Walter Sinnott-Armstrong argues that moral disagreement and widespread moral bias pose a serious problem for moral intuitionism. Seneca’s view that we just recognise the good could be criticised using a similar argument. His approach to argumentation offers a way out, one that may serve as a model for a revisionary intuitionism.

I argue against abductivism about logic, which is the view that rational theory choice in logic happens by abduction. Abduction cannot serve as a neutral arbiter in many foundational disputes in logic because, in order to use abduction, one must first identify the relevant data. Which data one deems relevant depends on what I call one's conception of logic. This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

In this paper, we provide a detailed critical review of current approaches to ecthesis in Aristotle’s Prior Analytics, with a view to motivate a new approach, which builds upon previous work by Marion & Rückert (2016) on the dictum de omni. This approach sets Aristotle’s work within the context of dialectic and uses Lorenzen’s dialogical logic, hereby reframed with use of Martin-Löf's constructive type theory as ‘immanent reasoning’. We then provide rules of syllogistic for the latter, and provide proofs of (...) e-conversion, Darapti and Bocardo and e-subalternation, while showing how close to Aristotle’s text these proofs remain. The authors equally emphasize basic ideas and finer technical details. In addition, many worked out exercises and examples will help readers to better understand the concepts under discussion. One of the chief ideas animating this study is that the dialogical understanding of definitional equality and its execution provide both a simple and a direct way of implementing the CTT approach (...) within a game-theoretical conception of meaning. In addition, the importance of the play level over the strategy level is stressed, binding together the matter of execution with that of equality and the finitary perspective on games constituting meaning. According to this perspective the emergence of concepts are not only games of giving and asking for reasons, they are also games that include moves establishing how it is that the reasons brought forward accomplish their explicative task. Recent work on the development of a dialogical approach to the logic of fiction stresses the notion of existence as choice. Moreover, this approach to existence has been combined with the notion of ontolog-ical dependence as deployed by A. Thomasson’s artifactual theory of fiction. In order to implement such a combination within the dialogical frame several predicates of ontological dependence have been de-fined. However, the definition of such predicates seems to lean on a model-theoretic semantics for mod-al logic after all. (...) The main aim of the present paper is to set a dialogical frame for the study of fictions in the context of the dialogical approach of CTT recently developed by S. Rahman and N. Clerbout where a fully-interpreted language is unfolded. We will herewith develop the idea that in such a setting fiction-al entities are understood as hypothetical objects, that is, objects (functions) the existence of which is dependent upon one or more hypotheses that restrict the scope of choices available. We will finish the paper by suggesting that this provides both a natural and genuinely dialogical way to understand R. Frigg’s take on scientific models as fictions and a new perspective on Thomasson’s notion of generic ontological dependence. There are several issues with the standard approach to the relationship between conditionals and assertions, particularly when the antecedent of a conditional is false. One prominent alternative is to say that conditionals do not express propositions, but rather make conditional assertions that may generate categorical assertions of the consequent in certain circumstances. However, this view has consequences that jar with standard interpretations of the relationship between proofs and assertion. Here, I analyse this relationship, and say that, on at least one (...) understanding of proof, conditional assertions may reflect the dynamics of proving, which generate categorical assertions. In particular, when we think about the relationship between assertion and proof as rooted in a dialogical approach to both, the distinction between conditional and categorical assertions is quite natural. What role, if any, does dialectic play in Aristotle’s epistemology in the Topics? In this paper I argue that it does play a role, but a role that is independent of endoxa. In the first section, I sketch the case for thinking that dialectic plays a distinctively epistemological role—not just a methodological role, or a merely instrumental role in getting episteme. In the second section, I consider three ways it could play that role, on two of which endoxa play at (...) least a co-starring role. But in the third section, I argue that endoxa don’t play that co-starring role, by arguing for a deflationary account of what endoxa are. For that reason, the third view emerges as the most plausible; but the third view is, I’ll suggest, Platonic. (shrink)
