Recent decades have witnessed tremendous progress in artificial intelligence and in the development of autonomous systems that rely on artificial intelligence. Critics, however, have pointed to the difficulty of allocating responsibility for the actions of an autonomous system, especially when the autonomous system causes harm or damage. The highly autonomous behavior of such systems, for which neither the programmer, the manufacturer, nor the operator seems to be responsible, has been suspected to generate responsibility gaps. This has been the cause of (...) much concern. In this article, I propose a more optimistic view on artificial intelligence, raising two challenges for responsibility gap pessimists. First, proponents of responsibility gaps must say more about when responsibility gaps occur. Once we accept a difficult-to-reject plausibility constraint on the emergence of such gaps, it becomes apparent that the situations in which responsibility gaps occur are unclear. Second, assuming that responsibility gaps occur, more must be said about why we should be concerned about such gaps in the first place. I proceed by defusing what I take to be the two most important concerns about responsibility gaps, one relating to the consequences of responsibility gaps and the other relating to violations of jus in bello. There is a concern that the widespread deployment of autonomous machines will open up a number of ‘responsibility gaps’ throughout society. Various articulations of such techno-responsibility gaps have been proposed over the years, along with several potential solutions. Most of these solutions focus on ‘plugging’ or ‘dissolving’ the gaps. This paper offers an alternative perspective. It argues that techno-responsibility gaps are, sometimes, to be welcomed and that one of the advantages of autonomous machines is that they enable us to embrace (...) certain kinds of responsibility gap. The argument is based on the idea that human morality is often tragic. We frequently confront situations in which competing moral considerations pull in different directions and it is impossible to perfectly balance these considerations. This heightens the burden of responsibility associated with our choices. We cope with the tragedy of moral choice in different ways. Sometimes we delude ourselves into thinking the choices we make were not tragic ; sometimes we delegate the tragic choice to others ; sometimes we make the choice ourselves and bear the psychological consequences. Each of these strategies has its benefits and costs. One potential advantage of autonomous machines is that they enable a reduced cost form of delegation. However, we only gain the advantage of this reduced cost if we accept that some techno-responsibility gaps are virtuous. (shrink)

Many seem to think that AI-induced responsibility gaps are morally bad and therefore ought to be avoided. We argue, by contrast, that there is at least a pro tanto reason to welcome responsibility gaps. The central reason is that it can be bad for people to be responsible for wrongdoing. This, we argue, gives us one reason to prefer automated decision-making over human decision-making, especially in contexts where the risks of wrongdoing are high. While we are not the first to (...) suggest that responsibility gaps should sometimes be welcomed, our argument is novel. Others have argued that responsibility gaps should sometimes be welcomed because they can reduce or eliminate the psychological burdens caused by tragic moral choice-situations. By contrast, our argument explains why responsibility gaps should sometimes be welcomed even in the absence of tragic moral choice-situations, and even in the absence of psychological burdens. What is techno-optimism and how can it be defended? Although techno-optimist views are widely espoused and critiqued, there have been few attempts to systematically analyse what it means to be a techno-optimist and how one might defend this view. This paper attempts to address this oversight by providing a comprehensive analysis and evaluation of techno-optimism. It is argued that techno-optimism is a pluralistic stance that comes in weak and strong forms. These vary along a number of key dimensions but each (...) shares the view that technology plays a key role in ensuring that the good prevails over the bad. Whatever its strength, to defend this stance, one must flesh out an argument with four key premises. Each of these premises is highly controversial and can be subjected to a number of critiques. The paper discusses five such critiques in detail. The paper also considers possible responses from the techno-optimist. Finally, it is concluded that although strong forms of techno-optimism are not intellectually defensible, a modest, agency-based version of techno-optimism may be defensible. (shrink)

Moralization is a social-psychological process through which morally neutral issues take on moral significance. Often linked to health and disease, moralization may sometimes lead to good outcomes; yet moralization is often detrimental to individuals and to society as a whole. It is therefore important to be able to identify when moralization is inappropriate. In this paper, we offer a systematic normative approach to the evaluation of moralization. We introduce and develop the concept of ‘mismoralization’, which is when moralization is metaethically (...) unjustified. In order to identify mismoralization, we argue that one must engage in metaethical analysis of moralization processes while paying close attention to the relevant facts. We briefly discuss one historical example and two contemporary cases related to COVID-19 that we contend to have been mismoralized in public health. We propose a remedy of de-moralization that begins by identifying mismoralization and that proceeds by neutralizing inapt moral content. De-moralization calls for epistemic and moral humility. It should lead us to pull away from our tendency to moralize—as individuals and as social groups—whenever and wherever moralization is unjustified. (shrink)

Experimental philosophy is a relatively recent discipline that employs experimental methods to investigate the intuitions, concepts, and assumptions behind traditional philosophical arguments, problems, and theories. While experimental philosophy initially served to interrogate the role that intuitions play in philosophy, it has since branched out to bring empirical methods to bear on problems within a variety of traditional areas of philosophy—including metaphysics, philosophy of language, philosophy of mind, and epistemology. To date, no connection has been made between developments in experimental philosophy (...) and philosophy of technology. The transfer of tasks with sometimes far-reaching implications to autonomous systems raises a number of ethical questions. In addition to fundamental questions about the moral agency of these systems, behavioral issues arise. We investigate the empirically accessible question of whether the imposition of harm by an agent is systematically judged differently when the agent is artificial and not human. The results of a laboratory experiment suggest that decision-makers can actually avoid punishment more easily by delegating to machines than by delegating (...) to other people. Our results imply that the availability of artificial agents could provide stronger incentives for decision-makers to delegate sensitive decisions. (shrink)

As artificial intelligence becomes more sophisticated and robots approach autonomous decision-making, debates about how to assign moral responsibility have gained importance, urgency, and sophistication. Answering Stenseke’s (2022a) call for scaffolds that can help us classify views and commitments, we think the current debate space can be represented hierarchically, as answers to key questions. We use the resulting taxonomy of five stances to differentiate—and defend—what is known as the “blank check” proposal. According to this proposal, a person activating a robot could (...) willingly make themselves answerable for whatever events ensue, even if those events stem from the robot’s autonomous decision(s). This blank check solution was originally proposed in the context of automated warfare (Champagne & Tonkens, 2015), but we extend it to cover all robots. We argue that, because moral answerability in the blank check is accepted voluntarily and before bad outcomes are known, it proves superior to alternative ways of assigning blame. We end by highlighting how, in addition to being just, this self-initiated and prospective moral answerability for robot harm provides deterrence that the four other stances cannot match. (shrink)

Robots are becoming more visible parts of our life, a situation which prompts questions about their place in our society. One group of issues that is widely discussed is connected with robots’ moral and legal status as well as their potential rights. The question of granting robots rights is polarizing. Some positions accept the possibility of granting them human rights whereas others reject the notion that robots can be considered potential rights holders. In this paper, I claim that robots will (...) never have all human rights, even if we accept that they are morally equal to humans. I focus on the role of embodiment in the content of the law. I claim that even relatively small differences in the ontologies of entities could lead to the need to create new sets of rights. I use the example of Neanderthals to illustrate that entities similar to us might have required different legal statuses. Then, I discuss the potential legal status of human-like robots. (shrink)

Many optimistic responses have been proposed to bridge the threat of responsibility gaps which artificial systems create. This paper identifies a question which arises if this optimistic project proves successful. On a response-dependent understanding of responsibility, our responsibility practices themselves at least partially determine who counts as a responsible agent. On this basis, if AI or robot technology advance such that AI or robot agents become fitting participants within responsibility exchanges, then responsibility itself might be engineered. If we have good (...) reason to think such technological advances are likely, then we should take steps to address the potential for engineering responsibility. (shrink)

Whatever one makes of the relationship between free will and moral responsibility – e.g. whether it’s the case that we can have the latter without the former and, if so, what conditions must be met; whatever one thinks about whether artificially intelligent agents might ever meet such conditions, one still faces the following questions. What is the value of moral responsibility? If we take moral responsibility to be a matter of being a fitting target of moral blame or praise, what (...) are the goods attached to them? The debate concerning ‘machine morality’ is often hinged on whether artificial agents are or could ever be morally responsible, and it is generally taken for granted (following Matthias 2004) that if they cannot, they pose a threat to the moral responsibility system and associated goods. In this paper, I challenge this assumption by asking what the goods of this system, if any, are, and what happens to them in the face of artificially intelligent agents. I will argue that they neither introduce new problems for the moral responsibility system nor do they threaten what we really (ought to) care about. I conclude the paper with a proposal for how to secure this objective. (shrink)

Recent work in philosophy of technology has come to bear on the question of responsibility gaps. Some authors argue that the increase in the autonomous capabilities of decision-making systems makes it impossible to properly attribute responsibility for AI-based outcomes. In this article we argue that one important, and often neglected, feature of recent debates on responsibility gaps is how this debate maps on to old debates in responsibility theory. More specifically, we suggest that one of the key questions that is (...) still at issue is the significance of the reactive attitudes, and how these ought to feature in our theorizing about responsibility. We will therefore provide a new descriptive categorization of different perspectives with respect to responsibility gaps. Such reflection can provide analytical clarity about what is at stake between the various interlocutors in this debate. The main upshot of our account is the articulation of a way to frame this ‘new’ debate by drawing on the rich intellectual history of ‘old’ concepts. By regarding the question of responsibility gaps as being concerned with questions of metaphysical priority, we see that the problem of these gaps lies not in any advanced technology, but rather in how we think about responsibility. Danaher (2016) has argued that increasing robotization can lead to retribution gaps: Situation in which the normative fact that nobody can be justly held responsible for a harmful outcome stands in conflict with our retributivist moral dispositions. In this paper, we report a cross-cultural empirical study based on Sparrow’s (2007) famous example of an autonomous weapon system committing a war crime, which was conducted with participants from the US, Japan and Germany. We find that (i) people manifest a considerable willingness (...) to hold autonomous systems morally responsible, (ii) partially exculpate human agents when interacting with such systems, and that more generally (iii) the possibility of normative responsibility gaps is indeed at odds with people’s pronounced retributivist inclinations. We discuss what these results mean for potential implications of the retribution gap and other positions in the responsibility gap literature. (shrink)

Responsibility gaps occur when autonomous machines cause harms for which nobody can be justifiably held morally responsible. The debate around responsibility gaps has focused primarily on the question of responsibility, but other approaches focus on the victims of the associated harms. In this paper I consider how the victims of ‘AI-harm’—by which I mean harms implicated in responsibility gap cases and caused by AI-agents—can make sense of what has happened to them. The reactive attitudes have an important role here. I (...) argue that regulating our reactive attitudes—withdrawing or sustaining them as our understanding of the actions, motives, status, and character of others develops—is an important part of the way in which we make sense of the harms we suffer. But, I argue, AI-agents can disrupt standard practices of regulating the reactive attitudes. This can lead victims of AI-harm to suffer a secondary hermeneutic harm (in addition to the primary AI-harm). This harm, which the responsibility gap and AI ethics literatures have neglected, can occur whether responsibility gaps are real or not. (shrink)
