Regardless of leaders’ efforts to do the right thing and meet performance expectations, they make mistakes, with possible ramifications for followers’ and leaders’ well-being. Some leaders will apologize following transgressions, which may have positive implications for their followers’ and their own well-being, contingent upon the nature and severity of the transgressions. We examine these relationships in two separate studies. In Study 1, leader apologies had a positive relationship with followers’ psychological well-being and emotional health, and these relationships were moderated by (...) the severity of the transgression. In Study 2, leader apologies had a positive relationship with their own psychological well-being, positive emotional health and authentic pride. In addition, the nature of transgressions moderated the relationship between leader apologies and leaders’ positive emotions and authentic pride, while the severity of transgressions moderated the relationship between leader apologies and their positive emotions, psychological health, and authentic pride. This empirical investigation showed that contrary to the popular notion that apologies signify weakness, the victims of mistakes made by leaders consistently perceived leaders who apologized as more transformational than those who did not apologize. In a field experiment (Study 1), male referees who were perceived as having apologized for mistakes made officiating hockey games were rated by male coaches (n = 93) as more transformational than when no apology was made. Studies 2 (n = 50) and 3 (n = (...) 224) replicated this effect in two vignette studies to enhance internal and ecological validity. Over the past two decades, a growing number of large multinational corporations have come to view philanthropy as an important part of their business operations. This has stimulated research on the many different strategies that are pursued by these corporations in their attempts to become more philanthropic while remaining economically responsible. In this situation, some researchers have argued, corporations run the risk of being caught out as hypocrites. Through an analysis of the corporate social responsibility reports of the biggest multinational (...) corporations, this article shows how the risk of hypocrisy is managed communicatively through the use of euphemisms. The article argues that the use of euphemisms makes it possible to communicate both economically and philanthropically without manifest contradictions. The purpose of this paper is to consider the question of whether we have a duty to forgive those who repent and apologize for the wrong they have done. I shall argue that we have a pro tanto duty to forgive repentant wrongdoers, and I shall propose and consider the norm of forgiveness. This norm states that if a wrongdoer repents and apologizes to a victim, then the victim has a duty to forgive the wrongdoer, other things being equal. That (...) someone has a pro tanto duty to forgive a repentant wrongdoer means that he or she ought to forgive unless other considerations outweigh the norm of forgiveness. Furthermore, a distinction is made between what are termed 'general considerations' and 'case-relative considerations', and it is argued that only after all the relevant considerations have been examined can it be determined whether there is a duty to forgive, all things considered. This study argues that actions taken during a crisis within the responsibility compass impacts reputation. The lens of responsible leadership was chosen from among the different foci of leadership scholarship because of its emphasis on relational and ethical dimensions. The focus of this study was the actions undertaken by the CEOs of United and Delta Airlines after the forceful removal of the passengers and its influence on the reputation capital as measured by the changes in the respective share prices of (...) the airlines. The overarching question was whether there was clear statistical evidence that linked the actions undertaken as part of the crisis management efforts and the reputation of the airlines. Findings from this study suggest that actions taken as part of responsible leadership compass explained the variations in the share prices. In the case of United Airlines almost 70% of the variations in the share prices could be explained by responsible leadership, whereas in the case Delta airlines only 50.6% of the variations in the share value could be predicted based on the role of leadership in crisis management. Using forgiveness theory, we investigated the effects of organizational apology and restitution on eliciting forgiveness of a transgressing organization after transactional psychological contract breach. Forgiveness theory proposes that victims are more likely to forgive offenders when victims’ positive offender-oriented emotions replace negative ones. Three pre-post laboratory experiments, using vignettes about a broken promise of financial aid, found that while apology-alone and restitution-alone each increased likelihood of forgiving, restitution-alone was the more effective of the two responses. When combined with an apology, (...) restitution boosted the effect of apology-alone. However, restitution was unnecessary if positive emotions replaced negative ones; third-party blame accomplished this negative-to-positive emotion replacement. Consistent with forgiveness theory, offender-oriented negative-to-positive emotion replacement partially mediated all effects, and negative emotion reductions were strongly correlated with positive emotion gains. We discuss implications for the repair of damaged norms and relationships within an organizational community. These include reparative effects of apology and restitution, dual-process conceptions of violation and repair, repair after psychological contract breach, and emotion replacement models of forgiveness. The purpose of this article is threefold: to examine the elements of an artful apology; to sequence them in a comprehensive configuration; and to use the taxonomy for assessing the effect of public apologies. The model identifies seven sequential components of an apology: revelation, recognition, responsiveness, responsibility, remorse, restitution, and reform. Also included in the model are four deflective stratagems: dissociation, diminution, dispersion, and detachment. Analysis focuses on actual offense situations rather than artificial simulated settings. Specifically, the study examines whether (...) seven well-publicized apologies conform to the proposed construct. Abstract: This article examines the uses of official apologies for massive human rights abuses in the context of democratic transitions. It sketches a normative model of apologies, highlighting how they serve to provide some moral and practical redress for past wrongs. It discusses a number of contributions apologies can make, including publicly confirming the status of victims as moral agents, fostering public reexamination and deliberation about social norms, and promoting critical understandings of history that undermine apologist historical accounts. The article (...) then presents certain normative criteria that any official apology must satisfy, and concludes with a discussion of several theoretical and practical challenges that apologies face in transitional contexts. Should we be concerned with, or alarmed or outraged by, the insincerity and hypocrisy of politicians who apologize for historical injustice? This paper argues that the correct reply to this question is: sometimes, but not always. In order to establish what types of insincerity must be avoided, Judith Shklar?s hierarchy of ordinary vices is critically revisited. Against Shklar?s overly benign account of hypocrisy, the paper then tries to demonstrate that only institutional and harmful forms of hypocrisy must be rejected in (...) political apologies for historical injustice. Employing Melissa Nobles? ?membership theory?, this paper defends the claim that the sincerity standard for political apologies is, in stark contrast to apologies between individuals, agent independent. This means that in political apologies, rather than focusing on the remorse and regret of the agent who apologizes, we must primarily examine the apology?s consequences in terms of renegotiating the legal, political and affective dimensions of citizenship. In domestic affairs, the paper shows that apologies can only be considered sincere if they push the polity towards a more inclusive conception of membership in the political community. (shrink)

This paper examines the interactive effects of apology source and apology components on forgiveness. Results revealed a significant source by component interaction. A remorseful employee apology was more successful than a remorseful CEO apology because consumers felt more empathy for the employee. Furthermore, a compensatory CEO apology was more effective than a compensatory employee apology because CEOs could significantly affect consumer perceptions of justice. Using two experiments, I examine how apologizing for fraud influences investor's avoidance and revenge behavior. Investors in experiment one report how many shares they would sell and how likely they would be to pursue legal punishment after discovering fraud has occurred in an organization they are currently invested in and subsequently reading about management's response to the fraud. I manipulate the nature of fraud as fraudulent financial reporting or asset misappropriation. I also manipulate whether management apologizes, scapegoats responsibility, or remains (...) silent after the fraud. Results show avoidance and revenge behavior is more negative after misreporting fraud. Data suggest that this difference may be partially attributable to the underlying moral norm that is violated. Specifically, misreporting is primarily a moral violation of deception, whereas embezzlement is primarily a moral violation of stealing. Results also show differential investor reactions depending on the type of fraud and management's response. For misreporting, revenge behavior is higher when management apologizes, but there is no effect on avoidance behavior. For embezzlement, avoidance behavior is reduced when the organization apologizes, but revenge behavior is unaffected. In experiment two, I replicate the misreporting condition from experiment one and manipulate apology sincerity. Results show that apology sincerity is positively associated with revenge behavior. Results of these two experiments extend both accounting and trust repair research by emphasizing the importance of disentangling moral integrity-based trust violations and that the adage of "just say you're sorry" is helpful in some situations and harmful in others. Recent developments in neuroscience and social science are illuminating the critical importance of regret in human choices, including criminal decision making. After differentiating regret from related emotions (e.g., disappointment, sadness, shame), I argue that regret can prompt desistance from crime and that regret avoidance is a powerful mechanism of conformity. I then turn to American and European penal history to demonstrate that the invention of the prison was premised on the notion that solitary confinement could inculcate regret in prisoners and (...) thereby change them profoundly. The place of regret in both historical and emerging thinking about human choice underscores its importance for understanding the connections between emotions and criminality. (shrink)

In this paper, I first consider three possible explanations for why celebrities typically apologise publicly and sometimes also include their fans among the targets of their apology. I then identify three moral dangers of celebrity apologies, the third of which arises specifically for fan-targeted apologies, and each of which teaches us important lessons about the practice of celebrity apologies. Usually, apologies are made by using non-conditional utterances: “I apologize for ruining your evening!” Very little, if any, attention has been given so far to conditional apologies which typically use utterances such as “If I have ruined your evening, I apologize!” This paper argues that such conditional utterances can constitute genuine apologies and play important moral roles in situations of uncertainty. It also proposes a closer analysis of such conditional apologies and contrasts them with unconditional apologies.

Apology is arguably the central act of the reparative work required after wrongdoing. Claudia Card’s (1940-2015) analysis of complicity in collectively perpetrated evils moves one to ask whether apology ought to be requested of persons culpably complicit in institutional evils. To better appreciate the benefits of and barriers to apologies offered by culpably complicit wrongdoers, this article examines doctors’ complicity in a practice that meets Card’s definition of an evil, namely, the non-medically necessary, nonconsensual “normalizing” interventions performed on babies born (...) with intersex anatomies. It argues that in this instance, the complicity of doctors is culpable on Card’s terms, and that their culpable complicity grounds rightful demands for them to apologize. (shrink)

This article investigates the impact of different emotions on trust decisions taking into account the experience of betrayal. Thus, an experiment was created that included one betrayal group and one control group. Participants in the betrayal group experienced more intense feelings governed by negative emotions than participants in the control group did. Moreover, participants in the betrayal group significantly lowered their trust of another stranger. On the other hand, we found some evidence that neuroticism exaggerated the relationship between experienced betrayal (...) and subsequent trust. (shrink)

This paper aims to explore the feasibility of a restorative justice service in the context of work‐related deaths, specifically in Victoria. Section 1 provides a brief summary of restorative justice and the kind of processes that are most likely to be used in the context of work‐related death. Section 2 discusses an issue for the use of restorative justice in this context that is similar to the problem of whether it is fair or reasonable to assign personal criminal liability for (...) corporate fault. Section 3 looks at what it is that restorative justice can offer a bereaved family. Section 4 presents a range of suggestions as to how restorative justice could be used in this context—informed by real cases wherever possible. Section 5 presents a brief proposal regarding what may be the most effective and efficient strategy or model, in terms of developing a pilot restorative justice service in this area. Section 6 offers some preliminary guidance for a further consultation that would involve all the key stakeholders. (shrink)

What are we to make of the fact that world leaders, such as Canada’s Justin Trudeau, have, within the last few decades, offered official apologies for a whole host of past injustices? Scholars have largely dealt with this phenomenon as a moral question, seeing in these expressions of contrition a radical disruption of contemporary neoliberal individualism, a promise of a more humane world. Focusing on Canadian apology politics, this essay instead proposes a nonideal approach to state apologies, sidestepping questions of (...) what they ought to do and focusing instead on their actual functioning as political acts. Through a sociologically informed speech act theory and Foucault’s work on power, apology is conceptualized as a speech act with an essentially relational nature. The state, through apologizing, reaffirms the norms governing its relationship to its subjects at a moment when a past transgression threatens to destabilize this relation. From a Foucauldian point of view, the state’s power inheres in the very stability of the state–citizen relation, and we should therefore see apologies as defensive moves to protect state hegemony. In the context of Western liberal democracies, such as Canada, apologies embody, rather than challenge, the logic of neoliberal governmentality by suggesting that everything, including resentment against the state, can be managed within the current status quo. Nevertheless, total cynicism about apology politics is not warranted. In many indigenous apology campaigners’ demands for contrition we see another side of apologies: their potential to bring about change by enacting counterhegemonic relations to the state. (shrink)

While the mechanisms of apology, forgiveness and reconciliation receive considerable scru-tiny, little attention has been afforded the non-apology. This counterfeit, confected typically by false substi-tution or mis-direction, adds moral insult to moral wrong. The paper elucidates the normative structural relationship among apologiser, the apologetic disposition, and the apology and defends the view of the non-apology as the pretended willingness to recalibrate the moral positional relationship among apologiser, wronged, and wrong without actually doing so.

This book looks at what it means to be wronged, and why we react to wrongdoing in ways that can cause us more suffering and pain. An alternative approach called 'restorative justice' is proposed as a safe and effective way of avoiding these reactions whilst honouring our values and our common humanity.

Focusing on Australian Prime Minister Kevin Rudd’s 2008 apology to the Stolen Generations, this article asks: can colonial-settler states obtain forgiveness through political apologies? The article first defends Jacques Derrida’s observation that political apologies resemble the Christian practice of confession. In doing so, it subsequently draws on Michel Foucault’s detailed treatise on confession in order to assess the potential for absolution. For Foucault, the process of engaging in exhaustive truth-telling of sin before a demarcated authority provides a route to such (...) atonement. By contrast, any potential unburdening of sin is lost when there is either no adequate authority to coax the confession or if the confession is less than full. The problem for the settler state is that it is predisposed to re-evoking the imaginary of the settler nation and Westphalian sovereignty in the very process of apologising. Consequently, there is no scope to submit before a higher sovereign body and any truth-telling is necessarily partial. As such, the central argument is that forgiveness for the settler state must remain elusive. The political opportunities arising from this for Indigenous peoples are discussed in the final section. Political apologies are commonly imagined as gestures of finality and closure: capstone moments that summate public knowledge. One manifestation of these assumptions is the position that apologies should be timed to come only after appropriate investigation into the wrongdoing has been completed. This article takes a different view, for two reasons. First, even apologies that seem based on robust knowledge can come to seem incomplete or inadequate in the light of subsequent learning and knowledge. Second, because apologies are complexly embedded (...) in longer-term processes of activism and response, they can contribute to their own unravelling by encouraging further consideration and inquiry. We develop these arguments by considering two Canadian cases that illustrate these dynamics: apologies that addressed, respectively, the wartime internment of Japanese Canadians and the policy of forcing Indigenous children to attend residential schools. This article is the first exploration of the Chinese notion of apology from a comparative legal perspective. By reviewing the significance of apology in the context of Chinese culture, the article presents a three-dimensional structure of apology that, in contrast to the understanding the research community now has, defines acknowledgement of fault, admission of responsibility, and offer of reparation as three essential elements of an apology. It is the combination of these three elements that enables apology to serve as a (...) form of reparation. The article further places the three-dimensional apology in the context of the Chinese concept of “the relations of humanity,” arguing that an apology accompanying admission of fault and responsibility may help to restore the harmony of relations and, by so doing, resolve medical disputes positively. Forgiveness seeking after a relational transgression is an important aspect of relational repair from an interpersonal perspective, although it has received much less attention than the process of granting forgiveness. This research focuses on the victim's perspective of the transgressor's behaviors and how they are related to forgiveness and offense characteristics. This paper proposes a multidimensional concept of seeking forgiveness that includes four dimensions: apologies, restorative action, relational caring behaviors, and diverting behaviors. A questionnaire for assessing these dimensions was developed (...) and tested with a general population sample of 450 subjects. Participants recalled a specific offense and then answered a questionnaire about the perceived usefulness of different forgiveness-seeking behaviors, a forgiveness inventory, and several questions regarding the characteristics of the offense. Our results support the four-factor structure of the questionnaire. As the perceived intentionality of the offense increases, behaviors that are directly related to the transgression, such as apologies and restorative actions, are experienced as less useful for forgiveness. The more hurtful the offense, the less useful the diverting behaviors are. Behavior such as apologies and restorative action are related to a lower motivation for revenge, while all forgiveness-seeking behaviors are related to an increase in feelings of benevolence toward the offender. The issue of apologising to patients harmed by adverse events has been a subject of interest and debate within medicine, politics, and the law since the early 1980s. Although apology serves several important social roles, including recognising the victims of harm, providing an opportunity for redress, and repairing relationships, compelled apologies ring hollow and ultimately undermine these goals. Apologies that stem from external authorities’ edicts rather than an offender’s own self-criticism and moral reflection are inauthentic and contribute to a “moral (...) flabbiness” that stunts the moral development of both individual providers and the medical profession. Following a discussion of a recent case from New Zealand in which a midwife was required to apologise not only to the parents but also to the baby, it is argued that rather than requiring health care providers to apologise, authorities should instead train, foster, and support the capacity of providers to apologise voluntarily. This paper critically revisits the A-bomb victims’ plea for cosmopolitan commemoration that takes humanity, rather than nationality, as a primary frame of reference. To this end, I first elaborate the nature of cosmopolitan commemoration espoused by A-bomb victims in Hiroshima and Nagasaki in comparison with another form of cosmopolitan commemoration pertaining to the Holocaust victims. I then analyze limitations in these cosmopolitan commemorations and explore how they can be transcended. In light of my critical analysis, I argue that genuinely cosmopolitan (...) commemoration, a prerequisite for reconciliation and world peace, will appear on the horizon if the commemorations of the two events are synthesized with the help of ‘historians’ debate’ that continuously subjects the logic of nationalism to critical reflections. This synthesis has the potential to help people envision cosmopolitan politics – cosmopolitics – where they can engage in peaceful but agonistic struggles, not as enemies but as fellow humans, in collectively governing their lives in today’s war-torn world. The offender who desires to restore or maintain a relationship after a conflict apologises to his or her victim. Not only an individual but also a group can make apology. Groups do it through their representatives who are recognised as such by both sides. Sometimes offenders acknowledge wrongdoing and express regret for it. At other times while apologising, they may also ask for forgiveness. Does apology without a request for forgiveness mean the same as apology with such a request? Are (...) there any cases where apology may be appropriate, but not a request for forgiveness? Do those who apologise without asking for forgiveness really not want to be forgiven? This article answers these questions by exploring the notion of apology and its relation to forgiveness. (shrink)

Different ethical frameworks have been proposed as appropriate for integrating into crisis management strategies. This study examines an ethic of care approach to crisis management analysing the case of Northern Rock bank which was at the centre of the recent financial crisis in the UK. The development and maintenance of relationships is fundamental to an ethic of care approach and the research recognises this by examining the bank–stakeholder relationship both before and after the crisis. Considerable anger was directed at the (...) bank post-crisis and, subsequently, the management team resigned. An important contention is that because an ethic of care approach had not been followed external parties judged that management should have foreseen the crisis and the harm caused was deemed intentional, even though predicting the crisis would have been difficult and it is improbable any harm was intended. Additionally, this negative reaction was heightened due to three facets of Northern Rock’s history: (i) its previous existence as a building society, (ii) the ‘local’ nature of the bank and (iii) the creation of The Northern Rock Foundation. These historical factors caused local stakeholders to presume a ‘caring’ relationship between themselves, and the bank had continued to exist post-demutualisation. The events of the crisis compelled stakeholders to re-appraise this presumption, amplifying the post-crisis anger. (shrink)

그동안 많은 전문서적을 출간한 경험을 가지고 있지만, 이번 출간하는 법과 생활은 생활 현장에서 느낀 바를 진솔하게 담고 있어 독자들이 쉽게 읽을 수 있게 하였다. 항상 법이 무엇인가를 생각하면서 단조로운 일상을 살아야 하는 변호사, 법학교수로서, 우리 주변의 이야기는 빈곤한 사고의 저변을 넓혀 준다. 조선대학교 법사회대학에서 학생들을 가르치는 백면서생이지만, 서울과 광주를 오가면서 한국 사회를 객관적으로 바라볼 수 있는 시간을 가질 수 있었던 것은 본서 출간을 가능하게 한 동인이었다. 본 서는 정밀한 법이론이나 사례 분석, 또는 판례에 대한 학술적 비평을 담고 있지 않다. 다만 (...) 지난 수년간 느껴온 바를 일상의 시간에 연결한 천학비재한 한 법학도의 단상과 에세이 모음집이라 할 수 있다. 페이스북을 통하여 발표된 글들을 정리하여 학술적 외관을 씌운 부끄러운 졸작이다. 그러나 저자로서 작은 소망이 있다면, 그것은 독자들이 함께 살아 온 시간들을 반추하면서, 민주주의와 법치주의의 가치를 조금이라도 음미할 수 있었으면 하는 것이다. 법을 공부하고 법을 가르치는 법학도나 법학 교수, 그리고 현실 사회에서 법과 정의를 구현하기 위하여 묵묵히 자신의 책무를 수행하는 일선 법률가들을 생각하며 조금이라도 도움이 될 수 있는 글을 써 보겠다는 마음으로 페북에 글을 올리기 시작한지 어언 5년 가까이 되고 있다. 우리 법률전문가들은 세상의 진실에 눈을 감고 진리를 왜곡하는 곡학아세의 길을 걷는 것을 항상 경계하여야 한다. 특히 좌우 정치가 자리를 잡아가면서 법률가들 마저 파벌을 이루어 법을 생각하기 앞서 자파의 이익을 생각하는 현실을 부인하기 어렵다. 이는 우리에게 양심의 회복을 질책한다. 무매한 민중을 호도하고 국가의 (...) 기강이자 바른 초석이어야 할 법과 법지식을 우롱하는 것이라 아니할 수 없다. 이는 민주주의와 함께 우뚝 서야 할 법치주의를 갉아 먹는 행태라 아니할 수 없다. 조심스러운 마음에서 같이 공부하여야겠다는 생각으로 ‘인간과 사회 그리고 법에 관한 성찰’이라는 제목으로 책을 출간하기로 마음 먹었다. 본서는 한 법률과목을 전문적으로 다루었다거나, 법이론이나 법해석학 관련 주제를 체계적으로 다룬 서적이 아니다. 그렇다고 법 실무에 도움이 될 수 있는 구체적이고 실무적인 문제를 다루고 있는 것도 아니다. 본서는 우리의 일상을 기반으로 법에 관한 단상, 그리고 관련되는 이론들을 생각나는대로 기술한 책이다. 변호사. 법률가. 법학교수, 법학도 등이 제 1차로 독자가 될 수 있을 것이지만, 그 밖에 인간, 사회, 법에 관심 있는 시민 모두가 즐겁게 읽을 수 있도록 엮으려고 노력하였다. 천학비재한 주제에도 화광동진(和光同塵)의 심정으로 출간에 나아가면서 감히 일독을 권하는 바이다. Within Alberta Health Services, the Alberta Provincial Patient Relations Department employs Patient Relations Consultants to assist unsatisfied patients, investigate healthcare related concerns, and facilitate resolution. The patients, who are referred to as complainants, interpret their experience and come forward with their complaint; the PRC is responsible to then interpret the complaint and take it forward for redress. In doing so, offering complainants an apology is unavoidable. Patient relations is an interpretive practice, however, and there are shortcomings when apology is inserted (...) into the conversation. In this article, I deconstruct apology from a patient relations perspective. I draw upon concepts in Richard Kearney’s Strangers, Gods and Monsters, as well as the work of Hans-Georg Gadamer and Jacques Derrida, to present an interpretive account of how the hospital is a host to strangers, and to patients. Following an unsatisfactory experience or adverse event, the patients become complainants, or monsters. The PRCs, who are also considered hosts, receive the monsters at their door and, in turn, they can become hostages to the monsters. In the field of Conflict Transformation, Restorative Justice is often perceived as a transformative process focused on healing relationships after a specific harm. The parties considered in a RJ setting are those harmed, those responsible and the community impacted. This is particularly true in the field of criminal and transitional justice, and in an extended and spiritual view, there is reconciliation with the parties and God. Despite cultural differences, RJ theory and concepts have been accepted favorably in the many countries. (...) From a viewpoint focused on methodology and process, however, cultural differences have a significant effect for implementation. For example, important concepts such as control, choice, harm, responsibility, apology, shame, reconciliation and forgiveness vary greatly in the manner in which they are perceived from culture to culture and may create obstacles for successful implementation of a successful process when one culture’s process and definitions are forced upon another. Therefore, promotional factors and the implication of semiotics are an absolute consideration in developing a RJ process within a particular culture. This paper discusses the cultural differences between the United States and Japan with regard to semiotic obstacles in the implementation of a RJ model in the Japanese criminal justice system. While the exploration of cultural differences, particularly between the United States and Japan is not new and has been the focus of many disciplines, little has been considered regarding the assimilation and implementation of a Western RJ model into the Eastern culture of Japan. In sum, is an attempt to clarify and integrate the effects of cultural differences for some factors as they apply to a RJ based reconciliation process focused in Semiotics, Social psychology and the Sociology of law as they apply to the United States and Japan.
