This chapter discusses the philosophical relevance of empirical research on moral cognition. It distinguishes three central aims of normative ethical theory: understanding the nature of moral agency, identifying morally right actions, and determining the justification of moral beliefs. For each of these aims, the chapter considers and rejects arguments against employing cognitive scientific research in normative inquiry. It concludes by suggesting that, whichever of the central aims one begins from, normative ethics is improved by engaging with the science of moral (...) cognition. (shrink)

The moral status of human brain organoids (HBOs) has been debated in view of the future possibility that they may acquire phenomenal consciousness. This study empirically investigates the moral sensitivity in people’s intuitive judgments about actions toward conscious HBOs. The results showed that the presence/absence of pain experience in HBOs affected the judgment about the moral permissibility of actions such as creating and destroying the HBOs; however, the presence/absence of visual experience in HBOs also affected the judgment. These findings suggest (...) that people’s intuitive judgments about the moral status of HBOs are sensitive to the valence-independent value of phenomenal consciousness. We discuss how these observations can have normative implications; particularly, we argue that they put pressure on the theoretical view that the moral status of conscious HBOs is grounded solely in the valence-dependent value of consciousness. We also discuss how our findings can be informative even when such a theoretical view is finally justified or when the future possibility of conscious HBOs is implausible. (shrink)

Suppose an agent is choosing between rescuing more people with a lower probability of success, and rescuing fewer with a higher probability of success. How should they choose? Our moral judgments about such cases are not well-studied, unlike the closely analogous non-moral preferences over monetary gambles. In this paper, I present an empirical study which aims to elicit the moral analogues of our risk preferences, and to assess whether one kind of evidence—concerning how they depend on outcome probabilities—can debunk them. (...) I find significant heterogeneity in our moral risk preferences—in particular, moral risk-seeking and risk-neutrality are surprisingly popular. I also find that subjects’ judgments aren't probability-dependent, thus providing an empirical defense against debunking arguments from probability dependence. (shrink)

Robert Nozick famously raised the possibility that there is a sense in which both deontology and utilitarianism are true: deontology applies to humans while utilitarianism applies to animals. In recent years, there has been increasing interest in such a hybrid views of ethics. Discussions of this Nozickian Hybrid View, and similar approaches to animal ethics, often assume that such an approach reflects the commonsense view, and best captures common moral intuitions. However, recent psychological work challenges this empirical assumption. We review (...) evidence suggesting that the folk is deontological all the way down—it is just that the moral side constraints that protect animals from harm are much weaker than those that protect humans. In fact, it appears that people even attribute some deontological protections, albeit extremely weak ones, to inanimate objects. We call this view Multi-level Weighted Deontology. While such empirical findings cannot show that the Nozickian Hybrid View is false, or that it is unjustified, they do remove its core intuitive support. That support belongs to Multi-level Weighted Deontology, a view that is also in line with the view that Nozick himself seemed to favour. To complicate things, however, we also review evidence that our intuitions about the moral status of humans are, at least in significant part, shaped by factors relating to mere species membership that seem morally irrelevant. We end by considering the potential debunking upshot of such findings about the sources of common moral intuitions about the moral status of animals. (shrink)

The trolley problem is one of the liveliest research frameworks in experimental ethics. In the last decade, social neuroscience and experimental moral psychology have gone beyond the studies with mere text-based hypothetical moral dilemmas. In this article, I present the rationale behind testing the actual behaviour in more realistic scenarios through Virtual Reality and summarize the body of evidence raised by the experiments with virtual trolley scenarios. Then, I approach the argument of Ramirez and LaBarge (2020), who claim that the (...) virtual simulation of the Footbridge version of the trolley dilemma is an unethical research practice, and I raise some objections to it. Finally, I provide some reflections about the means and ends of trolley-like scenarios and other sacrificial dilemmas in experimental ethics. (shrink)

In the last twenty years, there has been an enormous growth of scientific research concerning the process of human moral reasoning and moral intuitions. In contemporary descriptive ethics, three dominant approaches can be found – heuristic approach, dual-process theory, and universal moral grammar. Each of these accounts is based on similar empirical evidence combining findings from evolutionary biology, moral psychology, and neuroethics. Nevertheless, they come to different conclusions about the reliability of moral intuitions. The aim of this paper is to (...) critically investigate each of these approaches and compare them with recent scientific findings. Last chapter addresses implications of these findings for moral epistemology and normative ethics. The aim is to show that despite different interpretations of available data, we can reach a satisfying pragmatical conclusion which would be in compliance with the empirical evidence, yet it would not necessarily depend on it. Many contemporary ethicists use case-based reasoning to reach consistent beliefs about ethical matters. The idea is that particular cases elicit moral intuitions, which provide defeasible reasons to believe in their content. However, most proponents of case-based moral reasoning are not very explicit about how they resolve inconsistencies and how they abstract principles from judgments about particular cases. The aim of this article is to outline a methodology—called Consistency Reasoning Casuistry—for case-based reasoning in ethics. This methodology draws on Richmond Campbell and (...) Victor Kumar’s naturalistic model for the resolution of inconsistencies between the content of intuitions about particular cases. I argue that reasons similar to those that motivate their model also support a more abstract form of moral reasoning that goes beyond mere resolutions of inconsistencies between case judgments and demands the formulation of more abstract moral norms. Consistency Reasoning Casuistry, it is argued, is a good candidate for a methodology for case-based moral reasoning that is in harmony with paradigms of contemporary moral psychology and that can accommodate the methodology implicit in the work of many contemporary ethicists. Human civilisation faces a range of existential risks, including nuclear war, runaway climate change and superintelligent artificial intelligence run amok. As we show here with calculations for the New Zealand setting, large numbers of currently living and, especially, future people are potentially threatened by existential risks. A just process for resource allocation demands that we consider future generations but also account for solidarity with the present. Here we consider the various ethical and policy issues involved and make a case for (...) further engagement with the New Zealand public to determine societal values towards future lives and their protection. The idea of using biomedical means to make people more likely to behave morally may have a certain appeal. However, it is very hard to find two persons – let alone two moral philosophers – who agree on what it means to be moral or to act morally. After discussing some of the proposals for moral enhancements that all ethicists could agree on, I engage more closely with the recent idea of “procedural moral enhancement” that aims at improving deliberative processes (...) instead of particular moral views, motivations, or dispositions. I argue that it is better understood as a contribution to moral epistemology and should thus be labeled “moral-epistemic enhancement”. I then defend perspective-taking as a moral epistemic capacity which can be enhanced by both traditional and non-traditional biomedical means; a capacity which almost always contributes to the epistemic value of moral decision-making. Perspective-taking seems to be an uncontroversial non-trivial capacity for moral decision-making reasonably widely shared by proponents of ethical beliefs within the academic community. The enhancement of this capacity is thus a good candidate for an uncontroversial non-trivial moral enhancement. (shrink)

According to the dual-process account of moral judgment, deontological and utilitarian judgments stem from two different cognitive systems. Deontological judgments are effortless, intuitive and emotion-driven, whereas utilitarian judgments are effortful, reasoned and dispassionate. The most notable evidence for dual-process theory comes from neuroimaging studies by Joshua Greene and colleagues. Greene has suggested that these empirical findings undermine deontology and support utilitarianism. It has been pointed out, however, that the most promising interpretation of his argument does not make use of the (...) empirical findings. In this paper, I engage with recent attempts by Greene to vindicate the moral significance of dual-process theory and the supporting neuroscientific findings. I consider their potential moral significance with regard to three aspects of Greene’s case against deontology: the argument from morally irrelevant factors, the functionalist argument and the argument from confabulation. I conclude that Greene fails to demonstrate how neuroscience and dual-process theory in general can advance moral theorizing. (shrink)

While standard forms of discrimination are widely considered morally wrong, philosophers disagree about what makes them so. Two accounts have risen to prominence in this debate: One stressing how wrongful discrimination disrespects the discriminatee, the other how the harms involved make discrimination wrong. While these accounts are based on carefully constructed thought experiments, proponents of both sides see their positions as in line with and, in part, supported by the folk theory of the moral wrongness of discrimination. This article presents (...) a vignette-based experiment to test empirically what, in the eyes of “folks”, makes discrimination wrong. Interestingly, we find that, according to folks, both disrespect and harm make discrimination wrong. Our findings offer some support for a pluralistic account of the wrongness of discrimination over both monist respect-based and monist harm-based accounts. (shrink)

This paper addresses the concept of moral luck. Moral luck is discussed in the context of medical error, especially an error of omission that occurs frequently, but only rarely has adverse consequences. As an example, a failure to compare the label on a syringe with the drug chart results in the wrong medication being administered and the patient dies. However, this error may have previously occurred many times with no tragic consequences. Discussions on moral luck can highlight conflicting intuitions. Should (...) perpetrators receive a harsher punishment because of an adverse outcome, or should they be dealt with in the same way as colleagues who have acted similarly, but with no adverse effects? An additional element to the discussion, specifically with medical errors, is that according to the evidence currently available, punishing individual practitioners does not seem to be effective in preventing future errors. The following discussion, using relevant philosophical and empirical evidence, posits a possible solution for the moral luck conundrum in the context of medical error: namely, making a distinction between the duty to make amends and assigning blame. Blame should be assigned on the basis of actual behavior, while the duty to make amends is dependent on the outcome. (shrink)

Direct epistemic consequentialism is the idea that X is epistemically permissible iff X maximizes epistemic value. It has received lots of attention in recent years and is widely accepted by philosophers to have counterintuitive implications. There are various reasons one might suspect that the relevant intuitions will not be widely shared among non-philosophers. This paper presents an initial empirical study of ordinary intuitions. Is it fair for employers to select candidates partly based on how the employers think customers react to the candidates' appearances, that is, based on candidates' reaction qualifications? Both philosophically (in the literature on wrongful discrimination) and empirically, this question has recently been getting attention. Here, we focus on a theory of unfair disadvantages emphasizing (i) whether the possession of the appearance feature in question reflects choices on the part of the candidate and (ii) whether the appearance feature in question (...) reflects values or convictions of importance to the candidate. We scrutinize the theory by evaluating how well these factors map on to folk intuitions about wrongful discrimination using an experimental-philosophical approach and data from the United States. We do so on the presumption that coherence with folk intuitions is one desideratum for a philosophical theory and that attention should be given to potential discrepancies between philosophical theories and folk intuitions. Our central finding is that there is only general support for factor (i), not (ii), in the American population. Our study also adds to the extant empirical literature on reaction qualifications that tend to focus on the employer's side of the matter, not the candidate's as we do. (shrink)

Crashes involving self-driving cars at least superficially resemble trolley dilemmas. This article discusses what lessons machine ethicists working on the ethics of self-driving cars can learn from trolleyology. The article proceeds by providing an account of the trolley problem as a paradox and by distinguishing two types of solutions to the trolley problem. According to an optimistic solution, our case intuitions about trolley dilemmas are responding to morally relevant differences. The pessimistic solution denies that this is the case. An optimistic (...) solution would yield first-order moral insights for the ethics of self-driving cars, but such a solution is difficult to come by. More plausible is the pessimistic solution, and it teaches us a methodological lesson. The lesson is that machine ethicists should discount case intuitions and instead rely on intuitions and judgments at a higher level of generality. (shrink)

Debunking arguments use empirical evidence about our moral beliefs - in particular, about their causal origins, or about how they depend on various causes - in order to reach an epistemic conclusion about the trustworthiness of such beliefs. In this thesis, I investigate the scope and limits of debunking arguments, and their implications for what we should believe about morality. I argue that debunking arguments can in principle work - they are based on plausible epistemic premises, and at least some (...) of them avoid putative problems concerning regress and redundancy. However, I also argue that some debunking arguments fall short because they are insufficiently supported by the empirical evidence. By considering different objections, analyses, and a case study, I explore the conditions for a successful debunking argument. (shrink)

The Gamer's Dilemma is a much-discussed issue in video game ethics which probes our seemingly conflicting intuitions about the moral acceptability of virtual murder compared to virtual child molestation. But how we approach this dilemma depends on how we frame it. With this in mind, I identify three ways the dilemma has been conceptualized: the Descriptive Gamer's Investigation, which focuses on empirically explaining the source of our intuitions; the Gamer's Puzzle, which uses the dilemma to explore and test moral or (...) metaphysical theories; and the Applied Gamer's Dilemma, which reconstructs the moral commitments underlying the intuitions to provide action-guidance. Clearly distinguishing these framings allows us to identify the distinct methodologies and criteria of success for each approach. This tripartite framework helps resolve confusions in the debate, highlights the need for experimental philosophy to test proposed resolutions, and opens space for a serious reconsideration of consequentialism. How should scarce healthcare resources be distributed? This is a contentious issue that became especially pressing during the pandemic. It is often emphasised that studies exploring public views about this question provide valuable input to the issue of healthcare priority setting. While there has been a vast number of such studies it is rarely articulated, more specifically, what the results from these studies would mean for the justification of principles for priority setting. On the one hand, it seems unreasonable that (...) public values would straightforwardly decide the ethical question of how resources should be distributed. On the other hand, in a democratic society, it seems equally unreasonable that they would be considered irrelevant for this question. In this paper we draw on the notion of reflective equilibrium and discuss the relevance and roles that empirical studies may plausibly have for justification in priority setting ethics. We develop a framework for analysing how different kinds of empirical results may have different kinds of implications for justification. (shrink)

Ethical questions have traditionally been approached through conceptual analysis. Inspired by the rapid advance of modern brain imaging techniques, however, some ethical questions appear in a new light. For example, hotly debated trolley dilemmas have recently been studied by psychologists and neuroscientists alike, arguing that their findings can support or debunk moral intuitions that underlie those dilemmas. Resulting from the wedding of philosophy and neuroscience, neuroethics has emerged as a novel interdisciplinary field that aims at drawing conclusive relationships between neuroscientific (...) observations and normative ethics. A major goal of neuroethics is to derive normative ethical conclusions from the investigation of neural and psychological mechanisms underlying ethical theories, as well as moral judgments and intuitions. The focus of this article is to shed light on the structure and functioning of neuroethical arguments of this sort, and to reveal particular methodological challenges that lie concealed therein. We discuss the methodological problem of how one can—or, as the case may be, cannot—validly infer normative conclusions from neuroscientific observations. Moreover, we raise the issue of how preexisting normative ethical convictions threaten to invalidate the interpretation of neuroscientific data, and thus arrive at question-begging conclusions. Nonetheless, this is not to deny that current neuroethics rightly presumes that moral considerations about actual human lives demand empirically substantiated answers. Therefore, in conclusion, we offer some preliminary reflections on how the discussed methodological challenges can be met. (shrink)

Studies suggest that people's moral intuitions are sensitive to morally irrelevant factors, such as personal force, spatial distance, ethnicity or nationality. Findings of this sort have been used to construct debunking arguments. The most prominent champion of this approach is Joshua Greene, who has attempted to undermine deontology by showing that deontological intuitions are triggered by morally irrelevant factors. This article offers a critical analysis of such empirically informed debunking arguments from moral irrelevance, and of Greene’s effort to undermine deontology. (...) One problem with arguments from moral irrelevance concerns the hierarchy between the targeted case-specific intuitions and the more general intuitions about which factors are morally (ir)relevant. If we assume that general intuitions always take precedence over case-specific intuitions, arguments from moral irrelevance become dialectically useless. By contrast, if we assume that both case-specific and general intuitions should be taken seriously, particularly sweeping debunking projects, such as Greene’s, are unlikely to go through. Another problem concerns the experimental aspect of arguments from moral irrelevance. Empirically informed arguments from moral irrelevance have been presented as examples of how empirical moral psychology can advance moral theory. But arguments from moral irrelevance can also be constructed from the armchair. And basing these arguments on empirical findings about laypeople’s intuitions is even counterproductive. (shrink)

Reflective equilibrium has been criticized for various reasons ever since the publication of Rawls’ A Theory of Justice. Recent empirical research into moral decision-making poses new challenges to RE because it questions the reliability of moral intuitions. This research might discredit moral intuitionism in general and RE in particular insofar as it ascribes epistemic value to moral intuitions. These findings suggest, for instance, that moral intuitions vary with cultural background, gender or framing. If it could be shown that all or (...) certain kinds of moral intuitions are unreliable, this would diminish the plausibility of the claim that they provide good reasons to believe in the truth of their content, especially given the growing evidence that professional philosophers are just as biased and susceptible to distorting factors as lay people. In this paper I critically discuss three recent defenses of RE against this unreliable intuitions objection. Two of these defenses argue that the UIO misses its target, because RE does not depend on intuitions, or because the relevant considered judgments in RE are not intuitions. The third defense grants that RE depends on intuitions and that some Rawlsian considered judgments are intuitions. But it argues that the notion of considered judgments can be revised, and that wide reflective equilibrium has the means to adopt the criticism because it can use information about unreliable intuitions and exclude those from further consideration. I argue that the first two defenses do not succeed. The third defense is the most promising one. However, I argue that this defense also fails. In this defense, RE is not a distinctive moral epistemic theory: different versions of RE would be conceivable, all of which are deeply problematic. I conclude with a discussion of the broader philosophical implications of the UIO, specifically whether or not accepting the UIO would warrant skepticism regarding moral knowledge. (shrink)

Including these methods can lead to an empirical animal ethics approach that is far more adapted to the needs of humans and nonhuman animals and more appropriate in different circumstances than a purely theoretical concept solely premised on rational arguments. However, the potential (...) tension between lay people’s moral judgements and ethical theory must be handled with care. The thorough analysis of qualitative data can lead to a deep insight into e.g. ethical problems with the application of laws and guidelines, practicality issues with ethical theories, personal ambivalence, and cognitive biases. The interaction between animal ethics theory and empirical findings can lead to both a more context-sensitive and applicable ethical theory and a less arbitrary folk moral system. Findings from the natural sciences can also contribute valuable information to animal ethics theory—the more we know about the properties and preferences of nonhuman animals the better we can respect them. Here, however, it is vital not to justify invasive procedures for the sake of “ethical progress”. It might be ethically required to forego some scientific findings about nonhuman animals if it is not clear how much a procedure would harm them. Only with robust empirical methods will light ultimately be shed on the nature of our moral relationship with animals. (shrink)
