Drunk drivers and other culpably incapacitated wrongdoers are often taken to pose a problem for reasons-responsiveness accounts of moral responsibility. These accounts predicate moral responsibility upon an agent having the capacities to perceive and act upon moral reasons, and the culpably incapacitated wrongdoers lack exactly those capacities at the time of their wrongdoing. Many reasons-responsiveness advocates thus expand their account of responsibility to include a tracing condition: The culpably incapacitated wrongdoer is blameworthy despite his incapacitation precisely because he is responsible (...) for becoming incapacitated. As some skeptics have suggested, it is not clear that we need tracing. Here, however, I make a stronger case against tracing: I show that tracing gets things wrong. I consider a new sort of case, the case of the Odysseus agent, whose incapacitation is non-culpable (sometimes merely permissible and sometimes praiseworthy). Tracing would have us hold responsible and therefore blame unlucky Odysseus agents, Odysseus agents who commit a wrongdoing in the throes of their non-culpably induced incapacitation. But we should not hold these unlucky Odysseus agents responsible for their incapacitated wrongdoing. Because tracing gets these cases wrong, we should reject tracing. (shrink)

The counterfactual mental state of negligent criminal activity invites skepticism from those who see mental states as essential to responsibility. Here, I offer a revision of the mental state of criminal negligence, one where the mental state at issue is actual and not merely counterfactual. This revision dissolves the worry raised by the skeptic and helps to explain negligence’s comparatively reduced culpability.

The problem of moral luck arises due to a particular tension in our thought. On the one hand, we seem readily inclined to endorse the principle that moral responsibility, that is, one’s praiseworthiness or blameworthiness, cannot be affected by luck, that is, by factors over which one lacks control. But, when we examine our actual practices, we find that our moral judgments are highly sensitive to luck. This resulting tension between principle and practice is the problem of moral luck, and (...) an attempt to solve this problem is an attempt to resolve this tension. The article first explains the traditional characterization of the problem and reviews three general strategies in responding to it. It is then argued that we should characterize the problem in a slightly broader way. This refocusing turns out to have significant methodological implications. (shrink)

Most people would agree that a small child, or a cognitively impaired adult, is less responsible for their actions, good or bad, than an unimpaired adult. But how do we explain that difference, and how far can anyone be praised or blamed for what they have done? In this fascinating introduction, Matthew Talbert explores some of the key questions shaping current debates about moral responsibility, including: What is free will, and is it required for moral responsibility? Are we responsible for (...) the unforeseen consequences of our actions? Is it fair to blame people for doing what they believe is right? And are psychopaths open to blame? As Talbert argues, we are morally responsible for our actions when they are related to us in particular ways: when our actions express our true selves, for example, or when we exercise certain kinds of control over them. It is because we bear these relationships to our actions that we are open to praise and blame. _Moral Responsibility_ will be an important resource for students and researchers in ethics, moral psychology, and philosophy of agency and of great interest to all those wishing to understand an important aspect of our moral practices. For many philosophers, bad-history wrongdoers are primarily interesting because of what their cases might tell us about the interaction of moral responsibility and history. However, philosophers focusing on blameworthiness have overlooked important questions about blame itself. These bad-history cases are complicated because blame and sympathy are both fitting. When we are careful to consider the rich natures of those two reactions, we see that they conflict in several important ways. We should see bad-history cases as cases about whether and how (...) we should blame, rather than as cases giving us ready insight into the nature of moral responsibility. (shrink)

Theories of moral responsibility rely on tracing principles to account for derivative moral responsibility. Manuel Vargas has argued that such principles are problematic. To show this, he presents cases where individuals are derivatively blameworthy for their conduct, but where there is no suitable earlier time to which their blameworthiness can be traced back. John Martin Fischer and Neal Tognazzini have sought to resolve this problem by arguing that blameworthiness in these scenarios can be traced back, given the right descriptions of (...) these agents’ later conduct. I contend that this strategy may succeed against Vargas’s particular examples, but that it fails to resolve the larger problem. After clarifying some key issues about derivative responsibility and tracing principles, I develop a case that isn’t amenable to Fischer and Tognazzini’s treatment. I then suggest the outlines of a compromise solution to the problem for tracing principles. (shrink)

In this paper, I propose and defend a structural ownership condition on moral responsibility. According to the condition I propose, an agent owns a mental item if and only if it is part of or is partly grounded by a coherent set of psychological states. As I discuss, other theorists have proposed or alluded to conditions like psychological coherence, but each proposal is unsatisfactory in some way. My account appeals to narrative explanation to elucidate the relevant sense of psychological coherence.

In this paper, I first argue that sometimes freely and knowingly manipulating oneself does not fully preserve moral responsibility – namely, in cases of practically distinct self-manipulation. However, I argue that practically distinct self-manipulation preserves moral responsibility to some extent because such a self-manipulated person is more morally responsibility than an other-manipulated person. This is an important result: manipulating oneself doesn’t always fully preserve one’s moral responsibility for one’s actions. But in what sense is the self-manipulated person more morally responsible? (...) I argue the self-manipulated person is not a fitting target of the reactive attitudes but continues to have wrongdoing-incurred reparative obligations. This explains the intuitive judgement about the self-manipulated person, provides a better explanation of “tracing” cases, and reveals important requirements for a plausible theory of moral responsibility. In this paper, we set out to test empirically an idea that many philosophers find intuitive, namely that non-moral ignorance can exculpate. Many philosophers find it intuitive that moral agents are responsible only if they know the particular facts surrounding their action. Our results show that whether moral agents are aware of the facts surrounding their action does have an effect on people’s attributions of blame, regardless of the consequences or side effects of the agent’s actions. In general, it was (...) more likely that a situationally aware agent will be blamed for failing to perform the obligatory action than a situationally unaware agent. We also tested attributions of forgiveness in addition to attributions of blame. In general, it was less likely that a situationally aware agent will be forgiven for failing to perform the obligatory action than a situationally unaware agent. When the agent is situationally unaware, it is more likely that the agent will be forgiven than blamed. We argue that these results provide some empirical support for the hypothesis that there is something intuitive about the idea that non-moral ignorance can exculpate. (shrink)

Building on Peter French’s important work, this chapter draws three distinctions that arise in the context of attributions of moral responsibility, understood as the extent to which an agent is blameworthy or praiseworthy. First, the subject of an attribution of responsibility may be an individual agent or a collective agent. Second, the object of the responsibility attribution may be an individual action (or consequence) or a collective action (or consequence). The third distinction concerns the temporal dimension of the responsibility attribution. (...) Sometimes responsibility for an action is attributed to an agent at the time of the action. At other times responsibility for an action is attributed to an agent sometime after the action has taken place. Taken together, these three binary distinctions yield eight types of responsibility attribution. It is argued that a collective agent’s responsibility for a past collective act is properly understood on the same theoretical model as is an individual’s responsibility for a past individual act. While most assume that responsibility over time is a straightforward matter of identity over time, it is argued that instead this is a matter of psychological or attitudinal connectedness. The possibility is considered that this relation also grounds attributions involving an asymmetry between subject and object, such as individual responsibility for past collective action, but a skeptical worry is raised that such attributions entail an unpalatable form of moral luck and should therefore be rejected. Many philosophers accept derivative blameworthiness for ignorant conduct – the idea that the blameworthiness for one’s ignorance can ‘transfer’ to blameworthiness for one’s subsequent ignorant conduct. In this chapter we ask the question what it actually means that blameworthiness would transfer, and explore four distinct views and their merits. On views (I) and (II), one’s overall degree of blameworthiness is determined by factors relevant to one’s ignorance and/or one’s subsequent conduct, and transfer only involves an increase in scope. On views (...) (III) and (IV), one’s overall degree of blameworthiness is determined by factors relevant to one’s ignorance as well as one’s subsequent conduct, and transfer might not only entail an increase in scope, but also in degree. This paper has two main goals. The first is to defend a particular account of answerability according to which a person is (morally or criminally) answerable for their conduct if it is (morally or criminally) wrongful under the same description under which it is imputable to their agency. Negating defences in law aim to defeat criminal answerability by negating some element of the charged offence while their moral analogues aim to defeat moral answerability by defeating the aptness of the description (...) under which an action is imputed. In contrast, affirmative defences and their moral analogues aim to defeat the move from answerability to liability to sanction by offering an exculpatory explanation for the wrongful conduct. The second goal of this paper is to argue that there are important differences between the way that ignorance functions in negating defences and their moral analogues and affirmative defences and their moral analogues. Specifically, when ignorance functions to defeat answerability, it need only be sincere, but it is typically limited to matters of fact, whereas both moral and non-moral ignorance can excuse one from liability but only if non-culpable. Manipulation arguments are commonly deployed to raise problems for compatibilist theories of responsibility. These arguments proceed by asking us to reflect on an agent who has been manipulated to perform some (typically bad) action but who still meets the compatibilist conditions of responsibility. The incompatibilist argues that it is intuitive that the agent in such a case is not responsible even though she met the compatibilist conditions. Thus, it is argued, the compatibilist has not provided conditions sufficient for responsibility. Patrick (...) Todd has recently argued that incompatibilists have taken on a heavier dialectical burden than is necessary. Todd argues that incompatibilists need not argue that an agent in a manipulation case is not at all responsible, but only that her responsibility is mitigated in order to refute compatibilism. Hannah Tierney has responded to Todd’s argument by arguing that a compatibilist can admit that manipulation mitigates responsibility without eliminating it. I argue that Tierney’s response is unsuccessful on its own terms. But, I argue, Todd’s argument can be resisted by way of a parallel counter-argument for compatibilism. I argue that Todd’s argument for incompatibilism is no more powerful than my argument for compatibilism. And since Todd’s manipulation argument is offered as an objection to compatibilism, this amounts to a victory for the compatibilist; the objection is defused. (shrink)

One of the most influential arguments against compatibilism is Derk Pereboom’s four-case manipulation argument. Professor Plum, the main character of the thought experiment, is manipulated into doing what he does; he therefore supposedly lacks moral responsibility for his action. Since he is arguably analogous to an ordinary agent under determinism, Pereboom concludes that ordinary determined agents lack moral responsibility as well. I offer a hard-line reply to this argument, that is, a reply which denies that this kind of manipulation is (...) responsibility undermining. I point out that fully fleshed-out manipulated characters in fiction can seem morally responsible for what they do. This is plausibly because we identify with such characters, and therefore focus on their options and the reasons for which they act rather than the manipulation. I further argue that we ought to focus this way when interacting with other agents. We have no reason to trust the incompatibilist intuitions that arise when we regard manipulated agents from a much more detached perspective. (shrink)

I explore the question of when an agent is derivatively, rather than directly, culpable for an undesirable outcome. The undesirable outcome might be a harmful incompetent or unwitting act, or it might be a harmful event. By examining various cases, I develop a sophisticated account of indirect culpability that is neutral about controversies regarding normative ethical issues and the condition on direct culpability.

Philosophers, psychologists, and economists have reached the consensus that one can use two different kinds of regulation to achieve self-control. Synchronic regulation uses willpower to resist current temptation. Diachronic regulation implements a plan to avoid future temptation. Yet this consensus may rest on contaminated intuitions. Specifically, agents typically use willpower (synchronic regulation) to achieve their plans to avoid temptation (diachronic regulation). So even if cases of diachronic regulation seem to involve self-control, this may be because they are contaminated by synchronic (...) regulation. We therefore developed a novel multifactorial method to disentangle synchronic and diachronic regulation. Using this method, we find that ordinary usage assumes that only synchronic––not diachronic––regulation counts as self-control. We find this pattern across four experiments involving different kinds of temptation, as well as a paradigmatic case of diachronic regulation based on the classic story of Odysseus and the Sirens. Our final experiment finds that self-control in a diachronic case depends on whether the agent uses synchronic regulation at two moments: when she (1) initiates and (2) follows-through on a plan to resist temptation. Taken together, our results strongly suggest that synchronic regulation is the sole difference maker in the folk concept of self-control. (shrink)

In the criminal law of many jurisdictions complicity, though not itself a substantive crime but a way of committing a crime, is a doctrine that determines when one person is legally liable for a criminal offense that was committed by another person, typically by being an accomplice. That doctrine has a number of troubling moral implications with respect to responsibility, particularly when complicity is employed as a devise to capture one agent as morally accountable for the actions of another agent (...) and/or the consequences of those actions. I focus on the issue of responsibility for consequences and actus reus and mens rea difficulties with complicity as a moral concept in the light of two cases in which complicity is the basis for ascriptions of moral and criminal responsibility to someone who was not the primary wrongdoer. The book on the topic by Chiara Lepora and Robert E. Goodin provokes my discussion. (shrink)

In Ignorance of Law, Douglas Husak’s main thesis is that ignorance of the law typically provides an excuse for breaking the law, but in the case of recklessness he claims that the excuse it provides is only a partial one, and in the case of willful ignorance he claims that it provides no excuse at all. In this paper I argue that, given the general principle to which Husak appeals in order to support his main thesis, he should revise his (...) position on the exculpatory significance of both recklessness and willful ignorance. Moral responsibility requires that we are in control of what we do. Many contemporary accounts of responsibility cash out this control in terms of abilities and hold that the relevant abilities are strong abilities, like general abilities. This paper raises a problem for strong abilities views: an agent can plausibly be morally responsible for an action or omission, despite lacking any strong abilities to do the relevant thing. It then offers a way forward for ability‐based views, arguing that very weak (...) abilities can form the basis of moral responsibility for both actions and omissions. (shrink)

In most penal systems, success is punished more than failure. For example, murder is punished more severely than attempted murder. But success or failure is often determined by luck. It thus appears that punishment is allotted on the basis of arbitrary factors. The problem of criminal attempts is the question of how to best resolve this apparent tension. One particularly sophisticated attempt at resolution, first developed by David Lewis, holds that such differential punishment is not unjust when understood as a (...) natural penal lottery. What is most interesting about this view is that it does not appear to involve a commitment to resultant moral luck. I argue that the natural penal lottery fails to deliver justice. Upon analysis, it carries the same implication that it sought to avoid—namely, a commitment to resultant moral luck. I then argue that there can be, in principle, no penal lottery that delivers justice, natural or otherwise. (shrink)

This paper warns of two threats to moral responsibility that arise when accounting for omissions, given some plausible assumptions about how abilities are related to responsibility. The first problem threatens the legitimacy of our being responsible by expanding the preexisting tension that luck famously raises for moral responsibility. The second threat to moral responsibility challenges the legitimacy of our practices of holding responsible. Holding others responsible for their omissions requires us to bridge an epistemic gap that does not arise when (...) holding others responsible for their actions—one that we might often fail to cross. Resultant moral luck occurs whenever aspects of an agent’s moral responsibility are affected by luck pertaining to the outcomes of their actions. Many authors reject the existence of moral luck in this sense, but they do so in different ways. Michael Zimmerman argues that resultant luck affects the scope of moral responsibility, but not its degree. That is, it affects what agents are responsible for, but not how responsible they are. Andrew Khoury takes a more resolute approach, arguing that both (...) the scope and the degree of moral responsibility are free from resultant luck. -/- In this paper, I criticize both accounts and develop an alternative. I argue, first, that Khoury’s approach leads to an implausibly far-reaching error-theory about moral responsibility. Second, Zimmerman’s account cannot account for all the ways in which moral responsibility comes in degrees. Third, these problems can be overcome by introducing a distinction between two concepts of responsibility that both come with scope and degree. The first concept I call internal responsibility, as it applies exclusively to agent-internal factors. The second concept I call external responsibility, as it applies to (partly) agent-external factors such as actions and their outcomes. Given this distinction, we can avoid the problems of Khoury’s as well as Zimmerman’s accounts while preserving the central intuition behind the rejection of resultant moral luck. (shrink)

This paper seeks to challenge principles of culpability transfer as they appear in both criminal law and moral philosophy. I begin by discussing the legal doctrine of substituted mens rea, focusing on Section 33.1 of Canada’s Criminal Code. I argue that this doctrine violates the principle of contemporaneity, which there are sound philosophical reasons to accept. I then argue that the same reasons apply to tracing accounts of moral responsibility. Finally, drawing on the moral luck literature, I argue that cases (...) of extreme intoxication are better analyzed in terms of harm-causation than culpability-transfer. (shrink)

In this paper, I describe a hitherto overlooked kind of practical irrationality, which I call irrational option exclusion. An agent who suffers from this problem does not merely fail to act on her best judgement – she fails to realize that the superior action is even an option for her. I furthermore argue that this kind of irrationality is serious enough to undermine moral responsibility. I show that an agent suffering from this problem has compromised reasons-responsiveness, does not really express (...) her will through action, and has a hard time doing otherwise; thus, from the standpoint of several popular moral responsibility theories, we ought to conclude that her responsibility is at the very least diminished. Vicarious responsibility exists. It is (also) a species of moral responsibility. Nevertheless, it is seldomly discussed or considered as such in the main debates within moral philosophy. This article presents a case for the relevance of vicarious moral responsibility to several of these discussions. It seeks to provide new insights for the debate between historicism and structuralism and presents a further case for distinguishing between various facets of moral responsibility. Furthermore, the article demonstrates that an agent need not enter into (...) the relation of vicarious responsibility freely in order to be responsible. This idea then allows us to present new cases for compatibilism, demonstrating the consistency of moral responsibility with determinism. (shrink)

This paper argues that there are compelling grounds for thinking that coercive indoctrination can defeat or mitigate moral culpability in virtue of being a form of non-culpable moral ignorance. That is, I defend a two-tier account such that what excuses an agent for a wrongful act is the agent’s ignorance regarding the moral quality of their act; and what excuses the defendant for their ignorance is that coercion or manipulation deprived the defendant of a fair opportunity to avoid that ignorance. I further argue that criminal defense theory would better track moral culpability were it to broaden existing defenses whose desert-base is moral ignorance—such as insanity or mistaken-belief self-defense—to include non-culpable ignorance due to diminished situational control. In this way, criminal law can plausibly recognize a defense of coercive indoctrination without postulating any new categories of defense. (shrink)

This work develops a philosophically credible and psychologically realisable account of control that is necessary for moral responsibility. We live, think, and act in an environment of subjective uncertainty and limited information. As a result, our decisions and actions are influenced by factors beyond our control. Our ability to act freely is restricted by uncertainty, ignorance, and luck. Through three articles, I develop a naturalistic theory of control for action as a process of error minimisation that extends over time. Thus (...) conceived, control can serve to minimise the influence of luck on action and enable freedom in uncertainty. -/- In Article 1, Thor Grünbaum and I argue for a psychologically plausible account of the kind of control that is necessary for moral responsibility. We begin by establishing the relationship between agentive contribution and responsibility-level control. One way to determine whether one the right kind and degree of control to be morally responsible is to track one’s degree of contribution to an action. However, a psychologically plausible account of control in terms of agentive contribution may seem to contradict the types of functional-mechanistic explanations used in cognitive science. In cognitive psychology and cognitive neuroscience, personal-level capacities are explained by a set of sub-personal mechanisms. Often, such explanations leave no room for a contribution by the agent. By integrating insights from theories of cognitive control and incorporating them into a philosophical account of intentions, we propose a way of thinking about the distribution of cognitive control resources as something the agent does. -/- Article 2 argues that a classic argument concerning luck, originally aimed at libertarianism, generalises beyond any specific theory of free will, and regardless of whether determinism or indeterminism is true. I call this mental luck. Because we all make decisions under conditions of relative uncertainty and limited information, it is possible for an agent to make decisions that are contrary to their own motivation. In such situations, it may be a matter of luck whether the agent makes the right decision. Mentally lucky decisions are not rationally governed by attitudes within the agent's perspective, and thus, may be indistinguishable from unlucky ones. From the perspective of the agent, such decisions may resemble the outcome of a lottery. Therefore, mental luck poses a challenge to most prominent theories of free action and moral responsibility. -/- Finally, article 3 engages with the issue of resultant luck, namely luck in how things turn out. Resultant luck raises a challenge for theories of moral responsibility because its existence suggests that one may be responsible for factors beyond one’s control. Prominent responses to resultant luck led to a choice between internalism and scepticism. I argue that familiar cases of resultant luck are based on the assumption that actions are events. Instead, I propose an alternative ontology of action as an ongoing goal-directed process with a many-shots structure. Described this way, cases of resultant luck are not representative of ordinary action. The proposal of action as a many-shots process is consistent with predictive coding, a cognitive architecture which centres around error minimisation. Under this framework, cases of resultant more luck are no longer failures of action, but rather anticipated errors to be settled within the ordinary process of action. (shrink)
