The form of representation cannot be fully described, as Wittgenstein noted. This is because there is a non-linguistic component in the representation of truth that aesthetic experience shows us. It is the self-represented exemplar of conscious experience. On this basis, the author defends empiricism against the objection that all representation of experience is subject to error.

Many epistemologists have responded to the lottery paradox by proposing formal rules according to which high probability defeasibly warrants acceptance. Douven and Williamson present an ingenious argument purporting to show that such rules invariably trivialise, in that they reduce to the claim that a probability of 1 warrants acceptance. Douven and Williamson’s argument does, however, rest upon significant assumptions – amongst them a relatively strong structural assumption to the effect that the underlying probability space is both finite and uniform. In (...) this paper, I will show that something very like Douven and Williamson’s argument can in fact survive with much weaker structural assumptions – and, in particular, can apply to infinite probability spaces. Consequentialist positions in philosophy spell out normative notions by recourse to final aims. Hedonistic versions of ETHICAL consequentialism spell out what is MORALLY right/justified via recourse to the aim of increasing pleasure and decreasing pain. Veritistic versions of EPISTEMIC consequentialism spell out what is EPISTEMICALLY right/justified via recourse to the aim of increasing the number of true beliefs and decreasing the number of false ones. Even though these theories are in many respects structurally analogous, there are also interesting disanalogies. For (...) example, popular versions of epistemic consequentialism implicitly endorse the truth-indication principle (which claims that a belief is epistemically justified only if there are factors indicating that the belief itself is true), whereas popular versions of ethical consequentialism do not subscribe to an analogous pleasure-indicating principle (which claims that an act is morally justified only if there are factors indicating that performing the act itself is pleasurable). In a first step I will argue that this difference rests on the fact that plausible versions of epistemic consequentialism have to meet certain constraints, which versions of ethical consequentialism do not have to satisfy. As these constraints can be easily met by incorporating the truth-indication principle, epistemic consequentialists tend to subscribe to it. In a second step I will investigate whether the identified constraints can also be met independent from the truth-indication principle. Are there plausible versions of veritistic epistemic consequentialism that reject the principle, thereby allowing that some beliefs can be epistemically justified even though no factors speak in favor of their truth? Building on ideas put forward by Ludwig Wittgenstein, Crispin Wright, and others, I will answer this question affirmatively. (shrink)

It is a theory about the nature of the law which emphasises the role of reason in the law and which refuses to limit the role of reason to the application of deductive logic. (...) In 1989, when the first edition of On Law and Reason appeared, this book was ground breaking for several reasons. It provided a rationalistic theory of the law in the language of analytic philosophy and based on a thorough understanding of the results, including technical ones, of analytic philosophy. That was not an obvious combination at the time of the booka (TM)s first appearance and still is not. The result is an analytical rigor that is usually associated with positivist theories of the law, combined with a philosophical position that is not natural law in a strict sense, but which shares with it the emphasis on the role of reason in determining what the law is. If only for this rare combination, On Law and Reason still deserves careful study. On Law and Reason also foreshadowed and influenced a development in the field of Legal Logic that would take place in the nineties of the 20th century, namely the development of non-monotonic (a defeasiblea (TM)) logics for the analysis of legal reasoning. The growing literature on philosophical thought experiments has so far focused almost exclusively on the role of thought experiments in confirming or refuting philosophical hypotheses or theories. In this paper we draw attention to an additional and largely ignored role that thought experiments frequently play in our philosophical practice: some thought experiments do not merely serve as means for testing various philosophical hypotheses or theories, but also serve as facilitators for conceiving and articulating new ones. As we will put it, (...) they serve as ‘heuristics for theory discovery’. Our purpose in the paper is two-fold: to make a case that this additional role of thought experiments deserves the attention of philosophers interested in the methodology of philosophy; to sketch a tentative taxonomy of a number of distinct ways in which philosophical thought experiments can aid theory discovery, which can guide future research on this role of thought experiments. Knowledge is widely thought to entail belief. But Radford has claimed to offer a counterexample: the case of the unconfident examinee. And Myers-Schulz and Schwitzgebel have claimed empirical vindication of Radford. We argue, in defense of orthodoxy, that the unconfident examinee does indeed have belief, in the epistemically relevant sense of dispositional belief. We buttress this with empirical results showing that when the dispositional conception of belief is specifically elicited, people’s intuitions then conform with the view that knowledge entails (dispositional) (...) belief. In his 1993 article George Bealer offers three separate arguments that are directed against the internal coherence of empiricism, specifically against Quine’s version of empiricism. One of these arguments is the starting points argument (SPA) and it is supposed to show that Quinean empiricism is incoherent. We argue here that this argument is deeply flawed, and we demonstrate how a Quinean may successfully defend his views against Bealer’s SPA. Our defense of Quinean empiricism against the SPA depends on showing (1) (...) that Bealer is, in an important sense, a foundationalist, and (2) that Quine is, in an important sense, a coherentist. Having established these two contentions we show that Bealer’s SPA begs the question against Quinean empiricists. (shrink)

Evidentialism says that a subject S’s justification is entirely determined by S’s evidence. The plausibility of evidentialism depends on what kind of entities constitute a subject S’s evidence and what one takes the support relation to consist in. Conee and Feldman’s mainstream evidentialism incorporates a psychologist answer to and an explanationist answer to. ME naturally accommodates perceptual justification. However, it does not accommodate intuitive cases of inferential justification. Once upon a time, coherentism was the dominant response to the regress problem in epistemology, but in recent decades the view has fallen into disrepute: now almost everyone is a foundationalist (with a few infinitists sprinkled here and there). In this paper, I sketch a new way of thinking about coherentism, and show how it avoids many of the problems often thought fatal for the view, including the isolation objection, worries over circularity, and concerns that the concept of coherence is (...) too vague or metaphorical for serious theoretical use. The key to my approach is to take a familiar tool from discussions of the regress problem -- namely, directed graphs depicting the support relations between beliefs -- and to use that tool in a more sophisticated manner than it is standardly employed. One reasonably familiar argument for epistemological scepticism maintains that knowledge requires foundations and that we rarely, if ever, have such foundations. The conclusion of this argument is that we rarely, if ever, have knowledge. A second, less ambitious sceptical argument is that philosophers cannot justifiably say that they have knowledge unless their statement is based on foundations and that we never have such foundations. The conclusion of this argument is not that we never have knowledge, but that philosophers are never (...) justified in saying that they have knowledge. The scepticism is Pyrrhonic, rather than Academic, and merely attempts to counter knowledge assertions, not establish that they are false. It tries to show that in most cases the best response we can give to ‘Do we have knowledge?’ is to remain indifferent. (shrink)

This paper explains the nature and role of common sense in Reid and uses the exposition to answer some of Reid's critics. The key to defending Reid is to distinguish between two kinds of priority that common sense beliefs are supposed to enjoy. Common sense beliefs enjoy epistemological priority in that they constitute a foundation for knowledge; i.e. they have evidential status without being grounded in further evidence themselves. Common sense beliefs enjoy methodological priority in that they constrain philosophical theory: (...) they serve as pre-theoretical commitments that philosophical theories ought to respect in the absence of good reasons for rejecting them. I show that it follows from both externalist and internalist theories that stupid people may be in a better position to know than smart ones. This untoward consequence results from taking our epistemic goal to be accepting as many truths as possible and rejecting as many falsehoods as possible, combined with a recognition that the standard for acceptability cannot be set too high, else scepticism will prevail. After showing how causal, reliabilist, and coherentist theories devalue intelligence, I suggest that knowledge, (...) as contemporary theories construe it, is not a particularly valuable cognitive achievement, and that we would do well to reopen epistemology to the study of cognitive excellences of all sorts. This volume contains 12 papers addressed to researchers and advanced students in informal logic and related fields, such as argumentation, formal logic, and communications. Among the issues discussed are attempts to rethink the nature of argument and of inference, the role of dialectical context, and the standards for evaluating inferences, and to shed light on the interfaces between informal logic and argumentation theory, rhetoric, formal logic and cognitive psychology.

The dissertation examines the nature and epistemic implications of epistemic source circularity. An argument exhibits this type of circularity when at least one of the premises is produced by a belief source the conclusion says is legitimate, e.g. a track record argument for the legitimacy of sense perception that uses premises produced by sense perception. In chapter one I examine this and several other types of circularity, identifying relevant similarities and differences between them. In chapter two I discuss the differences (...) between internalist and externalist analyses of justification. I examine in detail foundationalist and non-foundationalist versions of internalism, and go on to consider how one might characterize externalism: either negatively, by denying particular internalist theses, or positively, in terms of a theory offering different conditions for justification. I discuss the views of reliabilist foundationalists at length. In chapter three I present the internalist objection to externalism that the latter mistakenly permit one to be justified in believing the conclusion of an epistemic source circular inference. I explain the externalists' response that it is not in virtue of their externalism that they permit epistemic source circularity but rather their foundationalism; thus, internalist foundationalists must permit epistemic source circularity as well. I evaluate the positions of several internalists, most of them explicitly foundationalists, and argue that they too cannot avoid permitting epistemic source circularity. In the final chapter I consider whether such circularity is vicious, even though both internalist and externalist foundationalists permit it. I argue that one can sustain an objection to epistemic source circularity by imposing a non-question-begging requirement on justification and explain how respecting this requirement leads one to a non-foundationalist view. I conclude by considering the objection that question-begging leads to a certain arbitrariness in belief formation that should give the foundationalist pause when it comes to determining, at the beginning of inquiry, which beliefs are justified and which are not. The dissertation is primarily concerned with making clear the possible skeptical and non-skeptical positions one can take towards epistemic source circularity. Reflective equilibrium has been considered a paradigm method involving intuitions. Some philosophers have recently claimed that it is trivial and can even accommodate the sort of scepticism about the reliability of intuitions advocated by experimental philosophers. I discuss several ways in which reflective equilibrium could be thought of as trivial and argue that it is inconsistent with scepticism about the reliability of intuitions.

Traditional accounts of justification can be characterized as trying to analyze justification in such a way that having a justified belief brings with it assurance of truth. The internalist offers a demanding requirement on justification: one's having a justified belief requires that one see what the belief has going for it. Externalists worry that the internalist's narrow conception of justification will lead to unacceptably radical and implausible skepticism. According to the externalist, one need not know what a belief has going (...) for it in order for that belief to be justified. Externalism, though, comes with its own problems. Ernest Sosa has attempted to bridge the divide between internalism and externalism by pairing the strengths of internalism with the strengths of externalism. Sosa distinguishes two kinds of knowledge: animal knowledge that is essentially externalist in character and reflective knowledge that is intended to capture our best intellectual procedure in regards to knowledge. On Sosa's view, one gains reflective knowledge by building upon animal knowledge. As a result, Sosa's view seems to illustrate a bottom-up approach to the analysis of knowledge : reflective knowledge is the result of animal knowledge and some other epistemic factor. My project, in contrast to Sosa's, is to argue that one should start with an account of ideal justification and then proceed by loosening the standards on ideal justification in an effort to develop the possibility of non- ideal kinds of justification. The view that I will develop will adopt Sosa's strategy of distinguishing kinds of knowledge, but will result in a top-down approach to the analysis of justification. Instead of starting with an undemanding standard and layer levels on top, I will start with an ideal standard and strip layers away. I will also argue that my view has some important advantages over Sosa's. Not only does Sosa's view seem to run into many of the problems that threaten externalism, but his view is incapable of offering the kind of assurance that the internalist is after. The view I develop will maintain the internalist's interest in assurance while also providing a response to some of the skeptical problems that have plagued internalists. If my project is successful, then, even if the justification that results in many of the cases I will be exploring is not ideal, we can use these conceptions of justification to help explicate how one might have justified beliefs about a great number of things. The essentially internalist account that I have offered will not only illustrate a serious approach to dealing with skepticism, but it will also capture how many of our commonsensically justified beliefs are in fact justified.
