to create meaning and joy for ourselves. Pulling from the literature in sociolinguistics, we look at examples of how trans people use language to make their lives better by gaining recognition, playing with gendered language, finding joy in gendered language, and taking control of definitional power, concluding that debates about gendered language need to consider not only how such language harms trans people but also how trans people use it for our own liberation. By attending to how people speak about their gender, we can find diverse answers to the question of what it is like to have a gender identity. To some, it is little more than having a body whereas others may report it as more attitudinal or dispositional—seemingly contradictory views. In this paper, I seek to reconcile these disparate answers by developing a theory of how individual gender identity comes about. In the simplest possible terms, I propose that gender identity is (...) how we make sense of our gender subjectivity, the totality of our gendered experiences of ourselves. Gender identity is constituted by gender subjectivity, but this constitutive relationship is underdetermined. While gender subjectivity may narrow the range of inhabitable gender identities, it is always compatible with more than one. To arrive at a gender identity, we arrange gender subjectivity like building materials. My theory helps us understand how different people offer seemingly incompatible accounts of their gender identity without questioning their authenticity or validity. The social categories to which we belong—Latino, disabled, American, woman— causally influence our lives in deep and unavoidable ways. One might be pulled over by police because one is Latino, or one might receive a COVID vaccine sooner because one is American. Membership in these social categories most often falls outside of our control. This paper argues that membership in social categories constitutes a restriction on human agency, creating a situation of non-ideal agency for many human individuals. -/- However, there (...) are ways to resist the causal influence of social categories, and certain socially marginalized groups can be understood as attempting to do just this. I discuss two instances of social category resistance: gender pronouns and the rights of trans individuals. I suggest that the intentional declaration of gender pronouns (“she/her” or “they/them”) can be understood as an attempt to resist the causal powers of nonconsensual social categorization. Similarly, one among many reasons to support the rights of trans individuals is that their self-declarations of gender identity can be viewed as a reclamation of agency in the face of causal constraints imposed by socially defined and imposed gender categories. This lesson can be generalized to people belonging to a broad range of marginalized groups. (shrink)

Identity labels like “woman”, “Black,” “mother,” and “evangelical” are pervasive in both political and personal life, and in both formal and informal classification and communication. They are also widely thought to undermine agency by essentializing groups, flattening individual distinctiveness, and enforcing discrimination. While we take these worries to be well-founded, we argue that they result from a particular practice of using labels to rigidly label others. We identify an alternative practice of playful self-labelling, and argue that it can function as (...) a tool for combating oppression by expressing and enhancing individual and collective agency. Previously proposed strategies for preventing hermeneutical injustices mostly take for granted the interests people have in various things about themselves being intelligible, and aim only to enable them to satisfy these interests. Historically, the pursuit of such strategies has been somewhat successful in preventing trans people from suffering hermeneutical injustices in their interactions with cis people. Yet the widespread anti-trans backlash of recent years has brought to the fore a number of limitations and previously unacknowledged downsides to trans people’s pursuit (...) of such strategies. Thankfully, the pursuit of such strategies is not the only way to go about preventing trans people from suffering hermeneutical injustices in their interactions with cis people. At least some such injustices can be prevented by instead doing away with some of the interests trans people have in certain things about themselves being intelligible to certain cis people, and thus with the possibility of those interests going unfairly unsatisfied. In particular, trans people can do away with some of those interests by meeting the needs which underly them for themselves. Such strategies are infrapolitical in the sense that because they largely play out within a marginalized group rather than between a marginalized group and a dominant group, they tend not to register on the radar of the dominant group. I argue that especially in the context of a backlash against a marginalized group by members of a dominant group, this is an important advantage to strategies of this previously untheorized sort. Iris Murdoch’s The Sovereignty of Good—especially the first essay, “The Idea of Perfection”—is often associated with a critique of a certain picture of agency and its proper place in ethical thought. There is implicit in this critique, however, an alternative, much richer one. I propose a reading of Murdochian agency in terms of the continuous activity of cultivating and refining a distinctive practical standpoint, and I apply this reading to her account of moral progress. For Murdoch moral progress depends on (...) transcending egoism and achieving clear perception of a normatively-saturated reality, but it would be a mistake to think of egoism in terms of selfishness, or clarity in terms of altruism. Rather, I argue, Murdochian moral progress requires overcoming socially-conditioned and often ideological forms of alienation, and making the social conditions that inform our practical standpoints self-conscious. In this paper, I argue that academic institutions have a pro tanto obligation to delegitimize transphobic views, which in many contexts is undefeated. By this, I mean academic institutions generally should not take such views seriously as viable candidates for belief, though sometimes this obligation may be outweighed by other considerations. Three premises together justify this conclusion. First, if academic institutions do not delegitimize transphobic views, then they structurally perpetuate the subordination of trans people. Second, institutions have a pro tanto (...) obligation to avoid structurally perpetuating subordination, which can only be defeated when such avoidance is excessively burdensome. Third, academic institutions can delegitimize transphobic views in a manner that is not excessively burdensome, at least in many contexts. More specifically, delegitimizing transphobic views aligns with important institutional norms and a robust notion of academic freedom. (shrink)

Philosophy of language in the 21st century has cultivated a concern for the hateful, the coercive, and the lethal. Amidst this shift of attention toward politically significant speech, ‘non-ideal’ philosophers of language investigate whether common conceptual toolkits from ‘mainstream’ philosophy of language manage to make contact with our non-ideal world in the first place. Drawing on a tradition of Wittgensteinian critical social thought, I contend that philosophers of language risk their (ideology‐)critical bite when they isolate our words from the activities (...) into which they are woven. That is, when philosophers fail to register our ordinary investment in the words we put on display—the interests, stakes, and concerns in light of which we voice them—we make their political import unavailable to philosophy of language. But the non-ideal philosopher’s concept of idealization is itself a normatively non-neutral tool; and, as such, it exemplifies the sort of theoretical resource that may be mobilized with an investment in shaping not only our epistemic resources but also our senses of what matters. This essay explores what it means to “queer” ethics. Writing from a perspective that is both personal and philosophical, I argue that we cannot queer ethics simply by expanding the range of topics studied by analytic philosophers to include things like kink, misgendering, and going stealth. Queering projects in analytic ethics require queer sensibility, ways of doing philosophy that deviate from analytic philosophy’s dominant norms. This paper has two aims: to explore the affective dimensions of moral shock and the way it relates to normative marginalization of those furthest from dominant society and also, more specifically, to articulate the trans experience of constantly being under moral attack because the dominant ‘world’ normatively defines trans individuals out of existence. Toward these ends, I build on Katie Stockdale's recent work on moral shock, arguing that moral shock needs to be contextualized to ‘worlds’ of sense to understand how (...) marginalized people affectively experience shocking events. My focus is the trans experience of moral shock due to the way trans people are positioned outside of dominant society, which creates the conditions to experience cyclical, chronic shock. These affective conditions point to a collective responsibility to ease the affective stress that the most marginalized experience. (shrink)

In this paper, I challenge standard views of the moral badness of sentimentality defended by art critics and philosophers. Accounts based on untruthfulness and self-indulgence lack the resources to both explain the badness of bad sentimentality and to allow that there are benign instances. We are sometimes permitted to be sentimental even though it is self-serving. A non-moralistic account should allow for this. To provide such an account, I first outline a substantive view of the ideal of unsentimentality by turning (...) to Rainer Maria Rilke’s Letters on Cézanne. Rilke celebrates the artist for his unsentimental love of his subjects and “untiring objective wakefulness” to them. I then turn to Iris Murdoch’s ethics of attention (itself influenced by Rilke) to explain why this ideal is so difficult to live up to in practice, the various ways that we fall short, and what our failures mean. What Murdoch contributes is both a sense that the lovingly attentive attitude that Rilke describes is morally—and not just artistically—important and a compassionate account of the human egocentrism that inhibits it. By thinking of sentimentality as a failure of moral attention, we can appreciate how particular instances differ from one another. Sentimentality can console us in difficult times or can gratify our egos; it can be a form of escapism or can rigidly enclose reality; and it can be harmlessly self-serving or a selfish failure to morally attend to the other when it counts. I conclude by outlining some ways that being seen with Cézanne-like moral attention can matter to us. (shrink)

Saba Mahmood’s anthropological work studies the gain in skills, agency and capacity building by the women’s dawa movement in Egypt. These women increase their virtue toward the goal of piety by following dominant, often patriarchal norms. Mahmood argues that “teleological feminism” ignores this gain in agency because this kind of feminism only focuses on opposition or resistance to these norms. In this paper I defend Mahmood’s “anti-teleological” feminist work from criticisms that her project valorizes oppression and has no vision for (...) a nonoppressive feminist future. I argue the future envisioned by teleological feminists gets caught in “the Hegelian” trap of replicating past oppression in their feminist future. I find in Mahmood’s work the tools to escape this trap. I argue, rather than a movement of overcoming oppression, Mahmood’s work suggests an immanent and creative movement that emphasizes difference for a truly new future. I turn to a Bergsonian metaphor and argue that this movement can be seen as akin to the movement of biological evolution. I conclude using the work of Eve Sedgwick that the Egyptian women that Mahmood studies are being read in a “paranoid” fashion and demonstrate using Leila Ahmed a better “reparative” reading of these women. I ask what is required for pregnant trans and gender diverse (TGD) people to receive trustworthy reproductive healthcare which supports their autonomy. My focus is on wanted pregnancies. I understand interpersonal trust as a positive attitude towards the competence and motivation or commitment of a person trusted in a particular role, such as a healthcare professional, and autonomy as self-governance shaped by what one cares about. I conceive of autonomy as relational and potentially enhanced or damaged by social interactions. I (...) argue that mainstream bioethical conceptions of autonomy can accommodate my claims about how the autonomy of pregnant TGD persons can be diminished or supported, especially in relation to trust. I argue that support for the autonomy of pregnant TGD persons requires acknowledgement and understanding of their gender identity and when it is not relevant to their healthcare. My discussion has implications for whether morality requires us to affirm trans identities and what this means in healthcare. I conclude with remarks about what else we can learn by centering the experiences of pregnant TGD persons. (shrink)

Philosophers of race and other writers in the Black and Latinx intellectual traditions have remarked on what it is like to live under “the racial gaze,” to be shaped and limited by the way whites perceive us. However, little work has been spent developing how the racial gaze functions in whites’, and other racially privileged people’s, moral psychology. I argue in this paper that there is a morally objectionable way of perceiving people of color. This claim builds on an insight (...) from Iris Murdoch that our perception can be morally evaluable and extends it to issues of race. I articulate how racial stereotypes and misvaluing distort one’s perception of people of color and that these distortions are organizing around a dominant conception for race that plays an important role in the oppression of people of color. I believe understanding racist perception lays a foundation for understanding the moral dimensions of interpersonal (as opposed to structural) racism. (shrink)

Cissexist perception involves a prejudicial judgment and an unmediated affective response, such as that of disgust, directed at the gendered aspects of another person. In this paper, I advance a view of how cissexist perception harms disabled people. On this view, there at least two morally problematic aspects of cissexist perception: that it has painful effects, and that it restricts bodily agency. I defend this claim through an analysis of a double bind faced by people subjected to cissexist perception: on (...) the one hand, such individuals are pressured into avoiding certain environments to dodge dangerous predicaments that can arise on behalf of looking different from others; this constitutes unfair exclusion from an environment and under some conditions causes pain. On the other hand, to avoid dangerous predicaments, targets of cissexist perception are pressured into concealing their gender non-conformity to fit into certain environments; concealing frustrates their bodily agency. I conclude with remarks about how trans-affirming artwork may have the capacity to interrupt cissexist perception. (shrink)
