This article aims to study the intersection between critical realism and complexity theories through the existing literature on complex systems via an engagement with Luhmann’s autopoiesis. With reference to the philosophies of substance and persistence, I build on previous critical realist scholarship and provide an explanation for what the literature has only noted as the limitations and potentials of autopoiesis for complex systems thinking and its compatibility with Critical Realism. By highlighting how Luhmann’s autopoiesis is not a trans-immanent/ perdurantist-exdurantist system, (...) I show first how a trans immanent system through the method of calibration entails a complex causation involving objects in the environment of systems and not just within their boundaries. Second, I explain how a trans-immanent system fits with CR via the Morphogenetic Régulation framework by exploring the theme of crisis in terms of the movement from inadequate to adequate understanding of objects. The Politics of Orientation provides the first substantial exploration of a surprising theoretical kinship and its rich political implications, between Gilles Deleuze's philosophy and the sociological systems theory of Niklas Luhmann. Through their shared theories of sense, Hannah Richter draws out how the works of Luhmann and Deleuze complement each other in creating worlds where chaos is the norm and order the unlikely and yet remarkably stable exception. From the encounter between Deleuze and Luhmann, Richter develops a novel take on (...) postfoundational ontology where subjects and societies unfold in self-productive relations of sense against a background of complexity. The Politics of Orientation breaks and rebuilds theoretical alliances by reading core concepts and thinkers of Continental Philosophy, from Leibniz to Whitehead and Marx, through this encounter. Most importantly, the book puts Luhmann and Deleuze to work to offer urgently needed insight into the rise of post-truth populism. The main goal of this article is to use the epistemological framework of a specific version of Cognitive Constructivism to address Piaget’s central problem of knowledge construction, namely, the re-equilibration of cognitive structures. The distinctive objective character of this constructivist framework is supported by formal inference methods of Bayesian statistics, and is based on Heinz von Foerster’s fundamental metaphor of objects as tokens for eigen-solutions. This epistemological perspective is illustrated using some episodes in the history of chemistry concerning the definition (...) or identification of chemical elements. In this paper epistemological, ontological and sociological questions concerning the statistical significance of sharp hypotheses in scientific research are investigated within the framework provided by Cognitive Constructivism and the FBST (Full Bayesian Significance Test). The constructivist framework is contrasted with the traditional epistemological settings for orthodox Bayesian and frequentist statistics provided by Decision Theory and Falsificationism.

Growing ecological problems have raised the need for conceptual tools dedicated to studying semiotic processes in cultural-ecological systems. Departing from both ecosemiotics and cultural semiotics, the concept of an ecosemiosphere is proposed to denote the entire complex of semiosis in an ecosystem, including the involvement of human cultural semiosis. More specifically, the ecosemiosphere is a semiotic system comprising all species and their umwelts, alongside the diverse semiotic relations (including humans with their culture) that they have in the given ecosystem, and (...) also the material supporting structures that enable the ecosemiosphere to thrive. Drawing parallels with Juri Lotman’s semiosphere concept, the ecosemiosphere is characterized by its heterogeneity, asymmetry, and boundedness. But unlike Lotman’s concept, the ecosemiosphere is not characterized by an overall boundedness, that is, by the presence of external binary boundaries and the shared identity arising from this unity. The involvement of human culture in the ecosemiosphere manifests in interspecies dialogues and semiotic engagements. We need to scrutinize what affordances and semiotic resources culture could offer to nonhuman species and how culture could, by semiotic means, raise the integrity, stability, and resiliency of the ecosystem. The recent drastic development of agriculture, together with the growing societal interest in agricultural practices and their consequences, pose a challenge to agricultural science. There is a need for rethinking the general methodology of agricultural research. This paper takes some steps towards developing a systemic research methodology that can meet this challenge – a general self-reflexive methodology that forms a basis for doing holistic or (with a better term) wholeness-oriented research and provides appropriate criteria of scientific quality.From a philosophy of (...) research perspective,science is seen as an interactive learning process with both a cognitive and a social communicative aspect. This means, first of all,that science plays a role in the world that it studies. A science that influences its own subject area, such as agricultural science, is named a systemic science. From this perspective, there is a need to reconsider the role of values in science. Science is not objective in the sense of being value-free.Values play, and ought to play, an important role in science – not only in form of constitutive values such as the norms of good science, but also in the form of contextual values that enter into the very process of science. This goes against the traditional criterion of objectivity. Therefore, reflexive objectivity is suggested as a new criterion for doing good science, along with the criterion of relevance. Reflexive objectivity implies that the communication of science must include the cognitive context, which comprises the societal,intentional, and observational context. Ina ccordance with this, the learning process of systemic research is shown as a self-reflexive cycle that incorporates both an involved actor stance and a detached observer stance. The observer stance forms the basis for scientific communication.To this point, a unitary view of science as a learning process is employed. A second important perspective for a systemic research methodology is the relation between the actual,different, and often quite separate kinds of science. Cross-disciplinary research is hampered by the idea that reductive science is more objective, and hence more scientific, than the less reductive sciences of complex subject areas – and by the opposite idea that reductive science is necessarily reductionistic. Taking reflexive objectivity as a demarcator of good science, an inclusive framework of science can be established. The framework does not take the established division between natural, social, and human science as a primary distinction of science.The major distinction is made between the empirical and normative aspects of science,corresponding to two key cognitive interests.Two general methodological dimensions, the degree of reduction of the research world and the degree of involvement in the research world, are shown to span this framework. The framework can form a basis for transdisciplinary work by way of showing the relation between more and less reductive kinds of science and between more detached and more involved kinds of science and exposing the abilities and limitations attendant on these methodological differences. Context: The problems that are most in need of interdisciplinary collaboration are “wicked problems,” such as food crises, climate change mitigation, and sustainable development, with many relevant aspects, disagreement on what the problem is, and contradicting solutions. Such complex problems both require and challenge interdisciplinarity. Problem: The conventional methods of interdisciplinary research fall short in the case of wicked problems because they remain first-order science. Our aim is to present workable methods and research designs for doing second-order science in domains (...) where there are many different scientific knowledges on any complex problem. Method: We synthesize and elaborate a framework for second-order science in interdisciplinary research based on a number of earlier publications, experiences from large interdisciplinary research projects, and a perspectivist theory of science. Results: The second-order polyocular framework for interdisciplinary research is characterized by five principles. Second-order science of interdisciplinary research must: 1. draw on the observations of first-order perspectives, 2. address a shared dynamical object, 3. establish a shared problem, 4. rely on first-order perspectives to see themselves as perspectives, and 5. be based on other rules than first-order research. Implications: The perspectivist insights of second-order science provide a new way of understanding interdisciplinary research that leads to new polyocular methods and research designs. It also points to more reflexive ways of dealing with scientific expertise in democratic processes. The main challenge is that this is a paradigmatic shift, which demands that the involved disciplines, at least to some degree, subscribe to a perspectivist view. Constructivist content: Our perspectivist approach to science is based on the second-order cybernetics and systems theories of von Foerster, Maruyama, Maturana & Varela, and Luhmann, coupled with embodied theories of cognition and semiotics as a general theory of meaning from von Uexküll and Peirce. Over the past decades, the modernization of agriculture in the Western world has contributed not only to a rapid increase in food production but also to environmental and societal concerns over issues such as greenhouse gas emissions, soil quality and biodiversity loss. Many of these concerns, for example those related to animal welfare or labor conditions, are stuck in controversies and apparently deadlocked debates. As a result we observe a paradox in which a wide range of corporate social responsibility initiatives, (...) originally seeking to reconnect agriculture and society, frequently provoke debate, conflict, and protests. In order to make sense of this pattern, the present paper contends that Western agriculture is marked by moral complexity, i.e., the tendency of multiple legitimate moral standpoints to proliferate without the realistic prospect of a consensus. This contention is buttressed by a conceptual framework that draws inspiration the contemporary business ethics and systems-theoretic scholarship. From the systems-theoretic point of view, the evolution of moral complexity is traced back to the processes of agricultural modernization, specialization, and differentiation, each of which suppresses the responsiveness of the economic and legal institutions to the full range of societal and environmental concerns about agriculture. From the business ethics point of view, moral complexity is shown to prevent the transformation of the ethical responsibilities into the legal and economic responsibilities despite the ongoing institutionalization of CSR. Navigating moral complexity is shown to require moral judgments which are necessarily personal and contestable. These judgments are implicated in those CSR initiatives that require dealing with trade-offs among the different sustainability issues. (shrink)

This article engages the French pragmatism of Laurent Thévenot, Luc Boltanski and Bruno Latour in debates on how to forge a moral-political sociology of ecological valuation, justification and critique. Picking up the debate initiated by Thévenot on the possible emergence of a novel ‘green’ order of worth, the article juxtaposes the sociology of critical capacity of Boltanski and Thévenot with the actor-network theory of Bruno Latour. In doing so, the article suggests that each of these three pragmatic sociologists succeeds, in (...) characteristically different ways, in theoretically articulating an important but partial socio-political grammar of ecological worth. This claim is substantiated by invoking three case studies into environmental critique and compromise, on transnational carbon markets, urban sustainability projects, and Japanese whaling, respectively. Against this backdrop, the article concludes that – when read together as grammarians of the ecological bond – pragmatic sociology provides important insights into the bounded multiplicity of nature’s worth in political modernity. In 1985, German sociologist Niklas Luhmann published a monograph on ecology, which appeared in English translation in 1989 as Ecological Communication. It contained many original insights for ecological thinking and, despite being well-reviewed upon publication, has had a relatively minor impact on Anglophone environmental discourse. This inattention is also present in environmental law, which has recently seen an increase in legal theories that challenge its mainstream. This contribution first investigates why Ecological Communication has received scant attention, pointing to changes in (...) the climatic context in which it first appeared and the reactionary nature of its arguments. Recognising that the work nevertheless contains critical theoretical insights for environmental law scholarship, the second aim of the article is to spotlight what from Ecological Communication remains relevant at the hand of three common claims progressive researchers level against mainstream environmental law: The critique of law's marriage to Cartesian dualism, that law should be better informed by climate science,of and law's anthropocentrism. Finally, environmental lawyers are called upon not to ignore Ecological Communication but to engage with it fruitfully. (shrink)

The theory of autopoiesis, that is systems that are self-producing or self-constructing, was originally developed to explain the particular nature of living as opposed to non-living entities. It was subsequently enlarged to encompass cognition and language leading to what is known as second-order cybernetics. However, as with earlier biological theories, many authors have tried to extend the domain of the theory to encompass social systems, the most notable being Luhmann. The pur-pose of this paper is to consider critically the extent (...) to which the theory of autopoiesis, as originally defined, can be applied to social systems-that is, whether social systems are autopoietic. And, if it cannot, whether some weaker version might be appropriate. It addresses this question by considering whether autopoiesis can be applied to the theoretical conceptions of Giddens and Bhaskar. This study is an attempt to analyze the factors that have contributed towards the success of the Democratic Party of Albania. It seeks to introduce new dimensions in measuring the success of a political party. The study rejects the elements of ‘office-holding’ and ‘policy – or performance-based’ measures of success, because they are determined by a complex array of economic, political, social and institutional factors. The concept of “party success” is defined in terms of: ‘breadth’ and ‘durability’. At the same (...) time the study aims at ‘emancipating’ the political parties from the past and macro-institutional factors, to which very often are ascribed the reasons for the perceived failure of politics in Albania. The approach used in this study has regarded the political parties as the real political actors that as such should assume the responsibility for the perceived failures. Neither the lack of political culture, nor the communist system, are the main factors to shape the activity and development of political parties in Albania. Both macro-institutional and historical structural approach has limited explanatory power for the success of the Democratic Party. Its success is a direct consequence of the decisions that the political parties themselves, including Democratic Party as one of the key actors, have taken. The research showed that the Democratic Party of Albania has been successful because and when its elite have been able to craft inclusive ideological programs and because of its extensive penetration in the country, which it owes to its structure as a mass party. The party has established patronage linkages with its sympathizers, the rank and file and militants and consequently has ensured their loyalty and maintained an extensive electoral penetration in country. The present paper builds on the Rawlsian critique of utilitarianism in order to identify the moral implications of Niklas Luhmann’s social systems theory. While Luhmann aptly discerned the pervasive problems of the precarious system–environment relations throughout the modern society, he took moral communication to be person-centered and thus ill-equipped to deal with these problems. At the same time, the Rawlsian possibility of sacrificing fundamental liberties for the sake of economic gains not only exemplifies the Luhmannian precariousness of the relations of (...) the economic system to its societal environment, but also shows this precariousness to be a moral problem. Thus, from the systems-theoretic perspective, the Rawlsian idea of justice denotes the moral dimension of the capacity of the societal environment to carry the economic system. More generally, the proposed complementarity between Rawls and Luhmann allows to see the precariousness of system–environment relations, for any type of social system, as a moral problem. Two implications follow. First, the morally problematic manifestations of the precarious system–environment relations are not limited to the Rawlsian case of the discrimination of the least advantaged groups but rather include a broad range of social costs and damaging effects of business on society and nature. Second, and related, the proposed systems-theoretic perspective explicates the moral value of sustainability of the economic as well as other social systems in their environment, societal and ecological alike. In this article, the author argues that complexity theories have limited use in the study of society, and that social processes are too complex and particular to be rigorously modeled in complexity terms. Theories of social complexity are shown to be inadequately developed, and typical weaknesses in the literature on social complexity are discussed. Two stronger analyses, of Luhmann and of Harvey and Reed, are also critically considered. New considerations regarding social complexity are advanced, on the lines that simplicity, complexity (...) that can be modeled, and incondensible complexity permeate society simultaneously. The difficulty of establishing complexity models for processes involving ongoing interpretation is discussed. It is argued that the notions of system and environment need recasting in social studies. Existing social studies and literature, it is argued, reflect a polymorphous, contextual, contingent, labyrinthine, dramatic and political face to social complexity. Context: Society is faced with “wicked” problems of environmental sustainability, which are inherently multiperspectival, and there is a need for explicitly constructivist and perspectivist theories to address them. Problem: However, different constructivist theories construe the environment in different ways. The aim of this paper is to clarify the conceptions of environment in constructivist approaches, and thereby to assist the sciences of complex systems and complex environmental problems. Method: We describe the terms used for “the environment” in von Uexküll, Maturana & (...) Varela, and Luhmann, and analyse how their conceptions of environment are connected to differences of perspective and observation. Results: We show the need to distinguish between inside and outside perspectives on the environment, and identify two very different and complementary logics of observation, the logic of distinction and the logic of representation, in the three constructivist theories. Implications: Luhmann’s theory of social systems can be a helpful perspective on the wicked environmental problems of society if we consider carefully the theory’s own blind spots: that it confines itself to systems of communication, and that it is based fully on the conception of observation as indication by means of distinction. Autopoietic theory is increasingly seen as a candidate for a radical theory of law, both in relation to its theoretical credentials and its relevance in terms of new and emerging forms of law. An aspect of the theory that has remained less developed, however, is its material side, and more concretely the theory’s accommodation of bodies, space, objects and their claim to legal agency. The present article reads Luhmann’s theory of autopoietic systems in a radical and material manner, linking it (...) on the one hand to current post-structural theorisations of law and society, and on the other hand extending its ambit to accommodate the influx of material considerations that have been working their way through various other disciplines. The latter comprises both a materialisation of the theory itself and ways of conceptualising the legal system as material through and through. This I do by further developing what I have called Critical Autopoiesis, namely an acentric, topological, post-ecological and posthuman understanding of Luhmann’s theory, that draws on Deleuzian thought, feminist theory, geography, non-representational theory, and new material and object-oriented ontologies. These are combined with some well-rehearsed autopoietic concepts, such as distinction, environment and boundaries; Luhmann’s earlier work on materiality continuum; more recent work on bodies and space; as well as his work on form and medium in relation to art. The article concludes with five suggestions for an understanding of what critical autopoietic materiality might mean for law. (shrink)

Each of four sections in this paper sketches the philosophical problems associated with a different dimension of sustainability. The untitled introductory section surveys the oft-noted discrepancies between different notions of sustainability, and notes that one element of the ambiguity relates to the different points of view taken by a participant in a system and a detached observer of the system. The second section, “Sustainability as a System Describing Concept,” examines epistemological puzzles that arise when one attempts to assess the truth (...) or falsity of claims that attribute sustainability or non-sustainability. In particular, such claims generally presume bounded systems, but boundary conditions are value-laden. The third section, “Sustainability as a Goal Prescribing Concept,” examines puzzles that arise in attempting to define sustainability in normative terms. In particular, the question of whether sustainability is an intrinsic or instrumental value is examined. The final section, “Sustainability and Bliss,” offers an analysis of the moral responsibilities that human beings have, given the fact that knowledge of conditions for achieving sustainability can never be complete. The concept of magic is frequently used to discuss technology, a practice considered useful by some with others arguing that viewing technology as magic precludes a proper understanding of technology. The concept of magic is especially prominent in discussions of artificial intelligence and machine learning. Based on an anthropological perspective, this paper juxtaposes ML technology with magic, using descriptions drawn from a project on an ML-powered system for propulsion control of cargo ships. The paper concludes that prior scholarly work on (...) technology has failed to both define magic adequately and use research into magic. It also argues that although the distinction between ML technology and magic is important, recognition of the similarities is useful for understanding ML technology. (shrink)

Randomization procedures are used in legal and statistical applications, aiming to shield important decisions from spurious influences. This article gives an intuitive introduction to randomization and examines some intended consequences of its use related to truthful statistical inference and fair legal judgment. This article also presents an open-code Java implementation for a cryptographically secure, statistically reliable, transparent, traceable, and fully auditable randomization tool.

Niklas Luhmann held a skeptical view of the role of morality in the modern society. The present paper reassesses this skepticism in view of his early work showing the regime of functional differentiation to be supported by fundamental human rights. Building on this argument, the paper advocates a more positive view of morality which is shown to be related to the sustainability of social systems in their encompassing societal and natural environment. This view is warranted by the overarching Luhmannian theme (...) of the precariousness of system–environment relations. If this view is accepted, Luhmann’s work on fundamental human rights can be read as an illustration of moral problems caused by the overexpansion tendencies of the political system. This argument is shown to connect up with the ideas of Buchanan and Rawls, as well as to fit in with the Luhmannian construct of the dilemma of structure and function. (shrink)

In this article I argue for a transdisciplinary approach to the human or social sciences. There is little ontological or epistemological justification for a division among these disciplines. I recommend that sociology stop worrying about policing its disciplinary boundaries and begin to encourage various forms of intellectual transculturation. I then analyze barriers to transdisciplinarity by comparing disciplines to states and comparing the relations among disciplines to different sorts of imperial practice, or interstate relations. The most common interdisciplinary strategies are analogous (...) to the informal, nonterritorial imperialism practiced globally by the United States. Three other forms of interdisciplinarity are discussed: the annexation of one discipline by another — a situation that is analogous to colonialism; nonhegemonized systems of equal disciplines (analogous to the Westphalian state system); and nonimperial `traveling' and transculturation among disciplines (analogous to the practices of members of weak or declining imperial states). While the critique of neoliberalism, as the form of contemporary capitalism, has been advanced from Marxian and Foucauldian perspectives, it has had limited attention from the perspective of Critical Theory. Largely unrecognized is the suitability of the theory of reification for this critique, specifically, Habermas’s version. This article reconsiders Habermas’s colonization thesis as the basis for a critical theory of neoliberalism, refining its theoretical framework to deepen its critical diagnosis. Against the dismissal of the system–lifeworld concept, a novel critique is (...) advanced to suggest its original elaboration fell confusedly between two versions of social systems theory. Drawing from late developments, the scheme is reinterpreted as distinguishing two forms of communication in capitalist society: delinguistified and linguistic. This opens the way to reframe and communicatively transform colonization as relinguistification; that is, the translation of monetary coding into ordinary language such that communicative action is distorted from within by reifying concepts. In accordance with the established view that the new social movements since the late 1960s have always pursued an agenda of comprehensive societal change, the new wave of movement activism since the late 1990s has widely been interpreted as evidence of the emergence of a new global movement for a radically different society. A critique of the one-sided reliance in social movement research on traditional actor-centred approaches leads to a systems-centred conceptualization of late-modern society, and via the diagnosis of its (...) particular dilemmas, to the interpretation of contemporary social movements as a vital resource for the stabilization of the socioeconomic order of democratic consumer capitalism. As an addition to the existing social movement theories, the suggested approach contributes to a more complex understanding of non-conventional forms of political articulation and participation. This article praises the development of second order cybernetics by von Foerster, Maturana, and Varela as an important step in deepening our understanding of the bio-psychological foundation of the dynamics of information, cognition, and communication. Luhmann's development of the theory into the realm of social communication is seen as a necessary and important move. The triple autopoietic differentiation between biological, psychological, and social-communicative autopoiesis and the introduction of a technical concept of meaning is central. Finally, the paper shows that second (...) order cybernetics lacks explicit and ontological concepts of emotion, meaning, and a concept of signs. C. S. Peirce's theory is introduced for this purpose. It is then shown, through Varela's development of Spencer Brown's ‘Laws of Form’ from a dual to a dynamic triadic categorical structure, that both theories are triadic and second order, and therefore can be fruitfully fused to a Cybersemiotics. Communication plays an important role in promoting sustainable consumption. Yet how the academic literature conceptualizes and relates communication and sustainable consumption remains poorly understood, despite growing research on communication in the context of sustainable consumption. This article presents the first comprehensive review of sustainable consumption communication (SCC) research as a young and evolving field of scholarly work. Through a systematic review and narrative synthesis of N = 67 peer-reviewed journal articles, we consolidated the research conducted in this field into four (...) distinct types: communication as an approach to (1) behavior change, (2) self-empowerment, (3) systems change, and (4) reflection on current discourses and practices around sustainable consumption. Our findings reveal that most journal articles focus on incremental changes in individual consumer behavior (“weak” sustainable consumption) and employ communication as an intervention tool with little reference to communication science and theory. They also reveal integration challenges arising from the disciplinary diversity and fragmentation characteristic of the research field. Future research should develop shared frameworks and terminology, diversify its foci, synthesize relevant evidence, and innovate critical perspectives that go beyond one-way business-to-consumer communication. The results of our review can serve researchers engaged in sustainable consumption communication to better systematize their efforts and contribute more effectively to changing systems of consumption in the future. Upshot: In our response we focus on five questions that point to important common themes in the commentaries: why start in wicked problems, what kind of system is a scientific perspective, what is the nature of second-order research processes, what does this mean for understanding interdisciplinary work, and how may polyocular research help make real-world decisions.

Providing an overview of Integral Ecology, this article defines and explains some of the key terms and concepts that underlie an approach to the environment that is inspired by and makes use of Ken Wilber's Integral Theory. First Integral Ecology is distinguished from other environmental approaches. Then Wilber's Integral Theory is introduced, which provides a foundation for a participatory approach to ecology. Next, the ontology, epistemology, and methodology of environmental phenomena is examined in light of Wilber's framework and illustrated with (...) multidimensional examples of recycling. In philosophy, there is an as yet unresolved discussion on whether there are different kinds of kinds and what those kinds are. In particular, there is a distinction between indifferent kinds, which are unaffected by observation and representation, and interactive kinds, which respond to being studied in ways that alter the very kinds under study. This is in essence a discussion on ontologies and, I argue, more precisely about ontological levels. The discussion of kinds of kinds can be resolved by (...) using a semiotic approach to ontological levels, building on the key semiotic concept of representation. There are three, and only three, levels of semiosis: non- or proto-semiotic processes without representation, such as physical or causal processes; semiotic processes with representation, such as the processes of life and cognition; and second-order semiotic processes with representation of representation, such as self-awareness and self-reflexive communication. This leads to the distinction between not two, but three kinds of kinds: indifferent, adaptive and reflexive kinds, of which the last two hitherto have not been clearly distinguished. (shrink)

Michel Foucault famously analysed orders of knowledge, ‘epistemes’, in past European ages. In this study, his analytical method is fruitfully applied to gaining a better understanding of business sustainability within and beyond the Modern episteme. After an introduction to the contextual background for the study, this article provides (i) a justification for the use of a Foucauldian epistemic analytical method, (ii) an outline of the method, (iii) an application of the method to identify four sets of questions (morality, specialisation, anthropologization (...) and mathematicization) that are both direct derivatives of the Modern episteme and problematic for sustainable development, and finally (iv) an application of the method to consider evidence for the emergence of a new episteme. In this thesis I outline a view of primary legislation from a systems perspective. I suggest that systems theory and, in particular, autopoietic theory, as modified by field theory, is a mechanism for understanding how society operates. The description of primary legislation that I outline differs markedly from any conventional definition in that I argue that primary legislation is not, and indeed cannot be, either a law or any of the euphemisms that are usually accorded to an enactment by a (...) parliament. I cite two reasons for such a conclusion. The primary reason for my conclusion is that I see primary legislation as being an output of a particular subsystem of society, while the law is the output of another subsystem of society. I argue that these outputs are the discrete products of separate subsystems of society. I argue that primary legislation should be viewed as a trinity. The first state of this trinity is that, upon enactment, primary legislation is a brute fact in that it is but a thing and the only property of this thing is that of being a text. The second state of this trinity is that following the act of enactment, the thing enacted will be reproduced and this reproduction is a separate thing that will sit in some repository until used. The third state of this trinity is that, upon use, this thing that is primary legislation will be transformed into an object and the user will attribute such functions and attributes to that object as are appropriate to the context within which the object is used. The thing has therefore become an object and an institutional fact. The second reason for my conclusion that primary legislation is not a law relates to the fact that the thing that is primary legislation is a text and the only function of a text is that it is available to be read. That is to say, of itself, a text is incapable of doing anything: it is the reader who defines the status of the text and attributes functions and attributes. Upon use, primary legislation thus becomes a censored input for future action and one of these actions may be some statement by a court of law. I assert that the view of primary legislation that has been accepted within the body politic is the product of the discourse of a particular subsystem of society that I have designated 'the legal practice', and I outline why and how this has occurred. Outlining a view about primary legislation also necessitates outlining a view as to the nature of the law. I assert that the law is a myth and I see this myth as a product of the discourse of the legal practice. I have asserted that although it is the judges that state the law, such statements flow from the discourse of those who practise the law. (shrink)

The scale and severity of the alterations to global ecologies should not simply be noted or acknowledged by communication scholars but rather should drive communication ethicists to carefully examine the values and communication practices that have enabled and promoted this kind of unchecked growth. At minimum, I argue, we ought to carefully examine this social trajectory to determine whether more growth at the current rate of speed should continue to be a goal of modern society and at what costs. This article describes the phenomenon of knowledge building in online environments. Knowledge building is a process within a community, which leads to the development of knowledge. In order to analyze this process, we will look into the ways in which individuals interact with the collective as a whole. For this purpose, the psychic and social systems, which are involved here are regarded as meaning-based systems in the sense of Luhmann’s systems theory—open to the environment, but operatively closed. The respective modes (...) of operation of psychic and social systems will be examined, and “structural coupling” between these systems described. Another characteristic of knowledge-building communities is self-organization, which is described here in the sense of autopoiesis. A pivotal task, which knowledge-building communities have to tackle, is to handle complexity and reach common understanding. These aspects will also be described using conceptualizations of Luhmann’s systems theory, illustrated by many examples. (shrink)

The object of this article is to demonstrate how stakeholder theory can be enlarged and enhanced by two communications theories, media systems dependency and community infrastructure theory. The stakeholder perspective is often represented by a diagram in which a firm is centrally positioned, surrounded by stakeholders. However, relationships between stakeholders are given relatively little attention, the various groups theoretically encompassed by the term “community” remain relatively undefined, and other marginalized stakeholders often go unrecognized. MSD and CIT can enable us to (...) conceptualize the stakeholder model more clearly, to develop research projects that more adequately capture the dynamic quality of stakeholder relationships, to tailor management strategies to particular stakeholder characteristics, and to understand corporate social responsibility messages. As an example, stakeholder theory, combined with MSD and CIT, is applied to California’s cannabis/marijuana industry. (shrink)

Global energy studies have produced a flurry of empirical analyses. However, the amount of theoretical reflection on the topic remains comparatively low. This article takes two specific limitations of the literature as its starting point: First, the often-unclear relationship between states and markets in global energy governance, and, second, the concept of energy as a material and external structure. With the aim of providing more nuanced perspectives on these issues, the article turns to the work of Niklas Luhmann and Bruno (...) Latour. Luhmann’s ideas of functional differentiation and structural coupling provide a new look at the interaction of states and markets. Latour’s symmetric anthropology allows us to rethink energy as a hybrid that is in the midst of instead of outside society. While these thinkers provide interesting ways forward for global energy studies, they also appear to be utterly incompatible. Instead of accepting this incompatibility, however, the article uses the tension between Luhmann and Latour’s work as a productive resource for further reflection on global energy governance. It develops a ‘Luhtourian’ approach, arguing that hybrid, issue-specific governance systems can emerge whenever a resistant hybrid instigates the emergence of symbolically generalized governance objects. This paper deals with Derrida's analysis of Kant's Critique of Judgment in his essay 'Economimesis'. I argue that Derrida's analysis of Kant's aesthetics can be used to describe the aporia within Kantian politics between rebellion and progressive revolutionary acts. The focus of my argument falls on examining how the recent debate over Derrida's ethics can be usefully considered from the background of this treatment of Kant. In particular, the analysis Derrida gives of Kant's aesthetics commits him to a series of (...) conceptual constraints that can be detected in his recent commentaries on 'forgiveness' and 'hospitality'. I suggest that these recent commentaries on political topics also depart from his earlier practice of ethics in 'Economimesis' as a 'witnessing' of the particular. This departure can be clearly seen once the Kantian background to Derrida's recent writing is set out. (shrink)

This article argues that Durkheim’s founding insight – uniquely social phenomena – presents us with both a foundation for the discipline of sociology and the risk that the discipline will become isolated. This, we argue, has happened. Our contention is that the emergent social phenomena need to be understood in relation to, but not reduced to, their biological and psychological substrates. Similarly, there are a number of other characteristics, notably of self-organization, which are distinguishing properties of social phenomena but also (...) of quite different phenomena. The comparison is instructive. We therefore argue for an ecological approach to sociological theory, which has important relationships to the general theories and philosophy of ecology and biology. We explore a number of terminological and conceptual parallels that may inform our understanding of the relation of social theory to these and other disciplines. (shrink)

This paper comprehensively examines Antoine Henri Becquerel’s discovery of radioactivity in 1896, a groundbreaking scientific advancement often viewed through serendipity. This case study explores the typologies of serendipity and investigates the conditions that foster its occurrence. A detailed study of Becquerel’s investigations reveals that his discovery aligns with a Walpolian type of serendipity, characterized by true serendipity heavily influenced by unforeseen experimental results. This paper emphasizes the role of bisociation, a cognitive process associating previously disconnected concepts, in Becquerel’s discovery, challenging (...) the view that his discovery was merely a chance event. Instead, it argues that Becquerel’s discovery represents an intricate interplay of logic and chance, exemplifying the Walpolian type of serendipity. Moreover, by examining Becquerel’s experimental design, results, and innovative approach, this paper illustrates that his discovery adheres to the fundamental aspects of the scientific method, albeit executed in a non-linear and iterative manner. The process and context of Becquerel’s discovery provide valuable insights into scientific knowledge inception, progression, and definition, underscoring the intertwined roles of serendipity and scientific inquiry in advancing science. This essay explores what it means to be human in an age of infomedia. Appropriating Niklas Luhmann's systems theory/media theory in dialogue with other resources, I propose a post-Luhmannian paradigm of (1) extended media/meaning that conceives the world as world multimedia systems processing variegated meanings, and (2) an embodied, contextualized soft posthumanist anthropology that conceives the human as emergent collective phenomena of distinct meaning making by body-mind-society-technology media couplings. I argue: (1) Homo sapiens is Homo medialis distinct with mediatic communication (...) that emerged to cope with contingencies. (2) Evolution is the mediatization/codification of the world that culminated with the outcome of Homo medialis uniquely equipped to process transcendent meanings and to mediatize the world via diverse media—Mediatized Co-Mediatizer or Codified Co-Codifier. (3) This anthropic universe is possibly the most “meaningful” (full of meaning possibilities) of all possible worlds. (4) Social fragmentation could be an optimization; science-and-religion is an infomedium optimizing religion's manifest and science’ latent observation of divine manifestations. (shrink)

This thesis investigates how recurrent face-to-face social interactions engender relatively invariant patterns of being together that cause those who instantiate them to act in ways that support their reproduction. Existing accounts within both cognitive science and sociology offer important insights into the consideration of patterns of being together. However, given their explanatory strategies, they struggle to integrate both ‘social’ and ‘individual’ levels of explanation. Herein a compatibilist account is developed, intended as a ‘third way’ that obviates the limitations of existing (...) accounts. This compatibilist account — by integrating insights from across disciplines and theoretical frameworks — develops a philosophical vocabulary with which to maintain explanatory consistency when articulating patterns of being together and moving between individual and social levels of explanation. It relies heavily on an extension of the enactive notion of autonomous habits to the social domain, redescribing patterns of being together as habituated participatory sense-making frames. Participatory sense-making frames result from processes of coenhabiting, i.e. processes of ongoing social habit making implicit in the dynamics of recurrent social interactions. Such processes are one primary means by which we produce and reproduce the relatively stable forms that characterise our shared worlds. These habituated frames embed much of the normativity of social life, and can serve our felicitous coordinations therein, allowing us to feel well situated, particularly in contexts within which we have some history of interacting. However, when they are not well aligned, they lead to tensions that result in either the production of novel frames or breakdowns in social interaction. The account developed has implications for many domains of human action, from psychotherapy to epistemology, and from critical studies to the development of political and ecological praxes. (shrink)

Law’s regulation of transboundary hydropower dams is a field of study brimming with paradoxes. The most notable being the paradox of a hydropower dam solving one problem and creating another. From a logical perspective, such a paradox would typically be viewed as an obstacle to be avoided because it brings everything to a standstill. But from a social perspective, paradoxes are not necessarily negative, as managing them also potentially enlightens and transforms planning systems. The latter perspective, which brings to analysis (...) a kind of dynamism, is employed in this text. In order to work out the reoccurring patterns under which law might productively make use of paradoxes, this text therefore proposes the methodological tools of exposing and building upon paradoxes. Exposing paradoxes sets out to make more visible some of the unthought limitations, self-deceptions and self-contradictions which arise in modern planning practices, while building upon paradoxes attempts to open up headways towards a more adequate conceptualisation of the solutions which law can offer. The overall intention here being to offer a Luhmannian-inspired theoretical framework which illuminates the value of social systems theory as a methodological tool for describing the communicative challenges facing law’s regulation of transboundary hydropower power dams. The new practices of human resource management can be seen as an expression of management communication, which has become increasingly pedagogical. This article is based on Luhmann systems theory regarding second-order observation. The article tries to observe how management communications observe the self-observations of employees, and claims that these observations take place within the code of the pedagogic. A number of effects are discussed: how the employee becomes a formator of him/herself as the medium child, how the employee is expected (...) to observe him/herself with a corrective pedagogical gaze, and finally how this installs a kind of a self-screening of the employee. A new form of contracts has emerged between public administration and the single citizen within the last 15 years. The present article will attempt to situate citizens' contracts in a larger systemic framework, in order to understand more fully an increasingly complex public administration that is making new and contradictory demands on public managers. Citizens' contracts emerge naturally as a form in which the individual can undertake a reconnaissance of communication. The contracts are able to connect the codes of law, (...) care, and economy because they can be constructed differently from the perspective of their different codes without losing its character of unity. The semantic incommensurability of the systems of communication that are coupled through the contract is constitutive for the test of will of the single citizen which function a premise making machine of help and support decisions. This essay has been by necessity a gloss of a complex look at the relations of power, control, and personal identity construction in a workplace. Features of the nature of the work process combine with social strategies to construct a reproductive self-referential system. Corporate organizations are central institutions in contemporary life; they make developmental decisions for individuals and for society as a whole. While they are in this sense political to the core, we have not done enough to understand how (...) this politics works or to explore its relation to people in a democratic society. Using a phenomenologically-based communication analysis enables a sensitive analysis of the multiple forms of power and domination as they exist in corporate sites. Although I have given only an outline of one case study here, this example suggests that phenomenologically-based projects can show harmful and unwarranted control, and can be a first step to fostering corporate practices that lead to decisions which are less wasteful of resources and more fully accomplish the goals of democratic society. The digital world provides various ethical frames for individuals to become ethical subjects. In this paper I examine – in a Foucauldian and Luhmannian way – the differences between three systems of communication: the proprietary, the open/free and the cracker system. It is argued that all three systems provide a different set of ethical codes which one can be subjected to. The language of each system is restricted and they cannot understand each other, they merely consider each other as the (...) environment. The systems generate a diversity of ethical codes as they give different shapes to digital objects. To proprietary software companies digital objects are an instrument of financial profit. The free software/open source movement emphasises transparency; the end user must be able to view and alter the source code. The cracker scene sees digital objects in a different way. For this particular system, only copy-protected digital objects are appealing. Copy protection binds its target to the world of matter. Breaking the protection is the ultimate challenge and a way to gain honour and status inside the cracker scene. A copy-protected digital object is simultaneously an utmost example of the hidden source code (the open/free system), a perfect artefact that can be owned and sold (the proprietary system) and a challenge to be cracked (the cracker system).
