Like other groups associated with social movements, rape crisis centers have been judged co-optive by some and progressive by others. This article argues that organizational theory yields fuller explanations of their dynamics and character. In a case study, two subcultures—dubbed the politicized and service perspectives—developed and epitomized fundamentally different approaches to sexual violence. These subcultures emerged for a number of reasons, including the organization's goals, the character of the fiminist movement, and organizational features such as permeability, a broad constituency, a (...) collective goods orientation, and an emphasis on open discourse. This article argues that similar organizational and environmental features in rape crisis centers and other social movement-related organizations are associated with organizational fluidity and conflict. While these groups may not be cohesive and stable actors for broad social change, they contribute incrementally to long-term shifts in gendered social structures. (shrink)

The increasing centrality of business firms in contemporary societies calls for a renewed attention to the democratization of these actors. This paper sheds new light on the possibility of democratizing business firms by bridging recent scholarship in two fields—deliberative democracy and business ethics. To date, deliberative democracy has largely neglected the role of business firms in democratic societies. While business ethics scholarship has given more attention to these issues, it has overlooked the possibility of deliberation within firms. As argued in (...) the paper, a combination of reforms based on the ideas of workplace deliberation and business deliberation is necessary in order to promote the prospect of deliberation in different business contexts. The paper also discusses the importance of more democratic firms for deliberative democracy at large and, in particular, for the recent debate on deliberative systems. Finally, the paper suggests new areas of investigation to better understand the prospect of democratic deliberation in business firms. (shrink)

Feminist scholars argue that women generally gain political rights followed by civil and social rights. However, this argument is based on data from North America and Western Europe, and few scholars, if any, have examined the progression of these rights within countries currently undergoing transitions to democracy in different parts of the world. Through in-depth interviews with members of women's organizations in Ghana, the author extends this literature. The findings both contradict and support the prior feminist argument. They indicate that (...) prior to democratization, women focused primarily on social rights to improve their economic well-being. However, new opportunities emerged with the transition, which allowed women to use their political rights to secure more civil and social rights. (shrink)

Taber and Lodge offer a powerful case for the prevalence of directional reasoning that aims not at truth, but at the vindication of prior opinions. Taber and Lodge's results have far-reaching implications for empirical scholarship and normative theory; indeed, the very citizens often seen as performing “best” on tests of political knowledge, sophistication, and ideological constraint appear to be the ones who are the most susceptible to directional reasoning. However, Taber and Lodge's study, while internally beyond reproach, may substantially overstate (...) the presence of motivated reasoning in political settings. That said, focusing on the accuracy motivation has the potential to bring together two models of opinion formation that many treat as competitors, and to offer a basis for assessing citizen competence. This paper considers the legislative debates in Australia that led to the passage of the Research Involving Human Embryos Act (Cth 2002) and the Prohibition of Human Cloning Act (Cth 2002). In the first part of the paper, we discuss the debate surrounding the legislation with particular emphasis on the ways in which demands for public consultation, public debate and the education of Australians about the potential ethical and scientific impact of human embryonic stem cells (hESC) research were deployed, and (...) the explicit and implicit framing of the scope of public consultation. We then ask whether, given the calls for public consultations, debate and understanding, current work in democratic theory could be helpful in analysing the process of policy-making in these areas. In particular, we canvass the literature relating to aggregative and deliberative models of democracy for processes that support the legitimacy of policy. We identify features of the debate that reflect the appeal of deliberative approaches as well as some of the possible hurdles or limitations to developing deliberative democratic approaches to policy in ethically contentious areas. A campaign to pass city council resolutions opposing an American invasion of Iraq in the Fall of 2002 and Spring of 2003 provided an opportunity to examine contrasting styles of public argument. This paper examines an extensive set of news and editorial articles as well as the actual deliberations before city councils. An argument’s style constructs a relationship between the speaker, audience, and issue through the strategic use of language. Two conflicting styles of argument were apparent in these deliberations: a (...) protest style and a dissent style. Each style operated within a different normative frame that managed tensions between unity and division, participation and its lack, and inclusive and exclusive reasoning. While protest and dissent styles conflict, each frames important relationships for public discourse and deliberation. (shrink)

Presentazione del curatore italiano (C.Corradetti): È possibile conciliare il pluralismo culturale con la dimensione pubblica della deliberazione? Partendo dall’analisi critica di Rawls e Habermas, James Bohman offre una risposta innovativa alla questione dell’accordo democratico. In tale proposta, parallelamente al rigetto di soluzioni meramente strategiche, viene riabilitata la nozione di compromesso morale nel quadro di un accordo normativo. Mantenendo fede ad una prospettiva composta da elementi normativi e fattuali, l’autore si propone di ampliare le opportunità democratiche nella riconciliazione tra conflitti culturali (...) profondi propri delle società contemporanee. L’elemento civico partecipativo risulta essere dunque una componente essenziale per la produzione di una sfera pubblica vibrante. Ne emerge una ricostruzione convincente volta non solo a respingere le critiche degli scettici sulle reali possibilità d’inclusività democratica, ma diretta soprattutto a suggerire un più efficace modello deliberativo per la garanzia della stabilità sociale. Questo testo è diventato ormai un riferimento internazionale classico nella discussione sul tema della deliberazione pubblica. L’autore ha inoltre sviluppato in ambito post-nazionale il suo modello deliberativo senza tuttavia ridiscutere i fondamenti concettuali della sua proposta teorica qui enunciati.Vista la rilevanza del tema e considerata la centralità del testo proposto, sembrerebbe dunque auspicabile rendere il testo disponibile anche al lettore italiano. Several democratic theorists have recently sought to vindicate the ideal of equal political power (“political equality”) by tying it to the non-derivative value of egalitarian relationships. This chapter critically discusses such arguments. It clarifies what it takes to vindicate the ideal of political equality, and distinguishes different versions of the relational egalitarian argument for it. Some such arguments appeal to the example of a society without social status inequality (such as caste or class structures); others to personal relationships among equals, (...) like friendship. Each strategy faces problems. After discussing what social status consists in, the chapter argues that social status equality does not require an equal distribution of power, but only that unequal distributions are not justified on grounds incompatible with the citizens’ fundamental equal moral standing. By contrast, personal relationships among equals do require equal power; but establishing that their norms apply to our political community is challenging. (shrink)

In this paper Jane Mansbridge reflects upon the role of resistance in democracy. Resistance “can cause inaction by focusing on stopping, rather than using, coercion.”’ Instead we should increase the legitimacy of democratic action and in that manner further the possibility of sanction through coercion. An improvement of democratic institutions and of the procedures of deliberation, which makes room for citizen input, would also make for a more efficacious and organized resistance, when necessary.

Among those who reject the Epicurean claim that death is not bad for the one who dies, it is popularly held that death is bad for the one who dies, when it is bad for the one who dies, because it deprives the one who dies of the good things that otherwise would have fallen into her life. This view is known as the deprivation account of the value of death, and Fred Feldman is one of its most prominent defenders. (...) In this paper, I explain why I believe that Feldman’s argument for the occasional badness of death fails. While staying within an Epicurean framework, I offer an alternative that adequately accounts for a significant range of widely held intuitions about prudential value. My account implies that death is almost always good for the one who dies, yet often less good than not dying. Finally, I discuss some puzzles that remain for my account and hint at possible ways to address them. (shrink)

This dissertation addresses a debate about the proper relationship between democratic theory and institutions. The debate has been waged between two rival approaches: on the one side is an aggregative and economic theory of democracy, known as constitutional economics, and on the other side is deliberative democracy. The two sides endorse starkly different positions on the issue of what makes a democracy legitimate and stable within an institutional setting. Constitutional economists model political agents in the same way that neoclassical economists (...) model economic agents, that is, as self-regarding, rational maximizers; so that evaluations of democratic legitimacy and stability depend on the extent to which the design of institutional rules and practices maximize individual utility by promoting efficient schemes of collective choice. Deliberative democrats, on the other hand, understand political agents as communicative reason-giving subjects who justify their preferences and positions on issues that jointly affect them in a process of consensus-directed discourse, or deliberation; so that evaluations of democratic legitimacy and order depend on the degree to which institutional norms and practices promote deliberation and draw upon deliberated public judgment. I argue that despite the numerous incompatibilities between constitutional economics and deliberative democracy—which amount to a 'deep divide'—an opportunity to produce a genuine synthesis of the two approaches arises inasmuch as it is possible to overcome several points of opposition in their separate research programmes. The central thesis of the dissertation is that it is possible to construct a bridge spanning the divide between constitutional economists and deliberative democrats, and that Dewey and Bentley's transactional view can facilitate this bridge-building project. Pursuant to this end, the points of opposition between the v research programmes are mediated by way of five concepts which, on balance, favor deliberative democracy and its feasible institutionalization. This essay examines the implications Wikipedia holds for theories of deliberative democracy. It argues that while similar in some respects, the mode of interaction within Wikipedia represents a distinctive form of “collaborative editing” that departs from many of the qualities traditionally associated with face-to-face deliberation. This online mode of interaction overcomes many of the problems that distort face-to-face deliberations. By mitigating problems that arise in deliberative practice, such as “group polarization” and “hidden profiles,” the wiki model often realizes the epistemic (...) and procedural aspirations of deliberative democracy. These virtues of the Wikipedia model should not, however, lead to the simple conclusion that it ought to replace traditional face-to-face deliberation. Instead, this essay argues that the collaborative editing process found within Wikipedia ought to be viewed as a promising supplement to traditional deliberation. These two modes of communication ought to be viewed in Madisonian terms – as distinctive forms of interaction that check and balance the vices of one another. When combined, the wiki model promotes the virtues of inclusion and accuracy at large scales, while the face-to-face model excels in conditions of localism and promotes the virtues of solidarity and social capital. One of the challenges related to the discursive practices of argumentative agents is to get to know if those interactions have an institutional effect. In this article, it is argued that in the new institutionalism, theoretical approaches and deterministic analysis are outlined to investigate argumentative practices that take place in processes of legitimation and recognition. Here a double socio-institutional and discursive or constructivist approach to the argumentation theory is defended, and it is argued that this perspective could be extended to (...) a research program aimed at interpreting argumentative processes in the public sphere that act as calculation mechanism and conformation of social capital.
