Recently it has been proposed that humans possess an innate, domain-specific moral faculty, and that this faculty might be fruitfully understood by drawing a close analogy with nativist theories in linguistics. This Linguistic Analogy hypothesizes that humans share a universal moral grammar. In this paper I argue that this conception is deeply flawed. After profiling a recent and appealing account of universal moral grammar, I suggest that recent empirical findings reveal a significant flaw, which takes the form of a dilemma: (...) either there is something wrong with the moral grammar model because we do not actually possess the innate contents it says we have, or the moral grammar model is simply the wrong model of moral cognition. In light of this dilemma, I conclude we ought to be skeptical that the Linguistic Analogy can adequately serve as a general account of moral cognition. (shrink)

Of the questions concerning the many great minds of the European Enlightenment, the question of what constitutes right and proper government perhaps had the most enduring influence on the world stage. Both Thomas Jefferson and Immanuel Kant attempted to answer the question of what constitutes right government, in particular by basing the system upon the idea of human freedom as an inalienable right. This project is an attempt to compare the systems proposed by these two authors, as well as to (...) critique each on its ability to protect and foster individual freedom. It is my opinion that neither manages to do what it is constructed to do, as each fails to fully protect individual freedom, and each has as part of it a component which conflicts with individual freedom. In this paper, I defend an interpretation of Kant’s Singularity Thesis: the claim that the formulae of the Categorical Imperative are in fact representations of a single, underlying law. I proceed by answering two questions: How should we state the underlying law? And How can we best understand the relationship between the formulae and this law they supposedly represent? My account focuses on the concept of rational agency and how Kant develops it in the Groundwork. I will argue that the (...) formulae are three ways of expressing, thinking about, or applying the Categorical Imperative — understood as Kant’s statement of the supreme principle of morality — corresponding to three features of rational agency. El concepto de dignidad humana ha sido considerado o demasiado denso o demasiado delgado. Sin embargo, desde el punto de vista del no-positivismo, la normatividad jurídica de la dignidad humana puede ser justificada y reforzada por medio de su corrección moral. Desde una perspectiva individual, la comprensión de Mencio sobre la dignidad humana como un valor intrínseco y el imperativo categórico de Kant (el ser humano como un fin en sí mismo) podrían ser adecuadamente comprendidos con base en la diferencia (...) Rational choice theory analyzes how an agent can rationally act, given his or her preferences, but says little about where those preferences come from. Preferences are usually assumed to be fixed and exogenously given. Building on related work on reasons and rational choice, we describe a framework for conceptualizing preference formation and preference change. In our model, an agent's preferences are based on certain "motivationally salient" properties of the alternatives over which the preferences are held. Preferences may change as new (...) properties of the alternatives become salient or previously salient properties cease to be salient. Our approach captures endogenous preferences in various contexts and helps to illuminate the distinction between formal and substantive concepts of rationality, as well as the role of perception in rational choice. The concept of human dignity has been criticized as either too thick or too thin. However, according to the non-positivistic standpoint, the legal normativity of human dignity can be justified and thus strengthened by means of its moral correctness. From the individual perspective, Mencius’ understanding of human dignity as an intrinsic value and Kant’s formula of ‘man as an end in itself’ can be adequately understood based on the differentiation of, as well as the connection between, principium diiudicationis and principium (...) executionis, between will and choice, and between homo phaenomenon and homo noumenon (that is, ‘humanity in the personality’). From the social perspective, since the dual dimensions of the individual and the social person are both fictive constructions, even Radbruch, once as a supporter of social law, has not replaced the concept of ‘legal person’ and, in the post-War period, acknowledges individualistic human dignity as the criterion for applying the famous ‘disavowal formula’. On the one hand, human dignity shows at least a weak normative character, which requires, firstly, balancing between the exercise of state powers and the constitutional review under the guidance of the dual dimensions of man and, secondly, optimization of the principle of human dignity in individual cases. On the other hand, through the necessary connection between the concept of dignity and that of personality, human dignity can exhibit a strong normative character, which unavoidably requires a metaphysical justification. The paper develops a Kantian view of the highest good and the relation between virtue and happiness. Several Kantian theses are defended, among them the thesis that the highest good is realized only if every virtuous individual is happy, the view that virtue is neither necessary nor sufficient for happiness, and the proposition that virtue is both necessary and sufficient for the worthiness of being happy. The author argues that the highest good ought to be realized and that it ought (...) to be that everyone who is virtuous is happy. To prove these claims, the author will use techniques developed by modern deontic logicians. According to Kant, we do not have an immediate duty to promote our own happiness, the aim of morality being not personal satisfaction but rather virtue and the good will. The important question is not “How do I become happy?” but “How do I become good?”. The arguments in this paper support this view. (shrink)

There is little doubt that Salomon Maimon was both highly respected by, and highly influential upon, his contemporaries; indeed, Kant himself referred to Maimon as the best of his critics. The appraisal and reformulation of the Kantian project detailed in Maimon’s Essay on Transcendental Philosophy played a significant role in determining the criteria of success for post-Kantian philosophy, and was thus crucial to the early development of German Idealism. Key aspects of Maimon’s transcendental philosophy remain, however, relatively obscure. In particular, (...) it remains unclear to what degree Maimon’s skepticism is internal to the Kantian framework, and how this skepticism is related to Maimon’s so-called dogmatic rationalism. The central aim of this project is to present Maimon’s as a distinct form of post-Kantian skepticism: one which poses significant problems for Kant’s theoretical project and which motivates a reformulation of the critical framework. In Kant’s eyes, pre-Kantian forms of skepticism are insufficiently critical insofar as they involve a commitment to transcendental realism. By contrast, I argue that Maimon’s skepticism does not involve a commitment to transcendental realism and that it strikes at the heart of Kant’s critical project insofar as it constitutes what I term ‘critical’ as opposed to merely ‘empirical’ skepticism. I further argue that Maimon’s rationalism provides the materials for a response to this form of skepticism. This thesis contributes to contemporary debates in the history of philosophy concerning the nature of Maimon’s coalition system and its relation to German Idealism, but also provides an alternative perspective on contemporary problems in the philosophy of perception concerning, in particular, the possibility of non-conceptual intentional content. In this paper, I explore a tension between the Law in the novel The Island of Doctor Moreau, by H. G. Wells, and Kant's reciprocity thesis. The Law is a series of prohibitions that Moreau has his beasts recite. Moreau devotes his time to transforming animals through a painful surgery into beings that resemble humans, but the humanized beasts are constantly slipping back into animalistic habits, and so Moreau promulgates the Law to maintain decorum. Kant's reciprocity thesis states that free (...) will is the necessary and sufficient condition of moral practical laws. That is, in order for a moral practical law to be applicable, there must be free will, and, if free will is present, then there will be a moral practical law that sets a standard for the free will. However, in Wells's novel, the humanized beasts seem to lack free will. So, how can a law be applicable to them? By delving deeper into the mystery of Moreau's strange island, I will shed light on the otherwise cumbersome concepts of free will, natural impulses, and practical laws, as well as their interrelationships. The upshot will be a deeper understanding of personhood through an exploration of the instinctual nature of animals, moral law, and free will. (shrink)

This dissertation concerns the methodology Kant employs in the first two sections of the Groundwork of the Metaphysics of Morals (Groundwork I-II) with particular attention to how the execution of the method of analysis in these sections contributes to the establishment of moral metaphysics as a science. My thesis is that Kant had a detailed strategy for the Groundwork, that this strategy and Kant’s reasons for adopting it can be ascertained from the Critique of Pure Reason (first Critique) and his (...) lectures on logic, and that understanding this strategy gains us interpretive insight into Kant’s moral metaphysics. At the most general level of methodology, Kant says there are four steps for the establishment of any science: 1) make distinct the idea of the natural unity of its material 2) determine the special content of the science 3) articulate the systematic unity of the science 4) critique the science to determine its boundaries The first two of these steps are accomplished by the genetically scholastic method of analysis, paradigmatically the method whereby confused and obscure ideas are made clear and distinct, thereby logically perfecting them and transforming them into possible grounds of cognitive insight that are potentially complete and adequate to philosophical purposes. The analysis of Groundwork I is a paradigmatic analysis that makes distinct what is contained in common understanding, i.e. its Inhalt or intension, making distinct the higher partial concepts that together define the concept of morality. The analysis of Groundwork II is an employment more specifically of the method of logical division, which makes distinct what is contained under the concept, i.e. its Umfang, by which the extension or object of morality is determined. Part I introduces Kant’s conception of moral metaphysical science and why he took it to be in need of establishment, explains the general method for establishing science and the scholastic method of analysis by which its first two steps are to be accomplished, then provides an interpretation of Groundwork I as an execution of this method. Part II details Kant’s determination of the special content of moral science in Groundwork II in relation to the central problem for moral metaphysics – how synthetic a priori practical cognition is possible. Best known for his ethical works, Immanuel Kant was part of the liberal Enlightenment and addressed most of the principal political issues of his day. Several of his major works were written in the wake of the storming of the Bastille in Paris, while Europe was engaged in the French Revolutionary Wars. His rejection of revolution but endorsement of the principles for which the French revolutionaries were fighting, as well as his plea for a federation of European states that would (...) settle disputes peacefully, reflected his engagement with the controversies raised by the Revolution. But, although he could not countenance revolution, he declared that, once a revolutionary government has succeeded in establishing itself, citizens should obey the new government, rather than try to restore the ousted authorities. I argue that Kant has developed a broad systematic account of the architectonic functionality of pure reason that can be used and advanced in contemporary contexts. Reason, in the narrow sense, is responsible for the picture of a well-ordered universe of science consisting of architectonic ideas of science, sciences and parts of sciences. In the first section (I), I show what Kant means by the architectonic ideas by explaining and interrelating the concepts of (a) the faculty of reason, (b) ideas (...) (as principles), (c) method, and (d) sciences of reason. Thereafter (II), I think through his holistic understanding of science and scientific progress and suggest differentiating between four levels of use of architectonic ideas, drawing on the metaphor of a well-structured universe as imagined by Kant in his work on the Universal Natural History and Theory of the Heavens. I also claim that each possible idea of reason can be (apart from its primary function) additionally regarded as a fourth-level architectonic concept when explicitly conceived as an object of (e. g. philosophical) studies, i. e. from a mere methodological perspective. In the final section (III), I unveil the potential of Kant’s theory by pointing out how this architectonic methodological function of pure reason is tacitly used in Karl-Otto Apel’s contemporary philosophical research programme. In Kant’s moral theory, he describes two levels of highest good as sensible and supersensible. He mentions to these concepts in all his works, without shedding light on fundamental conflict and dispute inherited in the simultaneousness of these two. In accordance with the first level of this concept, have been known as a theological reading of the highest good concept, comparison, and accompaniment of two component of the highest good, that is happiness and virtue, only is achieved with the help (...) of God. In addition to the postulate of God, this subject needs two other reasonable ideas of immortality and freedom. Besides, in accordance with the second level of this concept known as the secular and political reading of the highest good, the comparison is achieved with the help of human activity in this world in form of civil society. This content conflict, contrary to the view of some scholars, refers to two complementary forms in Kant’s thought and it corresponds with the general principles of his critical thinking. While explains Kant’s twofold positions on the highest good, this paper tries to demonstrate how these two forms need to another and otherwise, the complementary component cannot be explained. One of the issues with which bioethics is concerned is defining the limits of the organism’s transformations by technology in order for humanity to avoid evil. Kant’s teleological power of judgment enables us to identify an organism and it allows nature to be transformed only insofar as it affirms a moral subject acting on the basis of autonomy as reason. I propose a new way of utilizing Kantian philosophy in bioethical knowledge. I ask: can we make judgments about nature via (...) the principle of purposiveness? In answering this question, I clarify the following points. The first is Kant’s research into the foundations and reasons for using the teleological power of judgment. The second is the role of digital technology and how it complicates the use of the teleological power of judgment within the framework of bioethical knowledge. Scholars have compared Joseph Butler and Immanuel Kant’s moral theories, claiming that they both center on the concept of autonomy. In this thesis, I argue that, despite this superficial similarity, they disagree about the core commitments of their conceptions of autonomy. Butlerian autonomy relies on inferring from the normative authority of conscience to the descriptive that human nature is adapted to virtue, and from this descriptive claim about human nature to moral obligation. Kant rejects these inferences, and therefore rejects the (...) key components of Butlerian autonomy. Moreover, I argue that Kant’s rejection of Butler’s conception of human nature renders Butler’s stoic conception of virtue unavailable to Kant. (shrink)

Kant and Butler have a sharp methodological conflict in justifying moral obligations. While Kant argues that moral obligations can only be grounded in a prior justifications rather than in anything empirical, Joseph Butler grounds moral obligations in the empirical knowledge of human beings. Despite the apparent radical difference, I argue that Kant agrees with Butler that moral obligations must be grounded in the understanding of human beings. They, however, fundamentally disagree about human nature, which generates their methodological conflict in studying (...) morality. For Kant, the essential attribute for human beings is autonomy, which presupposes independence from any particular experience. In contrast, Butler understands human nature as a system that includes different particular experience. Although there is no conclusive answer of the correct understanding of human nature, I suggest that Butler’s account of moral obligations is a plausible one that can be considered as a counterexample to Kant’s account. Reading Edward Bond’s The War Plays in light of Theodor Adorno and Sigmund Freud, the writers of this article intend to investigate the interconnection between the mechanisms of social control and the psychology of submission. To this end, socio-political institutions in The War Plays, represented by the army and the state, are seen drawing on Adorno’s concept of identity-thinking, by which the cognitive potentials of the characters are systematically suppressed. Also, uninhibited aggression of characters will be discussed in view of (...) the mechanisms of sublimation, and the addendum, by which the complexities of the response characters give to the situation of coercion is elucidated. In The War Plays, socio-political institutions promote violence to produce socially conditioned victims. These aggressive victims, we conclude, would cooperate with power for the preservation of the status quo, yet challenge the system momentarily through expressing their sufferings. (shrink)

The paper begins with a description of a grey seal performing conspecific infanticide. The paper then gives an account of “nobleness” and “brutishness.” Roughly, a behavioural-disposition is noble/brutish if it is one that would be a moral virtue/vice if the possessor of the behavioural-disposition were a moral agent. The paper then advances two pairs of axiological claims. The first pair of claims is that nobleness is good and that brutishness is bad. The second pair of claims is about an axiological (...) interaction between nobleness/brutishness and well-being. That any non-human animal lacks well-being is bad. Yet, it is worse that a noble non-human animal lacks well-being, and not so bad that a brutish non-human animal lacks well-being. Lastly, the paper discusses some potential moral implications of these axiological claims, for instance that factory farming is especially wrong because it causes noble non-human animals to lack well-being. The purpose of this work is to offer a critical examination of Immanuel Kant's ethic of suicide. Kant's suicidology marks an influential view regarding the moral stature of suicide, yet one that remains incomplete in important respects. Because Kant's moral views are rationalistic, they restrict moral consideration to rational entities. Many people who commit suicide are not rational at the time of its commission, for they suffer from severe mental illness. Because of this, Kant's suicidology devastatingly excludes certain human demographics (...) from moral consideration, current Canadian statistics indicating that such people mark one of the highest populations at risk of committing suicide in the first place. The present research reveals the nature of moral philosophy in the human universe based on retrospective analysis and synthesis of the positions of modern sciences related to the problem of scientific searching practices and offers the author’s concept. In the process of achieving the pursued goal, the raised problem is actualized through the prism of a view on the activities of the relevant scientific communities, in particular, AME, APNME, ESMP — associations of moral education and moral philosophy, which study various (...) aspects of moral development and highlight the results in the journals founded by them: Journal of Moral Education, Journal of Moral Philosophy, Philosophical News, Moral Capital. Based on the retrospective study of moral philosophy in the human universe, it is proven that for many centuries, philosophers-moralists have been trying to clarify the specifics of the world of human freedom, their confession of moral norms, and rules accepted in society. Based on the analysis of modern paradigms of moral philosophy and moral psychology, which are related to each other, it is established that the universe contributes to the identification of moral values and their acceptance in the internal plan of human actions. The scientific research results made it possible to outline the author’s concept of the studied phenomenon and determine its main components. It is established that the basis of the universe in its significance for man provides an interaction process that is directly reflected in the formation of moral consciousness, the basis of which is moral philosophy with a system of moral values. In turn, this affects the formation of man’s moral self-consciousness, which contains such constructs as moral intuition, moral judgments, and moral behavior. In conclusion, it is postulated that man as a part of the single whole world acts as a builder of their own moral being, creating their moral “I” and producing their universe. (shrink)

The aim of the work is to examine the relationship between the concepts of “immanence” and “politics” in the works of Hegel and Deleuze. Both Hegel and Deleuze are thinkers of immanence and they explicitly think this concept in relation to the problem of political practice. As I show, they attempt to “ground” politics in immanence. The purpose of this work is to prove that there exists an inherent paradox in the undertaking to “ground” politics in immanence. Both philosophers are (...) confronted with a paradox that emerges from this “grounding”. The paradox appears in the form of natural violence. Both authors fail to contain this violence through arguments. In order to show this, I examine the relationship between two further concepts: history and the state. I compare Hegel’s and Deleuze’s formulations of world-history and universal history, tracing the analogies and differences in how they think the relationship of the state to history. Based on the conclusions I then focus on the relationship of politics to immanence. The paradox of natural violence, I show, emerges from the relationship of the state at the “end of history”. Autonomous vehicles (AVs) are expected to improve road traffic safety and save human lives. It is also expected that some AVs will encounter so-called dilemmatic situations, like choosing between saving two passengers by sacrificing one pedestrian or choosing between saving three pedestrians by sacrificing one passenger. These expectations fuel the extensive debate over the ethics settings of AVs: the way AVs should be programmed to act in dilemmatic situations and who should decide about the nature of this programming in the (...) first place. In the article, the ethics settings problem is analyzed as a trilemma between AVs with personal ethics setting (PES), AVs with mandatory ethics setting (MES) and AVs with no ethics settings (NES). It is argued that both PES and MES, by being programmed to choose one human life over the other, are bound to cause serious moral damage resulting from the violation of several principles central to deontology and utilitarianism. NES is defended as the only plausible solution to this trilemma, that is, as the solution that sufficiently minimizes the number of traffic fatalities without causing any comparable moral damage. در سنت برهان‌آوری کلاسیک، برهان‌های اخلاقی برای اثبات خدا اقامه شده است. به موازات این برهان‌ها و هم‌ارز با آنها براهین اخلاقی برای انکار خدا اقامه شده است. این سؤال مطرح می‌شود که آیا وجود برهان‌های اخلاقی در ردّ خدا به معنای بی‌اعتباری براهین اخلاقی در اثبات خداست؟ و آیا این براهینِ ضد باعث نمی‌شود ایمان خداباوران نامعقول باشد؟ ادعای ما این است که طرحی در زمینه بازتعریف برهان یافته‌ایم که می‌تواند سبب برون‌رفت براهین اخلاقی خداباوری از چالش برهان‌های اخلاقی (...) ضد باشد. در این پژوهش هشت برهان اخلاقی الحادی را در تاریخ فلسفه استخراج کردیم و طرح اصلاح ماهیت برهان از سوی ماورودس را بر آنها پیاده کردیم و نشان دادیم که خداباور می‌تواند همچنان از براهین اخلاقی خداباورانه دفاع کند و در باور به وجود خدا معقول باشد. البته توجه داریم که طرح اصلاح ماهیت برهان هزینه‌ای معرفت‌شناختی در پی دارد و آن این که براهین ضد نیز می‌توانند در چشم‌اندازها و دیدگاه‌های مورد پذیرش خود معقول انگاشته شوند. I here press an often overlooked question: Why does the fairness of a sanction require an adequate opportunity to avoid it? By pressing this question, I believe I have come to better understand something that has long puzzled me, namely, what philosophers (and others) might have in mind when they talk about “true moral responsibility,” or the “condemnatory force” of moral blame, or perhaps even “basic desert.” In presenting this understanding of “condemnation” or of “basic desert,” I am presenting an (...) idea that I do not, myself, endorse—one to which I am, myself, opposed. I present and defend it, hoping that, if what I say accurately captures what people have in mind, it will also show how condemnation or desert, in this sense, can be left behind. (shrink)

This paper is about dialogic listening as a precondition for meaningful engagement in Socratic dialogues and for music. In order to arrive at a better understanding of what constitutes dialogic listening in the context of educational philosophical dialogues, I first shed light on the practice of philosophy teaching based on Nelson & Heckmann’s neo-Socratic paradigm and link this practice to Plato’s dialogues. I then argue that the activity of listening to an interlocutor during Socratic dialogues on the one hand, and (...) listening to music on the other, may in both cases be understood as a precondition for the process of engagement and, consequently, the co-creation of meaning as a central objective to the philosophical practice. I show this by discussing both Buber and Gadamer, combining their insights into three interrelated features of dialogic listening: 1) openness, 2) reciprocity, and 3) awareness, which apply to both philosophical dialogues and music. Ultimately, I attempt to make a case for the complementary application of music in the philosophical educational practice. (shrink)

The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. Debates regarding theory and practice in social work have often avoided detailed discussion regarding the nature of knowledge itself and the various ways this can be created. As a result, positivistic conceptions of knowledge are still assumed by many to be axiomatic, such that context-dependent and practitioner-oriented approaches to knowledge creation and use are assumed to lack epistemological rigor and credibility. By drawing on epistemology, this theoretical paper outlines the case for a renewed approach to knowledge definition, creation and use (...) within social work by reference to pragmatism. Pragmatism has the potential to act as an organizing theoretical framework, taking account of the role of both ontology and epistemology, acting as a functional methodology for the further enhancement of practice-based knowledge. In the search for the foundations of cognition philosophers often encounter a familiar problem - the problem of content. The problem of content is essentially the problem of how content, whether experiential or intentional, is possible. In practice providing a response to this problem involves providing an account of how an active self-consciousness is able to conceive/perceive, or in some way be consciousness ofx. The unique nature of this problem imposes significant constraints on the field of explanatory possibilities. Since the (...) x which is to be accounted for is essentially the possibility of absolutely any x there is no y which is not also an x. Hence, nothing remains outside of the explanandum which can be appealed to in order to account for it without, to some extent, presupposing that which needs to be explained. In many of the theories we will examine overcoming this problem involves appealing to a transcendental “structure of awareness” which more often than not is composed of “universal-like” transcendental “entities” of indeterminate nature and ontological status. A major appeal of transcendental entities is that they can at least appear to provide a way of supplying the power of objective “determinateness” necessary to account for the possibility of determination without themselves being determinates. The general strategy of appealing to such transcendental “entities” has, however, for some time been suspiciously regarded as it is unclear how such an appeal is able to avoid the aforementioned presupposition of content. But if the appeal to transcendental cognizing intermediates is to be ‘ dismissed we may be left to face up to the fact that content simply “happens”- that the process of determination, of “judgment”, is a mysterious talent that can neither be taught nor understood. Through a critical examination of both Western and Eastern philosophical approaches to the problem of content this dissertation identifies and describes, insofar as is possible, “that” through which content is rendered possible. In so doing it draws attention to previously neglected points of contact between major philosophical traditions and clarifies the central issues surrounding the problem. The dissertation supports the conclusion that, although there is a need to acknowledge a particular role for a transcendental “self- consciousness” in providing a coherent response to the problem of content, the attempt to articulate a mechanism through which this role is fulfilled most likely misguided. Although it appears to be possible both to know something about this “self-consciousness”, and even to know it more directly, it cannot be understood in the usual sense. (shrink)

This chapter explores some features of pragmatic pluralism as an ethical perspective on climate change. It is inspired in part by Andrew Light’s work on climate diplomacy as U.S. Assistant Secretary of Energy for International Affairs, and by Bryan Norton’s environmental pragmatism, while drawing more explicitly than Light or Norton from classical pragmatist sources such as John Dewey. The primary aim of the chapter is to characterize, differentiate, and advance a general pragmatist approach to climate ethics. The main line of (...) argument is that we are suffering culturally from a sort of “moral jetlag” due in part to “moral fundamentalist” habits, and that a critical focus on pragmatic pluralism—in moral theory generally and climate ethics particularly—would be salutary for our recovery if philosophers are to speak more effectively to “wicked problems” in a way that aids public deliberation and social learning. Moral fundamentalist habits, and the monistic one-way assumption that unintentionally—but not blamelessly—exercises and unduly reinforces them, are obstacles to fostering habits of moral and political inquiry better suited to dealing with predicaments rapidly transforming our warming planet. Does the fact that humans are vulnerable, needy and dependent beings play an important role in Kantian ethics? It is sometimes claimed that it cannot and does not. I argue that it can and does. I distinguish between broad (all persons are vulnerable) and narrow (only some persons are vulnerable) senses of vulnerability, and explain the role of vulnerability in both senses in Kantian ethics. The basis of this argument is to show that the core normative focus of Kantian ethics (...) is on the dignity that human beings have in virtue of their capacity for rational agency. This implies that the empirical conditions under which human beings can acquire, sustain, exercise, and develop their rational capacities are of core moral importance in Kantian ethics. This explains why human vulnerabilities, including the vulnerability of human bodies, are important in Kantian ethics, since rational capacities in human agents (and the bodies those rational capacities depend upon) are highly vulnerable in all persons (vulnerability in the broad sense) and especially vulnerable in some sub-groups of persons (vulnerability in the narrow sense). Authority figures permeate our daily lives, particularly, our political lives. What makes authority legitimate? The current debates about the legitimacy of authority are characterised by two opposing strategies. The first establish the legitimacy of authority on the basis of the content of the authority’s command. That is, if the content of the commands meet some independent normative standard then they are legitimate. However, there have been many recent criticisms of this strategy which focus on a particular shortcoming – namely, its (...) seeming inability to account for who can legitimately command whom. This is the basis of the second strategy, which attempts to characterize the normative relationship that underlies and makes possible authoritative commands. The central point of Part I is that these two strategies are, in fact, not opposed and both raise questions which a theory of legitimacy must answer. If this is the case, then we need to ask: how ought we to determine the legitimacy both of the content of commands as well as who can command whom? Part II will answer this question. Starting with the question of standing, I argue that we ought not to look for normative principles outside of the institutions in which authority is embedded. Rather, one ought to start by elaborating the ontology of institutions in which a sui generis form of normativity arises. A joint commitment account of social ontology provides the tools necessary to see how the direction obligations emerge concurrently with the formation of institutions. Similarly, the question of content can be answered by paying close attention to the social ontology of institutions. We need not look beyond the internal constitutive standards of the institution itself. The constitutive standards provide an internal criterion by which the legitimacy of commands can be established. This thesis reconstructs John Rawl's Original Position in order to show that within a liberal democratic culture, the institution of punishment ought to conform to the Moral Education Theory of Punishment, put forth by Jean Hampton. According to Hampton, punishment should facilitate a medium where the state educates the criminal on the moral implications of her wrongdoing. I argue that citizens would select the Moral Education Theory of Punishment in the Original Position, since it offers the best opportunity to redress (...) two calamities related to the criminal's wrongdoing---namely, that it threatens the moral status of the victim, and that it results from the wrongdoer's deficient moral sensibility. Upon consideration, the representatives in the Original Position recognize that redressing either of the two calamities necessitates redressing the other; thus, both objectives reinforce one another. Consequently, the representatives would unanimously select the principles of punishment manifest in the Moral Education Theory. (shrink)

شیخ محمدحسین غروی اصفهانی بر وجود خداوند استدلالی را اقامه کرده است که در در زمرۀ براهین وجودی و صدیقین به شمار می‌رود. این برهان، در میان اندیشمندان معاصر، طرفداران و منتقدان جدی داشته و در مجموع پنج تقریر برای آن بیان گردیده است. در مقالۀ پیش رو، تقریرهای پنجگانه‌ای که برای برهان ایشان بیان گردیده است، در سه محور کلی مورد بررسی واقع شده‌ است: محور اول، مفهوم واجب‌الوجود از این جهت که مفهومی ذهنی است؛ محور دوم، مفهوم واجب‌الوجود (...) از این جهت که از امری ورای خود حکایت می‌نماید؛ و در نهایت، حقیقت واجب‌الوجود یا موجود بذاته در خارج. بعد از بیان هر تقریر، همخوانی آن با بیان محقق اصفهانی مورد بررسی قرار گرفته و در نهایت بین تقریرهای مختلف از جهت همخوانی با متن کلام ایشان داوری انجام شده است. نتیجۀ نهایی که در این مقاله گرفته می‌شود این است که تقریر برهان بر اساس محور دوم تنها تقریری است که با ابیات محقق اصفهانی همخوانی دارد. Are values objective or subjective? To clarify this question we start with an overview of the main concepts and debates in the philosophy of values. We then discuss the arguments for and against value realism, the thesis that there are objective evaluative facts. By contrast with value anti-realism, which is generally associated with sentimentalism, according to which evaluative judgements are grounded in sentiments, value realism is commonly coupled with rationalism. Against this common view, we argue that value realism can be (...) combined with sentimentalism, and we suggest that a plausible account, which we call ‘sentimental realism’, and according to which evaluative judgements are closely related to emotions, can be developped. The film A Serious Man cinematically deconstructs the life of a mid-twentieth century, mid-western American physics professor named Larry Gopnik. As it happens, Larry is up for tenure with a wife who is about to leave him, an unemployed brother who sleeps on his couch, and two self-obsessed teenage children. The film presents a Job-like theodicy in which the mysteries of quantum physics are haunted both by questions of good and evil as well as the spectre of an un-named God, (...) reverently referred to as Hashem. The following paper examines the broader set of philosophical, theological and ethical concerns which arise from the film’s themes, using it to illustrate those concerns. Just as Newtonian physics underwrote Kant’s evocation of the image of starry skies above and moral law within, quantum physics underwrites a new set of ethical anxieties, which the film narrates as a key facet of contemporary western culture’s postmodern re-enchantment. Although some, such as Slavoj Zizek, see this as a positively charged opportunity to rethink metaphysics and ethics, the film leaves the audience with more sinister conclusions. (shrink)

The aim of this thesis will be to give an elucidation of Nietzsche’s ideal of the post-moral autonomous individual: to give a picture of what Nietzsche takes such an individual to look like, and to show how this picture relates to some of Nietzsche’s most fundamental philosophical concerns. Overall, my argument will be that autonomy, or rather the degree of autonomy that a person possesses, is a function of the power of that person in relation to the other people and (...) forces, and of their ability to extend their will over long periods of time. Moreover, the achievement of the highest degrees of autonomy, and by extension the achievement of the greatest levels of power, requires imposing an ethic upon one’s actions and one’s self. There are several features that this ethic must have if it is adequately to perform its function: it must be self-chosen rather than simply picked up from one’s surroundings, it must act to give unity to the most diverse collection of collection of drives and affects possible for the person who holds it, and it must be well tailored to fit their specific natural constitution. In order to establish this I will focus on four main issues: the significance of the sovereign individual of GM II: 2, the role of ethics/values in Nietzsche’s ideal of autonomy, the relation between Nietzsche’s deflationary account of consciousness and his views of freedom, and the notion of unity at play in Nietzsche’s writings. I will also offer some thoughts on the coherence of Nietzsche’s ideal of autonomy with his thoughts on life-affirmation. (shrink)

This 183-page introductory part of my dissertation is an overview of some key debates in philosophical moral psychology and its methodology.

Kant claimed that human beings have no duties to animals because they are not autonomous ends in themselves. I argue that Kant was wrong to exclude animals from the realm of moral consideration. Animals, although they do not set their own ends and thus cannot be regarded as ends in themselves, do have ends that are given to them by nature. As beings with ends, they stand between mere things that have no ends, and rational beings that are ends in (...) themselves. I propose a broader version of Kant's kingdom of ends, in which rational beings respect the ends of all other beings that have them, including animals. The moral status of animals would still be dependent on the existence of rational beings, but our duty to take their ends into account would be a direct duty to them, rather than being a covert duty to human beings. This article aims at showing the applicability of the Confucian Way in non-Confucian contexts, through referring to the inner connectedness between theory and practice in Confucianism. Its first part addresses the Confucian ideas of knowledge, learning, dialogue and self-realization. Its second part suggests an application of the ideas in a project with women who are looking for a way to “check out” from prostitution. The article suggests that treating these women as partners to the Confucian humanistic Way brings to a (...) new state of mind, which decriminalizes prostitution, and leads both teacher and students to a meaningful practice. Some of the opponents of desire-based views of normativity seek to undermine them by arguing that even the existence of instrumental normativity (reasons to pursue the means to your ends) entails the existence of a desire-independent rational norm, the instrumental norm. Once we grant the existence of one such norm, there seems to be no principled reason for not allowing others. I clarify this alleged norm, identifying two criteria that any satisfactory candidate must meet: reasonable expectation and possible violation. Some (...) interpretations meet the first criterion and others meet the second, but there are no interpretations that meet both. After surveying the interpretations of Sidgwick, Hampton, and Korsgaard, I suggest that there is no instrumental norm of reason. The final section offers an alternative, desire-based account of instrumental normativity, on which individual normative requirements to pursue means derives from each individual desire for an end. Cooperation threatens to become rationally problematic insofar as the following conditions hold: reliance has a worst outcome—we rely and the other proves unreliable; the interaction is one-off; and we are ignorant of the other’s particular motivations but recognize a general motivation to be unreliable. The problem is that the satisfaction of these conditions is commonplace. Thus cooperation should be much less common than it in fact is. So what explains it? This chapter considers and rejects various game-theoretical solutions before canvassing (...) a ‘trust-based’ solution. According to this solution the problem is dissolved once one recognizes how trust itself can give reasons for cooperating. (shrink)

Desires matter. How are we to understand the intentionality of desire? According to the two classical views, desire is either a positive evaluation or a disposition to act: to desire a state is to positively evaluate it or to be disposed to act to realize it. This Ph.D. Dissertation examines these conceptions of desire and proposes a deontic alternative inspired by Meinong. On this view, desiring is representing a state of affairs as what ought to be or, if one prefers, (...) as what should be. Desire involves a deontic manner of representing: a norm of the ought-to-be type features in desire’s intentional mode, as opposed to content. The dissertation is structured in three parts. In order to defend this conception, I formulate three main desiderata for a promising theory of the intentionality of desire in the introduction (§0). The first concerns desire’s direction of fit, i.e. the intuition that the world should conform to our desires. The second concerns the death of desire principle, i.e. the intuition that one cannot desire what one represents as actual. The last pertains to desire’s role in psychological explanations, i.e. the intuition that desires can explain some mental states and be explained by other mental states. The first part examines the main conceptions of desire in light of these desiderata. I argue that the classical pictures of desire do not adequately meet our desiderata. The first chapter is devoted to the evaluative conception (§1), while the second examines the motivational approach (§2). Following these criticisms, I then present the deontic view of desire (§3). In the second part, I defend this conception with the help of three arguments. The main idea is that appealing to norms of the ought-to-be type can satisfy our chief desiderata: the world should conform to norms (world-to-mind direction of fit, §4), norms are grounded on values and in turn ground obligations (explanation, §5), and norms are about non-actual states of affairs (death of desire principle, §6). In the last part, I develop the deontic view to draw a cartography of the various types of desire. Some desires are correct, while others are inappropriate. This distinction is explained by the deontic conception, as it matches that between states of affairs that ought to obtain and states that should not obtain (§7). Two study cases are examined: caprice and the impermissibility of desire aggregation. Intuitively, hopes, wishes, or urges are types of desire. The next chapter presents a typology inspired by the deontic view and the type of norms there are (§8). The last chapter discusses the main objections to the deontic approach (§9). In conclusion, I show the relevance of the deontic view for several debates in philosophy of mind and ethics. Desires are crucial because they are the ‘eye’ of what should be. (shrink)

This treatise presents a transcendental argument for corporate social responsibility. The argument is that corporate social responsibility, or CSR, is best understood as a collective moral practice that is a precondition for sustainable business. There are a number of theories and definitions of CSR in the contemporary business literature. These theories include considerations of economic, legal, social, and environmental notions of what a corporation ought to take responsibility for based on either motives or concerns of accountability for corporate acts. This (...) work focuses on economic theories. I analyze the distinction between the technical terms "responsibility" and "accountability" found in these theories. This enables me to explicate the meaning of corporate responsibility as it relates to the conditions of sustainable business activity. These conditions necessarily include moral content. In other words, this is an applied ethics project. First, I inquire into the intellectual history of the broader sense of corporate responsibility and review various contemporary notions of corporate social responsibility. My concern is whether these notions presuppose broader forms of moral responsibility to others as an obligation, moral responsibility for acts, or to be held morally responsible based on moral tendencies, particular motives, or resulting outcomes. This concern forms the basis of my consideration of the notions of individual and collective responsibility. The following work includes an analysis of the notion of human choice as a collective endeavor of institutional relationships and practice in the economic market system. I argue that corporate motives for moral interrelationships are necessarily implicit in biosocioeconomic multinational market enterprise. I conclude that an analysis of corporate community involvement may be found in a case study of Starbucks Coffee Company's efforts to practice CSR in particular coffee bean farming communities in developing countries. کانت به طور کلی براهین نظری دال بر وجود باری را در سه دستۀ برهان وجودی، جهان‌شناختی و نظم جای می‌دهد. در نگاه او، چون وجود یک محمول واقعی و تعین‌بخش نیست، نمی‌تواند در تعریف شیء حاضر باشد و بنابراین برهان وجودی عقیم است. این مقاله، همگام با کانت و بنت، می‌کوشد تا نشان دهد که وجود نه مایۀ کمال و نه محمولی تعین‌بخش است. نیز بر خلاف نظر بنت، که دلایل کانت را ناکافی می‌داند، ادعا می‌شود که کانت مغالطۀ (...) بنیادینی را که در برهان وجودی نهفته است پیدا و هویدا کرده است. به زعم کانت، خطای برهان جهان‌شناختی وابستگی آن به برهان سست‌بنیان وجودی است. بنت به درستی، ابهام و سستی این وابستگی را مورد توجه قرار می‌دهد. با این حال، کانت در فرصتی دیگر، با نقدی قوی، استدلال جهان‌شناختی را از اعتبار ساقط می‌کند. در مرحلۀ آخر، کانت با همۀ دلبستگی‌ای که به برهان نظم دارد، آن را مبتنی بر برهان معیوب جهان‌شناختی توصیف می‌کند. نقد بنت در این مرحله، از ارتباطی ذاتی که میان برهان جهان‌شناختی و نظم وجود دارد غفلت می‌ورزد.
