The influence of virtue theory is spreading to the professions. I argue that journalists and educators would do well to refrain from placing too much faith in the power of the virtues to guide working journalists. Rather than focus on the character of the journalist, we would do better to concentrate on institutional constraints on unethical conduct. I urge this position in the light of the critique of virtue ethics advanced, especially, by Gilbert Harman (1999). Harman believed that the empirical (...) findings of psychologists show that character-based approaches to ethics are useless. I suspect that this rather overstates the case. Nevertheless, special features of journalism make virtue-centered approaches especially inappropriate, and we had best turn to alternatives. (shrink)

This article proposes 3 principles and 3 imperatives as the philosophical foundations of a global journalism ethics. The central claim is that the globalization of news media requires a radical rethinking of the principles and standards of journalism ethics, through the adoption of a cosmopolitan attitude. The article explains how and why ethicists should construct a global journalism ethics, using a contractualist approach. It then formulates 3 "claims" or principles: the claims of credibility, justifiable consequence, and humanity. The claim of (...) humanity is developed further by the formulation of 3 imperatives: to act as a global agent, to serve world citizens, and to enhance nonparochial understandings. This essay outlines an account of virtue ethics applied to the profession of journalism. Virtue ethics emphasizes character before consequences, requires the "good" prior to the "right," and allows for agent-relative as well as agent-neutral values. This essay offers an exploration of the internal characteristics of a good journalist by focusing on moral virtues crucial to journalism. First, the essay outlines the general tenets of Aristotelian virtue ethics. Second, it offers arguments touting virtue ethics in comparison with other popular normative (...) theories such as Mill's utilitarianism and Kant's deontology. Some have suggested that Jon Stewart of The Daily Show with Jon Stewart (TDS) and Stephen Colbert of The Colbert Report (TCR) represent a new kind of journalist. We propose, rather, that Stewart and Colbert are imitators who do not fully inhabit the role of journalist. They are interesting because sometimes they do a better job performing the functions of journalism than journalists themselves. However, Stewart and Colbert do not share journalists' moral commitments. Therefore, their performances are neither motivated nor (...) constrained by these commitments. Using a virtue theory framework, we suggest that this distinction between journalists and their imitators is morally significant because it implies differences in the kinds of excellence these moral agents are pursuing in their work. Rather than evaluating the work of Colbert and Stewart in the role of journalists, we propose analyzing their contributions to media ethics in the role of media critics. (shrink)

The neo-Aristotelian virtue theory of Philippa Foot is presented here as an alternative framework that is arguably more useful than deontological approaches and that relies less on the assertions of moral claims about the intrinsic goodness of foundational principles. Instead, this project focuses more on cultivating a true ethic; that is, a set of tools and propositions to enable individuals to negotiate inevitable conflicts among moral values and challenges posed by cultural contexts and technology use. Foot's ?natural normativity? connects the (...) conditions of human flourishing and objective reasons for acting morally, providing a framework for a digital media ethic to address three critical categories: virtuality and authenticity, privacy and autonomy, and exchange and discourse. The prevailing normative model of contemporary journalism, drawn primarily from a liberal enlightenment tradition emphasizing universal notions of rights, contributes to what many perceive as a crisis in contemporary journalism; at the least, Kantian models are too "thin" to provide an adequate ethical standard. We consider the extent to which an ethic of care, reconceived to address weaknesses identified in recent scholarly critiques, provides journalists with an alternative framework for moral decision making. We use the concept of unequal ethical pull (...) to rework caring and to promote caring for distant others because caring that remains at the personal level is inadequate as a moral value. We conclude by noting that public journalism and our retooled ethic of care share several important ideals. We suggest a program of mutually beneficial exploration, one that might help today's journalists cultivate the virtue of care as they work toward justice. (shrink)

The global turn in media ethics has presented a tough challenge for traditional models of moral theory: How do we assert common moral standards while also showing respect for the values of those from outside the Western tradition? The danger lies in advocating for either extreme: reason-dependent absolutism or cultural relativism. In this paper, I reject Cliff Christian’s attempts to solve the problem and propose instead a moral theory of universal standards that are discovered via a mix of rationally grounded (...) methods. Such universality refutes relativism but, because it is grounded in evolutionary naturalism and life-world philosophy—as opposed to a Kantian or theological transcendentalism—it also avoids absolutism. This pedagogical essay explores the tendency of undergraduate media ethics students to do what Bernard Gert calls “morality by slogans” and their tendency to misuse Aristotle's golden mean slogan. Critical self-reflection by news workers will better enable journalists to ethically deliberate news choices that balance their responsibilities to owners, peers, and the public.

In this article I argue, first, that genuinely effective ombudsmen could help restore news credibility-thereby staving off other, more intrusive external intervention-and that the position must have true sanctioning authority, much like that of the ethics officer in many corporations. I also argue that the effective ombudsman will be one who sufficiently understands the workings of journalism but who is not immersed in its ethos. This distancing is necessary for genuine critical appraisal to be possible.

The contemporary debate about "who is a journalist" is occurring in two distinct domains: law and professional ethics. Although the debate in these domains is focused on separate problems, participants treat the central question as essentially the same. This article suggests that the debates in law and professional ethics have to be resolved independently and that debate within those domains needs to be more nuanced. In law, it must vary depending on whether the context involves constitutional law, statutory law, or (...) the distribution of informal privileges by government officials. In professional ethics, the debate should not be oriented around a single definitional threshold but should identify tiers that take account of different communicators' unique goals, tactics, and values. Virtue ethical inspired approaches to practical and professional ethics have long been endorsed across various disciplines. Journalistic ethics is no exception. Call such approaches Virtue Ethical Journalism (VEJ). Virtue ethics has also drawn considerable attention from the field of moral psychology, though not all of it is supportive. Among the critics, some take the view that character traits and virtues are not effective enough in guiding people’s behavior. As a result, they conclude that traits should be minimized in ethical thought. (...) Call this stronger view character skepticism. VEJ has taken character skepticism seriously. Many responses to character skepticism defending VEJ, however, raise similar points as those that defend a more general theory of virtue ethics from such skepticism. I argue, however, that such responses to character skepticism are not up to the task of defending VEJ. Newspaper copy editors labor in anonymity and struggle for respect in their newsrooms. These conditions may make it difficult for them to realize their potential as the last line of defense against violations of ethical practice. By adopting existentialism as a guiding moral philosophy, however, copy editors can find the courage and confidence to act as final guardians of ethical journalism. This article examines how copy editors are often overlooked in the literature of journalism ethics and suggests ways in which (...) existential philosophy would address specific problems of copy editors. This article examines byline issues and journalism ethics in an Asian context, with particular focus on how journalists invent and subsequently publish articles under various non-existent authors. The study took place between April and August 2022 in Kazakhstan, Kyrgyzstan and Uzbekistan, where ethical misbehavior in journalism is normalized and academic institutions in the region fail to develop students’ ethical approach to journalism. It is well known that journalists write about politically sensitive issues under pseudonyms or other names in authoritarian contexts, (...) but this study adds to scholarship exploring why and under what circumstances journalists in an Asian context use non-existent authors even when writing on nonsensitive and trivial matters. The findings suggest that journalists choose to and/or are forced to publish articles using multiple pseudonyms by political, economic, and individual circumstances. In this article I use a case study of 3 newspaper pieces about assisted suicide and euthanasia to show how journalists can use analysis and commentary to highlight the ethical dimension of an important public issue. Using an approach grounded in ethical theory, I examine how these pieces-from the Christian Science Monitor, Los Angeles Times, and New York Times-shed light on ethical issues including matters of duties and consequences. It is argued that an analytical approach that openly frames a topic (...) as having a moral dimension is particularly appropriate for ethics coverage in light of the value-laden nature of writing about ethics. Fear of public disclosure that will add to the humiliation of rape or other sexual assault is real for victims. In discussing this issue, cases for concealment and for disclosure are examined and suggestions are made for determining whether to publish names of victims.

A significant and controversial 1996 news story was Dm% Alliance, a 3-part series wkitten by reporter Gary Webb fm the San Jose Mercury News. In the series, which appeared August 18-20, Webb reported links during the 1980s among the Central Intelligence Agency, a California drug ring, and US.-backed Nicaraguan rebels. Critics raised ethical questions about how Webb obtained information and about how he and the Mercury News presented the story. This essay examines those questions and discusses journalists' virtues. Media scholars have used ethical theory extensively to evaluate journalists' own ethical practices. However, they have given little attention to how ethical theory could be used to assess the way journalists cover the ethics of others. In light of the important role that medicine and other professions play in the lives of individuals and society, this article proposes a framework to evaluate news coverage of ethical issues that involve professions and in society. After making the case for the need for (...) this framework, the article describes the framework itself and the rationale for each component. In this article, we explore the tension between truth telling and the demands of civic life, with an emphasis on the tension between serving one's country and reporting the truth as completely and independently as possible. We argue that the principle of truth telling in journalism takes priority over the promotion of civic values, including a narrow patriotism. Even in times of war, responsible journalism must not allow a narrow patriotism to undermine its commitment to truth telling. Journalists best fulfill (...) their civic role by adopting the perspective of a democratic patriotism. We conclude that if news organizations accept the primacy of truth telling and democratic patriotism, they should not embed reporters with military units, or if they do, they have an ethical obligation to implement special editorial precautions. The debate over news ombudsmen remains at a seemingly irreconcilable impasse, and less relevant as journalism shifts away from print and traditional newsroom structures in the new-media age. There are fewer than 30 ombudsmen at U.S. media outlets today, according to the Organization of News Ombudsmen (Ombudsmen, 2010). We argue that the greatest failure of ombudsmanship is that it does not go far enough in giving voice and visibility to the ombudsman's work, including interacting with community. Media news outlets can (...) best serve the public trust by fulfilling the journalistic mission of civic transformation through empowerment advocated by Christians, Ferre, and Fackler (1993). As the vanguard of the communitarian approach of ?person-in-community,? the ideal ombudsman would be just that: a person in the community. The ethical goal of ombudsmanship should be not to promote an apologist from within the ranks but rather to facilitate a community conversation. We propose integrating the ideal ombudsman (which we redefine and rename as the ethics examiner) with the best practices of successful news councils (hereafter called media councils in a return to their original name and to encompass a broader universe of information outlets). This article argues that a potential expert witness's decision about testifying for a libel plaintif should not be driven by an unexamined loyalty to journalists, to the press, or to broad principles of expression. Real harm done to a plaintif by libel and the advantage to the press corps and to the system of expression of having a knowledgeable expert testihing for a libel plaintif are discussed as factors that might outweigh the traditional loyalties. Media organizations are simultaneously key elements of an effective democracy and, for the most part, commercial entities seeking success in the market. They play an essential role in the formation of public opinion and the influence on personal choices. Yet most of them are commercial enterprises seeking readers or viewers, advertising, favorable regulatory decisions for their media, and other assets. This creates some intrinsic difficulties and produces some sharp tensions within media ethics. In this article, we examine such tensions - (...) in theory and practice. We then consider the feasibility of introducing an ethics regime to the media industry - a regime that would be effective in a deregulated environment in protecting public interest and social responsibility. In the article, we also outline a rationale and a methodology for the institutionalization of an acceptable and workable media ethics regime that aims to protect the integrity of the industry in a future of undoubtedly increasing commercial pressure. This article argues that afirm and consistent editorial focus on a poilitician's public virtue would serve well as the essence of journalistic communication about piitical character. Public virtue is defined as the ethical character traits attributed to a politician by an editorialist, based on direct obsemation, of the politician's words and deeds, broadly construed. After presenting the theoretical foundation of this definition, via qualitative case-study methodology, this essay analyzes the editorial claims made in the Atlanta newspapers about Gov. Bill Clinton's (...) political character during the 1992 presidential campaign. The Atlanta case demonstrates how a clear focus on public virtue can operate in practice. The conclusion discusses expectations that readers, opinion columnists, and newspaper editors should keep in mind as character issue is broughtforth in the press. (shrink)

The field of journalism has experienced recent upheavals caused in part by shifts in technology, economic challenges, and questions about the concept of truth telling. This study compares the new version of the Society of Professional Journalists’ Code of Ethics with its 1996 version in an effort to determine how journalists who embrace the ethos of a profession have responded to these challenges, as reflected in the standards and practices outlined in their code. Roger Silverstone proposed media hospitality as an important element of media ethics. I agree that media hospitality can make a valuable contribution to media ethics. However, I have doubts about grounding media hospitality in what has been referred to as the “deductive abstractions and absolutist language of much media ethics theorizing” founded on Enlightenment assumptions. Despite his own reservations about Enlightenment theorizing, I propose that Silverstone's account ultimately suffers from these problems of abstraction and absolutism, as seen most clearly from (...) the vantage point of Alasdair MacIntyre's neo-Aristotelian theory of virtue ethics. ABSTRACTThis study aimed to throw light on the implied and tacit moral philosophical features of rulings from an apparently effective and well-respected press council. Statements from the Norwegian Press Council are analyzed from the perspective of 3 ethical theories. The analysis shows that the institutionalized media ethics as presented by this authoritative body have distinct features of discourse ethics, while perspectives of virtue ethics are surprisingly absent. The Norwegian Press Council is preoccupied with procedural norms for the public discourse and (...) pays less attention to the character of the journalist and the quality of the journalism. Some reflections in accordance with ethics of proximity can be traced in the council’s statements but take second place in relation to other considerations. (shrink)
