Managers of multinational companies often favour an aggressive tax avoidance strategy that pushes the legal limits onto the advantage of shareholders and the disadvantage of the spirit of democratically legitimized tax laws. The public and media debate whether such aggressive behaviour is immoral. Aggressive tax avoidance is a subset of the aggressive legal interpretations potentially observable in all fields which places little weight on the will of a democratically legitimized legislation. A thorough ethical analysis based on the deontological approach of (...) Kant demonstrates that aggressive tax avoidance as a special case of operating on the edge of legal boundaries is potentially immoral. Applying the Kantian “contradiction of conception or will” test shows that this maxim might not be conceived or willed as a general law of nature. If all natural or legal persons aggressively interpret laws on all subjects and in every imaginable situation, then central principles of the system of law we all rely upon would be severely compromised. Therefore, aggressive tax avoidance by managers of multinational companies may violate the managers’ moral duty to obey not only the letter but also the intention or spirit of the law. The validity of the argumentation depends critically on the formulation and interpretation of the respective maxims and on assumptions about the legal system. Preserving central elements of Kantian philosophy, the article demonstrates the complexity of a philosophical argumentation which tries to justify the moral intuitions that underpin the common negative evaluation of aggressive legal strategies in business. The aim of this article is to set out a theory for treatment of criminals that rejects retributive justification for punishment; does not fall afoul of a plausible prohibition on using people merely as means; and actually works in the real world. The theory can be motivated by free will skepticism. But it can also be supported without reference to the free will issue, since retributivism faces ethical challenges in its own right. In past versions of the account I’ve emphasized (...) the quarantine analogy for incapacitation together with the value of rehabilitation and reintegration. Immanuel Kant e Adam Smith foram dois filósofos historicamente próximos, afinal, foram dois pensadores modernos de reconhecida importância. Além da proximidade temporal, Adam Smith foi amigo pessoal e interlocutor daquele que foi o filósofo que, possivelmente, mais impressionava Kant, a saber, David Hume. Não é então de se estranhar que existam pontos de contato entre as obras de Kant e Smith, a menos que nos esqueçamos que, além de ser um pioneiro da ciência econômica, Smith foi também um importante filósofo (...) moral. Essa mera possibilidade de uma relação é reforçada por registros da admiração de Kant por Smith em escritos não publicados do primeiro. Dado o apreço de Kant pela investigação de Smith sobre o conhecimento moral do homem, este trabalho explora um paralelo entre o modo como Smith compara a virtude da justiça à virtude da beneficência na obra A Teoria dos Sentimentos Morais e o modo como Kant distingue os deveres jurídicos dos deveres éticos ou de virtude em sua Metafísica dos Costumes. A hipótese que temos em vista é que Smith poderia ter apresentado a Kant o conhecimento moral comum que haveria de ser formulado em princípios metafísicos por Kant. Na verdade, mais do que sabermos se foi de Smith que Kant retirou distinções e análises conceituais tão caras a sua própria filosofia moral, importa exatamente notar como o pensamento dos dois filósofos poderia bem guardar a referida relação um para o outro, de tal forma que um possa ser usado para iluminar o outro. This thesis examines the relation between self-deception and self-consciousness. It has been argued that, if we follow the literalist and take self-deception at face value – as a deception that is intended by, and imposed on, one and the same self-conscious subject – then self-deception is impossible. It will incur the Dynamic Problem that, being aware of my intention to self-deceive, I shall see through my projected self-deceit from the outset, thereby precluding its possibility. And it will incur the following (...) Static Problem. Qua self-deceiver, I shall believe not-P, but – qua self-deceived – I shall believe P. We shall then have to explain how I can sustain contradictory beliefs in full self-awareness. I argue that this rejection of literalism about self-deception rests on error. First, it misunderstands what literalism holds. Properly understood, literalism does not require the simultaneous commitment to contradictory beliefs. Second, it misunderstands the relation between self-deception and self-consciousness – and that is my primary focus. The phenomenology of self-deception reveals that the self-deceiver experiences the following tension. She is somehow aware of her self-deception as such. Yet also, she misrepresents that self-deception to herself as being a sincere commitment to the truth – so, in that sense, she is not aware of her self-deceit as such. To capture this tension, we require a theory of self-consciousness – independently defensible in its own right – that will meet this twofold requirement, of permitting the self-deceiver not to see what is right before her gaze. The rejection of literalism presupposes that no theory of self-consciousness can meet this twofold requirement.I argue that this twofold requirement can be met. The first part of this thesis offers a detailed defence of a theory of self-consciousness. The second part shows how this theory of self-consciousness can faithfully capture the tension of self-deception, while eschewing the Dynamic and Static Problems. In this paper, I defend an interpretation of Kant’s Singularity Thesis: the claim that the formulae of the Categorical Imperative are in fact representations of a single, underlying law. I proceed by answering two questions: How should we state the underlying law? And How can we best understand the relationship between the formulae and this law they supposedly represent? My account focuses on the concept of rational agency and how Kant develops it in the Groundwork. I will argue that the (...) formulae are three ways of expressing, thinking about, or applying the Categorical Imperative — understood as Kant’s statement of the supreme principle of morality — corresponding to three features of rational agency. In the 1960s Lewis White Beck criticized Kant’s highest good as a moral concept. In 1963 John Silber responded. Thus, the “Beck-Silber controversy.” This paper explores such controversy in the Spanish literature. It begins identifying four criticisms: the problems of heteronomy, derivation, impossibility, and irrelevance. It then identifies a new problem rescued from the Spanish literature: dualism. After categorizing, following Matthew Caswell, the Spanish defenses into revisionists, secularizers, and maximalists, this paper assesses these defenses. The paper also translates sections of (...) such literature into English and leaves us closer to a complete defense of the highest good by salvaging what it can of the Spanish literature’s unique points. This volume - the joint effort of the research groups on practical philosophy and the history of political thought of the Institute of Philosophy of the Research Centre for the Humanities of the Hungarian Academy of Sciences - brings together scholarly essays that attempt to face the challenges of the contemporary situation. The authors come from rather divergent disciplinary backgrounds, including philosophy, law, history, literature and the social sciences, from different cultural and political contexts, including Central, Eastern and Western Europe, (...) and belong to different generations. Instrumentalism is the view that all requirements of practical reason can be derived from the instrumental principle, that is, from the claim that one ought to take the suitable means to one's ends. Rationalists, by contrast, hold that there are requirements of practical reason that concern the normative acceptability of ends. To the extent that rationalists put forward these requirements in addition to the instrumental principle, rationalism might seem to go beyond instrumentalism in its normative commitments. This is why it (...) is sometimes thought that rationalism is stronger than instrumentalism in a way that entails that instrumentalism is the default view, while rationalists carry the burden of proof. In this paper, I explore and discuss different ways of spelling out this idea. I argue that rationalism is not stronger than instrumentalism in a way that has implications for matters of justification and differences in prima facie defensibility of the two sorts of views. In the quest to build truly sustainable corporations and supply chains, we propose the moral responsibility theory of corporate sustainability and the moral responsibility theory of sustainable supply chain. Built from morality literature in philosophy, the view of corporations as moral agents in law, and analyses of corporate hypocrisy and its role in an organization’s and its members’ behaviors, our theories show how a truly sustainable corporation and its external supply chain could emerge. At the core, we believe that without (...) a sense of moral responsibility businesses throughout the supply chain will not be truly sustainable. In today’s highly globalized and fragmented business environments, corporations do businesses with external supply chain partners, and without the truly sustainable supply chain partners, they may not be able to achieve sustainability goals. Moreover, for such a supply chain to be truly sustainable, each member of the supply chain must also be truly sustainable. For each member of the supply chain to be truly sustainable, the individuals who work in a corporation must be truly sustainable as well. That is, a truly sustainable supply chain cannot be established without its member corporations’ and employees’ commitment to and successes in sustainability. This paper shows how business moral responsibility and corporate sustainability are closely intertwined. How these theories could be applied in the corporate and supply chain settings are discussed, and future research opportunities are presented. (shrink)

In this essay, I argue that the Commodification Objection, locates a phenomenon of real moral significance. In defending the Commodification Objection, I review three common criticisms of it, which claim firstly, that commodification doesn’t always lead to instrumentalization; secondly, that commodification isn’t the only route to such an outcome; and finally, that the Commodification Objection applies only to persons, and human organs are not persons. In response, I conclude that moral significance does not require that an undesirable outcome be a (...) necessary consequence of the phenomenon under examination; the relative likelihood of an undesirable mode of regard arising provides a morally-relevant distinguishing marker for assessing the comparative moral status of social institutions and arrangements; and sales in blood products are sufficiently distinct from sales of everyday artefacts and sufficiently close to personhood to provide genuine grounds for concern. Accordingly, criticisms of the Commodification Objection do not provide grounds for rejecting the claim that human organ sales in general and compensation for blood plasma donation in particular can have morally pernicious ‘commodificatory effects’ upon our attitudes, for what human organ sales provide is a distinctive ethical hazard. This paper scrutinizes the tension between individuals’ rights and paternalism. I will argue that no normative account that includes rights of individuals can justify hard paternalism since the infringement of a right can only be justified with the right or interest of another person, which is never the case in hard paternalism. Justifications of hard paternalistic actions generally include a deviation from the very idea of having rights. The paper first introduces Tom Beauchamp as the most famous contemporary hard paternalist (...) by outlining his moral theory (principlism) and showing why it, as it stands, has to allow for hard paternalism. Secondly, the paper focuses on the notion of rights within principlism. I will employ traditional theories of rights to make sense of rights in principlism. Unfortunately, this attempt fails. In the third part, then, I claim that rights can only be limited with reference to the rights or interests of others. This structure is the very point of rights, it is their bite. I will argue for this claim and show its implications. The most important implication is that not only principlism, but every normative theory that includes rights of individuals, has to abolish hard paternalism. (shrink)

Both Kant and Levinas state that traditional ontology is a type of philosophy that illegitimately forces the structure of human reason onto other beings, thus making the subject the center and origin of all meaning. Kant’s critique of the ontology of his scholastic predecessors is well known. For Levinas, however, it does not suffice. He rejects what we could call an ‘existential ontology’: a self-centered way of living as a whole, of which all philosophical ontology is but a branch. Alternatively, (...) he presents an ethical way of living centered on ‘the Other’. Kant also, however, eventually turns to ethics to uncover a more fundamental domain of meaning. Hence, both thinkers ultimately agree about the primacy of ethics over theory. Despite this concurrence, Levinas nevertheless criticizes all aspects of Kant’s turn towards ethics: his reason for making this turn, the kind of critique that he applies to this domain, and the outcome thereof. ABSTRACT:We argue that Confucianism makes a fundamental contribution to understanding why civility is necessary for a morally decent workplace. We begin by reviewing some limits that traditional moral theories face in analyzing issues of civility. We then seek to establish a Confucian alternative. We develop the Confucian idea that even in business, humans may be sacred when they observe rituals culturally determined to express particular ceremonial significance. We conclude that managers and workers should understand that there is a broad range (...) of morally important rituals in organizational life and that managers should preserve and develop the intelligibility and integrity of many of these rituals. Governments are subject to the requirements of justice, yet often seem to go above and beyond what justice requires in order to act in ways many people think are good. These kinds of acts – examples of which include putting on celebrations, providing grants to poets, and preserving historic architecture – appear to be acts of government supererogation. In this paper, I argue that a common view about the relationship between government, coercion, and justice implies that most such acts are (...) not supererogatory, but wrong. This article analyses supplier-buyer relationships where the suppliers adapt to the buyers' needs and expectations to gain mutual advantages. In some cases, such closely knit relationships lead to violations of the autonomy of one or both partners. A concept of corporate autonomy (CA) is developed to analyze this problem. Three different facets can be distinguished: rule autonomy, executive autonomy, and control autonomy. A case study of Mattel's problems with lead-contaminated toys produced in China shows that the CA of buyer and (...) supplier can be restricted as a result of a dysfunctional partnership involving a moral dilemma. This paper argues that Adorno's metaphysics can be rescued from the constellation of his messianic materialism. The recovery of metaphysics in this context also means that it is rescued as the basis of possible critique. Rescue here entails that the ideas of truth, freedom, justice and democracy should be seen as transcending whatever is empirically given, while remaining immanently operative within society. These ideas can still be drawn on for a critique of the present, thus renewing the original project of (...) critical theory. (shrink)

In recent years, scholars of Confucian ethics have debated on important issues such as whether Confucian ethics embraces, or should embrace, universal values and impartiality. Some have argued that Confucian ethics integrates both care and justice, and that Confucian ethics is both particularistic and universalistic. In this essay, I will defend a view of the relation between care and justice and the relation between care ethics and justice ethics on the basis of the notion of 'configuration of values,' and show (...) why care ethics and justice ethics cannot be integrated. The paper develops a Kantian view of the highest good and the relation between virtue and happiness. Several Kantian theses are defended, among them the thesis that the highest good is realized only if every virtuous individual is happy, the view that virtue is neither necessary nor sufficient for happiness, and the proposition that virtue is both necessary and sufficient for the worthiness of being happy. The author argues that the highest good ought to be realized and that it ought (...) to be that everyone who is virtuous is happy. To prove these claims, the author will use techniques developed by modern deontic logicians. According to Kant, we do not have an immediate duty to promote our own happiness, the aim of morality being not personal satisfaction but rather virtue and the good will. The important question is not “How do I become happy?” but “How do I become good?”. The arguments in this paper support this view. (shrink)

Ethics and ethical behaviour are the fundamental pillars of a civilised society. The focus on ethical behaviour is indispensable in certain fields such as medicine, finance, or law. In fact, ethics gets precedence with anything that would include, affect, transform, or influence upon individuals, communities or any living creatures. Many institutions within Europe have set up their own committees to focus on or approve activities that have ethical impact. In contrast, lesser-developed countries are trying to set up these committees to (...) govern their academia and research. As the first European consortium established to assist academic integrity, European Network for Academic Integrity, we felt the importance of guiding those institutions and communities that are trying to conduct research with ethical principles. We have established an ethical advisory working group within ENAI with the aim to promote ethics within curriculum, research and institutional policies. We are constantly researching available data on this subject and committed to help the academia to convey and conduct ethical behaviour. Upon preliminary review and discussion, the group found a disparity in understanding, practice and teaching approaches to ethical applications of research projects among peers. Therefore, this short paper preliminarily aims to critically review the available information on ethics, the history behind establishing ethical principles and its international guidelines to govern research.The paper is based on the workshop conducted in the 5th International conference Plagiarism across Europe and Beyond, in Mykolas Romeris University, Lithuania in 2019. During the workshop, we have detailed a) basic needs of an ethical committee within an institution; b) a typical ethical approval process ; and c) the ways to obtain informed consent with some examples. These are summarised in this paper with some example comparisons of ethical approval processes from different universities. We believe this paper will provide guidelines on preparing and training both researchers and research students in appropriately upholding ethical practices through ethical approval processes. ABSTRACT In order to construct a satisfactory theory of cheng-yi 誠意, Zhu Xi 朱熹 develops an account of how self-deception is possible—a profound problem that has puzzled many philosophers. In Zhu’s opinion, zhi 知 can be divided into two categories: a priori knowing and empirical knowing. The further division of empirical knowing defines three sorts of self-deception: the self-deception caused by one’s ignorance, the self-deception caused by one’s superficial knowing, and the self-deception that may occur when one acquires genuine knowledge. In this paper, I will construct a theoretical model of self-deception that follows Zhu’s criterial definition of self-deception in Daxue Zhangju 大學章句, thereby accounting for the possibility of these three sorts of self-deception. Better understanding of Zhu’s conception of self-deception could, moreover, open fruitful avenues for further work on his metaphysics and moral psychology. (shrink)

Its ability to dismantle the prevailing positivist understanding of the interaction between legal orders and to stand out from the overwhelming and often repetitive literature on the philosophy of EU law should be praised. What is especially noteworthy is the idea of “corrective justice.” This notion explains very (...) well the adoption of financial assistance measures as expression of a new form of solidarity, based on the notion of fair redress for a committed wrong, namely the structural deficiencies detectable in the design of the eurozone. It has been widely observed that virtue ethics, regarded as an ethics of the ancient, in contrast to deontology and consequentialism, seen as an ethics of the modern (Larmore 1996: 19–23), is experiencing an impressive revival and is becoming a strong rival to utilitarianism and deontology in the English-speaking world in the last a few decades. Despite this, it has been perceived as having an obvious weakness in comparison with its two major rivals. While both utilitarianism and deontology can at (...) the same time serve as an ethical theory, providing guidance for individual persons and a political philosophy, offering ways to structure social institutions, virtue ethics, as it is concerned with character traits of individual persons, seems to be ill-equipped to be politically useful. In recent years, some attempts have been made to develop the so-called virtue politics, but most of them, including my own (see Huang 2014: Chapter 5), are limited to arguing for the perfectionist view that the state has the obligation to do things to help its members develop their virtues, and so the focus is still on the character traits of individual persons. However important those attempts are, such a notion of virtue politics is clearly too narrow, unless one thinks that the only job the state is supposed to do is to cultivate its people’s virtues. Yet obviously the government has many other jobs to do such as making laws and social policies, many if not most of which are not for the purpose of making people virtuous. The question is then in what sense such laws and social policies are moral in general and just in particular. Utilitarianism and deontology have their ready answers in the light of utility or moral principles respectively. Can virtue ethics provide its own answer? This paper attempts to argue for an affirmative answer to this question from the Confucian point of view, as represented by Mencius. It does so with a focus on the virtue of justice, as it is a central concept in both virtue ethics and political philosophy. (shrink)

This book offers a unique and insightful analysis of Western and Middle Eastern concepts of dignity and illustrates them with examples of everyday life. Dignity in the 21st Century - Middle East and West is unique and insightful for a range of reasons. First, the book is co-authored by scholars from two different cultures (Middle East and West). As a result, the interpretations of dignity covered are broader than those in most Western publications. Second, the ambition of the book is (...) to use examples from everyday life and fiction to debate a range of dignity interpretations supplemented by philosophical and theological theories. Thus, the book is designed to be accessible to a general readership, which is further facilitated because it is published with full open access. Third, the book does not defend one superior theory of dignity, but instead presents six Western approaches and one based on the Koran and then asks whether a common essence can be detected. -/- The answer to the question whether a common essence can be detected between the Koranic interpretation of dignity and the main Western theories (virtue, Kant) is YES. The essence can be seen in dignity as a sense of self-worth, which persons have a duty to develop and respect in themselves and a duty to protect in others. The book ends with two recommendations. First, given the 7 concepts of dignity introduced in the book, meaningful dialogue can only be achieved if conversation partners clarify which variation they are using. Second, future collaborations between philosophers and psychologists might be helpful in moving theoretical knowledge on dignity as a sense of self-worth into practical action. The “scourges” of a sense of self-worth and dignity are identified by psychologists as violence, humiliation, disregard and embarrassment. To know more about how these can be avoided from psychologists, is helpful when protecting a sense of self-worth in others. (shrink)

Kantians may be unable to derive all of benevolence from reverence for rational agency, but the remaining lacuna is not as extensive as Arpaly thinks. For while we should take seriously Kantian worries about separating benevolence from reverence, a considerable part of benevolence can be explained in terms of reverence for rational agency on a plausible intepretation of the latter. Furthermore, Kantians have an irreducible role for benevolence within their ethics, which is different from the role of a self-standing virtue.

This paper explores the relationship between our interpretations of another's actions and our readiness to forgive. It begins by articulating an account of forgiveness drawn from the New Testament. It then employs the work of Schleiermacher, Dilthey, and Gadamer to investigate ways in which our interpretations of an act or agent can promote or prevent such forgiveness. It concludes with a discussion of some ethical restrictions that may pertain to the interpretation of actions or agents as opposed to utterances and (...) a look at the significance of these restrictions for forgiveness-promoting interpretation. This article examines Kant’s discussion of the division between reason and unreason in his Anthropology from a Pragmatic Point of View . On the one hand, Kant says that there is a normative, clear, and definite division between reason and unreason. On the other hand, Kant offers three arguments showing that we cannot draw such a division. First, we cannot explain the normative grounds for the division. Second, both reason and unreason are present in everyone to varying degrees in different (...) ways. Third, Kant invalidates the division as such by characterizing what should be more incomprehensible than an extreme case of unreason as also being a rational way of life. (shrink)

For the last 50 years the idea of consumer rights has formed an essential element in the formulation of policy to guide the workings of the marketplace. The extent and coverage of these rights has evolved and changed over time, yet there has been no comprehensive analysis as to the purpose and scope of consumer rights. In moral and ethical philosophy, rights are integrally linked to the notion of justice. By reassessing consumer rights through a justice-based framework, a number of (...) key issues emerge regarding the way in which markets enable justice for consumers. The consumer rights which underpin the United Nations consumer protection guidelines address all forms of justice to some degree, but the predominant focus is on procedural justice. Our conclusions question whether this is sufficient and also whether there is a case to develop the notion of consumer ‘duties’ that complement the idea of rights. (shrink)

This study argues that the notion of transparency requires reconsideration as an essence of ethical agency. It provides a brief explication of the concept of transparency, rooted in the principle of human dignity of Immanuel Kant, and suggests that it has been inadequately appreciated by media ethics scholars and instructors more focused on relatively simplistic applications of his categorical imperative. This study suggests that the concept's Kantian roots raise a radical challenge to conventional understandings of human interaction and, by extension, (...) what it means to exercise freedom. My task in this paper is to demonstrate, contra Nel Noddings, that Kantian ethics does not have an expectation of treating those closest to one the same as one would a stranger. In fact, Kantian ethics has what I would consider a robust statement of how it is that those around us come to figure prominently in the development of one's ethics. Kant and Butler have a sharp methodological conflict in justifying moral obligations. While Kant argues that moral obligations can only be grounded in a prior justifications rather than in anything empirical, Joseph Butler grounds moral obligations in the empirical knowledge of human beings. Despite the apparent radical difference, I argue that Kant agrees with Butler that moral obligations must be grounded in the understanding of human beings. They, however, fundamentally disagree about human nature, which generates their methodological conflict in studying (...) morality. For Kant, the essential attribute for human beings is autonomy, which presupposes independence from any particular experience. In contrast, Butler understands human nature as a system that includes different particular experience. Although there is no conclusive answer of the correct understanding of human nature, I suggest that Butler’s account of moral obligations is a plausible one that can be considered as a counterexample to Kant’s account. In thinking about global poverty, the question of moral motivation is of central importance: Why should the average person in the West feel morally compelled to do anything to help the poor? Various answers to this question have been constructed—and yet poverty persists. In this paper I will argue that, among other difficulties, the current approaches to the problem of poverty overlook a critical element: that poverty not only harms the poor, it harms every human being. Its existence forces us (...) to live in a world where we are compelled by a pervasive ideology to eviscerate our own humanity and neglect our human impulses. Drawing on Karl Marx’s Aristotelian-influenced notion of our human essence as “species-being,” I will construct an account of moral motivation in the face of poverty that stems from a selfish desire to avoid these harms. Thus our moral impetus for acting to help the poor comes not from feelings of guilt about how poverty harms them, but rather from recognizing that poverty is harming all of us. By fighting against global poverty, we seek to make the world a better place for ourselves and the poor alike. (shrink)

Drucilla Cornell's Legacies of Dignity: Between Women and Generations proposes a feminist ethics of self-representation that asks what exclusions are necessary to autobiography's constructions of identity. Focusing on the ways in which alterity, particularly linked with figures of the mother, are silenced, it advances a mourning that is transformational. I question Cornell's use of a Kantian concept of dignity and suggest that Irigaray's engagement with Levinas offers another way of conceptualizing the problematic.

A common assumption in the selection of nonhuman animal subjects for research and the approval of research is that, if the risks of a procedure are too great for humans, and if there is a so-called scientific necessity, then it is permissible to use nonhuman animal subjects. I reject the common assumption as neglecting the central ethical issue of the permissibility of using nonhuman animal subjects and as being inconsistent with the principle of justice used in human subjects research ethics. (...) This principle requires that certain classes of individuals not be subjected to a disproportionate share of the burdens or risks of research. I argue for an extension of this principle to nonhuman animal research and show that a prima facie violation of the principle occurs because nonhuman animals bear an overwhelmingly disproportionate share of the risks of research without sufficient justification or reciprocal benefit. I first characterize a moral mistake in coercion. The principle of independence with which I criticize coercion seems also to condemn exchange. I propose an account of exchange from which it follows that exchange upholds independence after all. In support of that account I argue that, of the accounts of exchange that occur to me, only this one has the consequence that, on general assumptions, a person can take part in exchange while acting, intending, and believing with sufficient reason. I (...) argue that the hiring of very poor people by very rich people for labor from which the rich draw a substantial surplus does not give rise to an exchange of this kind. These instances of the wage labor relation resemble coercion insofar as they violate independence. (shrink)

Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)
