Republicans understand freedom as the guaranteed protection against any arbitrary use of coercive power. This freedom is exercised within a political community, and the concept of arbitrariness is defined with reference to the actual ideas of its citizens about what is in their shared interests. According to many current defenders of the republican model, this form of freedom is understood in strictly negative terms representing an absence of domination. I argue that this assumption is misguided. First, it is internally inconsistent. (...) The central republican focal point of arbitrariness is a necessarily socially constructed ideal that only exists as the creation of the citizens themselves. Second, republican freedom operates in two distinct realms or spheres. There is freedom under a law that is required to uphold the collective good as reflected in society’s norms, and there is freedom within that very system of norms. The threats to freedom from within each sphere are different and must be addressed accordingly. The negative approach, however, conflates the two and emphasises only the dangers faced under the law. This exposes citizens – especially those from marginalised social groups – to domination in the second realm from oppressive social norms. Only by clearly recognising the nature of both kinds of threats can a comprehensive republican freedom be formulated. (shrink)

Temporariness has become the norm in contemporary refugee protection. Many refugees face extended periods of time waiting for permanent status, either in camps or living among citizens in their state of asylum. Whilst this practice of keeping refugees waiting is of benefit to states, I argue that not only is it harmful to refugees but it also constitutes an injustice. First, I outline the prevalence of temporary assistance in the refugee protection regime. Second, I outline the orthodox view on temporary (...) refugee protection – it is acceptable as long as it is not indefinite. I then spend the remainder of the article considering four arguments against temporary refugee protection: the plan argument, the reciprocity argument, the domination argument, and the compounding injustice argument. I contend that the first two arguments, which already feature in the literature, merely show that temporary protection is harmful to refugees. My own arguments on domination and compounding injustice show, instead, that giving refugees temporary protection constitutes an injustice. The domination argument allows us to critique the current practice of temporary refugee protection, whereas the compounding injustice argument shows that temporariness in any form constitutes an injustice. Most nonhuman animals live on the terms imposed on them by human beings. This condition of being under the mastery of another, or domination, is what republicanism identifies as political unfreedom. Yet there are several problems that must be solved in order to successfully extend republicanism to animals. Here I focus on the question of whether freedom can be a benefit for individuals without a free will. Arbitrary state and corporate powers are helping to turn the Internet into a global surveillance dragnet. Responses to this novel form of power have been tepid and ineffective. Liberal critiques of surveillance are constrained by their focus on privacy, security and the underlying presupposition that freedom consists only of freedom from interference. By contrast, (post)Foucauldian critiques rejecting liberalism have been well rewarded analytically, but have proven incapable of addressing normative questions regarding the relationship between surveillance and freedom. Quite apart from (...) these debates, neorepublicans have excavated a third concept of freedom, understood as non-domination. Could neorepublicanism overcome the limitations of liberal and (post)Foucauldian critiques of surveillance? We argue, positively, that neorepublicanism can accommodate much of the (post)Foucauldian analyses while also incorporating a normative critique of surveillance vis-à-vis freedom. We further argue, negatively, that surveillance power has outstripped the capacities of traditional republican institutional responses to domination. We conclude by considering ways in which neorepublicanism can be recalibrated to address the novelty of surveillance power while adhering to the ideal of non-domination. Two ways of addressing the problem are proposed: an offensive, dedicated surveillance antipower and a defensive republican amplification of privacy. (shrink)

This paper addresses a neglected question in republican political philosophy: what are the conditions for a set of arguments to be considered republican? While republicanism traditionally confers a fundamental role to the democratic ideal of participation in decision-making, recent contributions argue that freedom could be promoted by facilitating exit where possible. The strong version of the latter argument states that when exit is possible, it constitutes the most important contribution to republican freedom, and it preserves the goal of isolating individual (...) choices, i.e. it precludes collective decision-making from interfering with them, and so it intends to limit the scope of public concern considered legitimate. I examine this argument to discuss the boundaries and varieties of republicanism: (i) the boundaries establish that an argument should be couched and substantively articulated in distinctively republican terms; (ii) the strong version of the exit argument does not fall within the boundaries because it is in tension with core republican commitments to self-government and civic virtues; (iii) once we abide by the boundaries we may encounter a diversity of proposals differing on the more concrete level of institutional design and empirical assumptions – these are the varieties of republicanism. Egalitarian theories assess when and why distributive inequalities are objectionable. How should egalitarians assess inequalities between generations? One egalitarian theory is (telic) distributive egalitarianism: other things being equal, equal distributions of some good are intrinsically better than unequal distributions. I first argue that distributive egalitarianism produces counterintuitive judgements when applied across generations and that attempts to discount or exclude intergenerational inequalities do not work. This being so, intergenerational comparisons also undercut the intragenerational judgements that made distributive egalitarianism intuitive in the (...) first place. I then argue that egalitarians should shed distributive egalitarianism: relational and instrumental arguments against inequality likely suffice to capture egalitarian concerns – including across generations – without encountering the problems produced by distributive egalitarianism. After defining the essential elements of Aristotelian citizenship, the article proposes to apply these criteria in its search for the equivalent of a citizen within the corporate polis. It argues that shareholding managers are the best positioned among a firm's constituents or stakeholders in fulfilling the role of corporate citizens. Greater participation by management not only in the control but also in the ownership of firms brings about benefits for the firm as a whole and for the managers themselves, as (...) organizational citizenship behavior literature, among others, suggests. While the rule of law is surely a very important good, the familiar discussions found in the literature lead many to conclude that it is either a relatively trivial political ideal, or else a redundant one. What is needed is a new and persuasive defense of the rule of law that properly reflects its great significance for human well being. An important step towards building such an argument is to question a widely-shared but often unnoticed assumption that the rule of (...) law should be understood as a virtue of legal systems. The path is then cleared for a republican argument built on two theses: first, the thought that an ideal society would be one in which no one is the master of anyone else, and second, the thought that our freedom from domination is not natural or pre-institutional. This paper addresses republican conditions of legitimacy for the constitution of the civic statuses of migrants. It identifies two legitimacy tests to which any civic status is subject, namely, that it does not make its bearers more vulnerable to the arbitrary exercise of private or public power and that the constitution of the person as bearer of this status is not itself the product of an arbitrary exercise of public power . It is argued that R1 puts significant constraints on (...) what can be legitimate migrant statuses and R2 links republicanism to cosmopolitanism in terms of a basic norm in respect of the production and allocation of civic statuses in that those who are subject to such a regime should have the effective power to ‘shape and contest’ the rules of this regime. István Hont identified a point in the history of political thought at which republicanism and commercialism became separated. According to Hont, Emmanuel Sieyès proposed that a monarchical republic should be formed. By contrast the Jacobins, in favour of a republic led by the people, rejected not only Sieyès’s political proposal, but also the economic ideology that went with it. Sieyès was in favour of a commercial republic; the Jacobins were not. This was, according to Hont, a defining moment in the (...) history of political thought. In this article, I offer a different analysis of that particular moment in the history of the commercial republic, one that instead of focusing on Sieyès and the Jacobins, looks at the thought of Girondins philosophers Nicolas de Condorcet and Sophie de Grouchy. I argue that their arguments provide sound models for a commercial republic, reconciling late 18th century republican ideals in which virtue was central, with the need for a flourishing and internationally active market economy. Jürgen Habermas’s theory of ‘discourse ethics’ has been an important source of inspiration for theories of deliberative democracy and is typically contrasted with agonistic conceptions of democracy represented by theorists such as Chantal Mouffe. In this article I show that this contrast is overstated. By focusing on the different philosophical traditions that underpin Mouffe’s and Habermas’s respective approaches, commentators have generally overlooked the political similarities between these thinkers. I examine Habermas’s and Mouffe’s respective conceptions of democratic politics and argue that (...) they cannot be so neatly distinguished from each other. I show that much of Mouffe’s criticism of Habermas’s theory does not hold up to careful scrutiny, and discourse ethics shares important points of similarity with her own democratic theory. By using critical republican theory to show the similarities in their work, I push beyond the agonistic versus deliberative debate, and show that at the heart of both of these approaches is a critical republican emphasis on the need for civic solidarity, on the constructive role of conflict in democratic politics and on the vital importance of self-government. These are crucial ingredients for the regeneration of democracy in contemporary pluralistic societies. (shrink)

On the face of it, self-censorship is profoundly subversive of democracy, particularly in its talk-centric forms, and undermines the culture of openness and publicity on which it relies. This paper has two purposes. The first is to develop a conception of self-censorship that allows us to capture what is distinctive about the concept from a political perspective and which allows us to understand the democratic anxiety about self-censorship: if it is not obvious that biting our tongues is always wrong, we (...) need a fuller account of the moral sensibility that finds it so troubling and this is elaborated here. The second is to develop an argument to the effect that this sensibility should not have the last, or only, word, but instead that self-censorship should be viewed as an ‘ordinary vice’ of democratic societies. The grounds for tolerating it rest on the democratic values that critics believe it threatens. (shrink)

Confucianism has been historically intertwined with authoritarianism in general and monarchy in specific. Various contemporary attempts to reconcile Confucianism with democracy have yielded controversial results mostly due to the theoretical tension between the authoritarian character of the former and the liberal one of the latter. This article seeks to develop an alternative route to Confucian democracy by drawing from Huang Zongxi’s 黃宗羲 Waiting for the Dawn: A Plan for the Prince. In this well-known work, Huang argues for a form of (...) limited government that is built upon laws, political protection of academic freedom, good institutional designs, and separation of governmental powers. While these features seem to qualify Huang only as a defective liberal, this article argues that they are in much coherence with the insights of republicanism concerning good governance. This article will argue that the republican themes embodied in Waiting for the Dawn can justify and support a particular form of Confucian republican democracy. (shrink)

It has become a commonplace in neo-republican thinking to claim that if the notion of rights can be allowed a place in republican political theory, it can never achieve the prominence that liberalism allegedly grants it. Philip Pettit’s book, Republicanism, provides several arguments to buttress this thesis. This article aims at examining these arguments in order to show that once properly stated, they must on the contrary be considered as powerful arguments to the effect that republicans take rights very seriously.

This research uses a normative approach to examine the relationship between basic income and migration. The decisive variable is the effect of labour automation, which increases economic insecurities globally, leaving some nation states in a position to cope with this and others not. The insecurities will increase migratory pressures on one hand but also justify the introduction of basic income on a nation state level on the other. The normative guideline is the republican conception of freedom as non-domination. This is (...) used to justify a basic income, analyse how labour automation creates dominating structures and how borders dominate migrants seeking to move to countries which introduce a basic income. The result is that nation states that introduce a basic income to counter internal domination through labour automation, also have to look outside of their nation state. The imposition of borders in order to keep a basic income sustainable as well as labour automation itself, establish a form of domination over less developed countries and thus demand international regulation. This article develops a civic republican approach to medical ethics. It outlines civic republican concerns about the domination that arises from subjection to an arbitrary power of interference, while suggesting republican remedies to such domination in healthcare. These include proposals for greater review, challenge and pre-authorisation of medical power. It extends this analysis by providing a civic republican account of assistive arbitrary power, showing how it can create similar problems within both formal and informal relationships of care, and offering strategies (...) for tackling it. Two important objections to civic republican medical ethics—that it overvalues independence and political participation in healthcare—are also considered and rebutted. (shrink)

Freedom and security are often portrayed as things that have to be traded off against one another, but this view does not capture the full complexity of the freedom-security relationship. Rather, there seem to be four different ways in which freedom and security connect to each other: freedom can come at the cost of security, security can come at the cost of freedom, freedom can work to the benefit of security, and security can work to the benefit of freedom. This (...) paper analyses each of these connections in turn. It shows that particular understandings of freedom can help us to see particular connections between freedom and security. The practical examples used to illustrate these connections are drawn from the context of the COVID-19 pandemic. It will be suggested that, in the face of challenges such as this one, taking into account all four connections between freedom and security can ultimately help decision-makers in upholding both. Although ‘virtue’ is a complex idea in Wollstonecraft’s work, one of its senses refers to the capacity and willingness to govern one’s own conduct rationally, and to employ this ability in deliberating about matters of public concern. Wollstonecraft understands virtue to be integral to the meaning of freedom rather than as merely instrumentally useful for its preservation. It follows, therefore, that a free republic must be a virtuous one. The first virtue of social institutions, we might say, is ‘virtue’ itself. (...) In a virtuous republic all citizens, from no matter which social group, are able to represent themselves in law and in public debate. This is a demanding condition, requiring not just suitably robust republican institutions but an open and accommodating public culture in which sufficient numbers of citizens are positively engaged in ensuring that the available stock of background ideas and values is representative, diverse and inclusive. Republicanism is an approach within political theory that seeks to secure the values of political liberty and non-domination. Yet, in historical practice, early modern republics developed empires and secured their liberty through policies that dominated others. This contradiction presents challenges for how neo-Roman theorists understand ideals of liberty and political freedom. This article argues that the historical practices of slavery and empire developed concurrently with the normative ideals of republican liberty. In the biomedical and behavioral sciences, it is widely recognized that researchers conducting studies involving human participants must respect the autonomy of research subjects. There is significant debate in the clinical research ethics and bioethics literatures about what it means for an individual to be autonomous. According to proponents of the Liberal Conception of Autonomy, an autonomous person is an agent who has interests and opinions and the capacity to deliberate about them. In contrast, proponents of the Relational Conception of (...) Autonomy argue that because humans are social creatures, autonomy is a relational concept and ought to be recognized as such by medical professionals. In this article, I argue that the LCA/RCA debate is flawed, and that the notion of freedom as non-domination, rather than autonomy, ought to be adopted for biomedical research ethics policies regarding informed consent and research agenda-setting. Cuando se habla de gestionar la diversidad cultural o de políticas de acomodo y reconocimiento de la diferencia, muchas veces se piensa en modelos comunitaristas donde se pretende afianzar, de manera cerrada y exclusiva, bienes culturales densos o en la dificultad que conlleva aplicar sin matices algunos de los principios del liberalismo en determinados contextos, como son la universalidad o la laicidad rígida. En este trabajo se exploran otras formas de acercarse a este reto de convivir armónicamente en la diversidad (...) cultural, en concreto las de, por una parte, un republicanismo pluralista e inclusivo y, por la otra, el modelo quebequés de integración y gestión de la diversidad cultural conocido como interculturalismo.
