Particularists in ethics emphasize that the normative is holistic, and invite us to infer with them that it therefore defies generalization. This has been supposed to present an obstacle to traditional moral theorizing, to have striking implications for moral epistemology and moral deliberation, and to rule out reductive theories of the normative, making it a bold and important thesis across the areas of normative theory, moral epistemology, moral psychology, and normative metaphysics. Though particularists emphasize the importance of the holism of (...) the normative, however, it is not something that they have been able to explain. In this paper I’ll show how to use a small number of simple and, I’ll argue, independently compelling assumptions in order to both predict and explain the holistic features of the normative with respect to the non-normative. The basic idea of the paper is simple. It is that normative claims are holistic because they are general, rather than because they defy generalization. (shrink)

It is commonly held that our intuitive judgements about imaginary problem cases are justified a priori, if and when they are justified at all. In this paper I defend this view — ‘rationalism’ — against a recent objection by Timothy Williamson. I argue that his objection fails on multiple grounds, but the reasons why it fails are instructive. Williamson argues from a claim about the semantics of intuitive judgements, to a claim about their psychological underpinnings, to the denial of rationalism. (...) I argue that the psychological claim — that a capacity for mental simulation explains our intuitive judgements — does not, even if true, provide reasons to reject rationalism. (More generally, a simulation hypothesis, about any category of judgements, is very limited in its epistemological implications: it is pitched at a level of explanation that is insensitive to central epistemic distinctions.) I also argue that Williamson’s semantic claim — that intuitive judgements are judgements of counterfactuals — is mistaken; rather, I propose, they are a certain kind of metaphysical possibility judgement. This paper concerns non-causal normative explanations such as ‘This act is wrong because/in virtue of__’. The familiar intuition that normative facts aren't brute or ungrounded but anchored in non- normative facts seems to be in tension with the equally familiar idea that no normative fact can be fully explained in purely non- normative terms. I ask whether the tension could be resolved by treating the explanatory relation in normative explanations as the sort of ‘grounding’ relation that receives extensive discussion in (...) recent metaphysics. I argue that this would help only under controversial assumptions about the nature of normative facts, and perhaps not even then. I won't try to resolve the tension, but draw a distinction between two different sorts of normative explanations which helps to identify constraints on a resolution. One distinctive constraint on normative explanations in particular might be that they should be able to play a role in normative justification. (shrink)

This paper defends a moderate intuitionism by extending a version of that view previously put forward and responding to some significant objections to it that have been posed in recent years. The notion of intuition is clarified, and various kinds of intuition are distinguished and interconnected. These include doxastic intuitions and intuitive seemings. The concept of inference is also clarified. In that light, the possibility of non-inferential intuitive justification is explained in relation to both singular moral judgments, which intuitionists do (...) not take to be self-evident, and basic moral principles, which they typically do take to be self-evident in a sense explicated in the paper. This explanation is accomplished in part by drawing some analogies between moral and perceptual judgments in the light of a developmental conception of knowledge. The final section of the paper presents a partial account of rational disagreement and indicates how the kind of intuitionist view defended can allow for rational disagreement between apparent epistemic peers. Moral philosophers are, among other things, in the business of constructing moral theories. And moral theories are, among other things, supposed to explain moral phenomena. Consequently, one’s views about the nature of moral explanation will influence the kinds of moral theories one is willing to countenance. Many moral philosophers are (explicitly or implicitly) committed to a deductive model of explanation. As I see it, this commitment lies at the heart of the current debate between moral particularists and moral generalists. In (...) this paper I argue that we have good reasons to give up this commitment. In fact, I show that an examination of the literature on scientific explanation reveals that we are used to, and comfortable with, non-deductive explanations in almost all areas of inquiry. As a result, I argue that we have reason to believe that moral explanations need not be grounded in exceptionless moral principles. (shrink)

The question of what role social and political practices should play in the justification of normative principles has received renewed attention in post-millennium political philosophy. Several current debates express dissatisfaction with the methodology adopted in mainstream political theory, taking the form of a criticism of so-called ‘ideal theory’ from ‘non-ideal’ theory, of ‘practice-independent’ theory from ‘practice-dependent’ theory, and of ‘political moralism’ from ‘political realism’. While the problem of action-guidance lies at the heart of these concerns, the critics also share a (...) number of methodological assumptions. Above all, their methodology is practice-dependent in the sense that an existing practice is assumed to put substantial limitations on the appropriate normative principles for regulating it. In other words, we cannot formulate and justify an appropriate principle without first understanding the practice this principle is supposed to govern. The aim of this paper is to map out and analyze the common denominators of these debates with regard to methodological commitments. We will investigate how this practice-dependent method may be understood and motivated. In particular, we point to challenges that must be met in order for the position to remain both distinct and attractive. (shrink)

The doctrine of precedent, as it has evolved within the common law, has at its heart a form of reasoning—broadly speaking, alogic—according to which the decisions of earlier courts in particular cases somehow generalize to constrain the decisions of later courts facing different cases, while still allowing these later courts a degree of freedom in responding to fresh circumstances. Although the techniques for arguing on the basis of precedent are taught early on in law schools, mastered with relative ease, and (...) applied on a daily basis by legal practitioners, it has proved to be considerably more difficult to arrive at a theoretical understanding of the doctrine itself—a clear articulation of the underlying logic. Surprisingly, many ethical realists and anti-realists, naturalists and not, all accept some version of the following normative appeal to the natural (NAN): evaluative and normative facts hold solely in virtue of natural facts, where their naturalness is part of what fits them for the job. This paper argues not that NAN is false but that NAN has no adequate non-parochial justification (a justification that relies only on premises which can be accepted by more or less everyone who accepts NAN) to (...) back up this consensus. I show that we cannot establish versions of NAN which are interesting in their own right (and not merely as instances of a general naturalistic ontology) by appealing to the nature of natural properties or the kind of in-virtue-of relation to which NAN refers, plus other plausible nonparochial assumptions. On the way, I distinguish different types of 'in virtue of claims. I conclude by arguing that the way in which assessment of meta-ethical hypotheses is theory-dependent predicts the failure of non-parochial justifications of NAN. (shrink)

The debate between proponents and opponents of a role for empirical psychology in ethical theory seems to be deadlocked. This paper aims to clarify the terms of that debate, and to defend a principled middle position. I argue against extreme views, which see empirical psychology either as irrelevant to, or as wholly displacing, reflective moral inquiry. Instead, I argue that moral theorists of all stripes are committed to a certain conception of moral thought—as aimed at abstracting away from individual inclinations (...) and toward interpersonal norms—and that this conception tells against both extremes. Since we cannot always know introspectively whether our particular moral judgments achieve this interpersonal standard, we must seek the sort of self-knowledge offered by empirical psychology. Yet reflective assessment of this new information remains a matter of substantive normative theorizing, rather than an immediate consequence of empirical findings themselves. (shrink)

What makes some acts morally right and others morally wrong? Traditionally, philosophers have thought that in order to answer this question we must find and formulate exceptionless moral principles—principles that capture all and only morally right actions. Utilitarianism and Kantianism are paradigmatic examples of such attempts. In recent years, however, there has been a growing interest in a novel approach—Particularism—although its precise content is still a matter of controversy. In this paper I develop and motivate a new formulation of particularism (...) as a research program and I show that my formulation is not vulnerable to the most common objections to particularism. What are moral principles? In particular, what are moral principles of the sort that (if they exist) ground moral obligations or—at the very least—particular moral truths? I argue that we can fruitfully conceive of such principles as real, irreducibly dispositional properties of individual persons (agents and patients) that are responsible for and thereby explain the moral properties of (e.g.) agents and actions. Such moral dispositions (or moral powers) are apt to be the metaphysical grounds of moral obligations and of particular (...) truths about what is morally permissible, impermissible, etc. Moreover, they can do other things that moral principles are supposed to do: explain the phenomena “falling within their scope,” support counterfactuals, and ground moral necessities, “necessary connections” between obligating reasons and obligations. And they are apt to be the truthmakers for moral laws, or “lawlike” moral generalizations. (shrink)

Moral principles play important roles in diverse areas of moral thought, practice, and theory. Many who think of themselves as ‘moral generalists’ believe that moral principles can play these roles—that they are capable of doing so. Moral generalism maintains that moral principles can and do play these roles because true moral principles are statements of general moral fact (i.e. statements of facts about the moral attributes of kinds of actions, kinds of states of affairs, etc.) and because general moral facts (...) explain particular moral facts (i.e. facts about the moral attributes of particulars). Moral holism maintains that what is a moral reason to φ in one case may not be one in another, and may even be a moral reason not to φ given suitable circumstances. Some ‘moral particularists’ maintain that moral holism motivates scepticism about the existence of and need for moral principles, along with scepticism about the viability of principle-based approaches to ethics and moral theory. But I argue that moral holism is itself a form of moral generalism, one that takes facts about the right- and wrong-making powers of (generic) moral factors to explain certain particular moral facts—namely, the rightness and wrongness of particular actions. I also argue that a moral-theoretic version of dispositionalism—the view that dispositions, powers, or capacities are the fundamental units of explanation—explains both why moral holism is true and why moral generalism is true. What are moral principles? The assumption underlying much of the generalism–particularism debate in ethics is that they are (or would be) moral laws: generalizations or some special class thereof, such as explanatory or counterfactual-supporting generalizations. I argue that this law conception of moral principles is mistaken. For moral principles do at least three things that moral laws cannot do, at least not in their own right: explain certain phenomena, provide particular kinds of support for counterfactuals, and ground moral necessities, “necessary (...) connections” between obligating reasons and obligations. Moreover, neither a best-systems theory of moral principles nor any of the competing theories of moral principles proposed by Sean McKeever and Michael Ridge, Pekka Väyrynen, and Mark Lance and Margaret Little could vindicate the law conception of moral principles. I conclude with some brief remarks about what moral principles might be if they are not moral laws. (shrink)

There have been many attempts during the history of applied ethics that have tried to develop a theory of moral reasoning. The goal of this paper is to explicate one aspect of the debate between various attempts of offering a specific method for resolving moral dilemmas. We contrast two kinds of deliberative methods: deliberative methods whose goal is decision-making and deliberative methods that are aimed at gaining edifying perspectives. The decision-making methods assessed include the traditional moral theories like utilitarianism and (...) Kantianism, as well as second order principles, such as principlism and specified principlism. In light of this assessment, we suggest taking a closer look at two perceptive models, casuistry and particularism. These models are used for dealing with moral dilemmas that provide for edifying perspectives rather than decision-making. These perceptive models, though less scientific and not as good at prescribing an action, are more human in the sense that they enrich our moral sensibilities and enhance our understanding of the meaning of the situation. ‘Particularism’ and ‘generalism’ refer to families of positions in the philosophy of moral reasoning, with the former playing down the importance of principles, rules or standards, and the latter stressing their importance. Part of the debate has taken an empirical turn, and this turn has implications for AI research and the philosophy of cognitive modeling. In this paper, Jonathan Dancy’s approach to particularism (arguably one of the best known and most radical approaches) is questioned both on logical and empirical grounds. (...) Doubts are raised over whether Dancy’s brand of particularism can adequately explain the graded nature of similarity assessments in analogical arguments. Also, simple recurrent neural network models of moral case classification are presented and discussed. This is done to raise concerns about Dancy’s suggestion that neural networks can help us to understand how we could classify situations in a way that is compatible with his particularism. Throughout, the idea of a surveyable standard—one with restricted length and complexity—plays a key role. Analogical arguments are taken to involve multidimensional similarity assessments, and surveyable contributory standards are taken to be attempts to articulate the dimensions of similarity that may exist between cases. This work will be of relevance both to those who have interests in computationally modeling human moral cognition and to those who are interested in how such models may or may not improve our philosophical understanding of such cognition. What place, if any, moral principles should or do have in moral life has been a longstanding question for moral philosophy. For some, the proposition that moral philosophy should strive to articulate moral principles has been an article of faith. At least since Aristotle, however, there has been a rich counter-tradition that questions the possibility or value of trying to capture morality in principled terms. In recent years, philosophers who question principled approaches to morality have argued under the banner of (...) moral particularism. Particularists can be found in diverse areas of philosophical inquiry, and their positions and arguments are of broad interest.1 Despite its importance, a proper evaluation of particularism has been hindered both by the diversity of arguments employed to defend it, and, perhaps more significantly, by the diversity of positions that can fairly claim to be particularist. Our aim is first to explicate particularism by identifying a unified range of particularist theses and explaining both what unites them as versions of particularism as well as what distinguishes them from each other. We then articulate and evaluate the main arguments for particularism and explain how each is especially well-suited to supporting some conceptions of particularism rather than others. We tentatively conclude that the positive arguments for particularism are not convincing. They do, however, reveal particularism to be a surprisingly resilient position, one that is not readily refuted.. (shrink)

The main aim of this thesis is to defend moral realism. In chapter 1, I argue that moral realism is best understood as the view that moral sentences have truth-value, there are moral properties that make some moral sentences true, and moral properties are not reducible to non- moral properties. Realism is contrasted with non-cognitivism, error-theory and reductionism, which, in brief, deny, and, respectively. In the introductory chapter, it is also argued that there are some prima facie reasons to assume (...) that non-cognitivism and error-theory are erroneous. In chapters 2 and 3, I suggest that the two main forms of reductionism, analytic and synthetic reductionism, are mistaken. In chapter 4, I argue that the considerations in the previous chapters in relation to non-cognitivism, error-theory and reductionism provide support to moral realism. It is also suggested that these considerations make it plausible to hypothesise that moral properties depend on non- moral properties in a way I refer to as ‘the realist formula’. The realist formula confirms moral realism since it implies that moral properties are not reducible to non- moral properties. In chapters 5, 6 and 7, I argue that moral realism, much owing to the realist formula, is able to explain significant meta-ethical issues regarding moral disagreement, moral reason and moral motivation. Among other things, externalism concerning moral motivation is defended. The explanatory value of moral realism in relation to these meta-ethical issues is taken to suggest that this view is preferable to non-cognitivism, error-theory and reductionism. Some of the meta-ethical issues discussed in these chapters, particularly moral disagreement and motivation, have been thought to provide support to non-cognitivism and error-theory. I maintain that since realism, unlike reductionism, is able to counter these arguments, it justifies us in upholding the view that moral sentences have truth-value and the view that there are moral properties. In chapter 8, various objections against realism with regard to the dependence of moral properties on non- moral properties are responded to. In chapter 9, I consider an influential argument to the effect that moral properties are not involved in causal explanations. I maintain that this argument fails and that it therefore is reasonable to assume that moral properties are natural properties. However, the discussions in chapters 8 and 9 also suggest that moral realism might face problems that cannot be thoroughly discussed in this thesis. (shrink)

According to radical moral particularists such as Jonathan Dancy, there are no substantive moral principles. And yet, few particularists wish to deny that something very like moral principles do indeed play a significant role in our everyday moral practice. Loathe at dismissing this as mere error on the part of everyday moral agents, particularists have proposed a number of alternative accounts of the practice. The aim of all of these accounts is to make sense of our appeal to general moral (...) truths in both reaching and justifying our particular moral judgments without thereby violating the particularists' stricture against substantive moral principles. In this paper, I argue that the most prominent non-substantive accounts of moral generalities appealed to by radical particularists – the heuristic account and default reasons accounts – fail in this aim. It is commonly thought that moral rules and principles, such as ‘Keep your promises,’ ‘Respect autonomy,’ and ‘Distribute goods according to need ,’ should play an essential role in our moral deliberation. Particularists have challenged this view by arguing that principled guidance leads us to engage in worse decision making because principled guidance is too rigid and it leads individuals to neglect or distort relevant details. However, when we examine empirical literature on the use of rules and principles in other (...) domains, we find that people can learn to use rules discriminately and that rule-based models tend to outperform even expert judgment. I argue that this evidence poses a problem for the moral particularist. If the particularist claims that we should not rely on decision-making rules when making practical decisions and it turns out that these rules help us make better decisions, then the particularists’ prescriptive account is deficient. However, if the particularist claims that we should rely on practical decision-making rules but not on moral rules, she needs to explain how practical rules are different from moral rules and why we should rely on the former but not the latter. Recent reflection on the professional knowledge of teachers has been marked by a shift away from more reductive competence and skill-focused models of teaching towards a view of teacher expertise as involving complex context-sensitive deliberation and judgement. Much of this shift has been inspired by an Aristotelian conception of practical wisdom (phronesis) also linked by Aristotle to the development of virtue and character. This has in turn led recent educational philosophers and theorists – inspired by latter-day developments in virtue ethics (...) and virtue epistemology – to investigate the contribution of various forms of virtue to the effective practice of teaching. In this light, the present paper undertakes further exploration of the logical geography of virtue, character and practical deliberation in teaching. (shrink)

Some opponents of ethical particularism complain that particularists cannot give a plausible account of moral education. After considering and rejecting a number of arguments to this conclusion, I focus on the following objection: Particularism, at least in Jonathan Dancy's version, has nothing to say about moral education because it lacks a substantial account of moral competence. By Dancy's own admission, particularists can tell us little more than that a competent agent 'gets things right case by case'. I respond by reflecting (...) on how we want our children to turn out, morally speaking. I argue that we can present a compelling story about our aspirations for our children's moral development that is consistent with particularism and that provides the beginnings of a plausible account of the competence we look to moral education to instil. Can someone be reasonable or justified in accepting a specific moral judgment not based on the prior acceptance of a general exceptioness moral principle, where acceptance of a general principle might be tacit or implicit and might not be expressible in language? This issue is an instance of a wider issue about direct or transductive inference. Developments in statistical learning theory show that such an inference can be more effective than alternative methods using inductive generalization and so can be reasonable. (...) This result carries over to moral transduction, although it is a difficult empirical issue whether people actually engage in any sort of transduction, including moral transduction. (shrink)

Epistemology is sometimes said to be a normative discipline, but what this characterization means is often left unclear. This paper distinguishes two kinds of normativity and thereby provides a new way of understanding attributions of normativity. Associated with this distinction are two kinds of epistemological reflection. These are shown to be parallel to two kinds of ethical reflection. In the light of what emerges in showing these points, the paper clarifies the requirements for naturalizing epistemology, the place normativity might have, (...) given certain kinds of naturalization, and the sense in which knowledge and justification may be viewed as normative. One form of scepticism about the possibility ofmoral theorydoes not deny that there is something describable as ‘the conduct of life’, but it argues that there is no special ethical account to be given of this since conduct has no identifiablymoraldimension. Here I explore the possibility that the problem of identifying distinctively moral aspects of action is explained by the thesis that the moral is ubiquitous; thateveryhuman actionis– not ‘may be’ – morally significant. To say, however, that morality is all (...) pervasive is not to say anything about howdemandingmoral considerations may be. Reasons for action ultimately relate to promoting or protecting the human good, and their relative strength and urgency derives from the manner, extent and immediacy of their bearing upon this end and not from belonging to some logically distinct category. I take the debate between the particularists and the principlists to be centered on the issue of whether there are true moral principles. One argument the principlists often appeal to in support of their claim that there are true moral principles is the argument from supervenience. Roughly, the argument is made up of the following three statements: (P1) If the thesis of moral supervenience holds, then there are true moral principles. (P2) The thesis of moral supervenience holds. (C) There are (...) true moral principles, and hence particularism is false. In this paper, I argue that the above argument is not sound by attacking (P1). I hold that no general supervenient/resultance base has a robust enough configuration of contextual features as to ground the existence of true moral principles. If I am right about this, I think it would be indicative of a reason to be less confident about the truth of principlism and more confident about the truth of particularism. (shrink)

Sidgwick gives various tests for highest certainty. When he applies these tests to commonsense morality, he finds nothing of highest certainty. In contrast, when he applies these tests to his own axioms, he finds these axioms to have highest certainty. The axioms culminate in Benevolence: “Each one is morally bound to regard the good of any other individual as much as his own, except in so far as he judges it to be less, when impartially viewed, or less certainly knowable (...) or attainable by him.” The axioms face challenges from two sides.First, one test requires that a claim not be denied by someone of whom one has no more reason to suspect of error than oneself. For Sidgwick, then, the egoist must not deny the axioms. But it would seem that an egoist would reject benevolence. Second, Sidgwick thinks he must show that the commonsense moralist agrees to the axioms. Benevolence seems to say that the only reason for departing from being bound to treat others like oneself is that more good would be produced. But the commonsense moralist will not agree that this is the only reason. In reply to the threat of an egoist's disagreement, this essay argues that many of the axioms should be read as having as their antecedent “from the point of view of the universe.” The essay replies to the objection that this makes these axioms analytic. In reply to the threat of a commonsense moralist's disagreement, this essay argues that each axiom states, in effect, a prima facie duty. The argument against the commonsense moralist concerns not benevolence but whether there are further duties that pass the tests. The essay raises the worry that here Sidgwick is unfair since sometimes he criticizes all-things-considered versions of commonsense duties; such criticisms would count against benevolence as well. This essay defends a three-dimensional response-model theory of recognition of persons, and discusses the related phenomenon of recognition of reasons, values and principles. The theory is three-dimensional in endorsing recognition of the equality of persons and two kinds of relevant differences: merits and special relationships. It defends a ‘response-model’ which holds that adequacy of recognition of persons is a matter of adequate responsiveness to situation-specific reasons and requirements. This three-dimen- sional response-model is compared to Peter Jones’s view, which draws the (...) distinction between status and merit recognition, and mediated and unmediated recognition. The essay discusses a number of questions related to how recognition of situation-specific reasons, and more general values and principles, is related to recognition of persons. The three- dimensional response-model of recognition of persons is in principle compatible with a constructivist view, which holds that the validity of values and principles is dependent on acknowledgement or endorsement. But even if one is a realist on that issue and thinks of validity as independent of acknowledgement, acknowledging relevant values, reasons and principles is a hugely important precondition of actual interpersonal recognition. Abstract: Kant declares the judgment of beauty to be neither ‘objective’ nor ‘merely subjective’. This essay takes up the question of what this might mean and whether it can be taken seriously. It is often supposed that Kant's denials of ‘objectivity’ to the judgment of beauty express a rejection of realism about beauty. I suggest that Kant's thought is not to be understood in these terms—that it does not properly belong in the arena of debates about the constituents of ‘reality’—motivating (...) the suggestion by first considering a pair of opposing views on the question of whether Kant can be understood to develop a real alternative to realism about beauty at all. Sinnott-Armstrong has attacked the epistemology of moral intuitionism on the grounds that it is not justified to have some moral beliefs without needing them to be inferred from other beliefs. He believes that our moral judgments are inferentially justified because the “framing effects” which are mostly discussed in the empirical psychology cast doubt on any non-inferential justification. In this paper, I argue that Sinnott-Armstrong’s argument is question begging against intuitionists and his description of epistemological intuitionism is a diluted version that (...) most of intuitionists do not believe, therefore he is not attacking the epistemological intuitionism in its strongest form. I then propose my alternative modest account of epistemological intuitionism. I also reconsider the concept of “non-inferentiality”, as one of the key elements of intuitionist epistemology, and propose a modest account of non-inferentiality. (shrink)

‘Particularism’ is a meta-ethical theory resulting from a holistic doctrine in the theory of reasons. According to Jonathan Dancy, the foremost contemporary proponent of particularism, ‘a feature that is a reason in favour of an action in one case may be no reason at all in another, or even a reason against’ (2004: 190). From this, Dancy claims, it follows that the ‘possibility of moral thought and judgement does not depend on the provision of a suitable supply of moral principles’ (...) (2004: 7). This doctrine is of significant interest and import in its own right, and accordingly is the subject of considerable critical attention. A popular argument form uses general theories of cognitive architecture to motivate conclusions about the nature of moral cognition. This paper highlights the possibility for modus tollens reversal of this argument form. If theories of cognitive architecture generate predictions for moral cognition, then tests of moral thinking provide feedback to cognitive science. In certain circumstances, philosophers' introspective attention to their own moral deliberations can provide unique data for these tests. Recognizing the possibility for this sort of feedback helps to illuminate (...) a deep continuity between the disciplines. (shrink)

In this paper I argue for a particularist understanding of thick evaluative features, something that is rarely done and is fairly controversial. That is, I argue that sometimes that the fact that an act is just, say, could, in certain situations, provide one with a reason against performing the action. Similarly, selfishness could be right-making. To show this, I take on anti-particularist ideas from two much-cited pieces (by Crisp, and by McNaughton and Rawling), in the influential Moral Particularism anthology (eds.) (...) Moral particularism, as recently defended, charges that traditional moral theorizing unduly privileges moral principles. Moral generalism defends a prominent place for moral principles. Because moral principles are often asked to play multiple roles, moral particularism aims at multiple targets. We distinguish two leading roles for moral principles, the role of standard and the role of guide. We critically survey some of the leading arguments both for and against principles so conceived.

In their article entitled “Ethical Particularism and Patterns”, Frank Jackson, Philip Pettit, and Michael Smith (JPS henceforth) argue that moral particularism is a cognitively implausible theory since it appears to entail the view that one might have a skill that is not grounded in an ability to recognise and represent natural patterns in the world. This charge echoes the complaints of computational theorists of cognition against their embodied cognition counterparts, namely that, theories of cognition that eschew talk of mental representation (...) are implausible qua theories of cognition. In both debates, the cognitive role of generalisation is central to the discussion; however, contrary to the received wisdom, I want to suggest that the dispute is not between generalisation or mental representation on the one hand and no generalisation or mental representation on the other, but rather between what I will call global and local generalisation. Using the dialogue between JPS and Dancy (our paradigm particularist) to frame this discussion, I show that by replacing Dancy's connectionist model for particularist reasoning with a case-based one, we not only vindicate his response to JPS, but we also gain insight into how it is the global/local distinction rather than the generalisation/no generalisation distinction that divides the two views. This essay argues that there is room for a third position between moral particularism and moral generalism in their orthodox forms. The view proposed in this essay is inspired by the later Wittgenstein's conception of grammar and holds that formulations of ethical principles can be interpreted as grammatical statements, while ethical problems can be interpreted as instances of grammatical tension. On this reading, situations in which ethical principles turn out to conflict come out as moments in the evolution of language. (...) In the Principles of the Penal Code, Jeremy Bentham described offences that he labelled presumed or evidentiary. The conduct penalized under such offences is punished not because it is intrinsically wrong, but because it probabilistically indicates the presence of an intrinsic wrong. Bentham was sceptical of the need to create offences, but grudgingly accepted their value in light of deficiencies in procedure and the judiciary. These days the scepticism is even greater, with courts and commentators in the United States, Canada, (...) the United Kingdom and elsewhere believing that such offences deny a defendant the right to establish that he did not engage in the conduct that the presumed offence probabilistically but not necessarily indicates. On closer analysis, however, such scepticism appears unjustified. Almost all offences, and indeed almost all legal rules, are premised on a probabilistic relationship between the behaviour the rule encompasses and the behaviour that is the rule-maker's real concern. Presumed offences may make this relationship especially obvious, but it is a relationship that exists whenever the law operates by the use of rules. (shrink)

Moral particularism, broadly understood, is the position that morality resists codification into a set of rules or principles.1 Jonathan Dancy, particularism's main contemporary proponent, maintains that there are few, if any, true moral principles, and moral reasoning and judgment do not require them. Instead, acts are justified by the salient features of particular situations, and moral reasoning requires attunement to these elements. In rejecting a rule-bound approach to morality, particularists deny pictures of moral education emphasizing knowledge and application of principles. (...) Abstract: The point of this paper is to undermine the support that particularism in the domain of epistemic reasons might seem to give to particularism in the domain of practical reasons. In the epistemic domain, there are two related notions: truth and the rationality of belief. Epistemic reasons are related to the rationality of belief, and not directly to truth. In the domain of practical reasons, however, the role of truth is taken by the notion of objective rationality. Practical reasons (...) are directly relevant to this objective notion, and therefore the reasons to expect holism and particularism in the epistemic domain do not transfer to the domain of practical rationality. A body of psychological data casts doubt on the idea of character traits. As a result, some conclude that situations determine action. This view, situationism, undercuts our conception of the individual as responsible for actions. Moreover, the situationist argues that virtue theories, because they emphasize character, are most vulnerable to this attack. At its extreme, situationists hold that there are no character traits of the sort virtue theory requires. I argue, however, that the virtue theorist can answer this critique. Their (...) response elucidates the ordinary process of moral development and reveals that the human good is partly constituted by social context. The situationist, mistaken about the virtues, makes an important point: situations have a substantial bearing on our abilities to be morally good and to flourish. But accepting this need not undermine the virtue theorist’s view because human beings can learn to be sensitive to morally salient aspects of situations. (shrink)

The problem of aesthetic principles and that of the nature of aesthetic reasons get confronted. If aesthetic reasons play an important role in our aesthetic evaluations and judgments, then both some general aesthetic principles and rules could support them (aesthetic generalism) or again their nature may be particularistic (aesthetic particularism). A recent argument in support of aesthetic generalism as proposed by Oliver Conolly and Bashshar Haydar is presented and criticized for its misapprehension of particularism. Their position of irreversible aesthetic generalism (...) is questioned. Aesthetic particularism is restated by the help of proposals by Jonathan Dancy’s version of moral particularism. (shrink)

Adherents of particularism draw rather strong implications of this view. However, particularism has never been stated in a canonical way. We locate the core of particularism as a claim about how different reasons combine to generate the Tightness or wrongness of an action. Using the notion of an ordering of alternatives containing separable factors, we show that particularism can be stated more generally as the denial that there exist separable factors.With this definition in place, we show that, once subjected to (...) a number of clarifications, particularism largely does have the implications often associated with it. However, we find the various arguments that have been given in support of particularism to be very poor. We conclude that particularists do have a point when they claim that some form of generalism cannot simply be taken for granted. But no particular reasons in favour of being a particularist have been offered. (shrink)

Do we need defeasible generalizations in epistemology, generalizations that are genuinely explanatory yet ineliminably exception-laden? Do we need them to endow our epistemology with a substantial explanatory structure? Mark Lance and Margaret Little argue for the claim that we do. I will argue that we can just as well do without them – at least in epistemology. So in the paper, I am trying to very briefly sketch an alternative contextualist picture. More specifically, the claim will be that although an (...) epistemic contextualist should commit himself to epistemic holism he can nevertheless appeal to epistemic principles other than defeasible generalizations in order to provide his epistemology with a structure.
