When an abortion is performed, someone dies. Are we killing a human person? Widespread disagreement exists. However, it is not necessary to establish personhood in order to establish the wrongness of abortion: a substantial chance of personhood is enough. We defend The Do Not Risk Homicide Argument: abortions are wrong after 10 weeks gestation because they substantially and unjustifiably risk homicide, the unjust killing of a human person. Why 10 weeks? Because the cumulative evidence establishes a substantial chance (a more (...) than one in five chance) that preborn human beings are persons after 10 weeks (if not before then). We submit evidence from our bad track record, widespread disagreement about personhood (after 10 weeks gestation), problems with theories of personhood, the similarity between preborn human beings and premature newborns, miscalculations of gestational age, and the common intuitive responses of women to their pregnancies and miscarriages. Our argument is cogent because it bypasses the stalemate over preborn personhood and rests on common ground rather than contentious metaphysics. It also strongly suggests that society must do more to protect preborn human beings. We briefly discuss its practical implications for fetal pain relief, social policy, and abortion law. (shrink)

The so-called Disability Paradox arises from the apparent tension between the popular view that disability leads to low well-being and the relatively high life-satisfaction reports of disabled people. Our aim in this essay is to make some progress toward dissolving this alleged paradox by exploring the relationship between disability and various “goods of life”—that is, components of a life that typically make a person’s life go better for her. We focus on four widely recognized goods of life (happiness, rewarding relationships, (...) knowledge, achievement) and four common types of disability (sensory, mobility, intellectual, and social) and systematically examine the extent to which the four disability types are in principle compatible with obtaining the four goods of life. Our findings suggest that that there is a high degree of compatibility. This undermines the widespread view that disabilities, by their very nature, substantially limit a person’s ability to access the goods of life, and it provides some guidance on how to dissolve the Disability Paradox. Over the course of the past few decades 4E approaches that theorize cognition and agency as embodied, embedded, extended, and/or enactive have garnered growing support from figures working in philosophy of mind and cognitive science. Correspondingly, there has been a rising interest in the wider conceptual and practical implications of 4E views. Several proposals have for instance been made regarding 4E’s bearing on ethical theory, 505–526, 2009; Cash, Phenomenology and the Cognitive Sciences, 9, 645–671 2010). In this paper I contribute (...) to this trend by critically examining the enactive contribution made by Colombetti and Torrance, Phenomenology and the Cognitive Sciences, 8, 505–526 and by laying the foundations for an alternative enactive approach. Building off recent enactive approaches to social interaction, Colombetti and Torrance, Phenomenology and the Cognitive Sciences, 8, maintain that many of our actions and intentions “and in particular the ethical significance of what we do and mean” are “emergent from the interactions in which we participate”. Taking this seriously, they argue, entails a radical shift away from moral theory’s traditional emphasis on individual or personal responsibility. I challenge their suggestion that accepting a broadly enactive 4E approach to cognition and agency entails the kind of wholesale shift they propose. To make my case I start by revisiting some of the general theoretical commitments characteristic of enactivism, including some relevant insights that can be gathered from Vasudevi Reddy’s broadly enactive approach to developmental psychology. After that I examine both the arguments internal to Colombetti and Torrance’s proposal and, in an effort to sketch the beginnings of an alternative view, I draw some connections between enactivism, the ethics of care and P.F. Strawson’s work on personal responsibility. I believe that a consideration of the commonalities but also the differences between these views helps advance the important conversation concerning the link between enactivism and questions of personal responsibility in ethical theory that Colombetti and Torrance have undeniably helped jumpstart. Human–nonhuman chimeras have been the focus of ethical controversies for more than a decade, yet some related issues remain unaddressed. For example, little has been said about the relationship between the origin of transferred cells and the morally relevant capacities to which they may give rise. Consider, for example, a developing mouse fetus that receives a brain stem cell transplant from a human and another that receives a brain stem cell transplant from a dolphin. If both chimeras acquire morally relevant (...) capacities as a result of transplantation, and if those capacities are indistinguishable, should the difference in cell origin matter to how we classify these creatures? I argue that if morally relevant capacities are easy to detect, cell origin is irrelevant to how the chimera ought to be treated. However, if such capacities are hard to detect, cell origin should play a role in considerations about how to treat the chimera. (shrink)

Ethicists have investigated ethical problems in other disciplines, but there has not been much discussion of the ethics of their own activities. Research in ethics has many ethical problems in common with other areas of research, and it also has problems of its own. The researcher’s integrity is more precarious than in most other disciplines, and therefore even stronger procedural checks are needed to protect it. The promotion of some standpoints in ethical issues may be socially harmful, and even our (...) decisions as to which issues we label as “ethical” may have unintended and potentially harmful social consequences. It can be argued that ethicists have an obligation to make positive contributions to society, but the practical implications of such an obligation are not easily identified. This article provides an overview of ethical issues that arise in research into ethics and in the application of such research. It ends with a list of ten practical proposals for how these issues should be dealt with. (shrink)

The historical relationship between health care professionals and people with disabilities is fraught, a fact all the more troubling in light of the distinctive roles clinicians play in both establishing and responding to that which is considered normal or abnormal by society at large. Those who wish to improve their clinical practice might struggle, however, to keep up with developments across numerous disability communities as well as the ever-growing body of disability studies scholarship. To assist with this goal, I offer (...) an overview of recent disability theory, outline a set of responsibilities clinicians have to disability communities, and provide recommendations for clinicians who hope to justly treat patients with disabilities and improve their care and health outcomes. Disabled people face obstacles to participation in epistemic communities that would be beneficial for making sense of our experiences and are susceptible to epistemic oppression. Knowledge and skills grounded in disabled people's experiences are treated as unintelligible within an ableist hermeneutic, specifically, the dominant conception of disability as lack. My discussion will focus on a few types of epistemic oppression—willful hermeneutical ignorance, epistemic exploitation, and epistemic imperialism—as they manifest in some bioethicists’ claims about and interactions with disabled people. One of (...) the problems with the epistemic phenomena with which I am concerned is that they direct our skepticism regarding claims and justifications in the wrong direction. When we ought to be asking dominantly situated epistemic agents to justify their knowledge claims, our attention is instead directed toward skepticism regarding the accounts of marginally situated agents who are actually in a better position to know. I conclude by discussing disabled knowers’ responses to epistemic oppression, including articulating the epistemic harm they have undergone as well as ways of creating resistant ways of knowing. Would the virtuous person eat animals? According to some ethicists, the answer is a resounding no, at least for the virtuous person living in an affluent society. The virtuous person cares about animal suffering, and so, she will not contribute to practices that involve animal suffering when she can easily adopt a strict plant-based diet. The virtuous person is temperate, and temperance involves not indulging in unhealthy diets, which include diets that incorporate animals. Moreover, it is unjust for an animal (...) to be killed for food when this is unnecessary. By contrast, I argue that the virtuous person in an affluent society would eat animals, at least sometimes. I explain how the very virtues thought to motivate “virtuous modest veganism”—compassion, temperance, and justice—motivate the virtuous person to consume some animals. (shrink)

In this paper, I argue that the concept of normality in medical research and clinical practice is inextricable from the concept of ambiguity. I make this argument in the context of Edmund Pellegrino's call for a renewed reflection on medicine’s basic concepts and by drawing on work in critical disability studies concerning Deafness and body integrity identity disorder. If medical practitioners and philosophers of medicine wish to improve their understanding of the meaning of medicine as well as its concrete practice, (...) I contend that they should take seriously the import and centrality of ambiguity for biomedicine. (shrink)

How do we theorize the experiences of caregivers abused by their children with autism without intensifying stigma toward disability? Eva Kittay emphasizes examples of extreme vulnerability to overturn myths of independence, but she ignores the possibility that dependents with disabilities may be vulnerable and aggressive. Instead, her work over-emphasizes caregivers' capabilities and the constancy of disabled dependents' vulnerability. I turn to Judith Butler's ethics and her conception of the self as opaque to rethink care amid conflict. Person-centered planning approaches, pioneered (...) by disability rights activists, merge Butler's analysis of opacity with Kittay's work on embodied care, while also inviting a broader network of people to both interpret needs and change communities. By expanding our conceptions of dependency, feminist disability studies can continue the aim of both Kittay and Butler: to humanize unintelligible lives. (shrink)

One way to determine whether a mental condition should be considered a disorder is to first give necessary and sufficient conditions for something to be a disorder and then see if it meets these conditions. But this approach has been criticized for begging normative questions. Concerning autism (and other conditions), a neurodiversity movement has arisen with essentially two aims: (1) advocate for the rights and interests of individuals with autism, and (2) de-pathologize autism. We argue that denying autism’s disorder status (...) could undermine autism’s exculpatory role in cases where individuals with autism are charged with a crime. Our argument raises a dilemma for the neurodiversity movement: advocating for the rights and interests of individuals with autism may require viewing autism as a condition that can be inherently disabling (at least for some individuals). If this is right, autism’s disorder status might be maintained (again, at least for some individuals) without deriving this result from any general account of disorder. (shrink)

Within the field of virtue and vice epistemology open-mindedness is usually considered an archetypal virtue. Nevertheless, there is ongoing disagreement over how exactly it should be defined. In this paper I propose a novel definition of open-mindedness as a process of impartial belief revision and use it to argue that we should shift our normative assessments away from the trait itself to the context in which it is exercised. My definition works by three sequential stages: not screening new claims, impartially (...) weighing the evidential strength of claims, and updating beliefs accordingly. Using this definition I argue for a focus on agents’ particular circumstances to determine what degrees of credulity, open-, or closed-mindedness are appropriate in any given situation. As well as providing conceptual clarity regarding the concept of open-mindedness this paper indicates the benefits of this contextual approach for our everyday epistemic attitudes. In particular it enables us to recognise, without stigma, when ourselves or others deviate from open-mindedness for appropriate reasons. (shrink)

Sufficientarians face a problem of arbitrariness: why place a sufficiency threshold at any particular point? One response is to seek universal goods to justify a threshold. However, this faces difficulties (despite sincere efforts) by either being too low, or failing to accommodate individuals with significant cognitive disabilities. Some sufficientarians have appealed to individuals’ subjective evaluations of their lives. I build on this idea, considering another individualized threshold: ‘tolerability’. I respond to some traditional challenges to individualistic approaches to justice: ‘expensive’ tastes, (...) and adaptive preferences. Finally, I end by offering some suggestions about how this relates to policymaking. (shrink)

Philosophers often enroll disabled bodies and minds as objects of thought in their arguments from marginal cases and in thought experiments: for example, arguments for animal ethics use cognitively disabled people as a contrast case, and Merleau-Ponty uses a blind man with a cane as an exemplar of the relationship of technology to the human, of how technology mediates. However, these philosophers enroll disabled people without engaging significantly in any way with disabled people themselves. Instead, disabled people are treated in (...) philosophy as literal objects—and in many cases, as less than human. (This sense of a categorical difference between disabled and nondisabled people is becoming especially clear during the Covid-19 pandemic, as I write this article.) Philosophical reflection thus makes assumptions—often wrong—about disabled people’s lives, experiences, and relationships to technology. Outside of philosophy as well as in, disabled people are not regarded as experts about our own experiences and lives; our testimony is paternalistically written over. We need better consideration of disabled people as people as we consider the future. Lack of disabled people’s points of view in philosophy colors—and sometimes invalidates—views of technological change. (shrink)

Janice Moulton's “The Adversary Method: A Philosophical Paradigm” articulated several criticisms of the popular idea of philosophy as adversarial debate. Moulton criticizes it on epistemic grounds, arguing that philosophy's overreliance on adversarial debate is to the detriment of its goals. Some, notably Trudy Govier, have argued in favor of at least a minimal adversariality, governed by norms of respectful argumentation. This paper suggests that Govier's faith in these norms is misplaced, because it neglects the social circumstances of the arguers. While (...) some authors have argued that politeness and aggression apply differently to those of different genders, this paper extends that analysis to social identities other than gender. In fact, given certain assumptions about the philosophy of language, engagement in polite adversarial debate may not even be possible for people occupying certain social locations. (shrink)

I argue that Alasdair MacIntyre has important resources to provide in the debate over the moral status of severely disabled people. In contrast, Gregory Poore suggests that MacIntyre’s virtue theory cannot account for our responsibilities to severely disabled people. Given that MacIntyre bases his theory around community membership, this charge is made especially severe in the case of severely disabled strangers. I present an interpretation of MacIntyre that accounts for responsibilities to severely disabled strangers. I then argue that Poore is (...) wrong to conclude that MacIntyre does not include severely disabled people in communities. (shrink)

The aim of this paper is to critically examine David Shaw, Wybo Dondorp, and Guido de Wert’s arguments in favour of the procurement of human organs from human/nonhuman-primate chimeras, specifically from great-ape/human chimeras. My main claim is that their arguments fail and are in need of substantial revision. To prove this I first introduce the topic, and then reconstruct Shaw et al.’s position and arguments. Next, I show that Shaw et al.: (1) failed to properly apply the subsidiarity and proportionality (...) principles; (2) neglected species overlapping cases in their ethical assessment; (3) ignored the ethics literature on borderline persons; and (4) misunderstood McMahan’s two-tiered moral theory. These mistakes render an important part of their conclusions either false or problematic to the point that they would no longer endorse them. Finally I will briefly mention a possible multipolar solution to the human organ shortage problem that would reduce the need for chimeras’ organs. (shrink)

In the philosophy of love, the possibility of loving a non-human animal is rarely acknowledged and often explicitly denied. And yet, loving a non-human animal is very common. Evidently, then, there is something wrong with both “human-focused” accounts (e.g. Niko Kolodny, Troy Jollimore), which assume we can only love human beings, and “person-focused” accounts (e.g. David Velleman, Bennett Helm), which understand the nature of love in terms of its being essentially directed toward those with a capacity for normative self-reflection (i.e. (...) “persons”). Even aside from the experiences of those who love a non-human animal, on which I draw, we already have reason to be worried about these latter, “person-focused,” views, insofar as they deny the possibility of loving the various human beings who do not meet their criteria for “personhood,” including at least some human beings with “severe” or “profound” cognitive disabilities. With this in mind, I argue that what we need is the (broader) notion of a “somebody” as a distinctive kind of love-object. This is the notion of a kind of presence of which we are acutely aware when, for example, we look into another’s eyes and see that there is “somebody home.” With this presence, there is a possibility of “togetherness,” and I suggest that it is precisely in the realm of togetherness that the possibility of love arises; the kind of love we speak of when we speak of loving our friends, family and romantic partners, and also, I argue, our animal companions. What does feminist disability studies contribute to feminist methods? Feminist disability scholars interweave life-writing about their experiences of disability or caring for a disabled person to challenge ableist stereotypes. As such, they foreground their own vulnerability to build disability identity and community. This style of life-writing, while essential, tends to calcify the dichotomy between the disabled and abled—a binary that the field of feminist disability studies aims to destabilise. Building on new work in feminist disability studies, I show how some (...) scholars use life-writing to cultivate an estranging sensitivity. This new sensitivity builds on prior feminist disability studies scholarship to estrange us from 1) the idea that disability is a cohesive identity and community, 2) that disability is always a socially desirable position, and 3) that allegiance to disability rights insulates us from ableist anxiety. By embracing the tension between solidifying and destabilising the meaning of disability, feminist disability scholars can leverage life-writing as a tool of resistance and thereby lessen the threat of conformity that life narratives tend to produce. The educational aims described by educational philosophers rarely embrace the full range of differences in intellectual ability, adaptive behavior, or communication that children exhibit. Because envisioned educational aims have significant consequences for how educational practices, pedagogy, and curricula are conceptualized, the failure to acknowledge and embrace differences in ability leaves open the question of the extent to which students with intellectual disabilities are subject to the same aims as their “typically-developing” peers. In articulating and defending valued aims of education, educational (...) philosophers tacitly or expressly concede that particular aims will be ill suited to many children with intellectual disabilities, and that separate aims will therefore apply to them. This paper evaluates the philosophical reasoning behind this conclusion that some people, by necessity, must be governed by separate educational aims, to be decided separately and secondarily. The author calls this the “deferral stance.” First, the paper outlines concerns about a particular ability-biased social and epistemic context in which theorizing about educational aims takes place. The author then examines assumptions that underpin the logic of deferral, arguing that the logic proves flawed when subjected to conceptual and empirical scrutiny. The paper concludes by outlining an inclusive approach—the affirmative stance—to theorizing about educational aims that resists the logic of exclusion and deferral. (shrink)

Dependency functions as a keyword in care theory. However, care theorists have spelled out the ontological and moral ramifications of dependency in different and often conflicting ways. In this article, I argue that conceptual disputes about dependency betray a fundamental discordance among authors, rooted in the empirical premises of their arguments. Hence, although authors appear to share a vocabulary of dependency, they are not writing about quite the same phenomenon. I seek to elucidate these differences by teasing out and comparing (...) different conceptions of dependency found in the literature. Borrowing a phrase from Eva Kittay, I trace four “paradigm cases” of dependency: the infant, the physically disabled person, the profoundly intellectually disabled person, and the refugee. These paradigm cases serve as the empirical touchstone from which theorists extract their conceptions of dependency. Each paradigm case, moreover, permits a particular ethical sensibility toward care. How we understand and value dependency thus seems to determine how we understand and value care, and vice versa. In this way, I contend, our normative orientation toward care might influence what sorts of dependency we see—and, by extension, which forms of dependency we fail to notice. (shrink)

Practically every development in medicine in the post–World War II period distanced the physician and the hospital from the patient and the community, disrupting personal connections and severing bonds of trust. We need an ethics that include bodily mediated knowledge as a complement to intellectual knowledge. Care is a challenging concept to explore, in part because it is employed widely and often without thoughtful parsing. Starting from a distinction between intrinsic and final value, I explore the implications of the supervenience of final value on extrinsic properties regarding moral status. I make a case for ‘extrinsic moral status’ based on ‘extrinsic final value’. I show that the assumption of ‘moral individualism’, that moral status supervenes merely on intrinsic properties, is misguided, and results from a conflation of intrinsic with final value. I argue that at least one extrinsic property, namely vulnerability, can be the basis of (...) both final value and moral status, and that dependence on such extrinsic properties is compatible with the requirement of agent-neutrality. In this essay, I argue for a new analysis of Porphyry’s argument for justice in On abstinence. I aim to show that (i) in addition to being an inner order of soul, justice is attributed to external actions and (ii) justice of actions consists in refraining from harming harmless living creatures, including animals and plants. The relevant harm, I argue, consists in taking the lives of living creatures and taking products from them by force or without care. I contend that (...) Porphyry extends moral concern for others to all living creatures, but not merely on the basis of animal suffering. Finally, I argue that that the hierarchy of godlikeness in On abstinence does not support the subordination of moral concern for animals and plants to higher virtues of purity and theory. (shrink)

This paper addresses Peter Singer's claim that cognitive ability can function as a universal criterion for measuring moral worth. I argue that Singer fails to adequately represent cognitive capacity as the object of moral knowledge at stake in his theory. He thus fails to put forth credible knowledge claims, which undermines both the trustworthiness of his moral theories and the morality of the actions called for by these theories. I situate Singer's methods within feminist critiques of moral reasoning and moral (...) epistemology, and argue that Singer's methods are problematic for moral reasoning because they abstract from their object valuable contextual features. I further develop this claim by showing the importance of embodiment for the construal of objects of moral knowledge. Finally, I develop the moral and scholarly implications of this critique. By showing that the abstract, universal methods of reasoning Singer employs cannot credibly construe the objects of ethical inquiry, I call into question the validity of these methods as a means to moral knowledge in general. Furthermore, since moral reasoning takes place within an embodied moral landscape, it is itself a moral enterprise. Singer's moral reasoning, and ours, must be held accountable for its knowledge claims as well as its concrete effects in the world. (shrink)

For caregivers of minimally communicative individuals, providing support in the absence of clearly meaningful responses is ethically fraught. We conducted a secondary analysis of qualitative data from caregivers of individuals who are minimally communicative, including persons with advanced dementia and individuals in disorders of consciousness. Our analysis led to two central claims: (1) Personhood is a threshold concept that is situated, relational, and dynamic and (2) in circumstances in which personhood is difficult to judge, caregivers can “fill the gap” to (...) reach the threshold through a repertoire of strategies. Because personhood is in part an attribution from others, a situational loss of personhood does not preclude restoration, nor does it eliminate moral status. (shrink)

The debate over the grounds of full moral status relies heavily on the “method of cases.” In the method of cases intuitions about particular cases are taken as evidence for philosophical theories. Much in the debate over the grounds of full moral status turns on our intuitions regarding the moral status of individuals with intellectual disability. This paper argues that the intuitions of those in close personal relationships with individuals with intellectual disability are more reliable than the intuitions of those (...) who lack such a relationship. When theorizing about full moral status, we should privilege the intuitions of those who have a close personal relationship with an individual with intellectual disability. (shrink)

While there exists considerable protest against the use of animals in experimentation, less protest is voiced against the use of knowledge gained from animal experimentation. Pulling from arguments against the use of Nazi data, I suggest that using knowledge gained from animal experimentation both disrespects animal victims and sustains the practice. It is thus pro tanto morally wrong.

El presente trabajo explora las conceptualizaciones actuales de la capacidad de resistencia que se aplican a personas con habilidades-diversas. El concepto de ‘ableísmo’ es presentado y se demuestra su utilidad como un lente analítico. Los resultados indican que un enfoque ecológico a la capacidad de resistencia representa un problema para el avance de los derechos de las personas con habilidades diversas. En concreto, la presencia de asunciones y lenguaje ‘ableístas’ demuestran una continua necesidad de examen crítico de las políticas relacionadas (...) con la capacidad de resistencia y su capacidad para incorporar a la población con habilidades diversas. Sugerimos que una ética feminista del cuidado de personas con habilidades diversas contribuye a la comprensión de la capacidad de resiliencia, promoviendo una agenda positiva de los derechos de las personas con habilidades diversas y dando una dirección positiva para políticas en esta área. Los resultados seguramente ayudaran a hacer frente a las lagunas existentes en la literatura de este tema, y serán de gran importancia para los responsables de políticas, investigadores, y la población con habilidades diversas. There is a view that what we owe to other people is explained by the fact that they are human beings who share in a common human life. There are many ways of construing this explanatory idea, and I explore a few of these here; the aim is to look for constructions that contribute to an understanding of what we owe to people with profound and multiple learning difficulties and disabilities. In exploring the idea of sharing in a common life (...) I construe ‘sharing’ as ‘participating in’, and ‘common life’ as the social life characteristic of the environment that someone lives in. My principal purpose is to render the idea of sharing in a common life in terms that help explain its eligibility as a ground for establishing the moral status of people with PMLD. The participatory options I examine each make some call on agency, if only as something hoped for in the future, including when hope flies in the face of expectation. Accordingly I look at conceptions of actual and potential participation in social life, and at the idea of treating people as if they have the potential to participate, even when the existence of any such potential is unlikely. I conclude with some thoughts on the relation between participation and the moral status of profoundly disabled people, and about how much, and how little, the argument has achieved. (shrink)

This paper argues that, although moral agency and moral patiency are distinct concepts, we have pro tanto normative reasons to ascribe some moral agency to all moral patients. Assuming a practice-focused approach, moral agents are beings that participate in moral responsibility practices. When someone is a participant, we are warranted to take a participant stance toward them. Beings who lack moral agency are instead accounted for by an objective stance. As such, they are assumed to be exempted from moral responsibility (...) practices but may still be acknowledged as moral patients. In this paper, I question that a wholly objective stance is, in practice, compatible with proper sensitivity and responsiveness to moral considerations regarding the exempted moral patient. I claim that the participant stance involves a distinct other-regarding perspective, only available from within this stance. Recognizing others specifically as addressor participants induces a readiness for second-person interaction. Instead of merely seeing and treating the moral patient as an object of moral concern, we see them as a source or maker of moral claims and demands. This “you-perspective” appears to be necessary for perceiving a wider range of morally relevant facts and considerations in relation to them. Consequently, taking a wholly objective stance towards a moral patient may impede, or even corrupt, one’s moral sensitivity and responsiveness. Given a commitment to scaffold and cultivate moral agency, there are normative reasons to take an addressor participant stance to all moral patients, and never a wholly objective one. (shrink)
