  1. Is the non-identity problem relevant to public health and policy? An online survey.Keyur Doolabh, Lucius Caviola, Julian Savulescu, Michael J. Selgelid & Dominic Wilkinson - 2019 - BMC Medical Ethics 20 (1):1-17.
The non-identity problem arises when our actions in the present could change which people will exist in the future, for better or worse. Is it morally better to improve the lives of specific future people, as compared to changing which people exist for the better? Affecting the timing of fetuses being conceived is one case where present actions change the identity of future people. This is relevant to questions of public health policy, as exemplified in some responses to the Zika (...)

  • Is Disability a Neutral Condition?Jeffrey M. Brown - 2016 - Journal of Social Philosophy 47 (2):188-210.
The issue of whether biological and psychological properties associated with disability can be harmful, beneficial, or neutral brings up an important philosophical question about how we evaluate disability, and disability’s impact on well-being. The debate is usually characterized as between those who argue disability is intrinsically harmful, and disability rights advocates who argue that disability is just another way of being different, in part, because disability can also provide important benefits. I argue that this debate is a false one, as (...)

  • Prostitution, disability and prohibition.Frej Klem Thomsen - 2015 - Journal of Medical Ethics 41 (6):451-459.
Criminalisation of prostitution, and minority rights for disabled persons, are important contemporary political issues. The article examines their intersection by analysing the conditions and arguments for making a legal exception for disabled persons to a general prohibition against purchasing sexual services. It explores the badness of prostitution, focusing on and discussing the argument that prostitution harms prostitutes, considers forms of regulation and the arguments for and against with emphasis on a liberty-based objection to prohibition, and finally presents and analyses three (...)

  • A world of difference: The fundamental opposition between transhumanist “welfarism” and disability advocacy.Susan B. Levin - 2023 - Bioethics 37 (8):779-789.
From the standpoint of disability advocacy, further exploration of the concept of well-being stands to be availing. The notion that “welfarism” about disability, which Julian Savulescu and Guy Kahane debuted, qualifies as helpful is encouraged by their claim that welfarism shares important commitments with that advocacy. As becomes clear when they apply their welfarist frame to procreative decisions, endorsing welfarism would, in fact, sharply undermine it. Savulescu and Kahane's Principle of Procreative Beneficence—which reflects transhumanism, or advocacy of radical bioenhancement—morally requires (...)

  • Please wear a mask: a systematic case for mask wearing mandates.Roberto Fumagalli - 2024 - Journal of Medical Ethics 50 (7):501-510.
This paper combines considerations from ethics, medicine and public health policy to articulate and defend a systematic case for mask wearing mandates (MWM). The paper argues for two main claims of general interest in favour of MWM. First, MWM provide a more effective, just and fair way to tackle the ongoing COVID-19 pandemic than policy alternatives such as laissez-faire approaches, mask wearing recommendations and physical distancing measures. And second, the proffered objections against MWM may justify some exemptions for specific categories (...)

  • Questionable benefits and unavoidable personal beliefs: defending conscientious objection for abortion.Bruce Philip Blackshaw & Daniel Rodger - 2020 - Journal of Medical Ethics 3 (46):178-182.
Conscientious objection in healthcare has come under heavy criticism on two grounds recently, particularly regarding abortion provision. First, critics claim conscientious objection involves a refusal to provide a legal and beneficial procedure requested by a patient, denying them access to healthcare. Second, they argue the exercise of conscientious objection is based on unverifiable personal beliefs. These characteristics, it is claimed, disqualify conscientious objection in healthcare. Here, we defend conscientious objection in the context of abortion provision. We show that abortion has (...)

  • Engineering Life Expectancy and Non-identity Cases.Tatjana Višak - 2018 - Journal of Agricultural and Environmental Ethics 31 (2):281-293.
In his paper “Eating Animals the Nice Way” McMahan : 66–76, 2008) explores whether there are ways of routinely using non-human animals for human consumption that are morally acceptable. He dismisses a practice of benign animal husbandry, in which animals are killed prematurely and believes that a practice in which animals were engineered to drop down dead instantaneously at the same age would be equally wrong, even though it would not involve killing. Yet, McMahan considers his intuition that both practices (...)

  • Consumer Food Ethics: Considerations of Vulnerability, Suffering, and Harm.Yana Manyukhina - 2017 - Journal of Agricultural and Environmental Ethics 30 (4):595-614.
Over the past years, various accounts of ethical consumption have been produced which identify certain concepts as central to mediating the ethical relationship between the consumer and the consumed. Scholars across disciplinary fields have explored how individuals construe their ethical consumption responsibilities and commitments through the notions of identity, taking care and doing good, proximity and distance, suggesting the centrality of these themes to consumer engagement in ethical practices. This paper contributes to the body of research concerned with unravelling consumers’ (...)

  • Toward a Critical Theory of Harm: Ableism, Normativity, and Transability (On Body Integrity Identity Disorder).Joel Michael Reynolds - 2016 - APA Newsletter on Philosophy and Medicine 16 (1):37-45.
Body Integrity Identity Disorder (BIID) is a very rare condition describing those with an intense desire or need to move from a state of ability to relative impairment, typically through the amputation of one or more limbs. In this paper, I draw upon research in critical disability studies and philosophy of disability to critique arguments based upon the principle of nonmaleficence against such surgery. I demonstrate how the action-relative concept of harm in such arguments relies upon suspect notions of biological (...)

  • No Offense! On the Offense Principle and Some New Challenges.Thomas Søbirk Petersen - 2016 - Criminal Law and Philosophy 10 (2):355-365.
A central aim within criminal justice ethics is to give a plausible justification concerning which type of acts ought to be criminalized by the state. One of the principles of criminalization which has been presented and critically discussed in the philosophical literature is the Offense Principle. The primary aim of this paper is to argue that unless a rather special and implausible objective list theory of well-being is accepted, the Offense Principle should be subsumed in the Harm Principle.

  • Assessing Baselines for Identifying Harm: Tricky Cases and Childhood.Monique Jonas - 2016 - Res Publica 22 (4):387-404.
Baselines are commonly used to enable harm identification. The temporal, the counterfactual and the duty-based normative baselines are the most prominent. Each of these captures an aspect of common conceptions of what it is to harm and be harmed. However, each baseline also fails to deliver workable identifications of harm when presented with certain types of case. Problematic cases are found readily in childhood, a venue in which harm identification is often called for. Without a reliable means of identifying harm (...)

  • Upgrading Discussions of Cognitive Enhancement.Susan B. Levin - 2016 - Neuroethics 9 (1):53-67.
Advocates of cognitive enhancement maintain that technological advances would augment autonomy indirectly by expanding the range of options available to individuals, while, in a recent article in this journal, Schaefer, Kahane, and Savulescu propose that cognitive enhancement would improve it more directly. Here, autonomy, construed in broad procedural terms, is at the fore. In contrast, when lauding the goodness of enhancement expressly, supporters’ line of argument is utilitarian, of an ideal variety. An inherent conflict results, for, within their utilitarian frame, (...)

  • Sex Reassignment Surgery and Enhancement.Tomislav Bracanović - 2017 - Journal of Medicine and Philosophy 42 (1):86-102.
Sex reassignment surgery is a therapy for gender dysphoria standardly provided only upon a psychiatric authorization. Transgender scholars criticize this practice as unjustified medicalization and stigmatization of transsexual people. By demanding that sex reassignment surgery is not classified as therapy, they imply it should be classified as some kind of a biomedical enhancement. It is argued in this article that this reclassification is empirically and morally implausible because sex reassignment surgery is incompatible with two major views of enhancement. It is (...)
